N. R. Hanson has argued that abductive reasoning relates strongly on the conceptual aspect of problem solving. In different kinds of intellectual enterprizes involving creation of new knowledge, language has an essential role. This conceptual aspect is here approached from a perspective of theory of linguistic meaning. The approach from theory of meaning intends to provide theoretical presuppositions for meaningful expressions and, thus, thoughts. It is argued that these presuppositions characterize the content of abductive reasoning. Language is essential for expressing (...) and communicating knowledge, but it also plays role in how meaningful thoughts about the world are constructed. It is argued here that the propositional content of thoughts is related to language through logical and grammatical forms of language. If abductive reasoning is seen as reasoning bound by certain presuppositions , and the possible number of conclusions of reasoning is limited, these linguistic structures characterize the.rst criterion for possible meaningful hypothesis suggestions. The theory of meaning, especially provided by Jerrold Katz, has also another useful theoretical device for understanding abduction, in addition to the compositional sentence meaning described above. Especially in pragmatism the meanings of linguistic expressions are seen to be dependent of the context they are used. These contextual tokens of meanings provide contextual information of the possible uses and meanings of a linguistic expression. These two theoretical conceptions from the theory of meaning can provide more thorough understanding of the contents of abductive reasoning. (shrink)

The appearance in 1945 of the idea of the open texture of empirical concepts, which anticipated Friedrich Waismann’s thesis of a many-level-structure of language, led to a re-evaluation of “context”. It widens the sense of context that we are accustomed to mentioning as being Wittgenstein’s conception of meaning in his later philosophy. The new idea Waismann brought into the landscape is how to “clarify the context”, which is in a way a very non-Wittgensteinian question as well as an “explanation of (...) context”, where open texture plays a key role. But despite the amount of literature about open texture, this idea of Waismann is still not properly understood. Open texture must be situated as an obstacle to exhaustiveness of definition for internal reasons not only because of unforeseen conditions that could always arise in the future, but also by virtue of an a priori aspect of the texture of concepts. Thus, the main goal of this paper is to propose an interpretation of open texture as an immanent property of a concept, that is, as something that is underlying its nature. (shrink)

When we use a word, we face a crucial epistemic gap: we ground our move on the fact that our interlocutor knows the meaning of the word we used, and therefore he can interpret our dialogical intention. However, how is it possible to know the other’s mind? Hamblin explained this dialogical problem advancing the idea of dialectical meaning: on his view, the use of a word is based on a set of presumptions. Building on this approach, the use of a (...) word in a dialogue can be analyzed in terms of presumptive reasoning, while the manipulative strategies based on slanted or loaded terms or redefinitions can be conceived as forms of conflicts of presumptions. A presumptive approach to meaning can also ground different dialectical strategies to solve misunderstanding or definitional disagreements, or tactics to undermine the interlocutor’s arguments by advancing charges of equivocation. In his recent book Interpretation and Legal Theory , Andrei Marmor makes a number of claims about meaning and interpretation, both in general and in law, which I will argue are mistaken. Actually, there is some confusion in his book between what I take to be his “official” view of the nature of meaning and interpretation, and a very different view which keeps surfacing despite his official rejection of it. I will argue that this alternative, rejected view, when properly developed, (...) is more plausible than his official view, and that the difference between them is of considerable practical consequence for legal interpretation. What is at stake is the role of legislative intention. The alternative view denies Marmor's claim that the meaning of a statute is conceptually independent of the intention or purpose which the legislature had in enacting it. It should be said at the outset that I will focus on just three of the eight chapters in Marmor's book, which contains many virtues that are untouched by my critique. (shrink)

Die vorliegende Studie unternimmt den Versuch, Gadamers Ideen zur Begriffsbildung und Textbedeutung einer rationalen Rekonstruktion im Licht neuerer Entwicklungen in der linguistischen und philosophischen Semantik zu unterziehen. Anschließend an eine Kritik gewisser auf Heidegger zurückgehender Annahmen in Gadamers Wahrheit und Methode werden seine Begriffe der Applikation und der Geschichtlichkeit von Textbedeutungen reformuliert. Dies geschieht unter Bezugnahme auf J. J. Katz' Bedeutungs- und Referenztheorie, H. Putnams Theorie der Stereotypen und J. M. E. Moravcsiks Begriff der 'aitiational frames'. Es wird im besonderen (...) die These vertreten, daß Gadamers Idee der Interpretation als eines Prozesses, bei dem Autor und Leser zu einer Übereinkunft über die 'Sache' kommen , neu und fruchtbar in Begriffen der Interaktion zwischen semantischer Kompetenz und Alltagswissen im Leseprozeß überdacht werden kann. In Verbindung mit weiteren Teilen linguistischer Theorie würde ein solcher Neuansatz es ermöglichen, die Frage zu beantworten wie Verstehen im Prinzip möglich ist. Eine rationale Rekonstruktion von Gadamers Begriff der Applikation in dieser Richtung würde es ferner erlauben, Antworten auf eine Reihe weiterer schwieriger Fragen wie zum Beispiel der nach dem Grad der Unbestimmtheit von Textbedeutungen und der 'Korrektheit' von Interpretationen zu erhalten.
