Diese Akzidenzphänomene sind prinzipiell unvorhersehbar und in ihrer komplexen Effektgesamtheit jenseits von Kalkulation und Antizipation. Eine allgemeine Verzukünftigung unseres Weltbezuges mit spezifischen weitreichenden Problemen ist die Folge und lässt klassische Agenturen des Risikomanagements und der Unsicherheitsbewältigung an ihre Leistungsgrenzen stoßen. Bruno Gransche zeigt, dass Philosophie und Zukunftsforschung gemeinsam großes Potenzial aufweisen, hier zu helfen.

Although Darwinian concepts have largely been banned from the social sciences of the last century, they have recently seen a revival in several disciplines such as sociology, anthropology, or economics. Most of the current proponents of evolutionary theorizing in the social sciences avoid references to the older literature on social evolution. On that background, this article presents a contribution to Darwinist thinking in early American sociology that has mainly been overlooked in the literature. As the leading figure of the Human (...) Ecology Approach, which was established during the 1920s and 1930s, Robert Ezra Park drew heavily on evolutionary concepts to explain human evolution. A systematic presentation of these concepts in the light of the modern discussion on sociocultural evolution is given, followed by a conclusion about what can be learned from Park today. (shrink)

This paper explores the political import of Husserl’s critical discussion of the epistemic effects of the formalization of rational thinking. More specifically, it argues that this discussion is of direct relevance to make sense of the pervasive processes of ‘technization’, that is, of a mechanistic and superficial generation and use of knowledge, to be observed in current contexts of governance. Building upon Husserl’s understanding of formalization as a symbolic technique for abstraction in the thinking with and about numbers, I argue (...) that processes of technization, while being necessary and legitimate procedures for the reduction of complexities, also may give rise to politically unresponsive and ultimately dysfunctional ‘economies of thinking.’ This paper is structured in three parts. In the first part I outline Husserl’s account of the formalization and technization of thought and knowledge. In the second part I make my case for the political import of this account, departing in this context from positions that (a) regard Husserl’s discussions of formalization and its effects as merely epistemological, or that (b) try to mobilize Husserl for a one-sided critique of instrumental reason. In the final part I address a major shortcoming of Husserl’s account, namely its neglect of the concrete and historically evolving technological infrastructures of processes of formalization/technization. This paper offers a conceptually novel contribution to the understanding of the distinctive governance challenges arising from the increasing reliance on formalized knowledge in the governance of research activities. It uses the current Australian research governance system as an example – a system which exhibits a comparatively strong degree of formalization as to its knowledge mechanisms. Combining theoretical reflections on the political-administrative and epistemic dimensions of processes of formalization with analyses of interview data gathered at Australian universities, it is suggested (...) that such a strong reliance on formalized knowledge has rather ambivalent governance ramifications. On the one hand, it allows for a seemingly rational and efficient form of the control and coordination of research activities. Yet on the other hand, it also increases the risk that knowledge is used in governance contexts in superficial, unconsidered and ultimately unreasonable ways. It is further suggested that there are a range of indications that precisely such use elicits and reinforces a range of dysfunctional behaviors on part of relevant individual and organizational actors in the public science system. The article offers a critical assessment of an article on “Corporate Legitimacy as Deliberation” by Guido Palazzo and Andreas Scherer in this journal. We share the concern about the precarious legitimacy of globally active corporations, infringing on the legitimacy of democracy at large. There is no quarrel with Palazzo/Scherer’s diagnosis, which focuses on the consequences of globalization and ensuing challenges for corporate social responsibilities. However, we disagree with the “solutions” offered by them. In a first step we refute the idea (...) of a legitimacy of morals, maintaining that morality is a premodern mode of creating legitimacy. Even worse, moral is becoming a dangerous commodity under conditions of fundamental global disagreements and antagonisms. We secondly refute the concept of the “politicized corporation”, maintaining that Palazzo/Scherer disregard the consequences of functional differentiation of modern societies and, in particular, disregard the wisdom of political restraint and constitutional guarantees for the autonomy of different spheres of society. Finally, we refute a seemingly romantic notion of deliberation, maintaining that deliberation and deliberative democracy is a worthy idea, which, however, has no place in the real world of globalized contexts. On the other hand, we also find enough common ground and common concern with Palazzo/Scherer to validate a fruitful discourse. (shrink)

The gambler’s probing of luck in games of chance cannot be reduced to rational calculation. The art of gambling flourishes at the margins of societies and undermines the correlation of effort and entitlement. This paper interprets the peculiar thrill of gambling in modern times by drawing on social systems theory and critical theory. It argues that gambling is a specific mode of agency that consists in a playful engagement with risk and contingency. The gambler reveals a highly aroused and yet (...) passive consciousness. Success in gambling depends on the art of proper timing as well as a preconscious awareness of fortune. (shrink)

ZusammenfassungDer Beitrag baut auf Niklas Luhmanns Unterscheidung zwischen verschiedenen Typen sozialer Systeme auf, nämlich Interaktionen, Organisationen und einer durch funktionale Teilsysteme strukturierten Gesellschaft. Auf dieser Basis wird der Fall zweier Schüler in einer Schweizer Sekundarschule analysiert, die ihren Lehrerinnen mit religiöser Begründung den Handschlag verweigerten. Gezeigt wird, wie dieses Ereignis von verschiedenen Systemtypen als Problem bearbeitet und jeweils unterschiedlich beobachtet wurde, wobei speziell auch die Frage nach dem Stellenwert des Teilsystems Religion gestellt wird. Insbesondere der Zeitbedarf und der Stellenwert schriftlicher (...) Kommunikation der verschiedenen Systeme erweisen sich als Faktoren, über die sich die unterschiedliche Rolle verschiedener Systemtypen in der Affäre verstehen lässt. Religion beeinflusste zunächst zwar die Interaktion im Klassenzimmer, schließlich fungierte sie aber eher als Thema von Recht, Politik und Massenmedien, als dass sich religiöse Kommunikation über den ursprünglichen Interaktionszusammenhang hinaus als einflussreich erwiesen hätte. Zusammenfassung In der soziologischen Diskussion spielen Begriff und Konzept der Inklusion – verstanden als umfassende Teilhabe aller Gesellschaftsmitglieder – aktuell eine große Rolle. Gleichzeitig gibt es eine entsprechende Konjunktur in den politischen, medialen und pädagogischen Diskursen. Über das Bildungssystem hinaus, wo Inklusion vor allem mit Blick auf die schulische Erziehung behinderter Kinder diskutiert wird, ist der Inklusionsgedanke auch in anderen Lebensbereichen, etwa im Sport oder Arbeitsleben, von Bedeutung. Insgesamt fällt auf, dass die soziologische Theorie und die gesellschaftliche Diskussion zwar lose (...) aufeinander verweisen, bisher jedoch kaum systematisch verbunden sind. Dabei ist von komplexen Wechselwirkungen zwischen den verschiedenen Diskursen auszugehen. In einem ersten Zugriff rekonstruiert der Beitrag den Inklusionsbegriff in genealogischer Perspektive, um dessen Umformungen und Umcodierungen sichtbar zu machen. Im zweiten Teil wird ein dispositivanalytischer Ansatz entwickelt, mit dessen Hilfe die Rationalitäten, Technologien, Institutionen und Subjektivierungen untersucht werden können, die Inklusion als ein hegemoniales Leitkonzept der Gegenwart formieren. Why is it so plausible that business organisations in contemporary society use values in their communication? In order to answer this question, a sociological, system theoretical approach is applied which approaches values not pre-empirically as invisible drivers for action but as observable semantics that form organisational behaviour. In terms of empirical material, it will be shown that business organisations resort to a communication of values whenever uncertainty or complexity is very high. Inevitably, value semantics are applied in organisations first when (...) the speakers are uncertain about which stakeholders to whom they have to address (uncertainty) or when different stakeholder groups have to be addressed simultaneously (complexity); second, when the identity of the organisation has to be described; and third, when future strategic options that cannot be expressed by quantitative terms have to be communicated. Values accordingly play a role in organisational practice when certain aspects are indeterminate. Therefore, they are a means for organisations to communicate under fuzzy circumstances. On the basis of these findings, new approaches to value management can now be formulated. (shrink)

This paper uses structural analogies to competing political philosophies of human society as a heuristic tool to differentiate between ecological theories and to bring out new aspects of apparently well-known classics of ecological scholarship. These two different areas of knowledge have in common that their objects are ‘societies’, i.e. units composed of individuals, and that contradictory and competing theories about these supra-individual units exist. The benefit of discussing ecological theories in terms of their analogies to political philosophies, in this case (...) liberalism, democratism and conservatism, consists in the fact that political philosophies show clear differences and particularities as regards their approach to the concepts of individuality and intentional action. The method therefore helps to expose peculiarities of ecological theories that are usually considered canonical, as well as hybrid forms, and to differentiate between two different types of theories about functional wholes. The basis of this method is the constitutional-theoretical premise that modern paradigms of socialization structure the ecological discourse. (shrink)

Of all contemporary social theorists, Luhmann has best understood the centrality of the concept of meaning to social theory and has most extensively worked out the notion's implications. However, despite the power of his theory, the theory suffers from difficulties impeding its reception. This article attempts to remedy this situation with some critical arguments and proposals for revision. First, the theory Luhmann adopted from biology as the basis of his own theory was a poor choice since that theory has no (...) explanatory power, being purely descriptive; furthermore, that theory is fundamentally flawed since it implies that viruses are impossible. Second, Luhmann's theory of meaning cannot coherently make the social domain autonomous as he desires since Luhmann does not take into account the distinction between syntax and semantics. By introducing this distinction, making clear that social systems consist of rules, not just communications, and raising the rule concept to the same prominence in social theory as those of actor and system, autonomy can be maintained while avoiding the counterintuitive aspects of Luhmann's theory. The present paper builds on the Rawlsian critique of utilitarianism in order to identify the moral implications of Niklas Luhmann’s social systems theory. While Luhmann aptly discerned the pervasive problems of the precarious system–environment relations throughout the modern society, he took moral communication to be person-centered and thus ill-equipped to deal with these problems. At the same time, the Rawlsian possibility of sacrificing fundamental liberties for the sake of economic gains not only exemplifies the Luhmannian precariousness of the relations of (...) the economic system to its societal environment, but also shows this precariousness to be a moral problem. Thus, from the systems-theoretic perspective, the Rawlsian idea of justice denotes the moral dimension of the capacity of the societal environment to carry the economic system. More generally, the proposed complementarity between Rawls and Luhmann allows to see the precariousness of system–environment relations, for any type of social system, as a moral problem. Two implications follow. First, the morally problematic manifestations of the precarious system–environment relations are not limited to the Rawlsian case of the discrimination of the least advantaged groups but rather include a broad range of social costs and damaging effects of business on society and nature. Second, and related, the proposed systems-theoretic perspective explicates the moral value of sustainability of the economic as well as other social systems in their environment, societal and ecological alike. The paper discusses the self-reproduction ability of the existing technogenic civilization and the issues of the influence of self-reproduction mechanisms on the formation of axiological grounds for the use of digital technologies generated by this civilization. The self-reproduction of civilizational structures is considered through their constant repetition in the process of communication. In existing philosophical and sociological studies based on systems approach, the term autopoiesis, introduced for these purposes in the works of N. Luhmann, has already been used to describe (...) such processes. Considering the autopoiesis of the technogenic civilization, the articles relies on the works of V.S. Stepin to determine the main features of that civilization. As a result of the conducted research, it was revealed that the existing internal contradictions of the technogenic civilization that can lead and are already leading to its crisis, including the value one, are caused by simultaneous presence of mutually non-complementary autopoietic structures: (1) the ones related to the industrial and post-industrial era and to the scientific worldview; (2) and structures that have passed into modernity from the pre-industrial era, and yet still are have value and cultural significance in modern society. The author concludes that, forming the value foundations of the use of modern digital technologies, the technogenic civilization is forced to overcome the abovementioned gaps in its own autopoietic structures and create value systems free from these contradictions. Over the last 25 years, suicide attacks have become an alarming threat. They are a political tool which has been adopted by several organizations in Sri Lanka, Palestine and the Occupied Territories, Turkey, Chechnya, Afghanistan, Pakistan and, in particular, by the Al-Qaeda-led insurgency in Iraq in its struggle against the US and its allies. Recent analyses have traced back the use of suicide terrorism to its `strategic logic': organizations and their militants resort to suicide attacks mainly because they view this (...) form of violence as an efficient weapon for their revolutionary and nationalist campaigns. An explanation based on the paradigm of rational choice theory or instrumental rationality alone is, however, insufficient. This article suggests the importance of combining the paradigm of instrumental rationality with that of axiological rationality. Only this kind of explanation is able to clarify the crucial role played by those cultural and symbolic elements which justify and encourage the martyrdom of suicide attackers. Moreover, by adopting a multi-causal analysis of the armed organizations, their constituencies and the attackers, as well as of their interaction, the article outlines a theoretical model of the most important social mechanisms underlying the use of suicide tactics. Niklas Luhmann and Jacques Derrida start with a common assumption in their analyses of the law and the economy - the foundational paradox of social institutions. But then autopoiesis and deconstruction move into opposite directions. Luhmann pursues the question of how de-paradoxification constructs the immanence of social institutions and builds a world of autopoietic social systems. By contrast, Derrida's thought aims at the transcendence of social institutions through their re-paradoxification. However, there is a hidden supplementarity of autopoiesis and deconstruction which (...) makes it worthwhile to relate the theories to each other. Derrida's distinction of writing/speech is necessarily blind toward Luhmann's distinction of consciousness/communication, but is, at the same time, continuously provoked by it. On another level, the opposite happens. Luhmann's autopoiesis is permanently irritated by Derrida's différance but is at the same time unable to conceptualize it. This complementary blindness of their distinctions directrices is a permanent source of mutual irritation which requires a reformulation of the social and of the possibility of justice. (shrink)

This article analyzes the transformation of Minerva from an intellectual towards a scholarly journal by making use of bibliometric methods. The aim is to provide some empirical insights that help to understand what properties of the journal changed in the course of this transformation process. Minerva was one of the first journals that reflected on science and its role in society and science policy in particular. Analyzing the development of the journal sheds light on the emergence of science (policy) studies (...) and on Minerva’s role as a forerunner in this field. In a first step, the methods will be described. The second section provides some empirical results of the publication output of Minerva and its relations to other journals in the field. The empirical findings are put into a broader perspective in the concluding third section. (shrink)

Religion and violence are related in an ambivalent, paradoxical way, for the systems of religious knowledge tend to prohibit violence and to motivate it at the same time. This paper looks for the roots of that ambivalence and reveals particular mechanisms that generate violence within religious systems and their associated practices. It argues that violence in religious systems is present in at least three forms: It is inherent to communication with the “sacred,” it is generated by processes of inclusion and (...) exclusion, shaping religiously interpreted lifeworlds, and it is motivated or moderated by the respective semantics of religious narratives. The paper concludes that violence as a moment of hierophany is constitutive for the living experience in religious systems and cannot be eliminated entirely by moderating semantics. (shrink)

This article is concerned with Niklas Luhmann's theory of art which he formulated in the 1990s, based on his general theory of autopoietic systems. This theory regards modern society as a functionally differentiated formation whose sub-systems operate according to their inner principles of communication. According to this, the domain of art can also be seen as an operationally closed and self-referential communicative system. The basic problem in these notions lies in the way in which their description of the relationships existing (...) between different systems is only in very narrow terms. Consequently they partially ignore the present process of de-differentiation which has noticeably changed the status of art in society. Instead, Luhmann's ideas expressly emphasize that functional differentiation is an ongoing process. In order to describe the process of de-differentiation, social theory does not need to abandon the concept of autopoiesis, but it does need to understand social systems as interlaced formations which, to an increasing extent, contain common normative and organizational constituents. Because social systems are not altogether self-referential formations, the concept of autopoiesis can describe them only in part. This particular concept of system has been developed in particular by Richard Münch, and as such it forms a productive alternative to the theory of autopoietic social systems. (shrink)

Among others, the term problem plays a major role in the various attempts to characterize interdisciplinarity or transdisciplinarity, as used synonymously in this paper. Interdisciplinarity is regarded as problem solving among science, technology and society and as problem orientation beyond disciplinary constraints. The point of departure of this paper is that the discourse and practice of ID have problems with the problem. The objective here is to shed some light on the vague notion of problem in order to advocate a (...) specific type of interdisciplinarity: problem-oriented interdisciplinarity. The outline is as follows: Taking an ex negativo approach, I will show what problem-oriented ID does not mean. Using references to well-established distinctions in philosophy of science, I will show three other types of ID that should not be placed under the umbrella term problem-oriented ID : object-oriented ID, theory-oriented ID, and method-oriented ID. Different philosophical thought traditions can be related to these distinguishable meanings. I will then clarify the notion of problem by looking at three systematic elements: an undesired state, a desired state, and the barriers in getting from the one to the other. These three elements include three related kinds of knowledge: systems, target, and transformation knowledge. This paper elaborates further methodological and epistemological elements of problem-oriented ID. It concludes by stressing that problem-oriented ID is the most needed as well as the most challenging type of ID. (shrink)

This article contributes to the debate about the political role of the business firm. The article clarifies what is meant by the “political” role of the firm and how this political role relates to its economic role. To this end, the authors present an ordonomic concept of corporate citizenship and illustrate the concept by way of comparison with the Aristotelian idea of individual citizenship for the antique polis. According to our concept, companies take a political role if they participate in (...) rule-setting processes and rule-finding discourses. Though this political role of the corporation is in principle ambivalent, the authors conclude that in such processes of “new governance” the economic and political roles of the firm need not contradict each other but can follow the same win-win logic of individual self-perfection through cooperative social interactions. It is well known that Niklas Luhmann’s theory of social systems is grounded in Spencer-Brown’s seminal Laws of Form (LoF) or ‘calculus of indications’. It is also known that the reception of the latter has been rather problematic. This article attempts to describe the construction of LoF, and confront it with Niklas Luhmann’s ontological and epistemological premises. I show how LoF must be considered a protologic, or research into the fundamentals of logical systems. The clue to its understanding is to (...) be found in its profoundly topological conception of common mathematics and (Boolean) algebra. Both are explained as direct offspring of their planar orientation. Self-reference is a justified instance of an extended, more intricate topological arrangement. Its consequences for ontology (non-identity) and epistemology (autology), I argue, have been adopted correctly by Niklas Luhmann. Separate sections are devoted to how Spencer-Brown’s notion of re-entry relates to Luhmann’s definition of system/environment, and to a comparison between Luhmann’s and Parsons’ functionalism. A conceptualization of capitalism as a consequence of functional differentiation is proposed. The general theoretical model of a functionally differentiated capitalist society is outlined in four steps based on these keywords: functional differentiation; capitalist economy; capitalist society; welfare state. This model grasps the essential characteristics of the analytical prototype of a capitalist society. What are its basic components that, working together, generate this kind of society’s structural dynamics?

Giorgio Agamben’s work on biopower thematizes the biopolitical distinction between what the 1789 Declaration distinguishes as citoyen and homme. In this contribution, Foucault’s and Agamben’s views on biopolitics are critically discussed. It argues that a crucial distinction exists between what can be called zoēpolitics and biopolitics. Whereas the former takes the biological body as its object and is only indirectly geared towards the social body, the latter more directly has the social body as its object. Citizenship can be regarded a (...) crucial form of population control that is both zoēpolitical and biopolitical in scope. It is zoēpolitical in that it distinguishes citizens from non-citizens. It is biopolitical in that it separates the life of ‘society’ from what is today, for instance, in discourse on immigrant integration, discursively articulated as the ‘outside society’. It is thus crucial to take seriously a discourse on what ‘society’ is, who belongs to it, and who resides ‘outside of society’, instead of taking the sovereign position of defining ‘society’ as a social body existing prior to its biopolitical articulation. Dis/Abling Practices: Rethinking Disability The paper discusses how ordinary acts of everyday life make up the complex and contingent scenarios of disabilities that create enabling and disabling practices. Drawing on qualitative empirical data the societal visibility and relevance of dis/abling practices are analyzed by connecting disability studies and sociological ideas with insights from Science and Technology Studies. The essay explores how dis/ability is the outcome of human and non-human configurations and suggests that dis/ability can be understood neither as an individual (...) bodily impairment nor as a socially attributed disability. Rather, dis/ability refers to complex sets of heterogeneous practices that associate bodies, material objects, and technologies with sensory practices. These practices, the paper concludes, draw attention to the multiple processes that concatenate the conduct of human affairs. (shrink)

This article inquires whether and to which degree some fundamental traits of the World Wide Web may encourage us to revise traditional conceptions of what constitutes scientific information and knowledge. Turning to arguments for `open access' in scientific publishing and its derivatives (open content, open archives, etc.), contemporary tendencies in `social software' and knowledge sharing, the authors project a new look on knowledge, dissociated with linear notions of cumulation, progression, and hierarchy (e.g. of scientific argument), but related to circularity, heterarchy, (...) and evolution. Arguing from a medium theoretical perspective, they illustrate their ideas with developments in library science, current debates in epistemology and theories about information architecture, with a particular focus on `unsystematic' folksonomies. A stationary eddy that constantly re-forms in the riverbed of the evolution of Western normative institutions, Legal Critique dates back, beyond modernity, to the beginning of the so-called Common Era. But critique also shapes the historical review of earlier phases of this evolution, and this not only as a method of the examination of sources, but also as a transferential displacement that tends to project into history the divides and aporias which define a present political situation. Unsurprisingly, this proceeding betrays (...) more about current conceptions than it reveals about those of the past. The fate of the philosophical topic of immanence and transcendence and that of the proto-modern politics inaugurated by the distinction of God’s absolute versus ordered power offer a significant case in point. Certain critical orientations find in the long and complex history of these divides merely their own anticipated echo. Yet, the split between the adepts of an Aristotelian universe rooted in the being of the good and the followers of Spinoza, accustomed to absolute power and immanent causality, resists such simplifications and warrants a new examination. In this paper, we understand we advent of a ''scientific spirit'' as a revival of Gnosticism, which proclaims the superiority of man over his creator and considers knowledge to be the key to salvation. Salvation is here understood as from of ''emancipation''. Empirically, toe see our interpretation confirmed in the tremendous influence of the Corpus Hermeticum and the Lurianic Cabala on all the Renaissance scientists. In the second part of this essay, we continue a line of research inaugurated by Ferdinand (...) Christian Baur in the 19th century, and look for Gnostic outlooks in contemporary philosophy and social science. By reading Niklas Luhmann's systems theory as a modem version of Gnostic mysticism, we do not intend to dismiss the relevance of his work. For if Gnosticism defines ''modernity'', we should not be surprised to find a speculative Gnostic system among society's self-descriptions. (shrink)

As a universal theory Luhmann's systems theory of society includes art in its ambit. The Art of Society (1995) reconstructs the formal and the social-historical conditions of the functional differentiation of a system of art since the Renaissance. The methodological focus of the reconstruction - Luhmann's theory of form (perception, first and second order observation, medium and form) and of systemic differentiation (social function, self-organization, codes and programmes, evolution and self-description of art) - are analysed in the first part of (...) the paper. The second part examines the unresolved question of the code of the art system, the hermeneutic circle integral to Luhmann's theory design, and the relation of his theory of art to the `aesthetic epoch' of art theory with special reference to Heidegger and Adorno. Global energy studies have produced a flurry of empirical analyses. However, the amount of theoretical reflection on the topic remains comparatively low. This article takes two specific limitations of the literature as its starting point: First, the often-unclear relationship between states and markets in global energy governance, and, second, the concept of energy as a material and external structure. With the aim of providing more nuanced perspectives on these issues, the article turns to the work of Niklas Luhmann and Bruno (...) Latour. Luhmann’s ideas of functional differentiation and structural coupling provide a new look at the interaction of states and markets. Latour’s symmetric anthropology allows us to rethink energy as a hybrid that is in the midst of instead of outside society. While these thinkers provide interesting ways forward for global energy studies, they also appear to be utterly incompatible. Instead of accepting this incompatibility, however, the article uses the tension between Luhmann and Latour’s work as a productive resource for further reflection on global energy governance. It develops a ‘Luhtourian’ approach, arguing that hybrid, issue-specific governance systems can emerge whenever a resistant hybrid instigates the emergence of symbolically generalized governance objects. This article addresses the question of the coherence of enactivism as a research perspective by making a case study of enactivism in mathematics education research. Main theoretical directions in mathematics education are reviewed and the history of adoption of concepts from enactivism is described. It is concluded that enactivism offers a ‘grand theory’ that can be brought to bear on most of the phenomena of interest in mathematics education research, and so it provides a sufficient theoretical framework. It has particular (...) strength in describing interactions between cognitive systems, including human beings, human conversations and larger human social systems. Some apparent incoherencies of enactivism in mathematics education and in other fields come from the adoption of parts of enactivism that are then grafted onto incompatible theories. However, another significant source of incoherence is the inadequacy of Maturana’s definition of a social system and the lack of a generally agreed upon alternative. (shrink)

This function of the legal systems is pivotal in our times as humankind is facing a systemic and evolutionary bifurcation between the heideggerian Gegnet of a strategic, high speed convergence (i.e., Singularity) among robotics, informatics, nanotechnologies, and genetics (RINGs)?which will reshape human life in terms of its life quality styles and standards (...) especially regarding health and environment matters, and the so called Neofeudal Scenario (NS) supported by those for whom the Industrial Model failed and the only way to save humankind and its environment would be a kind return to a Medieval life style based on a slow pace of life and austerity. This article provides an overview of the most important and recent international references regarding the two alternatives of bifurcation and describes a potential paradigm shift inside the systemic approach to reframe the conceptual map of global change through a systemic epistemology of the sociology of law. We claim that such an analysis can provide theoretical guidance for the changing role of business in society, especially in regard to the expectation and trend that businesses take a political role and act as corporate citizens. The systematicraison d'êtreof corporate citizenship is that business firms can and—judged by the criterion of (...) prudent self-interest—“should” take on an active role in rule-finding discourses and rule-setting processes with the intent of realizing a win-win outcome of the economic game. This article focuses on theoretical reflections on sovereignty and constitutionalism in the context of the globalization and Europeanisation of the nation states, their politics, and legal systems. Starting from a critical assessment of the Kelsen-Schmitt polemic, the author claims that sovereignty needs to be analysed by the sociological method in order to disclose its current structural differentiation. The constitution of society may be imagined as the multitude of self-constituted and functionally differentiated social subsystems. The constitutional pluralism argument subsequently reconceptualizes sovereignty (...) as socially differentiated and divided between specific subsystems. The EU's differentiated constitutional domain and the paradox of divided sovereignty are used as examples of profound structural and semantic changes in contemporary national and transnational societies. While the sovereign nation-state institutions have become marginalized in political structures of European societies, the self-constitutionalization of the functionally differentiated EU legal system proceeds by internalizing the concept of divided sovereignty and using it semantically as its mode of self-reference. Autopoietic theory is increasingly seen as a candidate for a radical theory of law, both in relation to its theoretical credentials and its relevance in terms of new and emerging forms of law. An aspect of the theory that has remained less developed, however, is its material side, and more concretely the theory’s accommodation of bodies, space, objects and their claim to legal agency. The present article reads Luhmann’s theory of autopoietic systems in a radical and material manner, linking it (...) on the one hand to current post-structural theorisations of law and society, and on the other hand extending its ambit to accommodate the influx of material considerations that have been working their way through various other disciplines. The latter comprises both a materialisation of the theory itself and ways of conceptualising the legal system as material through and through. This I do by further developing what I have called Critical Autopoiesis, namely an acentric, topological, post-ecological and posthuman understanding of Luhmann’s theory, that draws on Deleuzian thought, feminist theory, geography, non-representational theory, and new material and object-oriented ontologies. These are combined with some well-rehearsed autopoietic concepts, such as distinction, environment and boundaries; Luhmann’s earlier work on materiality continuum; more recent work on bodies and space; as well as his work on form and medium in relation to art. The article concludes with five suggestions for an understanding of what critical autopoietic materiality might mean for law. (shrink)

Reflexivity, or the systematic attempt to include the spokesperson in accounts of the social world, is a magnetic signature and inherent riddle of all modern thinking about knowledge and science. Turning the narrative back upon the narrator may sharpen our critical wits about the `inescapable perspectivity' of human knowledge; but self-referential accounts may also trigger endless loops of meta-theorizing and lose track of the object itself. Negotiating the twin pitfalls of spiralling meta-reflexivity and flat naturalistic accounts, I argue for a (...) reflexive `one step up', which adds one storey to the story. It explores, through critical discussions of the work of Harding and Bourdieu, how reflexivity may promiscuously combine with conflicting objectivist and constructivist epistemologies, and how reflexive accounts invariably appear to run in a circle. This performative circularity, it is argued, does not invalidate the reflexive effort but defines its major strength. Constitutive circularity graces both world-accounts and self-accounts with a radical uncertainty and incompleteness; which implies, among other things, that we must shift part of the burden of reflexive work to our friends, or rather: to our best enemies. In the age of ubiquitous computing and artificially intelligent applications, social machines serves as a powerful framework for understanding and interpreting interactions in socio-algorithmic ecosystems. Although researchers have largely used it to analyze the interactions of individuals and algorithms, limited attempts have been made to investigate the politics in social machines. In this study, I claim that social machines are per se political machines, and introduce a five-point framework for classifying influence processes in socio-algorithmic ecosystems. By drawing from scholars from (...) political theory, I use a notion of influence that functions as a meta-concept for connecting and comparing different conceptions of politics. In this way, I can associate multiple political aspects of social machines from a cybernetic perspective. I show that the framework efficiently categorizes dimensions of influence that shape interactions between individuals and algorithms. These categories are symbolic influence, political conduct, algorithmic influence, design, and regulatory influence. Using case studies, I describe how they interact with each other on online social networks and in algorithmic decision-making systems and illustrate how the framework is able to guide scientists in further research.
