The purely retributive moral justification of punishment has a gap at its centre. It fails to explain why the offender should not be protected from punishment by the intuitively powerful moral idea that afflicting another person (other than to avoid a greater harm) is always wrong. Attempts to close the gap have taken several different forms, and only one is discussed in this paper. This is the attempt to push aside the ‘protecting’ intuition, using some more powerful intuition specially invoked (...) by the situations to which criminal justice is addressed. In one aspect of his complex defence of pure retributivism, Michael S. Moore attempts to show that the emotions of well-adjusted persons provide evidence of moral facts which justify the affliction of culpable wrongdoers in retribution for their wrongdoing. In particular, he appeals to the evidential significance of emotions aroused by especially heinous crimes, including the punishment-seeking guilt of the offender who truly confronts the reality of his immoral act. The paper argues that Moore fails to vindicate this appeal to moral realism, and thus to show that intrinsic personal moral desert (as distinct from ‘desert’ in a more restricted sense, relative to morally justified institutions) is a necessary and sufficient basis for punishment. Other theories of the role of emotions in morality are as defensible as Moore’s, while the compelling emotions to which he appeals to clinch his argument can be convincingly situated within a non-retributivist framework, especially when the distinction between the intuitions of the lawless world, and those of the world of law, is recognised. -/- . Schopenhauer had important things to say about ethics in both normative and meta-ethical senses, but his impact on the evolution of moral theory has been minimized by the unfortunate neglect of his philosophy in general. A contemporary assessment of his ethical views reveals that they are both imaginative and interesting, not least because they challenge assumptions held by more canonical figures in the history of philosophy, both before and after his time. Since the roots of ethics are currently being vigorously (...) re-examined, it is regrettable that Schopenhauer's ideas have been omitted from mainstream discussion in the field. I attempt to remedy this lack by investigating how his ethics of compassion contributes to the following areas: reconciling ethics with strict determinism; naturalizing ethics; developing the philosophy of education; seeking inner peace and world peace; re-visioning our relationship with non-human animals and the environment. As this list indicates, Schopenhauer's moral theory has relevance for a much wider audience, beyond the limited sphere of professional philosophy. And because the world is in dire need of moral rejuvenation, any inspiration provided by a major thinker such as Schopenhauer should be heartily welcomed. While certain internal problems are posed by his metaphysical and epistemological doctrines, we can see past these in order to appropriate the living insights still to be found in Schopenhauer's ethical thought. The aim of this thesis will be to give an elucidation of Nietzsche’s ideal of the post-moral autonomous individual: to give a picture of what Nietzsche takes such an individual to look like, and to show how this picture relates to some of Nietzsche’s most fundamental philosophical concerns. Overall, my argument will be that autonomy, or rather the degree of autonomy that a person possesses, is a function of the power of that person in relation to the other people and (...) forces, and of their ability to extend their will over long periods of time. Moreover, the achievement of the highest degrees of autonomy, and by extension the achievement of the greatest levels of power, requires imposing an ethic upon one’s actions and one’s self. There are several features that this ethic must have if it is adequately to perform its function: it must be self-chosen rather than simply picked up from one’s surroundings, it must act to give unity to the most diverse collection of collection of drives and affects possible for the person who holds it, and it must be well tailored to fit their specific natural constitution. In order to establish this I will focus on four main issues: the significance of the sovereign individual of GM II: 2, the role of ethics/values in Nietzsche’s ideal of autonomy, the relation between Nietzsche’s deflationary account of consciousness and his views of freedom, and the notion of unity at play in Nietzsche’s writings. I will also offer some thoughts on the coherence of Nietzsche’s ideal of autonomy with his thoughts on life-affirmation. (shrink)
