This volume considers the ethics of policing and imprisonment, focusing particularly on mass incarceration and police shootings in the United States. The contributors consider the ways in which non-ideal features of the criminal justice system―features such as the prevalence of guns in America, political pressures, considerations of race and gender, and the lived experiences of people in jails and prisons―impinge upon conclusions drawn from more idealized models of punishment and law enforcement. There are a number of common themes running throughout (...) the chapters. One is the contrast between idealism and realism about justice. Another is the attention to harmful consequences, not only of prisons themselves, but to the events that often precede incarceration, including encounters with police and pre-trial detention. A third theme is the legacy of racism in the United States and the role that the criminal justice system plays in perpetuating racial oppression. (shrink)

In the past, experts have disagreed about whether Samuel Clarke accepted the idea that gravity is a power superadded to matter by God. Most scholars now agree that Clarke did not support superaddition. But the argumentation employed by Clarke to reject superaddition has not been studied before in detail. In this paper, I explicate Clarke's argumentation by relating it to an important discussion about the possibility of superadded gravity in the Clarke-Collins correspondence. I examine Clarke's responses to Collins and draw (...) on his other works to reconstruct Clarke's reasons for rejecting superadded gravity. (shrink)

States of emergency are declared frequently in all parts of the world. Their declaration routinely implies a suspension of basic constitutional rights. In the last half century, it has become the norm for constitutions to contain an explicit ‘emergency constitution’, i.e., the constitutionally safeguarded rules of operation for a state of emergency. In this paper, I ask whether inclusion of an emergency constitution can be legitimized by drawing on social contract theory. I argue that there are important arguments, both against (...) and in favor of constitutionalized emergency provisions, and that social contract theory—as applied by economists—can be of some help when deciding whether to have, or not to have an emergency constitution. This paper introduces a novel argument for justifying emergency constitutions. It argues that they can serve as a commitment mechanism protecting both citizens and politicians from overreacting to rare but significant threats. (shrink)

O objetivo deste artigo é analisar o projeto de lei de Locke sobre os pobres à luz do debate que se estabeleceu no século XVII inglês sobre o combate à pobreza. A leitura desse projeto de lei com outros textos de Locke, como o _Segundo tratado_, por exemplo, conduz o leitor a uma flutuação interpretativa que parte de sua visão moral, de salvação da alma_ per_ _si_, passa por uma perspectiva de cunho econômico-utilitarista, baseada no trabalho, e chega a uma (...) solução igualmente moral, de homem disciplinado e apto à vida do labor. Ler este texto de Locke, sem clichês e preconceitos, pode ajudar o leitor contemporâneo a entender a longa luta de inclusão do pobre enquanto ser de direito por meio da assistência social. (shrink)

La relación entre patrimonio y derechos políticos en la obra de John Locke ha sido ampliamente discutida. Por un lado, se encuentran posiciones como las de Kendall y Tully que atribuyen un carácter democrático a la concepción lockeana sobre la sociedad civil. Por otro, interpretaciones como las de Ashcraft que le asignan un sesgo revolucionario e igualitario, próximo a la concepción de los Levellers. Sin embargo, a la luz de una serie de documentos, es posible discutir estas interpretaciones, como ya (...) lo han hecho diversos intérpretes parcialmente. Se mostrará aquí que Locke supone que la discusión parlamentaria compete a quienes, representando a los diferentes sectores productivos, discuten la promoción de sus actividades y que los trabajadores, al no disponer de la formación necesaria para la discusión sobre los asuntos públicos, no son considerados para participar del ejercicio parlamentario sino sólo de una resistencia excepcional. La lectura de la propuesta de una nueva ley de pobres y de la desregulación de la tasa de interés , permitirá dar cuenta de la articulación que Locke establece por un lado entre dejar hacer a los agentes empresarios y proteger la balanza comercial y, por el otro, el disciplinamiento y la (...) regulación de los trabajadores. O presente ensaio tem por objectivo ajudar a discernir o novo prisma, e o novo curso de pensamento por Kant inaugurado sobre o mais originário dos tópicos da faculdade de representação humana: as representações obscuras; um tópico até então quase completamente negligenciado, ou então expressamente negado, em razão da sua ligação à sensibilidade, mas um tópico que, no entender do filósofo, não só era um tópico de grande relevância filosófica, como antes encerrava novas, até então impensadas potencialidades, que Kant traz (...) à palavra pela primeira vez nas Lições de Antropologia. Assim, é nosso intento provar a matriz originariamente cosmológica que, para Kant, é aquela do problema das representações obscuras; trazer à evidência a forma embrionária da consciência que é a das representações obscuras, e sua relação com o conhecimento claro ; e, por fim, salientar como o tópico das representações obscuras está na origem de um re-proporcionamento de todas as inferiores e superiores faculdades do ânimo – o mesmo que Kant visava com a poesia, de que as representações obscuras são afinal parte. Lockean theory of property in terms of irrestricted appropriation is as widely known as the criticism that has been addressed to it. The notions of abundance and slavery will be discussed here to claim that it is more accurate to talk about universal privatization than to talk about irrestricted appropriation. "Universal" has here three different meanings, which will be considered in different sections. The first meaning of "universality" within the theory of appropriation is related to its territorial scope. In this (...) regard, the notion of abundance as defined in Chapter V of Locke's Two Treatises of Government identifies the global perspective of the Lockean theory of appropriation. The second and third meanings arise from an analysis of the notion of slavery, and more precisely from both uses of the term. The study of political slavery, considered as illegitimate, will allow us to explore the paradoxical relation between Lockean theory of property and particular states. Lastly, the notion of legitimate slavery will allow us to establish the universality of the theory of appropriation and its object, not just concerning earth and fruits but human life too. (shrink)

In the United States, convicted offenders frequently lose the right to vote, at least temporarily. Drawing on the common observation that citizens of color lose democratic rights at disproportionately high rates, this chapter argues that this punishment is problematic in non-ideal societies because of the way in which it diminishes the political power of marginalized groups and threatens to reproduce patterns of domination and subordination, when they occur. This chapter then uses the case of penal disenfranchisement to illustrate how idealized (...) discussions of deterrence, rehabilitation, and retribution often ignore the relationship between punishment and social/political power, and thus systematically obscure morally significant aspects of our broader penal practices. Se puede afirmar que la concepción voluntarista de la ley en Locke es típicamente moderna. El empleo de un léxico que enfatiza el elemento volitivo como esencia de la ley tiene su origen en teorías antropológicas, jurídicas y teológicas tardomedievales, de las que Suárez es el principal vehículo en su transmisión a la modernidad. Sea directa, sea indirectamente, el influjo de la concepción suareciana de la ley sobre Locke es incontestable. El artículo indaga, finalmente, la secuencia histórica Suárez-Grotius-Locke en la (...) búsqueda del hilo conductor del voluntarismo de dichos autores y replantea diversamente de como habitualmente es entendida la fórmula empleada por Grotius sobre la validez de la ley natural, a saber «etiamsi daremus non esse Deum», cuyo verdadero sentido es indicar la relativa autonomía de la ley natural respecto de la voluntad divina. This work represents a research on the nature of the causal efficiency of law, i.e. on how the political command is communicated by authority and received by those who must obey it. In the words of political philosophy of aristotelic tradition, it is the classical problem of the “government over free and equal men”, i.e., the problem of compatibility between political government and the freedom of human act and political rights. In the words of kantian practical philosophy, the problem consists (...) in the compatibility between individual’s moral autonomy and juridical system’s heteronomy, i.e. it consists in justifying the dominion of one man over another one, so that the citizen obeys the laws without any kind of submission to a will other than his own. The question requires particular attention to the problem of the nature of political bonds, as communication of political command is necessarily founded on what is common to the members of political society. The work is divided in two parts. The first one proposes a model of practical philosophy whose fundamental structure is common to all major political thinkers of modern times. This model consists in a “moral of obligation” founded on the opposition between law (must) and freedom (will), originated on nominalistic scholastic voluntarism. Within this structure, the problem assumes the form of a dilemma: if law comes from our own will (autonomy), then it becomes necessary to explain how it is possible to command over oneself; if law comes from a will other than our own, then it becomes necessary to explain the difference between law and mere force. In this context, the theories of Hobbes and Rousseau are studied as the theoretical matrix of modern political philosophy and as the two dialectical poles of this opposition. The conclusions derived from the study of these two thinkers are then applied to Kelsen and Kant respectively. The second part proposes a reconstruction of classical philosophy’s position about this problem, meaning by “classical” the tradition that begins with Plato, continues with Aristotle and reaches a new summit with Saint Thomas Aquinas. In this part of the work, a “classical” model of practical philosophy, common to these three authors, is presented. This model consists in an “order of loves”. Two fundamental theses are proposed. The first one is that law is a rational communicable order, whose efficacy is founded on participation of the act of “imperium” of authority in individual’s subjective “imperium” over his own acts. The second one is that the principle of this communication consists in “political concord”, i. e. a “useful friendship” about the ends of society, and that the concrete realization of this order in the citizen’s soul is political virtue, which is analogue to man’s virtue with the same platonic analogy that exists between man’s soul and the city or the State. A lot of words investigated by philosophers get their inception for conventional or extra-philosophical dialect. Yet the idea of substance is basically a philosophical term of art. Its employments in normal dialect tend to derive, often in a twisted way, different from its philosophical usage. Despite this, the idea of substance differs from philosophers, reliant upon the school of thought in which it is been expressed. There is an ordinary concept in play when philosophers discuss “substance”, and this is seen (...) in the concept of object, or thing when this is contrasted with properties, attributes or events. There is also a difference in view when in the sense that while the realists would develop a materialistic theory of substance, the idealist would develop a metaphysical theory of substance. The problem surrounding substance spans through the history of philosophy. The queries have often been what is substance of? And can there be substance without its attributes? This paper tends to expose the historical problems surrounding substance. This paper criticizes the thinking which presupposes that there could be a substance without its attributes or substance existing alone. This paper adopts complimentary ontology principles which state that for anything to exist, it must serve as a missing connection to reality. This suggests that everything interconnects to each other and substance cannot exist in isolation. (shrink)

La teoría de la propiedad de Locke tiene como escenario el estado de naturaleza, cuyo correlato empírico es la colonización inglesa de América. Este es el supuesto que permite articular la apelación a la teología para fundar la propiedad privada de modo unilateral y en cualquier lugar del mundo; el desplazamiento del criterio de necesidad a la teoría del valor para justificarla; así como el supuesto de abundancia que la hace posible sin requerir pacto político ni consenso social. En este (...) sentido, si su teoría de la propiedad resultó esencial para legitimar el liberalismo que moldeó América desde la colonización inglesa y la Constitución norteamericana, el hecho de que América sea el ejemplo para su teórico más temprano y destacado, permite comprender mejor el carácter esencial de la relación entre liberalismo y colonialismo. Locke's theory of property appears in the context of the state of nature, whose empirical correlate is the English colonization of America. This is the basis upon which three elements can be articulated: the appeal to theology in order to found unilaterally private property anywhere in the world; the change from the criterion of necessity to the theory of value to justify private property; and the assumption of abundance which makes it possible without having recourse to political pact or social consensus. In this sense, if Locke's theory of property has come to be essential to legitimize the liberalism which modelled America since the English colonization and the American constitution, the fact that America is the example for its earliest and most distinguished theorist, allows to a better understanding of the essential nature of the relationship between liberalism and colonialism.
