  • The Institutional Consequences of Nudging – Nudges, Politics, and the Law.Robert Lepenies & Magdalena Małecka - 2015 - Review of Philosophy and Psychology 6 (3):427-437.
In this article we argue that a widespread adoption of nudging can alter legal and political institutions. Debates on nudges thus far have largely revolved around a set of philosophical theories that we call individualistic approaches. Our analysis concerns the ways in which adherents of nudging make use of the newest findings in the behavioral sciences for the purposes of policy-making. We emphasize the fact that most nudges proposed so far are not a part of the legal system and are (...)

The characteristics of the activities of the courts are manifested through the mechanism of judicial discretion, within the framework of which decisions on cases are made. There are two main models used to explain the behavior of judges: based on the law and on the basis of personal preference. In Russian conditions, the most adequate way to explain the behavior of judges on (...)

  • Problem of «language of sociology» usage in legal theory and practice.
The article examines the feasibility and the possibility of «the language of sociology» usage in jurisprudence. It is proved that «the language of sociology» not only promotes the implementation of the methodological function of law, but actively supports «the spirit of law» in the studying of social processes. It is emphasized that the coexistence in the modern society of two systems of norms - social legal and social non-legal - requires the search for differentiation criteria. As such criteria, it is (...)
