Se reflexiona sobre las fuentes de la normatividad según el neokantismo contemporáneo que ha dividido a los neokantianos en realistas y constructivistas. Se analiza el kantismo constructivista de Christine Korsgaard, para mostrar sus alcances y limitaciones, y se propone como alternativa fundar la normatividad en la sola idea de libertad, en cuanto valor interno o absoluto no normativo, como la entiende Kant. Esta propuesta que permite esbozar las líneas de un neokantismo que articule los modelos constructivistas y realistas a partir (...) de la sola idea de libertad. The article carries out a reflection on the sources of normativity in contemporary Neo-Kantianism, which has divided Neo-Kantians into realists and constructivists. After analyzing the constructivist Kantianism of Christine Korsgaard, we propose an alternative: that of grounding normativity solely on the idea of freedom, as an internal value or non-normative absolute, as Kant understands it. This proposal makes it possible to outline a Neo-Kantianism that articulates constructivist and realist models on the sole basis of the idea of freedom. (shrink)

This essay seeks to contribute to current debates about value in Kant's ethics. Its main objective is to dislodge the widely shared intuition that his view of autonomy requires constructivism or some other alternative to moral realism. I argue the following. Kant seems to think that the value of persons is due to their very nature, not to what anyone decides is the case (however rational or pure those decisions may be). He also seems to think that when we treat (...) persons as ends in themselves we are responding appropriately to the fact that their very nature elevates them above all other concerns. Neither of these beliefs is incompatible with his view of autonomy. So it is a mistake to think that Kant's ethics requires constructivism or any other form of anti-realism. (shrink)

In a previous paper in this journal, Jennifer Frey presented three arguments against New-Kantian approaches. This paper briefly reiterates these arguments and shows why New-Kantian positions do not succumb to them. Most noteworthy, such positions are formal and not substantive. They care little about the question whether people pursue the same goods and instead stress the role of procedure in explicating rationality and consent in explicating the good. By stressing this distinction between formal and substantive approaches, this paper also provides (...) a hint to the contentious topic of how Kantians can deal with cultural diversity, historicity, and plurality in ethics. It finishes with some questions to the author of the previous paper: do non-formal approaches imply that peace can only exist within similarity? (shrink)

In the second section of the Groundwork for the Metaphysics of Morals, Kant introduces the concept of an end in itself and defines it as something whose existence has an absolute value. He continues with the assertion that the ground of a possible categorical imperative lies solely in this end in itself. Now Kant, in his remarks on the realm of ends, also operates with the notions of an end in itself and absolute value — seemingly in a different way, (...) however. Thus, in the remarks on the realm of ends, the rational being becomes an end in itself through its real moral willing and acting, both of which presuppose the validity of the categorical imperative. Basically, the difference in the ways of using the concepts of absolute value and an end in itself consists in the fact that in the first case both serve as precondition for the categorical imperative’s validity, whereas in the passages concerning the realm of ends both are a consequence of its validity. At first glance we therefore must register an inconsistent use of both terms. In what follows, I aim to show that the assumption of such a putative inconsistency expresses a misleading understanding of the internal structure of the end in itself rather than a real problem in Kant’s way of arguing. The present study tries to solve this supposed problem of inconsistency by sketching a more appropriate understanding of the internal structure of the end in itself. (shrink)

This makes it hard for them to explain the supposed equivalence between the universal law and humanity formulations of the categorical imperative, since the former does not appear to assert any substantive value. Nor is it easy for defenders of value-based readings to explain Kant's claim that the law-giving nature of practical reason makes all beings (...) with practical reason regard the idea of a rational nature as an end in itself. This article seeks to replace these value-based readings with a reading of the idea of rational nature as an end that fits better with the overall argument of the Groundwork. (shrink)

La intensa discusión que mantienen los constructivistas y realistas en torno a si Kant habría asumido una teoría de valor “proyeccionista” o “detectivista”, ha puesto al desnudo las insuficiencias del lenguaje y los términos empleados. Lo que podríamos llamar “lenguaje de Eutifrón”, no parece abrigar la suficiente sensibilidad como para capturar la singularidad de la ética kantiana. Ciertamente, Kant realiza afirmaciones proyeccionistas y detectivistas, y esto se debe a que su enfoque acerca de la normatividad posee componentes tanto constructivistas como (...) realistas. En virtud de ello, el presente trabajo defiende la tesis de que la ética kantiana asume una teoría “constitutivista” del valor, la cual, en pocas palabras, entiende que las fuentes de la normatividad y el valor son construcciones reflexivas del agente que implican, al mismo tiempo, y de forma performativa, la asunción realista de la libertad en cuanto que valor absoluto.
