This paper seeks to uncover and rationally reconstruct four theoretical prescriptions that H. L. A. Hart urged philosophers to observe and follow when investigating and theorizing about the nature of law. The four prescriptions may appear meager and insignificant when each is seen in isolation, but together as an inter-connected set they have substantial implications. In effect, they constitute a central part of Hart’s campaign to put philosophical investigations about the nature of law onto a path to a genuine research (...) program. The paper takes note of certain prevalent and robust trends in contemporary legal philosophy that detract its practitioners from the four prescriptions, and that have them revert to the some older modes of thinking from which Hart sought a decisive break. A number of contemporary legal philosophers’ views and commitments are taken up and assessed, and in particular those of John Gardner and Leslie Green. (shrink)

This article argues that Agamben’s conception of fiction is crucial for understanding his recent works. I suggest that the key to understanding Agamben conception of fiction is to be found in a few curious remarks at the end of Language and Death. These remarks explain why the distinctions between life and death, animal life and human life, bare life and political forms of life, the outlaw and the sovereign, and the norm and the exception that continue to preoccupy Agamben are (...) all fictions. After considering Agamben’s account of these fictions and their relation to the relevant passage in Language and Death, the article explores the ways Agamben thinks the fictions that govern human action and social life might be unworked. Although now largely forgotten, the international language movement was, from the 1880s to the end of the Second World War, a matter of widespread public interest, as well as a concern of numerous scientists and scholars. The primary goal was to establish a language for international communication, but in the early twentieth century an increasing accent was placed on philosophical considerations: wanted was a language better suited to the needs of modern science and rational thought. In this paper, we examine (...) the example of the English scholar C.K. Ogden's international language Basic English and his efforts to win the Vienna Circle philosophers Otto Neurath and Rudolf Carnap over to the project. Basic is shown to be an implementation of key ideas in Ogden's philosophy of language, ideas shared to a large extent with Neurath and Carnap. This we see through an examination of their unpublished correspondence, as well as through the collaboration that emerged between Ogden and Neurath, in which Neurath's Isotype, a system for graphically representing statistical data, became closely aligned with Basic. Through the ideas and endeavours we investigate here, we gain a new perspective on this crucial period in the history of analytic philosophy. (shrink)

Les travaux récents ont permis de rendre justice à la théorie du langage qu’a élaborée Bentham et d’expliquer les enjeux théoriques de son attachement aux mots. Il est donc désormais possible de s’attacher à comprendre les enjeux langagiers à l’oeuvre dans les différents champs de la pensée benthamienne, et plus particulièrement au sein de sa théorie générale du droit. Dès lors, son projet de Nomographie semble aller de soi. Nous nous attacherons à montrer dans quelle mesure ce texte entend tirer (...) les conséquences de l’ensemble des acquis théoriques de la philosophie benthamienne et plus précisément comment il permet de penser les relations entre langage et droit pour aboutir à la constitution du droit comme système de contrôle social.
