We present a theoretical discussion of the sociological contribution concerning decisions in organizations. Two theories stand. The first, based on the decision process from a critical theory of the traditional linear multi rational by Lucien Sfez, argues that the decision is a process of interactions and treats it as an institutional process based on the freedom of the subject. The second theory based on self-referential systems by Niklas Luhmann, interprets organizations as systems-making, and understands the concept of decision as purely (...) epistemological specificity, abstracted from the decision of all the elements and organizational variables associated with it. Se expone un debate teórico sobre la aportación sociológica referente a las decisiones en las organizaciones. Sobresalen dos teorías de las decisiones. La primera, basada en el proceso de decisión a partir una teoría crítica de la multirracionalidad lineal elaborado por Lucien Sfez, al plantear que con la decisión se trata de un proceso de interacciones, al ser considerada como un proceso institucional fundamentado en la libertad del sujeto. La segunda fundamentada en la teoría de sistemas autorreferenciales, interpreta las organizaciones como sistemas de decisiones y entiende el concepto de decisión en su especificidad puramente epistemológica, al abstraer de la decisión de todos los elementos y variables organizacionales relacionados con ella (Niklas Luhmann). The current inclination, at the European level, to fund education in the form of projects radicalises the modern orientation towards the present as the attempt to bind a yet indeterminate future. This article proposes a close re-reading of Niklas Luhmann’s sociological oeuvre in order to problematise the place of the present in modern education. In an effort to sketch out the need for a new educational ecology, it then draws attention to how transnational projects articulate their educational meaning.

ZusammenfassungTrotz einer bereits vor der COVID-Krise erkennbar großen gesellschaftlichen Bedeutung und möglicher Potenziale der Digitalisierung für den organisierten Sport, liegen bislang nur wenige aussagekräftige Befunde darüber vor, welchen Stellenwert Sportvereine der Digitalisierungsthematik innerhalb der Vereinsarbeit beimessen. Vor diesem Hintergrund geht der Beitrag folgenden Fragen nach: (i) Welche Priorität messen Sportvereine dem Thema Digitalisierung bei? (ii) Welche vereinsspezifischen Faktoren beeinflussen die jeweilige Priorisierung des Themas Digitalisierung? Die Priorisierung der Digitalisierung wird dabei in Abhängigkeit von Vereinszielen, einstellungs- und organisationskulturbezogenen Faktoren sowie den (...) unterschiedlichen organisationalen Kapazitäten der Sportvereine modelliert. Für die Analyse konnte eine Stichprobe von n = 787 Sportvereinen generiert werden. Die Befunde zeigen, dass Digitalisierung für Vereine vor der COVID-Krise zwar ein wichtiges Thema, aber kein Thema von herausgehobener Priorität innerhalb der Vereinsarbeit darstellt. Die Ergebnisse des logistischen Regressionsmodells deuten darauf hin, dass die Unterschiede in der Priorisierung vor allem auf Differenzen in der Organisationskultur und der Organisationskapazität zurückzuführen sind. Organisationen spielen in modernen Gesellschaften eine zentrale Rolle. Der Beitrag geht davon aus, dass in den mittlerweile etablierten Formen von Ethik und Ethikberatung in Einrichtungen des Gesundheitssystems eine angemessene Reflexion des Organisationsbezugs oft ausbleibt bzw. eine besondere Herausforderung darstellt. Wir konzipieren deshalb eine „prozedurale Organisationsethik“, die sich kritisch mit der organisationalen Passung der Prozesse ethischer Reflexion auseinandersetzt. Daraus lassen sich als Anregung für Theorie und Praxis von ethischen Prozessen praktische Schlussfolgerungen ableiten. In view of the scope and scale of the latest scandals, e.g. Enron's maximum breaking bankruptcy, the re-discovery of ethics in business has received an impressive boost. By now even car salesmen have written ethics, a Code of Conduct, e.g. in the USA or Poland. But there is no clear aim of the role ethics obtains in organizational settings as we may show in some small cases of practical approaches to deal with ethics in organizations. We discuss how ethics is (...) the prerequisite to conduct any business and what advantages may be realized if a clear set of ethics is followed. We will discuss three practical examples. In cases of ethics-based values-added management of Siemens (Germany), Boeing (U.S.) and SAP (Germany) we explain the mechanisms of ethics in management to strengthen organizational success. We emphasize the importance of clear ethics-related communication processes in organizations. We explain the use of communication theories inside organizational processes to clarify communication about such an abstract topic as ethics. Finally, we point out how a management of ethical ideas and cultural values should be designed in business enterprises. (shrink)

Founded in the second half of the twentieth century, the young European Union was driven by the experience of two world wars which had devastated big parts of Europe and traumatized its population. For some decades its peace-building impulse kept the organization going. After the fall of the Iron Curtain the idea of a common market remained the dominant motivation of the EU. However, the Union’s enlargement in the early 2000s to include almost 30 member states rendered it a highly (...) diverse organization, without sufficiently adapting its structures and processes to this dramatic change. Since neither the insistence on homogeneity and discipline, nor old forms of nationalism, offers an adequate answer to these crises, I present a diversity management model, to characterize, examine and understand the EU’s diversity problems and the kind of solutions or directions of change that may be drawn from it. This function of the legal systems is pivotal in our times as humankind is facing a systemic and evolutionary bifurcation between the heideggerian Gegnet of a strategic, high speed convergence (i.e., Singularity) among robotics, informatics, nanotechnologies, and genetics (RINGs)?which will reshape human life in terms of its life quality styles and standards (...) especially regarding health and environment matters, and the so called Neofeudal Scenario (NS) supported by those for whom the Industrial Model failed and the only way to save humankind and its environment would be a kind return to a Medieval life style based on a slow pace of life and austerity. This article provides an overview of the most important and recent international references regarding the two alternatives of bifurcation and describes a potential paradigm shift inside the systemic approach to reframe the conceptual map of global change through a systemic epistemology of the sociology of law. SummaryThis article explores the representation of Yusra Mardini as a refugee Olympic athlete. Her participation in the 2016 Olympic Games is analyzed through different areas of programming of the mass media and, specifically, through Mardini’s autobiography, documents of the International Olympic Committee, and German newspapers. A qualitative content analysis is carried out and a systems theoretical framework applied. The results reveal that Mardini’s refugee background was both an obstacle and an advantage for her career within the sport system. The establishment (...) of the Refugee Olympic Team generated positive response from the International Olympic Committee but also exposed contradictions in its inclusion rules. The newspapers showed a strong interest in Mardini and presented her as a hero, downplaying her performances and emphasizing her life story. Following an analysis of the interconnections between these different representations, the discussion turns to the mechanisms that go beyond the inclusion of Mardini in professional sports and focuses on the latent information within the materials. This paper explores what is apparently a non-topic for Luhmann. Luhmann is preoccupied with decision-making rather than with judgment. The paper argues that Luhmann, attempting to find a way out of the dilemma between the fundamentalism of positivistic legal theory and the relativism of anti-foundationalist post-modern thinking, presents the epistemological–ethical doublet of a “self-binding” of the law. In this bootstrapping manoeuvre decision plays the central part. The paper begins by examining judgment in its relation to decision as considered by non-system-theoretical (...) thinking. Against that background it unfolds the distinction between distinction, form and decision in systems theory and in the system-theoretical observation of the law. The article then discusses Luhmann’s description of the functioning of decision(-making) within the legal system. The hypothesis is that Luhmann blends here cognitive with ethical aspects. Finally, the article addresses Luhmann’s polemics against alternative approaches to his own. The suggestion is that ‘judgment’, in Luhmann’s systems theory, re-enters by the back door as an ethical–theoretical imperative that commands theory’s responsibility for society and law. (shrink)

A high level of complexity and a continuous and always changing relationship among its elements characterizes modern world society. As a result, a constant differentiation and specialization of diverging social fields aiming to reduce the uncertainty emerging from that complexity takes place. Paradoxically, as differentiation and specialization increase, they become a new source of uncertainty. In order to confront this self-producing ambiguity, some social operations develop structural interdependencies with a sufficient level of operational stability that distinguish them from their environment. In this paper this is called contextual differentiation, i.e. the emergence of differentiated contexts of interaction, decision and symbolization that make possible a mutilayered concretization of social functions in supranational contexts. With regard to the differentiation of law, economy and sports this process is analyzed and illustrated in four case studies: the Bill & Melinda Gates Foundation, the Bank for International Settlements, FIFA, the game and its publics, and the international commercial arbitration. La sociedad mundial moderna se caracteriza por su alta complejidad, es decir, por la continuamente cambiante interrelación de sus elementos. El resultado de ello es una constante diferenciación y especialización de espacios sociales orientada a manejar la incertidumbre que esa complejidad genera. Paradójicamente, la diferenciación y especialización es nuevamente una fuente de complejidad. Para enfrentar esta ambigüedad auto-producida, determinadas operaciones sociales se distinguen por generar interdependencias estructurales que logran una estabilidad operacional suficiente para distinguirlas de su entorno. A ello se le denomina en este artículo diferenciación contextual, esto es, la emergencia de contextos diferenciados de interacción, decisión y simbolización que posibilitan una concretización múltiple de funciones sociales en espacios supranacionales. Esto se observa especialmente a propósito de la diferenciación del derecho, la economía y el deporte, y se ilustra con cuatro estudios de caso: la Bill & Melinda Gates Foundation, el Bank for International Settlements, la FIFA, el juego y sus públicos, y el arbitraje comercial internacional. Definition of the problem Organizations, being important intermediaries of modern, highly differentiated, and pluralistic societies, are a key place of decision making. This especially applied to health care organizations. Arguments Organizations and their processes are reconceptualized and eminently challenged by digitization and cross-linking in the World Wide Web. Thus, organizational ethics also needs to be reconceptualized. Conclusion The paper provides scenarios of some of the crucial issues of organizational ethics in light of digitization.

ZusammenfassungUm Fachkompetenz zu stärken und Verantwortung an Entscheidungskompetenz zu koppeln, haben einige Sportverbände mittlerweile bezahlte Führungskräfte als Vorstand nach § 26 BGB installiert, während ein ehrenamtliches Präsidium im Sinne eines Aufsichtsrats fungiert. Der vorliegende Beitrag zielt darauf ab, das Verständnis für den mit einer solchen Änderung hinsichtlich Vorstand und Vertretung verbundenen organisationalen Wandel zu schärfen und daraus folgende Effekte auf die Verbandsarbeit zu beleuchten. Am Beispiel der DHB-Strukturreform „Perspektive 2020+“ eröffnet die Analyse – basierend auf Dokumentenanalysen und problemzentrierten Interviews – (...) differenzierte Einblicke in organisationalen Wandel von Sportverbänden und Schlussfolgerungen für die praktische Verbandsarbeit. This two-part article presents the research program for a theory and empirical analysis of religious evolution. It is assumed that religion isprimarilya co-evolution to societal evolution, which in turn is a co-evolution to mental, organic, and physical evolution. The theory of evolution is triangulated with the systems theory and the semiotically informed theory of communication, so that knowledge can be gained that would not be acquired by only one of the three theories: The differentiation between religion and its environment can (...) be reconstructed based on the theory of evolution. The elements of the theory of evolution can be understood as the formation of systems. The semiotically informed theory of communication clarifies the conditions of the combination of both the systems theory and the theory of evolution as well as its objects. In turn, the combination of the systems theory and the theory of evolution can describe how communication—including religion and science—evolves and is structured. (shrink)

Law’s regulation of transboundary hydropower dams is a field of study brimming with paradoxes. The most notable being the paradox of a hydropower dam solving one problem and creating another. From a logical perspective, such a paradox would typically be viewed as an obstacle to be avoided because it brings everything to a standstill. But from a social perspective, paradoxes are not necessarily negative, as managing them also potentially enlightens and transforms planning systems. The latter perspective, which brings to analysis (...) a kind of dynamism, is employed in this text. In order to work out the reoccurring patterns under which law might productively make use of paradoxes, this text therefore proposes the methodological tools of exposing and building upon paradoxes. Exposing paradoxes sets out to make more visible some of the unthought limitations, self-deceptions and self-contradictions which arise in modern planning practices, while building upon paradoxes attempts to open up headways towards a more adequate conceptualisation of the solutions which law can offer. The overall intention here being to offer a Luhmannian-inspired theoretical framework which illuminates the value of social systems theory as a methodological tool for describing the communicative challenges facing law’s regulation of transboundary hydropower power dams. El concepto de memoria social es una de las categorías que más relevancia adquirió en la producción teórica de Niklas Luhmann en los últimos años de su vida. Tal concepto se encuentra, en una buena parte, inspirado en la memory fuction descripta por el matemático inglés George Spencer Brown. La memoria social pretende dar cuenta de un rendimiento de memoria propio de la sociedad, independiente de las memorias de los sistemas psíquicos y neurofisiológicos. En este trabajo se abordará el tema (...) críticamente, poniendo atención en la operatividad de la memoria social, para poder observar a qué preguntas responde. Además, se analizará detenidamente el tipo de apropiación que hace Luhmann de la función de oscilador y memoria tomada de Spencer Brown, evaluando la consistencia de tal decisión. También será de suma importancia estimar si el sociólogo alemán arriba a una teoría de la memoria social capaz de desprenderse de la metáfora del almacén o depósito, tal como él dice haberlo hecho al proponer esta formulación.The concept of social memory is between those categories, which acquired more relevance in Niklas Luhmann’s theoretic production in the last years of his life. This concept is largely inspired in the memory function depicted by the English mathematician George Spencer Brown. Social memory tries to account for the own memory performance of society, which is independent from the memories of the psychic and neurophysiologic systems. This paper deals critically with this topic, focusing the attention on the operativity of the social memory, in order to observe to which questions it can answer. In addition, it will be carefully analyzed how Luhmann utilizes the Spencer Brown’s oscillator and memory functions, so to evaluate the consistency of Luhmann’s decision to include these concepts in his theory. It will also be of great importance to estimate if the German sociologist develops a theory of social memory with the capacity to get rid of the storage metaphor, as he expected to have done with this formulation. Der Artikel konstruiert dieses Phänomen der Unvereinbarkeit zweier Karrieren zunächst gesellschaftstheoretisch als Inklusionsproblem. Da eine merkliche Verbesserung der Situation der Athleten letztlich nur auf Seiten der Hochschule erwartet werden darf, werden anschließend aus organisationstheoretischer Perspektive die dortigen Möglichkeiten und Grenzen interner Strukturveränderungen reflektiert. Schließlich wird diskutiert, wie Hochschulen mit den Erwartungen des Spitzensports umgehen können und in welcher Weise sich im Rahmen von Netzwerken (...) womöglich doch Kooperationsbeziehungen zwischen den beteiligten Organisationen zugunsten studierender Spitzensportler aufbauen lassen. Discussions about the appropriate way of assessing and managing new or emerging technologies—like nanomaterials—expose the problematic relationship between scientific knowledge production and regulatory decision-making. On one hand, there is a strong demand for scientific expertise to support decisions, especially by analyzing risks and hazards when uncertainties are prevalent and society’s stakes are high. On the other hand, science is criticized for its authoritative claim to objectivity and for keeping the inherent uncertainty, ambiguity, and selectivity of scientific observation latent. Requests for (...) more transparency in science can lead to revealing, to risk managers and the public, the indeterminacy in knowledge production processes. This has consequences for the prevalence of scientific knowledge in decision-making, because it increases uncertainty on both sides of the breach between science and decisions: scientists lose confidence regarding the scientifically tested knowledge which they pass on, and risk managers lose confidence regarding their decisions based on this knowledge. Nonetheless, the concept of “probabilistic risk assessment” remains an important heuristic for dealing with potential future events. This paper addresses questions of the function of scientific risk assessment in organized risk management. The main argument in this paper is that knowledge alone no longer functions as a mechanism for absorbing uncertainty. Accordingly, the interaction between science and decisions must enable a temporarily stable commitment to manage new threats like products and applications coming from the field of nanoscience and nanomaterials. Relying on Niklas Luhmann's systems theoretical redescription of modern society, this article aims at questioning the basic theoretical notions of the ongoing inclusion/exclusion debate. The most remarkable aspect of Luhmann's reassessment of the inclusion/exclusion relationship within functionally differentiated societies is that individuals are basically situated within the exclusion domain of society, and thus cannot but partially be included within society's function systems and organizations. This reassessment not only allows Luhmann to raise fundamental questions with respect to the implicit norm of (...) full inclusion which still dominates the debate on inclusion and exclusion, but it also directs his attention to the different inclusion/exclusion conditions within function systems, organizations and interaction systems. Eventually Luhmann's position comes down to the idea that exclusion rather than inclusion is the rule, and, moreover, that inclusions differ from one another. The article closes off with a critical evaluation of Luhmann's redescription of the inclusion/exclusion debate. It is argued that systems theory might suffer from empirical deficiency, as it seems to have difficulties to detect and to depict the actual mechanisms of social exclusion without resorting to theories that are more geared to empirical reality and that are of help in observing it. The public debate on climate change is filled with moral claims. However, scientific knowledge about the role that morality, ethics, and values play in this issue is still scarce. Starting from this research gap, we focus on corporations as central decision makers in modern society and analyze how they respond to societal demands to take responsibility for climate change. While relevant literature on business ethics and climate change either places a high premium on morality or presents a strong skeptical bias, (...) our sociological model depicts morality as an indeterminate force: it can lead to both workable solutions or merely reinforce the status quo, depending on what different corporations make of it. We describe, on the one side, the diffusion of moral values in the media discourse on climate change and, on the other side, the specific responses of corporations. While the media discourse generates a pressure on corporations to act responsibly, their moral claims do not provide clear advice for action. As a result, morality becomes available to organizations as a medium that can be re-specified according to their internal dynamics. Corporations transform moral values into something compatible with their own structures through a variety of different responses: introducing formal ethical structures (e.g., codes of conduct), initiating value-oriented projects, or developing informal moral norms, and so on. In some occurrences, morality becomes a mere façade, while in others it serves as a decision-making criterion and deeply influences core activities in firms. (shrink)

The background of the article is Marxism's lack of a notion of management. The article suggests that anyone rethinking capitalism should pause for a moment to check on the evidence for such a notion. It seems necessary because today's theory of capitalism can no longer be content with a structural theory of the conflict between capital and labour, but must integrate a poststructural, or operational, theory of how capitalism is sustained on a day-to-day basis by organized projects in networks. The (...) article develops a notion of `management by strata', which is matched to the traditional role of hierarchies, and a notion of `management by ties', which is tuned to the newly discovered role of hierarchies in networks. How do markets come about? This article offers a first systematic analysis of three different ideal types of market fashioning: mutual adjustment, organization, and fields. Although aspects of these are identifiable in most empirical markets, these three ideal types provide analytic tools for students of real markets and marketplaces. After going through this comprehensive literature, it is argued that mutual adjustment, which refers to non-planned processes, is affinity with markets in which products are differentiated, for example, producer markets. Organization refers (...) to process driven by attempts to decide for others and shows affinity with markets for standardized and homogenous products, for example, stock exchanges. Organization also accounts for the making of marketplaces. The broader notion of fields does not refer to any specific process, but accounts for the context of market fashioning and its respective power struggles. (shrink)

This paper explores the ethical dilemma of conflicting loyalties found in whistleblowing. Central to this dilemma is the internal/external disclosure dichotomy; disclosure of organisational wrongdoing to an external recipient is seen as disloyal, whilst disclosure to an internal recipient is seen as loyal. Understanding how the organisation and society have dealt with these problems over the last 30 years is undertaken through an analysis of Vandekerckhove’s project, which seeks to place the normative legitimisations of whistleblowing legislation and organisational whistleblowing policies (...) within a globalisation semantic able to contain this conflict between society and the organisation. This project fails, it is argued, because of Vandekerckhove’s particular understanding of the organisation as an autopoietic system, i.e. an operationally closed system. A case is made to understand organisations as complex systems, i.e. operationally open systems. Critical Complexity theory sees the identities of systems and components as coterminous. In the context of the organisation, this means that the identities of the corporation and its corporate members arise and die together. The whistleblower’s disclosure reconfigures the organisation by forcing the organisation to open up and make its boundaries flexible, making the designation ‘internal’ or ‘external’ to the organisation, and, therefore, who qualifies as a recipient of a disclosure of wrongdoing, flexible. The organisation is restrained from retailing against the whistleblower, because its identities are coterminous. Furthermore, as the disclosure cannot be categorically defined as either internal or external, the question of whether an external disclosure can qualify as an act of organisational loyalty becomes moot. Zusammenfassung Zahlreiche Fußballvereine der 1. und 2. Bundesliga sind aus Fusionen hervorgegangen, doch bislang ist kaum etwas über dieses Phänomen in der Sportwissenschaft bekannt. Ziel des Aufsatzes ist es, mittels einer organisationssoziologischen Brille den SC Paderborn 07, als Bundesligaverein, der aus mehreren Fusionen hervorgegangen ist und als solcher verschiedene Traditionslinien in sich vereint, zu beleuchten. Dabei werden insbesondere die sozialen Folgen in den Blick genommen.
