The article argues that civil disobedience must be perceived as an action with progressive and political significance, thus reflecting, from a Kantian perspective, the recognizable paradox between morality and law, as expressed in Kant’s moral and political writings. Hence, this article firstly analyzes on which grounds Kant claims rebellion to be unjust. Secondly, it examines how and if people, from a Kantian point of view, can defend themselves against an unjust sovereignty. On this basis, it argues that ‘civil disobedience’ can (...) be juxtaposed with the Kantian idea of ‘freedom of the pen,’ thus having the same function as a political corrective. However, two questions are still to be answered, namely if civil disobedience must be punished, and if civil disobedience as a political corrective can be justified? By considering civil disobedience primarily as political agency, both questions are answered in the affirmative. (shrink)

This paper uses a novel account of non-ideal political action that can justify radical responses to severe climate injustice, including and especially deliberate attempts to engineer the climate system in order reflect sunlight into space and cooling the planet. In particular, it discusses the question of what those suffering from climate injustice may do in order to secure their fundamental rights and interests in the face of severe climate change impacts. Using the example of risky geoengineering strategies such as sulfate (...) aerosol injections, I argue that peoples that are innocently subject to severely negative climate change impacts may have a special permission to engage in large-scale yet risky climate interventions to prevent them. Purpose This paper aims to examine whether there are morally defensible reasons for using or operating websites that offer distributed denial-of-service attacks on a specified target to users for a price. Booters have been linked to some of the most powerful DDoS attacks in recent years. Design/methodology/approach The authors identify the various parties associated with booter websites and the means through which booters operate. Then, the authors present and evaluate the two arguments that they claim may be used to justify (...) operating and using booters: that they are a useful tool for testing the ability of networks and servers to handle heavy traffic, and that they may be used to perform DDoS attacks as a form of civil disobedience on the internet. Findings The authors argue that the characteristics of existing booters disqualify them from being morally justified as network stress testing tools or as a means of performing civil disobedience. The use of botnets that include systems without the permission of their owners undermines the legitimacy of both justifications. While a booter that does not use any third-party systems without permission might in principle be justified under certain conditions, the authors argue that it is unlikely that any existing booters meet these requirements. Practical/implications Law enforcement agencies may use the arguments presented here to justify shutting down the operation of booters, and so reduce the number of DDoS attacks on the internet. Originality/value The value of this work is in critically examining the potential justifications for using and operating booter websites and in further exploring the ethical aspects of using DDoS attacks as a form of civil disobedience. This paper seeks to investigate and assess a particular form of relationship between the State and its citizens in the context of the COVID-19 pandemic, namely that of obedience to the law and its related right of protest through civil disobedience. We do so by conducting an analysis and normative evaluation of two cases of disobedience to the law: (1) healthcare professionals refusing to attend work as a protest against unsafe working conditions, and (2) citizens who use public demonstration and (...) deliberately ignore measures of social distancing as a way of protesting against lockdown. While different in many aspects, both are substantially similar with respect to one element: their respective protesters both rely on unlawful actions in order to bring change to a policy they consider unjust. We question the extent to which healthcare professionals may participate in civil disobedience with respect to the duty of care intrinsic to the medical profession, and the extent to which opponents of lockdown and confinement measures may reasonably engage in protests without endangering the lives and basic rights of non-dissenting citizens. Drawing on a contractualist normative framework, our analysis leads us to conclude that while both cases qualify as civil disobedience in the descriptive sense, only the case of healthcare professionals qualifies as morally justified civil disobedience. How should feminists view acts of self-sacrifice performed by women? According to a long-standing critique of care ethics such acts ought to be viewed with scepticism. Care ethics, it is claimed, celebrates acts of self-sacrifice on the part of carers and in doing so encourages women to choose caring for others over their own self-development. In doing so, care ethics frustrates attempts to liberate women from the oppression of patriarchy. Care ethicists have responded to this critique by noting limits on (...) the level, form, or scope of self-sacrifice that work to restrict its role in their theories. While we do not here take issue with the initial feminist critiques of self-sacrifice, we suspect that the strategies offered by Care ethicists in response are importantly flawed. Specifically, these responses undervalue the positive roles that self-sacrifice can play in fighting patriarchal oppression. As a result, in attempting to restrict an oppressive norm, these responses risk foreclosing on valuable means of resistance. Our aim is to explore these positive roles for self-sacrifice and thereby rehabilitate its standing with feminists. (shrink)

Can anti-deportation resistance be justified, and if so how and by whom may, or perhaps should, unjust deportations be resisted? In this paper, I seek to provide an answer to these questions. The paper starts by describing the main forms and agents of anti-deportation action in the contemporary context. Subsequently, I examine how different justifications for principled resistance and disobedience may each be invoked in the case of deportation resistance. I then explore how worries about the resister’s motivation for engaging (...) in the action and their epistemic position apply in the specific context of anti-deportation action and consider in what circumstances there is not merely a right but a duty to resist deportation. The upshot of this argument, I conclude, is that the liberal state ought to respond to anti-deportation action not by criminalising disobedience and resistance in this field, but rather by creating legal avenues for such actors to influence deportation decision-making.
