Esta enciclopédia abrange, de uma forma introdutória mas desejavelmente rigorosa, uma diversidade de conceitos, temas, problemas, argumentos e teorias localizados numa área relativamente recente de estudos, os quais tem sido habitual qualificar como «estudos lógico-filosóficos». De uma forma apropriadamente genérica, e apesar de o território teórico abrangido ser extenso e de contornos por vezes difusos, podemos dizer que na área se investiga um conjunto de questões fundamentais acerca da natureza da linguagem, da mente, da cognição e do raciocínio humanos, bem (...) como questões acerca das conexões destes com a realidade não mental e extralinguística. A razão daquela qualificação é a seguinte: por um lado, a investigação em questão é qualificada como filosófica em virtude do elevado grau de generalidade e abstracção das questões examinadas (entre outras coisas); por outro, a investigação é qualificada como lógica em virtude de ser uma investigação logicamente disciplinada, no sentido de nela se fazer um uso intenso de conceitos, técnicas e métodos provenientes da disciplina de lógica. Arguing that our attachment to Aristotelian modes of discourse makes a revision of their conceptual foundations long overdue, the author proposes the consideration of unacknowledged factors that play a central role in argument itself. These are in particular the subjective imprint and the dynamics of argumentation. Their inclusion in a four-dimensional framework and the focus on thesis validity allow for a more realistic view of our discourse practice. Exhaustive analyses of fascinating historical and contemporary arguments are provided. These range from (...) Columbus’s advocacy of the Western Passage to India, over the trial of King Louis XVI during the French Revolution, to today’s highly charged controversies surrounding euthanasia and embryo research. Excavating foundational issues such as the purpose of argument itself and the contested role of argument as a generator of knowledge, the book culminates in a discussion of the relationship between rationality and reasonableness and criticizes the restrictions of ‘rational’ argument relying on fixed logical, economic or cultural criteria that in reality are mutable. Here, a true, open argument requires the infusion of Paul Lorenzen’s principle of ‘transsubjectivity’, which recognizes but transcends the partiality of the individual and which can be seen in the pragmatic and expanding consensus that humanity can control itself to safeguard the future of a fragile, damaged world. We start with a example of assembler programming, and show how even at this low level the structure of the programming language does not directly mirror the structure of the hardware, but that it is also decisively influenced by the human practices surrounding computer use, and that assembly language gives a view of the hardware which is accommodated to human interests and capabilities. We give several historical examples and illustrate the changing pattern of mutual accommodation between human practices and computer (...) technology, and argue for a more explicitly dialectical and critical approach to the history and philosophy of programming. The author distinguishes two concepts of practical reason: (a) practical reason as a source of practical principles, and (b) practical reason as the theory of thought operations connected with action. He proves that there is no practical recognition in the sense (a). We can deal with actions only on the basis of dichotomic semantics. Critical analyses of some theories of practical reason are presented (Kant, Lorenzen, Apel, Alexy). Popper's critical rationalism is widely accepted under scientists and philosophers of science as a proper method for the reconstruction of scientific theories. On occasion of the application of the Popperian ideas for the reconstruction of chemistry by Akeroyd the flaws of the critical rationalist approach are criticised and a methodical alternative is proposed, involving the operational definition of scientific terms.

The paper presents a dialogical approach applied to the analysis of argumentative strategies in philosophy and examines the case of the critical comments to the Tanner Lectures given by the Dutch biologist and primatologist, Frans de Waal, at Princeton University in November 2003. The paper is divided into five parts: the first advances the hypothesis that what seem puzzling aspects of philosophical argumentation to scholars in other academic fields are explained by the global role played by a series of arguments (...) within a broader argumentative strategy, e.g. arguing that a question that seems important is not really worthwhile; the second presents five groups of dialectical operations, making use of concepts and tools from the dialectical dialogical approach (WaltonWalton and Krabbe, Commitment in Dialogue: Basic Concepts of Interpersonal Reasoning, SUNY Press, Albany, 1995), Hubert Marraud's Argument dialectic (Marraud, En buena lógica. Una introducción a la teoría de la argumentación, Editorial Universidad de Guadalajara, Guadalajara, 2020) and from the vast tradition of formal dialectics and dialogical logic. A chief aim of this paper is to provide common ground for discussion of outstanding issues between defenders of classical logic and contemporary advocates of intuitionistic logic. In this spirit, I draw upon (and reconstruct) here the relationship between dialogue and evidence as emphasized in German constructivist authors. My approach depends upon developments in the methodology of empirical linguistics. As a preliminary to saying how one might decide between these two versions of logic (this issue is most closely approached in (...) Section V. discussing the constructivist approach), it is well worth the effort to look closely at how logic is (or might be) learned and at questions concerning logic in translation, i.e., the question of how we might detect the variety of logic actually employed in a given speech community. In a lecture that Habermas gave on his 90th birthday he ironically, but with serious intent, called a good Kant a sufficiently Marxist educated Kant. This dialectical Kant is the only one of the many Kants who maintains the idea of an unconditioned moral autonomy but completely within evolution, history and in the middle of societal class and other struggles. The article tries to show what Kant could have learned from his later critics to enable him to become a member (...) of the Frankfurt School’s neo-Marxist theory of society. (shrink)

In this work it is argued that legal justification can best be studied from a procedural, dialogical point of view: legal statements are justified if the audience is convinced in an argumentative dialog. The formalized and implemented model DiaLaw guards the procedure in which two players aim at justifying statements. DiaLaw shows the advances and problems linked to procedural models of legal justification. Moreover, an instructive discussion of the different models of procedural justification is provided. It is stressed that in (...) legal justification not only logically compelling arguments should be considered, but also convincing arguments. Therefore DiaLaw also deals with the rhetorical, psychological aspects of argument. This book is relevant for scholars in legal theory, artificial intelligence, and argumentation, and can be used in graduate courses on AI and Law, and legal argumentation. (shrink)

The idea to produce the current volume was conceived by Jiirgen Mittelstrass and Robert E. Butts in 1978. Idealist philosophers are wrong about one thing: the temporal gap separating idea and reality can be very long indeed - even ten or so years! Problems of timing were joined by personal problems and by the pressure of other professional commitments. Fortunately, James Brown agreed to cooperate in the editing of the volume; the infusion of his usual energy, good judgement and good-natured (...) promptness saved the volume and made its produc tion possible. Despite the delays, the messages of the papers included in the book have not gone stale. An extremely worthwhile exercise in international philosophical cooperation has come to fruition; the German constructivist philosophical position is here represented in papers in English that will make its contemporary importance available to a larger audience. The editors owe thanks to many persons. All involved in the project owe much to the interest and support of Nicholas Rescher, a friend of the undertaking from the time of its inception. My review of the translations was helped immensely by Andrea Purvis' careful copy editing of the typescript. Reviewing the beginnings and the further development of logicistic idea I am mainly focusing on the tradition of Frege and Russell, i. e. the tradition which was in the closest relationship with the enterprise of modern logic. I am trying to assess its connections to other „logistic“ programs such as Dedekind’s structuralism or Peano‘s axiomatism, to underline its specific features and the share in the success of modern logical semantics, including both its substantial contribution and limitations.
