ABSTRACT The philosophical tradition approaches to morals have their grounds predominantly on metaphysical and theological concepts and theories. Among the traditional ethics concepts, the most prominent is the Divine Command Theory (DCT). As per the DCT, God gives moral foundations to the humankind by its creation and through Revelation. Morality and Divinity are inseparable since the most remote civilization. These concepts submerge in a theological framework and are largely accepted by most followers of the three Abrahamic traditions: Judaism, Christianity, and (...) Islam: the greatest part of the human population. Holding faith and Revelation for its grounds, the Divine Command Theories are not strictly subject to the demonstration. The opponents to the Divine Command conception of morals, grounded in the impossibility of demonstration of its metaphysical and religious assumptions, have tried for many centuries (albeit unsuccessfully) to devalue its importance. They held the argument that it does not show material evidence and logical coherence and, for this reason, cannot be taken into account for scientific nor philosophical purposes. It is just a belief and, as so, should be understood. Besides these extreme oppositions, many other concepts contravene the Divine Command theories, in one or another way, in part or in full. Many philosophers and social scientists, from the classic Greek philosophy up to the present date, for instance, sustain that morality is only a construct, and thus culturally relative and culturally determined. However, this brings many other discussions and imposes the challenge to determine what is the meaning of culture, which elements of culture are morally determinant, and finally, what are the boundaries of such relativity. Moral determinists claim that everything related to human behavior, including morality, is determined, once free will does not exist. More recently, modern thinkers argued that there is a strict science of morality. However, the scientific method alone, despite explaining several facts and evidence, cannot enlighten the entire content and full meaning of ethics. Morals’ understanding requires a broader perception, and an agreement among philosophers, which they have never achieved. All of these questions have many different configurations depending on each philosophical strand, and start complex analysis and endless debates, as long as many of them are reciprocally conflictive. The universe and the atmosphere involving this thesis are the dominions of all these conceptual conflicts, observed from an objective and evolutionary standpoint. Irrespective of this circumstance and its intrinsic importance, however, these questions are far distant from the methodological approach of an analytical discussion on objective morals, what is, indeed, the aim and scope of this work. We should briefly revisit these prominent traditional theories because this thesis shelters a comparative study, and its assumptions at least differ profoundly from all traditional theories. Therefore, it becomes necessary offering direct and specific elements of comparison to the reader, for the right criticism, dispensing interruptive researches. However, even revisiting the traditional theories, for this comparative and critical exposure purpose, they will be kept by the side of our main concerns, as “aliena materia.” Irrespective of the validity of any or all of the elements of this discussion, and their meaning as the philosophical universe of this thesis, the purpose of this work is demonstrating and justifying the existence and meaning of prehistoric moral archetypes arisen directly from the very first social needs and efforts for survival. These archetypes are the definition of the essential foundation of ethics, its aggregation to the collective unconscious and corresponding logic organization and transmission to evolutionary stages of the human genome and different relations space-time, irrespective of any contemporary experience of the individuals. The system defined by these archetypes composes an evolutionary human social model. Is this a metaethical position? Yes, it is. Moreover, as in any metaethical reasoning, we should look carefully for the best and coherent routes, as the Analytical Philosophy offers them. Thus, this work should reasonably demonstrate that morals are not a cultural product of the civilized men or modern societies and that despite being subject to several cultural relative aggregations and subtractions, its essential foundations are archetypal and have never structurally changed. This reasoning induces that morality is an original attribute of the “homo sapiens”; it is not a property and nor an accident: it integrates the human essence and belongs to the realm of the ontological human identity. The human phenomena is a continuing process, playing its role between random determination and free will, and we need to question how morality began and how did it come to us in the present. Gli approcci della tradizione filosofica alla morale si fondano prevalentemente su concetti e teorie metafisiche e teologiche. Tra i concetti etici tradizionali, il più importante è la Teoria del Comando Divino (DCT). Secondo la DCT, Dio dà fondamenti morali all’umanità attraverso la sua creazione e attraverso la Rivelazione. Moralità e Divinità sono inseparabili fin dalle civiltà più remote. Questi concetti si inseriscono in un quadro teologico e sono accettati principalmente dalla maggior parte dei seguaci delle tre tradizioni abramitiche: ebraismo, cristianesimo (...) e islam: la parte più considerevole della popolazione umana. Tenendo come fondamento la fede e la Rivelazione, le Teorie del Comando Divino non sono strettamente soggette alla dimostrazione. Gli oppositori alla concezione della morale del Comando Divino, fondata sull'impossibilità di dimostrare i suoi presupposti metafisici e religiosi, hanno tentato per molti secoli (anche se senza successo) di sminuirne l'importanza. Sostenevano che esso non presenta prove materiali e coerenza logica e, per questo motivo, non può essere preso in considerazione per scopi scientifici o filosofici. È solo una convinzione e, come tale, dovrebbe essere intesa. Oltre a queste opposizioni estreme, molti altri concetti contravvengono alle teorie del Comando Divino, in un modo o nell'altro, in parte o del tutto. Dalla filosofia greca classica fino ai giorni nostri, molti filosofi e scienziati sociali sostengono che la moralità è solo un costrutto e quindi culturalmente relativo e culturalmente determinato. Tuttavia, ciò apre la strada a molte altre discussioni e impone la sfida di determinare il significato della cultura, quali elementi della cultura siano moralmente determinanti e, infine, i confini di tale relatività. Indipendentemente da questa circostanza e dalla sua intrinseca importanza; tuttavia, queste domande sono lontane dall’approccio metodologico di una discussione analitica sulla morale oggettiva, che è, in effetti, lo scopo e la portata di questo lavoro. Dovremmo rivisitare brevemente queste importanti teorie tradizionali perché questo lavoro ospita uno studio comparativo e i suoi presupposti differiscono profondamente da tutte le teorie tradizionali. -/- Diventa quindi necessario offrire al lettore elementi di confronto diretti e specifici per una critica valida, dispensando ricerche interruttive. Tuttavia, anche rivisitando le teorie tradizionali, a questo scopo di esposizione comparativa e critica, esse verranno tenute ai margini delle nostre preoccupazioni primarie come “aliena materia”. Indipendentemente dalla validità di alcuni o tutti gli elementi di questa discussione e dal loro significato come universo filosofico della nostra ricerca, lo scopo di questo lavoro è dimostrare e giustificare l’esistenza e il significato degli archetipi morali preistorici sorti direttamente dal contesto sociale fondamentale e corrispondenti bisogni e sforzi per la sopravvivenza. Tali archetipi sono la definizione del fondamento essenziale dell'etica, la sua aggregazione all'inconscio collettivo e la corrispondente logica di organizzazione e trasmissione agli stadi evolutivi del genoma umano e dei diversi rapporti spazio-temporali, indipendentemente da qualsiasi esperienza contemporanea dei singoli individui. Il sistema definito da questi archetipi compone un modello sociale umano evolutivo. È questa una posizione meta etica? Sì. Inoltre, come in ogni ragionamento meta etico, bisognerebbe cercare attentamente i percorsi migliori e più coerenti, come offre la Filosofia Analitica. Pertanto, questo lavoro dovrebbe ragionevolmente dimostrare che la morale non è un prodotto culturale degli uomini civilizzati o delle società moderne. Pur essendo soggetto a molteplici aggregazioni e sottrazioni culturali, i suoi fondamenti essenziali sono archetipici e non sono mai strutturalmente mutati. Философские, традиционные подходы к морали в основном основаны на метафизических и теологических концепциях и теориях. Среди традиционных концепций этики наиболее заметной является теория божественного повеления (DCT). Согласно DCT, Бог дает человечеству моральные основы через его творение и откровение. Мораль и божественность были неразделимы со времен самой далекой цивилизации. Эти концепции укладываются в теологические рамки и в основном принимаются большинством последователей трех авраамических традиций: иудаизма, христианства и ислама: наиболее значительной части человеческого населения. Теории Божественного повеления основываются на вере и откровении и (...) не подлежат строгой демонстрации. Противники концепции морали Божьего повеления, основанной на невозможности продемонстрировать свои метафизические и религиозные допущения, пытались (хотя и безуспешно) на протяжении многих веков преуменьшать ее значение. Они придерживались аргумента, что он не демонстрирует никаких материальных доказательств и логической согласованности и по этой причине не может быть рассмотрен в научных или философских целях. Это всего лишь убеждение, и оно должно пониматься при этом условии. Помимо этих крайних противоположностей, многие другие концепции противоречат теориям Божественного повеления, так или иначе, частично или полностью. От классической греческой философии до наших дней многие философы и социологи утверждают, что мораль — это всего лишь конструкция, и поэтому она культурно относительна и обусловлена культурой. Die philosophischen, traditionellen Ansätze zur Moral beruhen hauptsächlich auf metaphysischen und theologischen Konzepten und Theorien. Unter den traditionellen Ethikkonzepten ist die göttliche Befehlstheorie die prominenteste (DCT). Gemäß der DCT gibt Gott der Menschheit moralische Grundlagen durch ihre Schöpfung und durch Offenbarung. Moral und Göttlichkeit sind seit der fernsten Zivilisation untrennbar. Diese Konzepte tauchen in einen theologischen Rahmen ein und werden hauptsächlich von den meisten Anhängern der drei abrahamitischen Traditionen angenommen: Judentum, Christentum und Islam: dem bedeutendsten Teil der menschlichen Bevölkerung. Die (...) göttlichen Befehlstheorien halten den Glauben und die Offenbarung für ihre Grundlage und unterliegen nicht strikt der Demonstration. Die Gegner der Gottesbefehlskonzeption der Moral, gegründet auf der Unmöglichkeit der Demonstration ihrer metaphysischen und religiösen Annahmen, haben seit vielen Jahrhunderten (obwohl erfolglos) versucht, ihre Bedeutung zu devalvieren. Sie hielten das Argument, dass es keine materiellen Beweise und logische Kohärenz zeigt und aus diesem Grund nicht für wissenschaftliche oder philosophische Zwecke berücksichtigt werden kann. Es ist nur ein Glauben und sollte daher verstanden werden. Abgesehen von diesen extremen Gegensätzen widersprechen viele andere Konzepte den Theorien des göttlichen Befehls, in der einen oder anderen Weise, teilweise oder vollständig. Unabhängig von der Gültigkeit eines oder aller der Elemente dieser Diskussion und ihrer Bedeutung als philosophisches Universum unserer Forschung, ist der Zweck dieses Werkes, dass die Existenz und die Bedeutung der prähistorischen moralischen Archetypen, die direkt aus den grundlegenden sozialen Bedürfnissen und Anstrengungen für das Überleben demonstrierten Archetypen sind, die Definition der wesentlichen Grundlage der Ethik, ihre Aggregation in das kollektive Unbewusste und die entsprechende logische Organisation und Übertragung auf die evolutionären Stadien des menschlichen Genoms und verschiedene Raum-Zeit-Beziehungen, unabhängig von jeder zeitgenössischen Erfahrung der Individuen. This article seeks to explain why the social movement had its historical origin in the 1760s. It argues that the rise of the social movement as a particular form of political action was closely linked to a new interpretation of sovereignty that emerged within eighteenth century British politics. This interpretation, which drew inspiration from Jean-Jacques Rousseau’s social contract thinking, not only resonated with the radicalism of John Wilkes and his followers’ struggle to promote civil liberties to Englishmen of all classes, (...) it also spurred a transformation of the repertoire of popular contention. The article traces the evolution of the concept of sovereignty in British political thought from the Restoration to the Wilkites and discusses how this evolution informed the contentious actions of the Wilkites as they formed the first mass movement to promote a specific political issue. This paper suggests the democratic direction in which the right of freedom of expression should be conceived and applied. In the first two sections it suggests some counter-examples to, and diagnoses of, the libertarian and liberal conceptions of freedom of expression, taking Scanlon (1972) and Scanlon (1979), respectively, to be their chief proponents. The paper suggests that these conceptions cannot take into account clear examples, like fraudulent propaganda, which should not be legal. The democratic conception takes it to heart that (...) the pillars upon which the right of freedom of expression is founded are individual and collective autonomy, the right to know facts of public interest and information necessary for effective democratic control of government. The paper suggests that in a time when private powers seriously threaten these pillars, it is correct for the government to step in to provide the framework in which genuine discussion geared toward fulfilling the objectives of these pillars can take place. Certainly principles of criminal liability may be understood as rules or norms outlining orders or prohibitions and standing out among other norms with their weight, for legal culture, legal doctrine, etc. In such a classic approach they are norms defining basic rights and obligations in the applicable criminal law. However, is it the only possible and cognitively interesting meaning of the word “principle” in jurisprudence? From the semiotic point of view, they can occur in three forms: special-kind norms, teleological directives, (...) rules which constitute valid performance of conventional activities. In an extra-directival sense these principles may be understood as models-descriptions of shaping the system of criminal law. From a theoretical and practical point of view principles addressed to the legislator are extremely weighty—they can be called rules constructing the system of criminal liability. This article addresses two central topics in normative debates on transnational citizenship: the inclusion of resident non-citizens and of non-resident citizens within the demos. Through a critical review of the social membership (Carens, Rubio-Marin) and stakeholder (Baubock) principles, it identifies two problems within these debates. The first is the antinomy of incorporation, namely, the point that there are compelling arguments both for the mandatory naturalization of permanent residents and for making naturalization a voluntary process. The second is the arbitrary demos (...) problem and concerns who determines whether expatriate voting rights are granted (and on what terms). The argument developed provides a way of dissolving the first problem (and defending the proposed solution against possible objections) and resolving the second problem. In doing so it provides a defensible normative basis for the political theory of transnational citizenship. (shrink)

Some have recently argued that the current generation dominates future generations by causing long-term climate change. They relate these claims to Philip Pettit and Frank Lovett's neorepublican theory of domination. In this paper, I examine their claims and ask whether the neorepublican conception of domination remains theoretically coherent when the relation is between current agents and nonoverlapping future subjects. I differentiate between an ‘outcome’ and a ‘relational’ conception of domination. I show how both are theoretically coherent when extended to posterity (...) but only if we make different definitional and normative choices than those made by Pettit and Lovett. (shrink)

Contemporary global politics is characterized by an increasing trend toward experimental forms of governance, with an emphasis on private governance. A plurality of private standards, codes of conduct and quality assurance schemes currently developed particularly, though not exclusively, by TNCs replace traditional intergovernmental regimes in addressing profound global environmental and socio-economic challenges ranging from forest deforestation, fisheries depletion, climate change, to labor and human rights concerns. While this trend has produced a heated debate in science and politics, surprisingly little attention (...) has been paid on the effects of private governance on questions of distribution and justice. This is highly problematic. At the beginning of the twenty-first century global inequalities are greater than ever before, while rapid economic, social, political, and environmental changes threaten to further derail sustainable development and humanitarian objectives. If private governance creates or intensifies some of the pressing global inequalities (e.g., food security), and alleviates others (e.g., environmental degradation), from a business ethics perspective, we need to know which aspects need to be strengthened and where appropriate interventions are necessary and desirable. This paper proposes a framework to examine and classify the distributive outcomes of private governance institutions through the lenses of one particular approach to distributive justice, the capability approach. Empirically, it focuses on agrifood one area where the controversy regarding the distributive concerns of private governance are particularly pronounced. (shrink)

Although the moral foundations of voting rights regulations have been the subject of widespread scrutiny, there is one aspect of the debate which has gone largely unquestioned and is currently accepted in every state’s actual voting rights regulations. This is the requirement of prior residence, which stipulates that immigrants are granted the right to vote only once they have lived in the host country for a certain period of time. It is this requirement I call into question in this paper. (...) Taking up the most plausible justifications for this requirement, I aim to put substantial pressure on its moral acceptability by arguing that it is not directly grounded by any of the principles that are currently defended as a means to determine the demos, nor a proxy for some other morally relevant feature, nor a warrantor for abilities held to be significant for the right to vote. Two distinct approaches to the incorporation of animal interests within democratic theory are identified. The first, anthropocentric, account suggests that animal interests ought to be considered within a democratic polity if and when enough humans desire this to be the case. Within this anthropocentric account, the relationship between democracy and the protection of animal interests remains contingent. An alternative account holds that the interests of animals ought to be taken into account because they have a democratic right that their interests (...) are considered. This alternative account is defended in this article by utilising democratic theory and, in particular, the all-affected principle. The interests of animals are affected by collective decisions and, therefore, they, or – more specifically – their representatives, have a democratic right to have some say in the making of those decisions. This approach is favourably contrasted with an alternative, citizenship, account which relies on contested, capacity-oriented, claims current within the field of animal ethics. (shrink)

One of the biggest challenges facing modern societies is how to monitor one’s intelligence community while maintaining the necessary level of secrecy. Indeed, while some secrecy is needed for mission success, too much has allowed significant abuse. Moreover, extending this secrecy to democratic oversight actors only creates another layer of unobserved actors and removes the public scrutiny that keeps their power and decision-making in check. This article will therefore argue for a new type of oversight through a specialised ethical whistleblowing (...) framework. This includes, first, outlining what intelligence wrongdoings justify whistleblowing; second, whether whistleblowing is the correct remedy – something not necessarily clear with intelligence; and finally, what form the whistleblowing should take. This framework will examine the Snowden case to determine whether he was correct leaking intelligence data and whether the means were appropriate, and second, whether those involved in the Central Intelligence... This paper critiques the All-Subjected Principle. The All-Subjected Principle is one of the most prominent answers to the Boundary Problem, which consists in determining who should be entitled to participate in which democratic decision. The All-Subjected Principle comes in many versions, but the general idea is that all people who are subjected in a relevant sense with regard to a democratic decision should be entitled to participate in that decision. One respect in which versions of the All-Subjected Principle differ concerns (...) how to best understand ‘subjectedness’. One view spells out ‘subjectedness’ in terms of legal bindingness. Another view understands ‘subjectedness’ in terms of coercion. I argue that the All-Subjected Principle is extensionally inadequate on both views in that it yields verdicts that are at odds with our considered judgements about certain cases. The volume Applied Ethics. Perspectives from Romania is the first contribution that aims at showing to the Japanese reader a sample of contemporary philosophy in Romania. At the same time a volume of contemporary Japanese philosophy is translated into Romanian and will be published by the University of Bucharest Press. -/- Applied Ethics. Perspectives from Romania includes several original articles in applied ethics and theoretical moral philosophy. It is representative of the variety of research and the growing interest in applied (...) ethics in the last few years in Romania. The philosophy practised here is at the same time an international activity, but also a kind of research deeply involved in Romanian realities. The contributors to the volume are Romanian philosophers from the most important Universities in the country, including members of the Romanian Academy, but also junior researchers. -/- This volume was made possible thanks to the relationship established between the Applied Ethics Centres of the University of Bucharest, Romania, and Hokkaido University, Japan. From a decision theoretic perspective, arguments stem from decisions made by arguers. Despite some promising results, this approach remains underdeveloped in argumentation theories, mostly because it is assumed to be merely descriptive. This assumption is mistaken: considering arguments as the product of decisions brings into play various normative models of rational choice. The challenge is rather to reconcile strategic rationality with other normative constraints relevant for argumentation, such as inferential validity and dialectical appropriateness.
