In this paper we consider whether a pragmatics of semantic content can be a useful approach to legal interpretation. More broadly speaking, since a pragmatic conception of meaning is a component of inferential semantics, we consider whether an inferentialist approach to legal interpretation can be useful in dealing with some problems of this important aspect of law. In other words, we ask whether Legal Inferentialism is a suitable conception for legal interpretation. In Section 1 we briefly consider the semantics/pragmatics debate (...) in contemporary philosophy of language and in relation to legal interpretation. In Section 2 we discuss the relations between a pragmatics of semantic content and an inferentialist conception of content. In Section 3 we consider how Inferentialism can be applied to legal interpretation. This paper aims to argue for two related statements: first, that formal semantics should not be conceived of as interpreting natural language expressions in a single model (a very large one representing the world as a whole, or something like that) but as interpreting them in many different models (formal counterparts, say, of little fragments of reality); second, that accepting such a conception of formal semantics yields a better comprehension of the relation between semantics and pragmatics and of the role (...) to be played by formal semantics in the general enterprise of understanding meaning. For this purpose, three kinds of arguments are given: firstly, empirical arguments showing that the many models approach is the most straightforward and natural way of giving a formal counterpart to natural language sentences. Secondly, logical arguments proving the logical impossibility of a single universal model. And thirdly, theoretical arguments to the effect that such a conception of formal semantics fits in a natural and fruitful way with pragmatic theories and facts. In passing, this conception will be shown to cast some new light on the old problems raised by liar and sorites paradoxes. (shrink)

The paper presents an argument against a "metaphysical'* conception of logic according to which logic spells out a specific kind of mathematical structure that is somehow inherently related to our factual reasoning. In contrast, it is argued that it is always an empirical question as to whether a given mathematical structure really does captures a principle of reasoning. lMore generally, it is argued that it is not meaningful to replace an empirical investigation of a thing by an investigation of its (...) a priori analyzable structure without paying due attention to the question of whether it really is the structure of the thing in question.) It is proposed to elucidate the situation by distinguishing two essentially different realms with which our reason must deal: "the realm of the natural'*, constituted by the things of our empirical world, and "the realm of the formal'*, constituted by the structures that we use as "prisms'* to view, to make sense of, and to reconstruct the world. It is suggested that this vantage point may throw light on many foundational problems of logic. (shrink)

Theories of language in the twentieth century tend towards one of two radically different models. One paradigm holds that expressions ‘stand for’ entities and their meanings are the entities stood for by them. According to the other, expressions are rather tools of interaction and their meanings are their functions within the interaction, their aptitudes to serve it in their distinctive ways.

Summary. I do not think there is one true answer to the question What is logic?. There are, clearly, good and less good answers, and there are answers which are plainly wrong; but the term 'logic' has been employed, throughout the history of the subject matter, in such diverse ways that no single one of the uses can be said to be the correct one. However, even among the answers which are acceptable on historico-semantical grounds there are still, without doubt, (...) good and less good ones, in the sense of more and less useful. In this paper, I will argue for a certain, rather narrow conception of logic; and I am going to argue that it is not only an acceptable answer, but also one which is more useful and fruitful than its alternatives.
