Many take the claim that you cannot ‘get’ an ‘ought’ from an ‘is’ to imply that non- moral beliefs are by themselves incapable of justifying moral beliefs. I argue that this is a mistake and that the position that moral beliefs are justified exclusively by non-moral beliefs—a view that I call moral inferentialism—presents an attractive non-sceptical moral epistemology.

Neste artigo pretendo mostrar a importância do conceito de razoável na teoria da justiça como equidade, de John Rawls e também, explicar o problema da razoabilidade nessa teoria. O ponto de partida será ressaltar a exigência de razoabilidade que é feita ao agente moral na justiça como equidade. Posteriormente, procurarei identificar algumas críticas a esse critério. Partirei da crítica formulada por Estlund a respeito do estreitamento do conceito de razoabilidade e a necessidade da verdade e das críticas estabelecidas por Timmons (...) e Gaus sobre a exigência demasiada e ineficaz da razoabilidade. O passo seguinte será tentar responder a essas críticas formuladas e, na parte final do texto, procurarei estipular um argumento a respeito de um tipo de responsabilidade moral razoável que pode estar contida na justiça como equidade. In this paper, I hope to provide an account of the conditions of moral realism whereby there are still significant metaphysical commitments made by the realist which set the view apart as a distinct position in the contemporary meta-ethical landscape. In order to do so, I will be appealing to a general account of what it is for realism to be true in any domain of experience, whether it be realism about universals, realism about unobservable scientific entities, realism about artifacts, (...) and so forth. The concern of this paper is not with the truth of any particular realist or anti-realist view, but rather with determining what it is to be a realist or anti-realist in the first place. While much skepticism has been voiced in recent years about the viability of such a project, my goal is to articulate interesting and informative conditions whereby any view in any domain of experience can count as either a realist or an anti-realist position.

After a brief outline of Enoch’s defense of robust realism in his Taking Morality Seriously, I focus on Enoch’s taking-morality-seriously thought by making explicit the assumptions I see involved in it. Enoch’s argument from impartiality is then reconstructed to show how these assumptions are at work. Next, I explain the reasons why Enoch does not succeed in converting these assumptions into a positive argument for the thesis implied by robust realism that there is a moral objectivity. Finally, I conclude that (...) the critical analysis provided casts a shadow on the reliability of the taking-morality-seriously thought as a basis of a theoretical inquiry into the nature of morality. Do psychopaths make moral judgments but lack motivation? Or are psychopaths’ judgments are not genuinely moral? Both sides of this debate seem to assume either externalist or internalist criteria for the presence of moral judgment. However, if moral judgment is a natural kind, we can arrive at a theory-neutral criterion for moral judgment. A leading naturalistic criterion suggests that psychopaths have an impaired capacity for moral judgment; the capacity is neither fully present nor fully absent. Psychopaths are therefore not counterexamples (...) to internalism. Nonetheless, internalism is empirically problematic because it is unable to explain psychopaths’ moral deficits. (shrink)

Intuitionism and nihilism, according to nihilists, have key features in common: the same semantics and the same phenomenology. Intuitionism is the object of nihilism’s attack. The central charge nihilism lodges against intuitionism is that its nonnatural moral properties are queer. Here I’ll examine what ‘queer’ might mean in relation to the doctrines nihilism uses to support this charge. My investigation reveals that nihilism’s queerness charge lacks substance and resembles a tautology served with a frown. There’s really nothing to it. After (...) I show that, I’ll offer an explanation for why nihilism has gotten intuitionism wrong. It makes a central mistaken methodological assumption and doesn’t target any identifiable intuitionism in the last hundred or so years. (shrink)

This paper provides a novel critique of Walter Sinnott-Armstrong’s influential argument against epistemological moral intuitionism, the view that some people are non-inferentially justified in believing some moral propositions. At the beginning of the twenty-first century, this view experienced a revival, which coincided with an increasing interest in empirical research on intuitions. The results of that research are seen by some as casting serious doubt on the reliability of our moral intuitions. According to Sinnott-Armstrong, empirical evidence shows that our moral beliefs (...) have a high error rate in general, which creates a need for inferential confirmation for every single moral belief. His argument involves the problematic assumption that it is reasonable for informed moral believers to ascribe a high probability of error to every particular moral belief unless the believer has some special evidence that this particular moral belief belongs to a class that has a lower probability of error than the class of moral beliefs. Focussing on the non-moral example that Sinnott-Armstrong uses in the latest reformulation of his argument, the “Californian wine example”, I argue that apart from exceptional circumstances, the description of moral agents as ascribing correctness probabilities to their moral beliefs is odd, ERROR reveals an awkward picture of how agents relate to their moral beliefs and ERROR is problematic from the perspective of moral competence. This critique goes deeper than the worries raised by other critics to earlier versions of the argument, and part of it applies to moral intuitionism as well. (shrink)

Divine command theories of metaethics are commonly rejected on the basis of the Euthyphro problem. In this paper, I argue that the Euthyphro can be raised for all forms of moral realism. I go on to argue that this does not matter as the Euthyphro is not really a problem after all. I then briefly outline some of the attractions of a divine command theory of metaethics. I suggest that given one of the major reasons for rejecting such an analysis (...) has been found to be unsound divine command theories deserve to be taken more seriously in contemporary metaethics. This paper investigates the nature of scientific realism. I begin by considering the anomalous fact that Bas van Fraassen’s account of scientific realism is strikingly similar to Arthur Fine’s account of scientific non-realism. To resolve this puzzle, I demonstrate how the two theorists understand the nature of truth and its connection to ontology, and how that informs their conception of the realism debate. I then argue that the debate is much better captured by the theory of truthmaking, and not by (...) any particular theory of truth. To be a scientific realist is to adopt a realism-relevant account of what makes true the scientific theories one accepts. The truthmaking approach restores realism’s metaphysical core—distancing itself from linguistic conceptions of the debate—and thereby offers a better characterization of what is at stake in the question of scientific realism. This paper examines the concept of coherence and its role in legal reasoning. First, it identifies some problem areas confronting coherence theories of legal reasoning about both disputed questions of fact and disputed questions of law. Second, with a view to solving these problems, it proposes a coherence model of legal reasoning. The main tenet of this coherence model is that a belief about the law and the facts under dispute is justified if it is “optimally coherent,” that is, if (...) it is such that an epistemically responsible legal decision-maker would have accepted it as justified by virtue of its coherence in like circumstances. Last, looking beyond the coherence theory, the paper explores the implications of the version of legal coherentism proposed for a general theory of legal reasoning and rationality. (shrink)

This thesis examines the little-known phenomenological ethical theory of Max Scheler, discussed in his Formalism in Ethics and Non-Formal Ethics of Values and The Nature of Sympathy, also bringing in various other complementary philosophers. It argues that Scheler’s theory, when supplemented with complementary ideas, is superior to those offered by contemporary analytic intuitionism and other meta-ethical theories. It argues that a theory of pluralist emotive intuitionism provides a better description of both our experience of ethical value and the logical requirements (...) for the ethical knowledge presumed by that experience. This thesis places Scheler’s theory in the context of ethical intuitionism up until the present. It considers why intuitionism has been generally rejected, looking at outstanding philosophical questions facing ethical intuitionism and previous attempted answers, and discussing current theories of analytic ethical intuitionism and their flaws. It explains the significant elements of Scheler’s ethical theory and how it can be understood in its phenomenological context. To demonstrate how Scheler’s material intuitionism is better than current theories of rationalist intuitionism, and other meta-ethical alternatives, this thesis looks at two main groups of issues. Firstly, the epistemological issues raised by Scheler’s theory and how it offers a possible solution to the problem of ethical knowledge, along with a brief consideration of ontological issues. Secondly, normative issues raised by Scheler’s theory: major issues on normative judgement raised but not answered by Scheler’s theory and, following this, a chapter dedicated to Scheler’s theory of ‘persons’, particularly with reference to Emmanuel Levinas. It concludes that an adapted Scheleran theory of ethical intuitionism can be superior to contemporary theories. It explains how the fundamental features of ethical experience may be epistemologically and phenomenologically justified based on objective values. It provides better responses to standard problems raised against intuitionism while also providing a natural explanation for a wider range of moral phenomena than standard meta-ethical alternatives. This demonstrates its superior explanatory power and provides strong arguments for its value as an over-arching meta-ethical theory. (shrink)
