Dirty hands cases are often seen as a crucial challenge for political ethics. Michael Walzer’s analysis of dirty hands cases has been especially influential. On closer inspection, however, Walzer’s analysis contains some serious flaws. This article examines how and to what extent the political ethics of Paul Ricoeur can remedy the problems in Walzer’s approach. It is shown that Ricoeur’s approach can offer a better understanding of what is at stake in dilemmas in political action and that it can provide (...) guidance for dealing with such issues. Ricoeur’s analysis, furthermore, provides the foundation for a more critical political ethics than Walzer can offer. (shrink)

This article attempts to show the continuing practical relevance of hermeneutics through the example of legal interpretation. The article begins with the very concrete nature of legal hermeneutics that forms everyday legal practice – the interrelation of meaning and application – and expands at a more theoretical to show how legal hermeneutics, and hermeneutics more generally, offers what Ricoeur calls an interpretive “choice in favor of meaning.” The choice in favour of meaning underscores the restorative character of hermeneutics that legal (...) hermeneutics can epitomize. The term “social cognition” can be construed in different ways. On the one hand, it can refer to the cognitive faculties involved in social activities, defined simply as situations where two or more individuals interact. On this view, social systems would consist of interactions between autonomous individuals; these interactions form higher-level autonomous domains not reducible to individual actions. A contrasting, alternative view is based on a much stronger theoretical definition of a truly social domain, which is always defined by a (...) set of structural norms; moreover, these social structures are not only a set of constraints, but actually constitute the possibility of enacting worlds that would just not exist without them. This view emphasises the heteronomy of individuals who abide by norms that are impersonal, culturally inherited and to a large extent independent of the individuals. Human beings are socialised through and through; consequently, all human cognition is social cognition. The article argues for this second position. Finally, it appears that fully blown autonomy actually requires heteronomy. It is the acceptance of the constraints of social structures that enables individuals to enter new realms of common meaningfulness. The emergence of social life marks a crucial step in the evolution of cognition; so that at some evolutionary point human cognition cannot but be social cognition. (shrink)

The article presents possible applications of Paul Ricoeur’s theory in interpretation of legal texts and legally relevant human action. One should notice that Paul Ricoeur developed a comprehensive interpretation theory of two seemingly distant phenomena: literary texts and human action. When interrelating these issues, it becomes possible, on the basis of Ricoeur’s work, to construct a unified theory of the interpretation of legal texts and of legally relevant human action. What is provided by this theory for jurisprudence is the possibility (...) of formulating a comprehensive theory of application of law, well established in the ontology of the recipient of the legal text. It should be emphasised that the resulting benefits, outlined in the article become particularly noticeable when set against the background of the methodological weaknesses of legal positivism, concerning both the interpretation of law and a syllogistic model of its application. ABSTRACTRicoeur’s proposal to understand the encounter between religions as a practice of ‘linguistic hospitality’ has appealed to many interreligious scholars. Usually, religious texts are at the heart of interreligious hermeneutics, turning Ricoeur’s linguistic hospitality into a practice of interreligious cross-reading. Recently, due to the influence of material and ritual scholars, the textual focus of interreligious hermeneutics has been criticized. Two criticisms are prominent. First, the assumption that understanding religious otherness is best mediated via language and texts leads religious scholars to (...) minimize the ‘non-textual’ practices in religious life. Second, interreligious interpreters mistakenly assume that they can read all meaningful action and ritual performances, especially as texts. This assumption leads to a textualization of the world and does not take into account that there might be other ‘vehicles of intelligibility’ apart from texts. In this article, I explore to what extent the criticisms raised against Ricoeur’s interreligious hermeneutics are fair. I have learned from Ricoeur the importance of mediating between seemingly opposed positions, and I seek to follow his example in this article. (shrink)

En el presente artículo presentaremos algunos de los aspectos centrales del concepto ricoeuriano de hermenéutica crítica a partir de lo que se desprende de su análisis y discusión con las obras de Althusser y Habermas. En términos generales, mientras que las investigaciones históricas del primero apuntan a poner de manifiesto las estrategias de la reproducción de los sistemas de poder, el segundo propone un proyecto liberador basado en una construcción utópica independiente de la historia. El uso que hacen Althusser y (...) Habermas del psicoanálisis nos acercará tangencialmente al vínculo de Ricoeur con esta disciplina. Concluiremos señalando al concepto de “memoria feliz”, desarrollado en La memoria, la historia, el olvido, como un ejemplo de utopía y muestra de que Ricoeur mantendrá algunos aspectos centrales de esta propuesta hasta el final de su vida. This article presents a comparison between Ricoeur’s and Patočka’s ideas on the subject as a rational and ethical person. Despite differences in style and interests, their work manifests important resemblances and agreements. The comparison focuses on the primordial embedding of the individual subject in natural and social structures, on the ethical implications of this situation of the subject, and on the differences in both philosophers’ evaluation of modern culture.

This paper is an attempt to bring together the convergent elements in J.L. Austin’s and Paul Ricoeur’s philosophies of language. Though a number of studies have already claimed that Ricoeur has in some ways been influenced by Austin, to date, not a single study has been made that exclusively focuses on the interrelatedness between Austin’s and Ricoeur’s philosophies of language. Thus, in this paper, I will start with a general exposition of the philosophical connection between Austin and Ricoeur. I will (...) then show how Austin and Ricoeur define and also understand the nature of words, the central component of every language. I will next explore the interplay of meaning and hermeneutics through a detailed discussion of the Speech Acts Theory (Austin) and the Hermeneutics of Symbols (Ricoeur). Afterward, I will argue that in Austin and Ricoeur, words, meaning, and hermeneutics constitute the art of making sense of things and of interpreting certain aspects and features of language. (shrink)
