Contemporary debates over the appropriate balance of unilateralism and multilateralism in U.S. foreign policy reflect disagreements not simply about the practical effectiveness of these alternative options but also about their legitimacy. Advocates of multilateral and unilateral action alike tend to bundle prudential calculations with normative claims, making assessments about costs and benefits difficult to disentangle from ethical arguments about fairness, justice, morality and obligation. Greater clarity may be possible by classifying U.S. foreign policy into six analytical categories, based on whether (...) the aims pursued are nationalist, internationalist, or cosmopolitan and the strategies adopted to realize them are unilateral or multilateral. Each set of aims has different ethical justifications that generate and help to explain divergent attitudes and judgments about the role of multilateral cooperation in U.S. foreign policy. The article sheds new light on alleged U.S. unilateralism, showing that the U.S. decision to go it alone–or to act with others–can be motivated by the desire to advance the narrow interests of the United States, to advance the interests of all states, or to advance the interests of humanity at large. The article suggests that purely nationalist policies, whether pursued through unilateral or multilateral means, will become increasingly untenable and illegitimate as world politics becomes institutionalized and as humanity becomes integrated, albeit slowly, into a single cosmopolitan community. What is »justice« from the perspective of contemporary Arabo-Islamic philosophy? Kaouther Karoui takes a transcultural approach, open to different philosophical traditions, and seeks to decenter Western notions of normativity. She focuses on two thinkers, namely the feminist Fatima Mernissi (d.2015) and Mohammed Arkoun (d.2010), a well-known critic of hegemony and orthodoxy. She situates their thinking within current debates among Arab thinkers and brings their ideas into dialog with Western political philosophy. Human dignity is one of the key concepts of our ethical evaluations, in politics, in biomedicine, as well as in everyday life. In moral philosophy, however, human dignity is a source of intractable trouble. It has a number of characteristic features which apparently do not fit into one coherent ethical concept. Hence, philosophers tend to ignore or circumvent the concept. There is hope for a philosophically attractive conception of human dignity, however, given that one takes three crucial turns. The negative (...) turn: to start the inquiry with violations of human dignity. The inductive turn: to consider the whole range of applications of the concept of human dignity in different areas of ethics. And finally, the historical turn: to take into account the historical bonds between human dignity and traditional conceptions of dignity. This book offers a unique and insightful analysis of Western and Middle Eastern concepts of dignity and illustrates them with examples of everyday life. Dignity in the 21st Century - Middle East and West is unique and insightful for a range of reasons. First, the book is co-authored by scholars from two different cultures (Middle East and West). As a result, the interpretations of dignity covered are broader than those in most Western publications. Second, the ambition of the book is (...) to use examples from everyday life and fiction to debate a range of dignity interpretations supplemented by philosophical and theological theories. Thus, the book is designed to be accessible to a general readership, which is further facilitated because it is published with full open access. Third, the book does not defend one superior theory of dignity, but instead presents six Western approaches and one based on the Koran and then asks whether a common essence can be detected. -/- The answer to the question whether a common essence can be detected between the Koranic interpretation of dignity and the main Western theories (virtue, Kant) is YES. The essence can be seen in dignity as a sense of self-worth, which persons have a duty to develop and respect in themselves and a duty to protect in others. The book ends with two recommendations. First, given the 7 concepts of dignity introduced in the book, meaningful dialogue can only be achieved if conversation partners clarify which variation they are using. Second, future collaborations between philosophers and psychologists might be helpful in moving theoretical knowledge on dignity as a sense of self-worth into practical action. The “scourges” of a sense of self-worth and dignity are identified by psychologists as violence, humiliation, disregard and embarrassment. One-third of all human lives end in early death from poverty-related causes. Most of these premature deaths are avoidable through global institutional reforms that would eradicate extreme poverty. Many are also avoidable through global health-system reform that would make medical knowledge freely available as a global public good. The rules should be redesigned so that the development of any new drug is rewarded in proportion to its impact on the global disease burden (not through monopoly rents). This reform would bring (...) drug prices down worldwide close to their marginal cost of production and would powerfully stimulate pharmaceutical research into currently neglected diseases concentrated among the poor. Its feasibility shows that the existing medical-patent regime (trade-related aspects of intellectual property rights—TRIPS—as supplemented by bilateral agreements) is severely unjust—and its imposition a human-rights violation on account of the avoidable mortality and morbidity it foreseeably produces. In this paper I argue that cosmopolitanism prohibits war and requires a global approach to criminal justice. My argument proceeds by drawing out some implications of the core cosmopolitan intuition that every human being has a moral status which constrains how they may be treated. In the first part of this paper, I describe cosmopolitanism. In the second part, Cosmopolitanism and War, I analyse violence, consider the standards cosmopolitanism sets for its justification, and argue that war fails to meet them. (...) In the third part, Cosmopolitanism and Criminal Justice, I argue that cosmopolitanism implies a moral obligation to deal justly with human wrongdoing wherever it occurs. Cosmopolitan pacifism follows: war is prohibited, and a consistent global criminal justice system is required. In the fourth part, Why No Cosmopolitan Pacifists?, I consider why cosmopolitans tend not to identify as pacifists, and in the final part, Objections, I discuss some objections. (shrink)

My paper consists of two parts. The first part deals with the fundamental normative standards of domestic social justice on the one hand and global justice on the other, standards that are requisite in order to identify injustices on both levels. On this basis, the second part focuses on the interrelations between domestic social justice and global justice with particular attention to the interdependencies between domestic and global injustices.

This essay is a review ofKarl Marx and Contemporary Philosophy. While the text will provide even knowledgeable Marxist readers with new insights on key texts and concepts in Marx, it nevertheless fails to intervene in crucial contemporary philosophical debates. The book is concerned less with the contemporary significance of Marxist philosophyas philosophyand more with re-reading classical Marxist texts in a contemporary context. This job it does well, but leaves the more important question of what Marxists have to say about fundamental (...) philosophical problems today unaddressed for the most part. (shrink)

Nanoparticles have multifaceted advantages in drug administration as vaccine delivery and hence hold promises for improving protection of farmed fish against diseases caused by pathogens. However, there are concerns that the benefits associated with distribution of nanoparticles may also be accompanied with risks to the environment and health. The complexity of the natural and social systems involved implies that the information acquired in quantified risk assessments may be inadequate for evidence-based decisions. One controversial strategy for dealing with this kind of (...) uncertainty is the precautionary principle. A few years ago, an UNESCO expert group suggested a new approach for implementation of the principle. Here we compare the UNESCO principle with earlier versions and explore the advantages and disadvantages by employing the UNESCO version to the use of PLGA nanoparticles for delivery of vaccines in aquaculture. Finally, we discuss whether a combined scientific and ethical analysis that involves the concept of responsibility will enable approaches that can provide a supplement to the precautionary principle as basis for decision-making in areas of scientific uncertainty, such as the application of nanoparticles in the vaccination of farmed fish. This paper examines the links between acting upon a duty to assist, responsibility for these actions, and how such actions link with incremental moral duties that can amass as a consequence of such action. More specifically, this paper is concerned with practices of international aid and assistance, whereby public and privately funded donations enable the actions of parties outside of the territorial and jurisdictional boundaries of a community and state to directly influence the functioning of that community, and the incremental (...) moral duties to which such action can give rise. Using a Senian account of the basis of moral duty, it explains how agents are responsible for the outcomes of their acts of assistance, even when mediated through international institutional actors, and how such acts can give rise to accumulative duties and obligations that are not bound or constrained by territorial boundaries or pre-existing special obligations. This paper gives a normative assessment of the problem of forced environmental migration, or, migration driven primarily by environmental events, drawing particular attention to the framing of citizen and non-citizen rights in the context of anthropogenic climate change. It explores a moral imperative to install special migration rights for Environmentally Displaced Peoples and briefly assesses the ability of current domestic migration policy to offer such rights. The paper concludes by offering three theoretical policy-oriented exercises, ultimately locating tiered citizenship as the (...) most immediate ethically robust and politically acceptable solution to the challenge of environmental displacement. In this article I rethink Rawls' conception of international economic justice, with a particular focus on international trade. I ground my normative argument on a different interpretation of the concepts of basic structure and of basic institution. I use the contemporary international trading system to illustrate my normative interpretation. I use the Law of Peoples to discuss the Rawlsian concept of basic structure. I contest Samuel Freeman's interpretation of this concept as one that pertains exclusively to the domestic realm. As (...) a reply, I work out an interpretation of basic institutions valid for both the national and international context. I base my understanding on the impact and the form of membership that characterize basic institutions. Both properties are compatible with an extension of the concept of a basic institution to the international domain. I then show how the World Trade Organization (WTO) system can be compared to a domestic basic institution. I analyse the decisional setting that surrounds the choice of joining the WTO. I conclude that no real alternative exists. Hence, WTO membership is not to be considered a completely free policy choice. I also state that the new system is witnessing a strong expansion of the areas subject to trade governance. Such expansion is responsible for the growing impact that international trade has on domestic institutions and hence on people. Finally, I use my analysis of contemporary international trading relations to test Rawls' position in the Law of Peoples. I conclude that although Rawls' principles for fair trade and international cooperation can regulate GATT-style international trade, they are not proficient in assessing the new characteristics of international trade. Zu diesem Zweck wird nach einer einleitenden Erörterung des dieser Idee zugrundeliegenden Gerechtigkeitsbegriffs zuerst das Projekt einer vertragstheoretischen Begründung einer gerechten staatlichen Ordnung in der frühen Neuzeit vor dem Hintergrund des Herausbildung des modernen Staates behandelt. Im Anschluss werden die theoretischen Leitideen und gesellschaftlichen Triebkräfte des Kampfes um bürgerliche Freiheit und demokratische Teilhabe beleuchtet, wovon ausgehend dann die Entstehung der (...) heute vorherrschenden Vorstellung von sozialer Gerechtigkeit einer näheren Betrachtung unterzogen wird. The question of whether to force Henning Jacobson to be immunized in 1905 in accordance with the 1902 Massachusetts smallpox vaccination law was one of ethics as well as law. How Thomas Parran, Surgeon General in 1936, chose to respond (...) to a raging syphilis epidemic in the United States in the early part of the 2W century raised considerable moral debate in determining the appropriate public health response for a government? More recently, questions have arisen concerning the appropriate reach of government in controlling HIV banning smoking, or promoting healthy lifestyles. This paper identifies three sets of problems of a specific ethico-political type, generated by the interrelationship between ethics and politics in the areas of world justice and global politics. One instance in which this interrelationship is tested is that of the conflict of duties and values as it appears in the particular domain of the relations amongst sovereign nation states as well as between them and other social groups. Following the general Introduction, the main body of the paper contains the (...) following three sections. (1) Without elaborating on the detailed mechanics of Kant's theory of perpetual peace, Section II discusses criticisms against the Kantian version of world peace in the context of which the first problem is encountered. The problem identified here is the ambiguity as to whether the establishment of a federated kind of peaceful co-existence between sovereign nations depends on the moral improvement of mankind or whether it is the other way round--i.e. whether ethical progress is a necessary presupposition or, rather, a consequence of political peace. That is, what is here identified as worrying is that the direction of dependence is not clear in such a proposal. Furthermore, such an approach, when applied to certain cases of inter-state differences, yields a rather alarming result as to the de-politicization of national states (Section II.2). (2) Yet such a type of international federalism requires a certain, peculiar, kind of legal enforcement of order without recourse to a supra state. So a re-examination of the notion of a legal order in general is needed. Given these requirements, Section III moves on to discuss moral conflict from the standpoint of relativism as it appears in the ethical and in the legal spheres. The second of our problems, identified in this section, is that, before discussing world justice we must first acknowledge the special relation and asymmetry between ethical standards and legal rules required by such a world order. (3) Finally, Section IV asks whether, given the above two problems, it is possible to envisage theoretically the logical possibility of moral conflict-resolution by postulating unchanging and encompassing super-norms of conduct. These special norms, if possible, would be able to direct action unequivocally when confronted with ethical or other dilemmas of duties (involving equally valid but conflicting demands among sovereign nations). This is the third problem. The Conclusion offers an evaluation of the whole discussion. These three ethico-political problems are shown to be interrelated. The overall thrust of the discussion is that it points to a number of philosophical difficulties in understanding the changing role of national states in a globalized political, economic and cultural environment. Accordingly, such difficulties have repercussions for any moral criticism of issues of world justice and global politics. At present, the debate on global justice, a debate which is at the core of global ethics, is largely being conducted by European and American scholars from different disciplines without taking into account views and concepts from other regions of the world, particularly, from the Global South. The lack of a truly intercultural, interreligious, and international exchange of ideas provokes doubts whether the concepts of global justice introduced so far are able to transcend regional and cultural horizons. The article introduces (...) concepts of justice from African scholars, whose voices have remained marginal until now, like the Kenyan philosopher Henry Odera Oruka, the Ethiopian philosopher Teodros Kiros, and the debate on ubuntu, one of the most controversial concepts in southern Africa today. If Europe wants to overcome its current crisis, it urgently needs to develop a new political vision and a new concept for political integration. By focusing on the idea of a cosmopolitan Europe, this article outlines such a political vision for Europe. To this end, it first suggests reformulating the concept of cosmopolitanism in such a way that it is not tied to the ‘cosmos’ or the ‘globe’. With the aid of such a generalized concept of cosmopolitanism it then presents (...) a novel, cosmopolitan approach to European integration that is no longer concerned with harmonizing rules and eliminating (national) differences, but with recognizing them. Finally, it outlines a new, post-national model of democracy for Europe that no longer disenfranchises citizens and instead gives them an active role in European decision-making processes. (shrink)

How to hospitably welcome refugees and migrants presents urgent questions for social and political thought. Current debates can be attributed to three discursive fields. Liberal versions hold that there are good reasons for political and legal limits of hospitality, critical perspectives advocate a renewed cosmopolitanism and, finally, deconstructive perspectives focus on the demand of unconditional hospitality as an absolute ethical requirement. These concepts trouble the conventional congruence of citizenship and bounded territory that make up modern nation states, on the one (...) hand. On the other hand, they affirm the rights of political communities to decide on the contents and the extent of the universal duty to host those endangered. Taking the Mediterranean and the local arena (Lampedusa) as the example, the article, which is based on extensive, multi-sited anthropological field research, engages with the tensions and limits inherent in current notions of hospitality. This article addresses the issue of future cosmopolitanism, building on a minimal reconstruction of what cosmopolitanism has been in the past. It will elucidate the notion of ‘political’ cosmopolitanism in its relation to a certain methodological option which is designated by the shorthand term ‘judgment’. Cosmopolitanism is not a new idea but a new version of it is constituted by ‘political’ cosmopolitanism, bound up with a judgmentbased, as opposed to principle-based, understanding of normativity.

What does it mean to introduce the notion of imagination in the discussion about global justice? What is gained by studying the role of imagination in thinking about global justice? Does a focus on imagination imply that we must replace existing influential principle-centred approaches such as that of John Rawls and his critics? We can distinguish between two approaches to global justice. One approach is Rawlsian and Kantian in inspiration. Discussions within this tradition typically focus on the question whether Rawls's (...) theory of justice (1971), designed for the national level, can or should be applied to the global level. Can and should Rawls's Difference Principle be globalized, as Thomas Pogge argues? Is this proposal superior to Rawls's Law of Peoples (1999)? Another approach to global justice has been developed by Martha Nussbaum in Cultivating Humanity (1997), Poetic Justice (1995), and other work. I will construct her view and critically examine it by looking at her arguments about the relation between empathy, literature, and global justice. At first sight, these two approaches seem to be opposed. The former puts an emphasis on principles, universal reason, and the moral aspects of institutions and their policies, whereas the latter is rather concerned with the relation between imagination and justice, with the particular, and with the individual moral development. But is this necessarily so? I will show that both approaches could benefit from each other's insights to strengthen their own position. Moreover, I will argue for middle way between, or an integration of the two approaches that combines principles and imagination. In this way, we can move towards a more comprehensive account of global justice. (shrink)

Defenders of a priority for compatriots have to acknowledge two strong moral constraints: states have to fulfil all their special, domestic and trans-domestic duties, and associative duties are limited by distributive constraints resulting from the moral duty to fight poverty and gross global inequalities. In the recent global context, I see four main problems for liberal-nationalist defenders of (...) priority for compatriots: (i) Reasonable particularists often forget that associative duties for compatriots compete with many sub-national and trans-domestic associative duties. (ii) They tend to forget that associative national duties compete with other, strong special (contractual, reparative) obligations regarding not only citizens and residents inside nation-states but also trans-domestic obligations across state borders. (iii) They do not properly discuss the problem of unallocated duties in addressing global poverty and insecurity. (iv) The design of supra-national and global mediating institutions, and the crafting of policies to remedy the misallocation of duties and to coordinate the required state activities is an urgent task neglected by liberal nationalists. In the recent context, reasonable partialitys bias towards partiality is most unwelcome and morally dubious. Reasonable impartialitys bias towards cosmopolitanism helps to stimulate a drastic shift in obligations and stimulates productive trans-national institutional design. (shrink)

In this paper I argue that resource allocation in publicly funded medical systems cannot be done using a purely substantive theory of justice, but must also involve procedural justice. I argue further that procedural justice requires institutions and that these must be “local” in a specific sense which I define. The argument rests on the informational constraints on any non-market method for allocating scarce resources among competing claims of need. However, I resist the identification of this normative account of local (...) justice with the actual approach to local decision-making taken within the UK National Health Service. I illustrate my argument with reference to the case of provision of In Vitro Fertilisation within the UK NHS. (shrink)

The word ‘cosmopolitan’, which derives from the Greek word kosmopolitês (‘citizen of the world’), has been used to describe a wide variety of important views in moral and socio political philosophy. The nebulous core shared by all cosmopolitan views is the idea that all human beings, regardless of their political affiliation, do (or at least can) belong to a single community, and that this community should be cultivated. Different versions of cosmopolitanism envision this community in different ways, some focusing on (...) political institutions, others on moral norms or relationships, and still others focusing on shared markets or forms of cultural expression. The philosophical interest in cosmopolitanism lies in its challenge to commonly recognized attachments to fellow citizens, the local state, parochially shared cultures, and the like. (shrink)
