  1. The Property Equilibrium in a Liberal Social Order (or How to Correct Our Moral Vision).Gerald Gaus - 2011 - Social Philosophy and Policy 28 (2):74-101.
The “welcome return” to “substantive political philosophy” that Rawls'sA Theory of Justicewas said to herald has resulted in forty years of proposals seeking to show that philosophical reflection leads to the demonstrable truth of almost every and any conceivable view of the justice of property rights. Select any view—from the justice of unregulated capitalist markets to the most extreme forms of egalitarianism—and one will find that some philosophers have proclaimed that rational reflection uniquely leads to its justice. This is, I (...)

  • The Ethics of Policing and Imprisonment.Molly Gardner & Michael Weber (eds.) - 2018 - Cham: Springer Verlag.
This volume considers the ethics of policing and imprisonment, focusing particularly on mass incarceration and police shootings in the United States. The contributors consider the ways in which non-ideal features of the criminal justice system―features such as the prevalence of guns in America, political pressures, considerations of race and gender, and the lived experiences of people in jails and prisons―impinge upon conclusions drawn from more idealized models of punishment and law enforcement. There are a number of common themes running throughout (...)

  • Clarke's Rejection of Superadded Gravity in the Clarke-Collins Correspondence.Lukas Wolf - 2019 - History of Philosophy Quarterly 36 (3):237-255.
In the past, experts have disagreed about whether Samuel Clarke accepted the idea that gravity is a power superadded to matter by God. Most scholars now agree that Clarke did not support superaddition. But the argumentation employed by Clarke to reject superaddition has not been studied before in detail. In this paper, I explicate Clarke's argumentation by relating it to an important discussion about the possibility of superadded gravity in the Clarke-Collins correspondence. I examine Clarke's responses to Collins and draw (...)

  • Contracting for Catastrophe:Legitimizing Emergency Constitutions by Drawing on Social Contract Theory.Stefan Voigt - 2021 - Res Publica 28 (1):149-172.
States of emergency are declared frequently in all parts of the world. Their declaration routinely implies a suspension of basic constitutional rights. In the last half century, it has become the norm for constitutions to contain an explicit ‘emergency constitution’, i.e., the constitutionally safeguarded rules of operation for a state of emergency. In this paper, I ask whether inclusion of an emergency constitution can be legitimized by drawing on social contract theory. I argue that there are important arguments, both against (...)

  • An Analysis of the Notions of Abundance and Slavery in Order to Rethink the Universal Range of Locke's Theory of Appropriation.Joan Severo Chumbita - 2013 - Las Torres de Lucca: Revista Internacional de Filosofía Política 2 (2):69-83.
Lockean theory of property in terms of irrestricted appropriation is as widely known as the criticism that has been addressed to it. The notions of abundance and slavery will be discussed here to claim that it is more accurate to talk about universal privatization than to talk about irrestricted appropriation. "Universal" has here three different meanings, which will be considered in different sections. The first meaning of "universality" within the theory of appropriation is related to its territorial scope. In this (...)

In the United States, convicted offenders frequently lose the right to vote, at least temporarily. Drawing on the common observation that citizens of color lose democratic rights at disproportionately high rates, this chapter argues that this punishment is problematic in non-ideal societies because of the way in which it diminishes the political power of marginalized groups and threatens to reproduce patterns of domination and subordination, when they occur. This chapter then uses the case of penal disenfranchisement to illustrate how idealized (...)

Gonzalo Letelier Widow - unknown
This work represents a research on the nature of the causal efficiency of law, i.e. on how the political command is communicated by authority and received by those who must obey it. In the words of political philosophy of aristotelic tradition, it is the classical problem of the “government over free and equal men”, i.e., the problem of compatibility between political government and the freedom of human act and political rights. In the words of kantian practical philosophy, the problem consists (...)

A lot of words investigated by philosophers get their inception for conventional or extra-philosophical dialect. Yet the idea of substance is basically a philosophical term of art. Its employments in normal dialect tend to derive, often in a twisted way, different from its philosophical usage. Despite this, the idea of substance differs from philosophers, reliant upon the school of thought in which it is been expressed. There is an ordinary concept in play when philosophers discuss “substance”, and this is seen (...)
