What is »justice« from the perspective of contemporary Arabo-Islamic philosophy? Kaouther Karoui takes a transcultural approach, open to different philosophical traditions, and seeks to decenter Western notions of normativity. She focuses on two thinkers, namely the feminist Fatima Mernissi (d.2015) and Mohammed Arkoun (d.2010), a well-known critic of hegemony and orthodoxy. She situates their thinking within current debates among Arab thinkers and brings their ideas into dialog with Western political philosophy. In this chapter we argue for biophilosophy as a queerfeminist and posthumanities methodology that attends to the question of life by focusing on multiple differences and transformations, materiality and processuality, as well as relations, intra-actions, and disconnections. By combining both the ontological and ethical concerns that go beyond what is conventionally seen as “life”, biophilosophy offers a critical and innovative approach to the issues of death, extinction, (un) liveability, terminality, and toxicity, among others, which all form the backbone of the (...) environmental crises and changing conditions of life on Earth, often framed as the Anthropocene. In what follows, we first discuss select theorisations and implications of the “life/death” coupling as an ethico-political question; subsequently we elaborate the concept of biophilosophy as a methodology; and finally, we propose two examples where we test biophilosophy as a framework that allows us: (1) to engage with the enmeshment of life and death through the concept of the non/living, and (2) to explore the concept of toxic embodiment as an onto-ethical condition we all (human and non-human) are differentially immersed in. This book is a timely intervention in the areas of philosophy, history, and literature. As an exploration of the modern political order and its racial genealogy, it emerges at a moment when scholars and activists alike are wrestling with how to understand subject formation from the perspective of the subordinated rather than from dominant social and philosophical modes of thought. For Sawyer, studying the formation of racialized subjects requires a new imagining of marginalized subjects. Black subjectivity is not viewed from (...) the static imaginings of social death, alienation, ongoing abjection, or as a confrontation with the treat of oblivion. Sawyer innovates the term "fractured temporality," conceptualizing Black subjects as moving within and across temporalities in transition, incorporated, yet excluded, marked with the social death of Atlantic slavery and the emergent political orders it etched, and still capable of exerting revolutionary force that acts upon, against, and through racial oppression. Through an example of the prohibition against dating in a technical school in southwest China in 1978, this article analyzes how three intersecting forces - the ideology of socialist collectivism, the structure of the work unit system and the socialist sovereign ownership of the body - account for sexual repression in the Maoist period in China. Rather than being an ahistorical, essential component of Maoist socialism, sexual repression (psychic and social) was a historically specific and complex phenomenon. The transformation of (...) sexual repression at a historical moment took the form of an assemblage of the return of love discourse and an emergent desire-centered subjectivity in the great transformation from Maoist socialism to the post-Mao reform period. How can we account for trials in which the judgment speaks not only to and about the defendants and their deeds, but also about injustices from a more distant past? Building on approaches to ghosts and haunting by Jacques Derrida and Avery Gordon, I propose to examine a set of the German post-1990 trials for human rights violations committed in the former East Germany as instances of haunted justice. Here, the courts not only adjudicated the present cases, but also tried (...) to ‘go back and make whole what has been smashed’ by their own lack of judgment in the failed trials of the Nazi perpetrators. In this instance, the ‘time is out of joint’, and we see the ghosts of the failed trials of Nazi perpetrators standing next to the inheritance of impunity fostered in West German courts, and next to the now present East German perpetrators. What can justice mean in such a complex constellation of injustices? I argue that the ghostly dimension of these cases point to a need for a kind of justice and engagement that can ultimately not be found in courts—yet the courts’ engagement with this ghostly matter is nevertheless important. My aim in this paper is to introduce a theory of affective labor as byproductive, a concept I develop through analysis of the phenomenology of various affective labor practices in dialog with feminist scholarship, both on gendered and racialized labor, and on affect and emotion. I motivate my theory in the context of literature on affective and emotional labor in philosophy and the social sciences, engaging the post-Marxist literature on affective and immaterial labor and emphasizing feminist critiques. I argue that (...) affective labor is not only the work of producing affects for others to consume or the reproductive work that rejuvenates and sustains labor power and social life, but also the work of metabolizing waste affects and affective byproducts. Myra Hird and Harlan Weaver have been invited by the editors of this special issue to enter into discussion with each other – to conduct a series of interchanges – because of the careful attention their research has paid to the ways in which transness as a lived reality is ontologized in humans, non-human animals, bacteria, and viruses. With this issue’s interchanges, we would like to further the conversation on critically approaching the consequences of merging transness with animality. In this article I examine what happens to the “I” when the other disappears. I elucidate the relationship between ontic – relational ties to specific others – and ontological relationality – the fundamental relationality that facilitates the very existence of the “I.” The loss of an ontic relationality, I contend, ensures that the “I” can never be the same as it was prior to the loss. But the disappearance of an ontic relationality also accentuates that the “I” cannot disavow its (...) ontological relationality, despite the pain and suffering brought about by the loss of a specific other. I argue that exposure to this ontological relationality, through the deprivation of an ontic one, offers us the opportunity to re-think habituated and potentially damaging forms of relationality, particularly in an age when neoliberal rationality encourages us to turn away from the other and to seek shelter in the self. To explicate the chiastic relationship between ontic and ontological relationality, I draw on Maurice Merleau-Ponty’s concept of the “hinge,” Judith Butler’s work on grief and mourning, and Emmanuel Levinas’s notion of the “face.” By looking specifically at remembrance campaigns for victims of forced disappearance – particularly in Guatemala and Argentina – I show how faces of the disappeared continue to haunt the political present in ways that refuse the fantasy of a return to a former order. In doing so, these campaigns keep exposing us to the ontological relationality that underpins all human life, encouraging us to find new ways of relating that transcend our habituated and repetitive relational behaviours. This exposure, I argue, illustrates that no amount of self-sufficiency allows us to escape the ontological necessity of relationality. The disappearance of the other, any other, discloses the fraudulent anti-relationality of the neoliberal era by revealing the ties that connect beings together. While the turn to vulnerability in law responds to a recurrent critique by feminist scholars on the disembodiment of legal personhood, this article suggests that the mobilization of vulnerability in the criminal courts does not necessarily offer female drug mules a direct path to justice. Through an analysis of sentencing appeals of female drug mules in England and Wales, this article presents a feminist critique of the dispositif of the person and its relation to vulnerability. Discourses on drug mules’ vulnerability (...) mobilize the trope of the colonial victim in need of protection, which is often translated into legal mercy. But mercy is rather an expression of biopower which inscribes not only fragility onto the bodies of drug mules by figuring them as exemplar paradigms of colonial subjectivity, but also reinvigorates the dispositif of gender implicit in the legal person. In this set-up, it would appear as if law and politics totalize the registers of life, in this case the contours of vulnerable body. The article suggests we must revisit the image of the wounded body in order to carve out a space for resistance. Drawing on Elaine Scarry and Judith Butler, it suggests vulnerable bodies are marked by a semiotic openness, which renders them subject to appropriation but also able to signify the precarity produced by the law through their resistance to representation. Bodily methodologies that engage with the affective, rhythmic, and temporal dimensions of movement have altered the landscape of social science and humanities research. Walking is one such methodology by which scholars have examined vital, sensory, material, and ephemeral intensities beyond the logics of representation. Extending this rich field, this article invokes the concept trans to reconceptualize walking research through theories that attend to the vitality and agency of matter, the interconnectedness between humans and non-humans, the importance of mediation and bodily (...) affect, and the necessity of acknowledging ethico-political responsibility. While theoretical and empirical research about embodied, emplaced, and sensorial relations between moving bodies and space are well developed in the field of walking studies, their entanglements become profoundly altered by theories of trans – transcorporeality, transspecies, and transmaterialities. The article aims at reconstructing how pain is used in contemporary societies in the process of engraving power. Firstly, a social phenomenological analysis of pain is conducted: Husserl’s and Merleau-Ponty’s ideas are used for clarifying the experience of pain itself; Elaine Scarry’s analyses are overviewed in order to reconstruct how pain contributes to the establishing of power. Secondly, this complex approach is applied in early modern context: the parallel processes of the decline of a transcendental and the emergence of a (...) medical interpretation of pain is introduced, along with the marginalization of violence. Thirdly, the era characterized by the triumph of medical pain management is analysed: it is argued that the constitutive role of pain in establishing power does not cease to exist with the emergence of technologies of discursive governance ; it is an open question, what sort of power is engraved through pain understood in strictly medical frames. Definitions of death are often referred to as legal fictions since brain death was conceived in the mid-twentieth century. Reference to legal fiction is generally paired with bioethicists’ concern that it facilitates post-mortem tissue donation and the health system generally, by determining death earlier on the continuum of dying and availing more viable tissue and therapeutic resources for others. The author argues that spatio-legal theory, drawing from legal geography, can account for the heterogeneity of effects that the fiction has in (...) spatially managing bodies (e.g., physicians, patient, family) at the bedside. The legal fiction is produced in physicians’ socio-legal practices, coordinating decision-making according to geographies of scarcity and severable, self-contained live- and dead-bodies. The determination liminally exists between private and public, enacting a sterile, affectless ordering of bodies but administered in the spectacle of sovereign death-making, conveying authority whilst managing patient’s and family’s consents. Spatialising traces of anatamo-politics and biopolitics thereby congeal and are enacted heterogeneously in and through the legal form of the fiction, securing preferred constructions of the body in the management of mortality. These spatio-legal features of the legal fiction are described from their collision with case law and literature that document competing nomoi produced from or secreted by antinomian bodies. The Trump Administration's governance of COVID-19 racial health disparities data has become a key front in the viral war against the pandemic and racial health injustice. In this paper, I analyze how the COVID-19 pandemic joins an already ongoing racial spectacle and system of structural gaslighting organized around “racial health disparities” in the United States and globally. The field of racial health disparities has yet to question the domain assumptions that uphold its field of investigation; as a result, the entire (...) reform program called for by racial health disparities science is already featured on the menu of the white supremacist power structure. The societal infrastructure that produces scientific knowledge about patterns of health and disease in the human population needs to confront its structural position as part of the racial spectacle organized around racial health disparities in the United States. This paper offers an interpretation of racial antimatter to explain why the data will not save us in the COVID-19 pandemic, drawing on articulations of racial spectacle and structural gaslighting within critical race theory and Afropessimist thought. By positioning events in the COVID-19 pandemic together within the same racially speculative frame, I show how the collection of racial health disparities data came up against white supremacists’ political ambitions in a time-space where the demand for human life to matter and the iterative regeneration of racial antimatter collided. This essay is an attempt to begin to think through the complex interlacing of Levinasian ethics, violence, terror and war. The question driving this essay is: in the midst of the harrowing debris of body parts that followed the synchronised explosions of bombs in a number of London train carriages and a bus, what can possibly remain of the ethical? This question will be examined in the context of what remains unspeakable in the face of such acts of violence. Framed (...) by the authorising rubric of declarations of law—as ‘that which speaks in the language of legislation and promises certainty in the anxious aftermath of the loss of certainty’, and the attendant concerns with the question of the ‘enemy’ —this essay seeks to examine the ‘unspeakable remainder’ of declarations of law, as that which unsettles promises of certainty in the anxious aftermath of a terrorist explosion and its ongoing trauma. In the course of this essay, I proceed to think through the contentious relation between violence and ethics in the context of a Levinasian framework, arguing for a Levinas that challenges and unsettles pietistic views of his ethical philosophy. In deploying the neologism necroethics, I attempt to examine anachronic and necrological violence and its relation to the ethical injunction to own responsibility for the dead. (shrink)

The accurate illustration of the contemporary refugee subject has presented an unprecedented theoretical, epistemological and methodological challenge to all fields of academic research. Seeking for alternative philosophical modalities capable of liberating refugee representation from the suffocating threat–victim bipolarity, this article critically investigates Giorgio Agamben and Judith Butler’s theoretical perspectives on refugee subjectivity. Section 1 systematises the dominant tropes of refugee representation either as dehumanised threats or depoliticised victims. Section 2 introduces the readers to Giorgio Agamben’s emblematic homo sacer as a (...) potentially fertile reconceptualisation of refugee subjectivity. In this context, Judith Butler’s critique on the Agambenian bare life is presented in two core pillars. Following one Butlerian claim, we trace the Agambenian inadequacy to successfully overcome the contemporary threat–victim mode of refugee representation in the absence of an empowering theoretical account of the homo sacer’s agentic and resisting capacities. In Section 4, we explore Judith Butler’s main argument regarding the constitutively political character of vulnerable refugee existence. By designating the Butlerian constellation of vulnerability and agency as an invigorating alternative perspective on modern refugee representation, we finally argue that Butler’s epistemological framework provides a more agonistic and nuanced theorisation of refugee subjectivity than Agamben. One of the key questions facing Gothic Studies today is that of its migration into and out of its once familiar generic or symbolic modes of representation. The BBC series In the Flesh addresses these concerns against the background of a neoliberal medical culture in which pharmaceutical treatments have become powerful tools of socio-economic normalization, either through inducing passivity or in heightening productivity, generating chemically adapted biomachines tuned to think and produce. But the pharmakon has always been a risky form (...) of normalization, its poisonous mechanisms threatening to undo its helpful patterns by stealth. This essay discusses the pharmacological and medical contexts of the series in which zombies are subjected to medical management and normalized as “PDS sufferers,” thereby locating In the Flesh in terms of an already gothicized neoliberal pharmacology of everyday life. It also enquires how the proximity of the symbolic pharmacology of the series to neoliberal medical discourses and practices actually challenges traditional representational patterns of the Gothic and whether the Gothic can still have a role as an alternative cure to society’s ills. In this article two series are analyzed: Black Earth Rising and Queen Sono, shows that are about African realities from an African perspective. The findings in this article show that both series address social and political issues such as neocolonialism, neoextractivism, internal colonialism, racism, inequality, justice, self-determination, corruption, violence, peace, memory, necropolitics, mental health, and decoloniality. I also argue that the shows could be used as pedagogical tools to raise critical consciousness in a wide public regarding the social and political (...) issues addressed. The research in this article has been conducted with a qualitative methodology, using both shows as case studies and using content analysis and bibliographical research. The analysis of the series is based in the discussion of critical theory and decoloniality approaches and authors, especially from Latin America and Africa. Furthermore, the analysis of popular media is a relevant effort to decolonize knowledge, using alternative and non-academic sources to produce and socialize knowledge. (shrink)

In June 2007, the Australian federal government sent military and policy into Indigenous communities in the Northern Territory on the premise that sexual abuse of children was rampant and a national crisis. This article draws on Foucault’s work on sovereignty and rights to argue that patriarchal white sovereignty as a regime of power deploys a discourse of pathology in the exercising of sovereign right to subjugate and discipline Indigenous people as good citizens.

This essay looks to the omission of aging queer bodies from new medical technologies of sex. We extend the Foucauldian space of the clinic to the mediascape, a space not only of representations but where the imagination is conditioned and different worlds dreamed into being. We specifically examine the relationship between aging queers and the marketing of technologies of sexual function. We highlight the ways queers are excluded from the spaces of the clinic, specifically the heternormative sexual scripts that organize (...) biomedical care. Finally, using recent zombie theory, we gesture toward both the constraints and possibilities of queer inclusion within the discourses and practices that aim to reanimate sexual function. We suggest that zombies usefully frame extant articulations of aging queers with sex and the dangerous lure of medical treatments that promise revitalized, but normative, sexual function at the cost of other, perhaps queerer intimacies. The text elaborates on the relations of objectivity and materiality fiction and those of virtuality produced by new media and digital technologies. It presents and elaborates a critique of the two most relevant debates in contemporary philosophy and theory, the relation of materialism to what is termed the “new materialism,” which is proposed as a substitute for what in the modernist era formed the relation between objectivity, materialism and realism, and then proceeds to expose the difference between thanatopolitics and necropolitics.

In this essay, I argue that the Indian state’s response to the Maoist insurgency has been ideologically shaped by the “new terrorism” discourse cultivated by Western powers, particularly by the United States. Following the post-9/11 othering of Islamic terrorism as a trope of a “civilizational clash” between East and West, the Indian state has strategically demarcated the regions affected by the Maoist armed insurgency as the “Red Corridor,” conceiving the insurgency as “the single biggest threat to the internal security of (...) the nation.” The domestic othering of the Red Corridor as an “unpatriotic,” “undemocratic,” “contaminated,” or even a “diseased zone” is further exacerbated by the systemic demonization, criminalization, and depoliticization of the Maoist insurgency through state-sponsored propaganda. In the attempt to uncover the implied collusion and complicity between the U.S.-led “war on terror” and India’s “war with the Maoists,” I draw on Hamid Dabashi’s view of “post-Orientalism,” Giorgio Agamben’s notion of “bare life,” and Achille Mbembe’s coinage of “necropolitics.”. This article discusses death, mourning and decolonisation, focusing on the Selk’nam of Karokynka/Tierra del Fuego, Chile. Methodologically, it is grounded in feminist experiments of bringing creative and personalized writing into academic scholarship to challenge subject/object-relations, and to generate platforms for affective, world-making intra-actions and undoings of power. Through collaborative efforts of three differently situated co-authors, using poetic epistolary forms of address, the article unfolds an indigenous centered feminist, decolonial methodology. Along similar lines, the theoretical approach to death and mourning is (...) pluriversal, transgressing Western epistemologies and ontologies. Through letters, addressed to dead and alive, human and non-human key actors in a revitalizing of Selk’nam culture, the article questions ethico-politically in/appropriate ways of mourning the consequences of the necropolitics imposed on the Selk’nam through white colonisation, Western modernity and its colonial matrix of necropower. It is critically addressed how mourning the lost became embedded in colonial discourses of white melancholia and humanism. Moreover combining creative writing methodologies, inspired by feminism, posthumanism, and by indigenous activism and practices of reviving Selk’nam culture, the authors use their different locations to search affirmatively for ways of mourning, which open horizons towards decolonising, cultural revitalising, reclaiming of indigenous rights and philosophies of death and mourning. This article examines the changing relationship between sexual politics and the carceral state. While sexual and gender nonconforming people have been historically punished for transgressing social norms, lesbian, gay, bisexual and transgender activists in Europe and North America have begun to invest in the state punishment of others. Whether supporting hate crime legislation, calling for more police in gentrifying neighborhoods, or participating in police recruitment campaigns, organisations that formerly fought against criminalisation trends now actively support expanding forms of state violence (...) and punishment. Focussing on examples from the British and US context—and drawing from the concept of ‘queer necropolitics’—this article considers how the carceral state has shifted from a key target of queer protest to celebrated guardian of sexual citizenship. Arguing that this process constitutes more than just another story of queer assimilation and co-optation, the article suggests this shift reflects a deeper reconfiguration of sexual politics, where citizenship norms and practices are increasingly infused with a chillingly punitive and deathly logic. The bodies of non-White girls are hyper-visible in humanitarian discourses. This article engages in theoretical reflections around the articulation of Whiteness through the body of the third world girl. I curate and examine an archive of texts and visuals from menstrual hygiene and female genital mutilation (FGM) awareness campaigns to show how the figure of the third world girl is materialised simultaneously as deserving of care/protection and as a contaminant/imperfection. These apparently contradictory registers of legibility are possible due to the (...) reiteration of the non-White female body as ontologically dirty, incomplete and an imperfect representation of full humanity. The third world girl then is the constitutive outside of Whiteness, and her production as such conjoins humanitarian protection codes with penalising political regimes. The latter is reflected by new border patrolling initiatives in the US and UK, launched specifically to identify victims of FGM. Such exercises of state power craft racialised bodies for constant interrogation, prodding and, ultimately, ejection. These bodies then become the loci of benevolent necropower and experience slow social death. (shrink)

Working with Jorge Luis Borges’s The Book of Imaginary Beings, this essay shows how creaturely beings, or transfigurations, dramatize the afterlife of racial slavery, coloniality, the temporality of HIV/AIDS, and how their im/possibility disturbs and breaks with the “order of things.” While transitive and transversal in their potentiality for insurgency, Imaginary Beings and Fantastic Zoology also always carry a colonial logic, a conquest paradigm, while also un-resting the enjoyment of, what Borges calls, “terrible grounds.” Taking up fantastical and imaginary figures, (...) this essay aims to add to Borges’s compendium of beings; this is a tracing of fugitive forces, of pessimistic and potent provocations that break from “the Human,” “the Man,” and their enumerable agents – from the Fanonian invocation of the bestiary, to the +* value form and its racialized and erotico-, bio-, and necropolitical calculus of HIV/AIDS risk, the authors explore transfigurations at the edge of existence. Teresa Brennan was born in 1952 in Australia and died in South Florida, following a hit-and-run car accident in December 2002. In the ten years between her doctorate and her death, Brennan published five monographs, the most famous posthumously. Necropolitics by Achille Mbembe takes us back to his seminal text on “Necropolitics” translated and published in the US in 2003. At this point, 40 years after Foucault’s Biopolitics, Mbembe was re-theorizing biopolitics through a necro horizon, which turned out to be a robust conceptual shift from Western thought. Not much else is explicitly said about necropolitics in the titular book, which comes 17 years after the seminal text that had a significant impact on the theory and practice of philosophy, (...) politics, anthropology, and esthetics. Mbembe presents the layers of forms, modes, and procedures of the necropolitical working through contemporary neoliberal global societies. It is therefore not surprising that Mbembe makes reference to theory in forms, form is the way to redefine or rephrase content, and “who should live and who must die” is currently the beginning. But how this is done in the 21st century, what are the methods and procedures to implement this central act in neoliberal global democracy —that is the task of this book. (shrink)

This reflection contrasts the dominant imaginary underlying ‘lawofthe Anthropocene’ with an imaginary reaching towards ‘law/sforthe Anthropocene’. It does so primarily by contrasting two imaginaries of human embodiment—law’s existing imaginary of quasi-disembodiment and an alternative imaginary of embodiment as co-woven with the lively incipiencies and tendencies of matter. It draws on ‘transcorporeality’ and ‘sympoiesis’ as inspiration for ‘sympoietic normativities’ as ways of co-living and co-organizing in the face of the catastrophic implications of the Anthropocene emergency.

Zusammenfassung: Der Beitrag nimmt eine politiktheoretisch-dispositivanalytische Perspektive ein. Er zeigt auf, inwiefern im mediterranen Grenzraum Europas nicht nur Mechanismen wirksam werden, die Migrant*innen verandern, sondern sie töten. Die letale VerAnderung vollzieht sich im europäischen Grenzregime innerhalb eines militärisch-humanitären Komplexes, in dem über Vergeschlechtlichung und Rassifizierung Migrant*innen mit spezifischen Affekten verkoppelt und dadurch de-/humanisiert werden. Durch diese Regierung der Anderen sollen regressive Migrationspolitik und ein repressives Grenzregime plausibilisiert werden. Der Heterogenität des Grenzregimes Rechnung tragend diskutiert der Beitrag die diskursive Produktion des (...) Anderen, dessen affektiv-performative Stabilisierung sowie die materiell-technologische Kultur der Grenze. Damit lehnt sich der Beitrag an die Arbeiten Foucaults zu Diskurs, Wahrheitsproduktion und Gouvernementalität an, fokussiert jedoch auf Theorien, die Foucaults Konzepte affekt- und geschlechtertheoretisch bzw. postkolonial reiterieren: Sara Ahmeds Konzept der affektiven Ökonomie, Judith Butlers Theorie der Betrauerbarkeit und Achille Mbembes Begriff der Vergrenzung. Dadurch werden die trauer- und nekropolitischen Aspekte des europäischen Grenzregimes nicht nur über politiktheoretische Perspektivierungen reflektiert, sondern durch einen rassismus- und geschlechterkritischen Blick ernst genommen. Why does #RepealedThe8th matter for feminist legal studies? The answers seem obvious in one sense. Feminism has long constituted itself through the struggle for sexual and reproductive justice, and Irish feminism has contributed a significant ‘legal win’ with the landslide vote of approval for lifting abortion restrictions in the referendum on the 25th May 2018. That win comes at a global moment when populist legal engagement is doing significant damage in countries that regard themselves as world leaders, and beyond. #RepealedThe8th (...) offers Ireland, and the world, the actuality that the popular vote, and everything that contributes to it, could be something else. Repeal shows how legal tools like the vote may be made into an expression of care for reproductive lives. This expression is important in recognizing pregnant people as knowing agents who are best placed to decide, and in seeking to do justice to those who contribute to everyday reproductive life. But repeal, like the many who brought it into being, has multiple meanings. #RepealedThe8th matters because it is a moving process of socio-legal translation, which draws on a collective energy, ‘repeal energy’, to turn the travesty that was the Eighth Amendment and all it represents into a search for the rest of reproductive life. In opening up the meaning of the vote, much like feminists elsewhere have opened up the meaning of the strike, Irish feminists have turned public mourning over past mistreatment into a series of reproductive connections. This is not a strategy that can be rolled out. Figuring out #RepealedThe8th will take many tellings. Rather we need to give repeal, and repealers, room to breathe and rest. We need to feel our way through repeal’s production of legal change so that this success is not reduced to some generic transferable set of legal instructions. I begin by reflecting on repeal as a process of feminist socio-legal translation, which shows us how legal change comes about through the motivation of collective joy, the mourning of damaged and lost lives, the sharing of legal knowledge, and the claiming of the rest of reproductive life. Zusammenfassung: Die Passage über das Mittelmeer ist in den letzten Jahren zu einer der tödlichsten Migrationsrouten der Welt geworden. Während die Mitgliedsstaaten der Europäischen Union gegen die sogenannte „Flüchtlingskrise“ eine militärische und diskursive Fluchtabwehrpolitik betreiben und die Seenotrettung geflüchteter Menschen aussetzen und kriminalisieren, begreifen normative politische Theorien der Migration Fluchtbewegungen als ein politisches oder moralisches Problem sowie als Krise für etablierte Demokratien. Gegen den Topos der „Flüchtlingskrise“ und die implizite Normalisierung von Grenzen in einem Großteil gegenwärtiger politiktheoretischer Debatten zu Migration (...) und Flucht entwickelt der vorliegende Beitrag eine politische Theorie der Grenze aus der Perspektive postkolonialer und Schwarzer kritischer Theorie. Dazu werden zunächst Kolonialität und Rasse als bislang vernachlässigte analytische Kategorien in die politische Theorie eingeführt, um die koloniale Gegenwart von Grenzregimen und die Rassifizierung von Grenzen zu rekonstruieren. Im Rückgriff auf die Figur des Schwarzen Mittelmeers, die aus der radikalen Schwarzen Tradition stammt und im Kontext gegenwärtiger Migrationsrouten von Afrika nach Europa aktualisiert wird, wird sodann ein alternatives Register für eine politische Theorie der Grenze entwickelt: Erstens wird das europäische Grenzregime als eine rassistische Politik der Vergrenzung verstanden; zweitens werden die postkolonialen Ambivalenzen und rassifizierten Dimensionen einer Politik der Solidarität mit geflüchteten Menschen problematisiert; drittens werden Fluchtbewegungen als widerständige politische Imaginationen und Praktiken nachgezeichnet, die die Widersprüche hegemonialer Konzeptionen von Demokratie und Zugehörigkeit aufzeigen. Abschließend wird die Epistemologie des Schwarzen Mittelmeers für eine Kritik des dominanten Krisennarrativs der Demokratie und für eine selbstreflexive Auseinandersetzung mit den kognitiven Grenzen der politischen Theorie selbst produktiv gemacht. The English word ‘pain’ is commonly used by lay people in a ‘messy’ life-world of imprecise meanings. It has a complex etymology, including legal and political uses as ‘punishment’. Understandings of pain in the political theory of Hobbes and Bentham are summarized. This wider historical and philosophical account of the uses of ‘pain’ means the IASP definition can be seen in relation to medical history and to present-day clinical challenges. We can consider the misunderstandings that may occur between clinicians and (...) pain sufferers, and the ways in which ‘pain’, although ‘subjective’, is inescapably a political concern. Using Wittgenstein’s approach to meaning, however, we can envisage a context-sensitive and flexible approach to communication about pain. (shrink)

This essay provides an analytic review of Jasbir Puar’s book, Terrorist Assemblages (2007), situating her discussion and analysis of “homonationalism” within the context of recent developments in queer theory in the USA, and specifically, critiques of queer liberalism and gay imperialism; racial analyses of hetero- and homo-normative formations; and challenges to identity politics and representational frameworks that dominate LGBT studies. It takes up Puar’s interest in finding new methods and ‘reading’ practices to track certain shifts in LGBT politics and to (...) account for alignments between (white) queerness and normative, nationalist and imperial interests. Engaging with and expanding on her analysis, this paper discusses the challenge that Terrorist Assemblage poses to the identity categories that undergird human rights campaigns, and addresses the racist and nationalist sentiments that she locates within them. How does a sense of touch, figuratively and practically, get deployed within equality governance, and to what questions and ways of thinking about the state does this direct us? Taking 2009–2010 as a snap-shot moment in the development of British equality reform—the year leading up to passage of the Equality Act 2010—this article explores the relationship between touch (the haptic) and equality governance from three angles. First, how have governmental bodies used touch language and imagery, including in geometrical representations of (...) disadvantage? Second, what other, more challenging encounters and actions are imaginable; specifically, can touch mobilise the feeling state as a critical form of active citizenship? Third, what re-conceptualisations of the state does the touching, feeling state invoke, and with what effects? Specifically, does conceiving of the state as a multi-identity formation reframe the risks associated with a haptic state, thereby opening up new strategies for political action? (shrink)

The Kurdish-led autonomous entity called Autonomous Administration of North and East Syria - also known as Rojava - considers women?s liberation an imperative condition for shaping a democratic society. The practice of autonomy in NES shares strong resemblances with Non- Territorial Autonomy models; however, it introduces a novelty in the role of women as active agents in building a plurinational democracy. This paper examines the intellectual and political origins of the political role ascribed to women in autonomous administrations and how (...) the practice of autonomy in Rojava has advanced women?s rights by shedding light on both institutional implementation of women?s rights, as well as the creation of -territorial spaces of women?s emancipation within the autonomous model. The argument made is that the conceptual framework of the Rojava model goes beyond the Kurdish question and can be considered an attempt to resolve a democratic deficit of liberal democratic nation-states through bringing together solutions that address the intertwined subordination of minorities and women. nema. ABSTRACTThe article assesses a postcolonial critique of Emmanuel Levinas’ thought. Levinas’ work has recently been accused of Eurocentrism, racism and xenophobia; those accusations are supported by recorded interviews, which at times voice bigoted and xenophobic remarks. What postcolonial critics suggest is that these remarks are made possible by Levinas’ philosophical commitments to phenomenology and Europe as an intellectual process. The article gives an assessment of the postcolonial critique and argues that the critique is necessitous but incomplete and extends a uniformity (...) thesis that carries with it a set of questionable assumptions regarding the connection of philosophy and historical narratives. The notion of biopolitical sovereignty and the theory of the state of exception are perspectives derived from Carl Schmitt’s thought and Michel Foucault’s writings that have been popularized by critical political theorists like Giorgio Agamben and Michael Hardt and Antonio Negri of late. This article argues that these perspectives are not sufficient analytical points of departure for a critique of the contemporary politics of terror, violence and war marked by a growing global exploitation of bodies, tightened management of life, and (...) endless and unpredictable abusive force. To better capture the singularity of our present condition of violence, war and terror, a supplementation of Schmitt’s and Foucault’s approaches by way of Hannah Arendt’s language of political action and agonistic engagement is useful. By bringing Arendt’s language of political agony to bear on contemporary biopolitical debates and discourses, we wish to revisit common practices of war and terror as matters of ‘agonal sovereignty’. ‘Agonal sovereignty’ allows us to peer into the ‘abyss of total violence’ that manifests itself after sovereign decisionism and biopolitical modalities of power have taken over the everyday conduct of political affairs. Political theorists are increasingly drawn to the recovery of anticolonial thinkers as global figures. Frantz Fanon is largely excluded from these discussions because of his presumed commitment to the nation-state and its territorialist assumptions. This essay claims, by contrast, that Fanon’s writings reveal an alternative way of thinking about worldmaking, less as a question of political and economic institution-building spearheaded by leaders than as a multiscalar project that permeates the production of the built environment and the creation of selves. I (...) show how Fanon challenges the dichotomy between the global and the national by seeking to transform not just the national scale in relation to the international, but also the corporeal, urban, rural, and regional scales of an imperially configured world. In order to read Fanon as a scalar thinker and to highlight aspects of his thought that have been relatively neglected, I draw on concepts from geography, and specifically scalar analysis, which, I demonstrate, allows political theorists to develop a richer understanding of the operations of power in colonial contexts and how they can be restructured to inaugurate more liberated ways of being human. El artículo se propone analizar la relación entre violencia y ley en la filosofía temprana de Hegel, rastreando el concepto de positividad en los textos de juventud en paralelo con el análisis de la libertad absoluta y el terror en la Fenomenología del Espíritu. Se plantea como tesis central que las nociones de desaparición y terror, presentadas en este artículo como dos momentos, diferenciados, en el análisis de dicha figura de la conciencia en la Fenomenología, no son otra cosa que (...) las caras más extremas, llevadas hasta sus últimas consecuencias en el mundo práctico, de lo que Hegel en sus escritos tempranos había ya desarrollado como las dos caras de la positividad. Las herramientas conceptuales que Hegel desarrolla a lo largo de sus escritos de Frankfurt, y que son puestas a prueba en la Fenomenología, resultan útiles para comprender el aspecto crítico de lo que Hegel presenta como el riesgo de una violencia radical, alojada en el corazón de una interpretación paradigmáticamente moderna de la soberanía, y de sus desarrollos conceptuales e históricos en las nociones modernas de derecho y acción de Estado que la presuponen. The thesis introduces and criticizes the discourse on technology, with a specific reference to the concept of AI. The discourse on AI is particularly saturated with reified metaphors which drive connotations and delimit understandings of technology in society. To better analyse the discourse on AI, the thesis proposes the concept of “Expected AI”, a composite signifier filled with historical and sociocultural connotations, and numerous referent objects. Relying on cultural semiotics, science and technology studies, and a diverse selection of heuristic concepts, (...) the thesis delves beneath the surface of AI discourse and demonstrates the hidden political, social, cultural, and ecological dangers of AI. The entanglement of the discourse(s) with (science) fiction, folklore, myth, and religion impacts how AI is perceived and received, as well as the expectations to AI-enabled technologies now and in the future. The thesis also proposes a more ethical and comprehensive ontological model for AI systems. The model describes AI systems as complex figurations, considering their socio-material organisation, global economic-material becoming, and impact on the environment, social institutions, and the semiosphere. The dissertation argues that AI should be understood not just as an object or sociotechnical system, but as its entire product chain encompassing people and cultures, as well as the used resources and impact (both material-ecological and semiotic) on a planetary scale. There has been the recurrent suspicion that community, harmony, cohesion, and similar relational goods as understood in the African ethical tradition threaten to occlude difference. Often, it has been Western defenders of liberty who have raised the concern that these characteristically sub-Saharan values fail to account adequately for individuality, although some contemporary African thinkers have expressed the same concern. In this chapter, I provide a certain understanding of the sub-Saharan value of communal relationship and demonstrate that it entails a substantial (...) allowance for difference. I aim to show that African thinkers need not appeal to, say, characteristically Euro-American values of authenticity or autonomy to make sense of why individuals should not be pressured to conform to a group’s norms regarding sex and gender. This article aims to conceptualize the interplay between sarcasm, scatology and writing in Darija (Moroccan Arabic or Al-Maghribia) on the web in a post-uprising era. It focuses on the new Darijophone prose that emerged after 20 February 2011 protests in Goud and The Newزحيليكر‎ (The New Bumpkin). Originating with absurdist February 20 movement founder member, Mohammed Sokrat, this writing genre is realist, vulgar, profane, taboo-breaking, and borrows from the toilet space to poke fun at the schizophrenia, herd mentality and populism (...) that attend a modernizing society under a neoliberal regime. A vocabulary of trash, waste, filthy social types and risqué gags has informed a unique online minoritarian prose that is unpopular, yet widely read. This article studies the virtual politics and poetics of dirt and laughter in written Darija. Writing at the interstices of commitment and co-optation, this subcultural mode of knowledge production reveals Moroccan youth's heretofore suppressed yet incessant longing for change in a post-uprising context of disillusionment. This introduction to the Queer Death Studies special issue explores an emerging transdisciplinary field of research. This field critically, reflexively and affirmatively investigates and challenges conventional normativities, assumptions, expectations, and regimes of truths that are brought to life and made evident by current planetary scale necropolitics and its framing of death, dying and mourning in the contemporary world. It is set against the background of traditional engagements with the question of death, often grounded in Western hegemonic and normative ideas of (...) dying, dead and mourning subjects and bodies, on the one hand; and on the other contemporary discourses on human and nonhuman death and extinction, directly linked to the environmental crisis, capitalist and post/colonial extractivist necropolitics, material and symbolic violence, oppression and inequalities, and socio-economic, political and ecological unsustainabilities. By bringing together conceptual and analytical tools grounded in feminist materialisms and feminist theorising broadly speaking, queer theory and decolonial critique, the contributions in this special issue strive to advance queerfeminist methodologies and ontological, ethical and political understandings that critically and creatively attend to the problem of death, dying and mourning in the current environmental, cultural, and socio-political contexts.
