My aim in this paper is to demonstrate the relevance of the Aristotelian notion of civic friendship to contemporary political discussion by arguing that it can function as a social good. Contrary to some dominant interpretations of the ancient conception of friendship according to which it can only be understood as an obligatory reciprocity, I argue that friendship between fellow citizens is important because it contributes to the unity of both state and community by transmitting feelings of intimacy and solidarity. In that sense, it can be understood as an important relationship predicated on affection and generosity, virtues lacking from both contemporary politics and society that seem to be merely dominated by Post-Enlightenment ideals. This article examines Machiavelli’s image of humanity. It argues against the prevailing views that characterize it either as pessimistic or optimistic and defends the thesis that the Florentine has a realist image of humanity. Machiavelli is a psychological egoist who conceives of man as a being whose actions are motivated by his drives, appetites, and passions, which lead him often to immoral behavior. Man’s main drives are “ambition” (ambizione) and “avarice” (avarizia). This article also investigates Machiavelli’s concept of nature and (...) shows that, for him, the constancy of human nature is the central premise that makes the scientific analysis of politics possible. Despite the fact that human drives and capabilities are the same at all times, good laws, military training, and religion allow man to be changed and educated toward “virtue” (virtù). To make such changes in man, however, presupposes a good legal and political order. Machiavelli justifies the state because of its capacity to reshape human nature and to improve man. The state is not only a coercive power but a moral institution. This leads to the conclusion that Machiavelli does not separate politics from morality as most scholars claim. (shrink)

El artículo muestra la importancia de la amistad en el contexto de la filosofía política aristotélica. Esta importancia se verifica en su peso específico en comparación con la justicia, puesto que Aristóteles mismo sostiene que la amistad cívica es incluso un objetivo superior al de la búsqueda de la justicia. En concreto, el artículo se centra en la función de la concordia, como tipo especial de amistad cívica, en términos de conservación de la unidad y estabilidad de la polis. Para (...) captar su significación, se plantea el papel de la concordia como complemento a la condición política del ser humano. La concordia es necesaria a la luz de la tendencia a la lucha entre las partes de la ciudad, entre el demos y los oligarcas. Puesto que esta lucha pone en peligro la continuidad de la polis, la concordia entre ciudadanos se convierte en un antecedente privilegiado del principio de fraternidad republicana, el cual todavía no ha gozado de una atención suficiente en el campo de la historia de la filosofía política. Human beings, according to Aristotle, are not the only political animals. Bees, wasps, ants and cranes are the other political species mentioned by Aristotle in the History of Animals. Politics, I, 2 confirms this point and makes the additional statement that human beings, if not the only political animals, are nevertheless more political than the other political animals. There has been a traditional scholarly agreement that the capacity for rational speech is the reason why human beings are more political. This (...) traditional view seems to have some support from the same chapter of Politics, where Aristotle addresses, right after having stated that human beings are more political, the role of language in human beings’ political life. This paper contests this traditional view about language and claims that it is the more political character of human beings which explains the political role of language and not vice versa. -/- . In this article, I use the expanded hohfeldian model presented by Wenar to argue that, according to Aristotle's theory of friendship, every bond of friendship that is based on utility or virtue creates duties and hohfeldian incidents between those who are friends. In section 1, I provide a quick presentation of Hohfeld's work and of Wenar's hohfeldian model. In section 2, I present my thesis about the creation of certain hohfeldian incidents and certain duties in virtue and utility friendships as (...) conceived by Aristotle. In section 3, I give a broad characterization of Aristotle's theory of friendship and of the three great kinds of friendship that he recognizes. In section 4, I defend the thesis that it is only in virtue and utility friendships that duties are created. In section 5, I specify what are the hohfeldian incidents created by these two kinds of friendship. In section 6, I specify the two ways in which, according to Aristotle, these incidents and duties might be created. In section 7, I conclude with a brief recapitulation of the argument. En este artículo utilizo el modelo hohfeldiano extendido, presentado por Wenar, para argumentar que, según la teoría de la amistad de Aristóteles, todo lazo de amistad basado en la utilidad o la virtud crea deberes e incidentes hohfeldianos entre aquellos que son amigos. En la sección 1 proporciono una presentación rápida de la obra de Hohfeld y del modelo hohfeldiano de Wenar. En la sección 2 presento mi tesis sobre la creación de ciertos incidentes hohfeldianos y ciertos deberes en las amistades basadas en la virtud y la utilidad tal como fueron concebidos por Aristóteles. En la sección 3 ofrezco una caracterización general de la teoría de la amistad de Aristóteles y de los tres grandes tipos de amistad que reconoce. En la sección 4 defiendo la tesis de que los deberes se crean solamente en las amistades basadas en la virtud y la utilidad. En la sección 5 especifico cuáles son los incidentes hohfeldianos creados por estos dos tipos de amistad. En la sección 6 especifico las dos maneras en que, según Aristóteles, podrían crearse estos incidentes y deberes. En la sección 7 concluyo con una breve recapitulación de la argumentación. (shrink)

Can compensation repair the moral harm of a previous wrongful act? On the one hand, some define the very function of compensation as one of restoring the moral balance. On the other hand, the dominant view on compensation is that it is insufficient to fully repair moral harm unless accompanied by an act of punishment or apology. In this paper, I seek to investigate the maximal potential of compensation. Central to my argument is a distinction between apologetic compensation and non-apologetic (...) compensation. Apologetic compensation, I argue, is an act that expresses regret and apology by means of some offer of money, goods, or services. Non-apologetic compensation is an act that seeks to restore loss or harm without expressing regret or apology. In the paper, I defend the view that acts of compensation can be apologetic and argue that such apologetic compensation is sufficient for moral repair. (shrink)
