Diese besondere Situation des Kindes ist gekennzeichnet durch das Faktum der ‚Natalität‘, d. h. durch ein radikales Vorherbestimmt-Sein und eine radikale Abhängigkeit der kindlichen Existenz. Can one speak philosophically of a justified limitation of freedom? Hegel’s logically founded definition of free will and his understanding of right and duty can contribute to a clarification of the concept of freedom. Important is a precise differentiation between freedom and caprice (Willkür) – the latter being a necessary but one-sided element of the free will. In caprice, the will is not yet in the form of reason. Rational rights and duties are not a restriction of freedom. Insofar as (...) individual rights can collide (e. g. in emergency situations), there can be a temporary and proportionate restriction of certain rights in favour of higher rights, such as the right to life. Dictatorships are instances of capricious rule which restrict freedom; the rationally designed state, by contrast, restricts only caprice. What is tobe defined are the duties and the rights of the state and the duties and the rights of the citizens. (shrink)

In this paper I argue that we need to analyze ‘religious violence’ in the ‘post-secular context’ in a twofold way: rather than simply viewing it in terms of mere irrationality, senselessness, atavism, or monstrosity – terms which, as we witness today on an immense scale, are strongly endorsed by the contemporary theater of cruelty committed in the name of religion – we also need to understand it in terms of an ‘originary supplement’ of ‘disengaged reason’. In order to confront its (...) specificity beyond traditional explanations of violence, I propose an integrated phenomenological account of religion that traces the phenomenality of religion in terms of a correlation between the originary givenness of transcendence and capable man’s creative capacities to respond to it. Following Ricœur, I discuss ‘religious violence’ in terms of a monopolizing appropriation of the originary source of givenness that conflates man’s freedom to poetically respond to the appeal of the foundational with the surreptitiously claimed sovereignty to make it happen in a practical transfiguration of the everyday. Value is a basic concept in economics, ethics and sociology. Locke made labour the source of value, whereas Smith referred to an ideal exchange and Kant specified that commodities only have a market price, no intrinsic value. One can distinguish two modern concepts of value, an economic one trying to explain value in terms of utility, interest or preferences, and an ideal one considering values as ends in themselves. On this basis, Durkheim constructed his theory of value, which was developed (...) by his followers Mauss and Bouglé and further by Bataille. Their line of thought makes it possible to develop a conceptual framework, which can be used to criticise neo-liberalism, big business and the effects of globalisation, while at the same time defending the moral value of business and giving an interpretation of the anti-globalisation protests. Contemporary Christian ethics encounters the challenge to communicate genuinely Christian normative orientations within the scientific debate in such a way as to render these orientations comprehensible, and to maintain or enhance their plausibility even for non-Christians. This essay, therefore, proceeds from a biblical motif, takes up certain themes from the Christian tradition (in particular the idea of social justice), and connects both with a compelling contemporary approach to ethics by secular moral philosophy, i.e. with Axel Honneth's reception of Hegel, as (...) based on Hegel's theory of recognition. As a first step, elements of an ethics of recognition are developed on the basis of an anthropological recourse to the conditions of intersubjective encounters. These conditions are then brought to bear on the idea of social justice, as developed in the social-Catholic tradition, and as systematically explored in the Pastoral Letter of the United States Conference of Catholic Bishops, Economic Justice For All (1986). Proceeding from this basis, aspects of a Christian ethics of community service with regard to long-term care can be defined. (shrink)

Practical philosophy in the classical German tradition from Kant to Hegel seems to be moralistic and even ascetic. The core of its moral and legal philosophy is a concept of freedom as independence from any longing for pleasure and happiness. Tracing the development of Hegel’s philosophy of subjective, objective and absolute spirit, however, exhibits a deep systematic connection between the forms of freedom and happiness in all their traditional and modern meanings. Many of them can be compared with modern conceptions, (...) but others have to be saved from oblivion and defended against reductive conceptions of freedom and happiness in modern philosophy. Definition of the problem: Is respect for autonomy in medicine synonymous with respect for autonomous choices? Does it depend on the competency of patients? Arguments: The article criticizes this opinion, which is widely held in the field of medical ethics. This position does not recognize the problem of paternalism in its full import in modern medicine. It misunderstands the moral meaning of autonomy in its primacy over the psychological meaning, as well as the close ties between autonomy and beneficence. These (...) ties are made evident by reflection on basic anthropological conditions of ethics. Conclusion: Proceeding from this reflection I outline consequences for the praxis of non- paternalistic care that also respects the will of non-competent patients. (shrink)

The theories of Locke, Hume and Kant dominate contemporary philosophical discourse on property rights. This is particularly true of applied ethics, where they are used to settle issues from biotech patents to managerial obligations. Within these theories, however, the usual criticisms of private property aren’t even as much as intelligible. Locke, Hume and Kant, I argue, develop claims about property on a model economy that I call “Frontier Town.” They and contemporary authors then apply these claims to capitalist economies. There (...) are two problems with this application: First, we’ll be considering the wrong kind of property: The only property in Frontier Town are means of life. Critics, however, object to property in concentrated capital because they associate only this kind of property with economic coercion and political power. Second, the two economies differ in central features, so that very different claims about empirical consequences and hence about fairness and merit will be plausible for each. This second problem, I argue, is a consequence of the first. I conclude that Frontier Town theories are more likely to distort than to illuminate property issues in capitalist economies. (shrink)

What is commonly called a right has since about 1980 increasingly come to be called a subjective right. In this paper the origin and rise of this solecism is investigated. Its use can result in a lack of clarity and even confusion. Some aspects of rights-concepts and their history are also discussed. A brief postscript introduces Leibniz's Razor.

[full article, abstract in English; abstract in Lithuanian] During the last few years, it has become usual to turn to some seventeenth century readings of the traditional idea of an original common possession of the earth for philosophical aid to explain and support the rights of persons in situations of extreme need, including refugees. Hugo Grotius’s conception of this idea is one of the most cited ones. In this paper, I hold that a Grotian reading of the idea of an (...) original common possession of the earth is not a fruitful principle if we want to elaborate a solid defence of the rights of the ones in need. I reconstruct and analyse the role this idea has in Grotius’s theory of private property and present objections to it from a Kantian perspective. (shrink)

This contribution investigates whether Hegel’s critique of social contract theory is still applicable to contemporary contract theory proposed by, e. g., Rawls and Nozick. At first sight, they seem to have overcome the problems identified by Hegel because Rawls and Nozick appropriate the social contract as something essentially rational and normative. I argue, however, that for Hegel, their appeal to rational argumentation is not compatible with the concreteness of human individuals. A revised reading of the master/ bondsman-relation, emphasizing the role (...) of the “fear of death”, shows the limited scope of contemporary contract theory. (shrink)

Many countries encourage immigration, yet almost without exception they impose medical conditions on the admissibility of prospective immigrants. This paper examines the ethical defensibility of this practice. It argues that the neighbourhood principle, which states that we owe a greater duty to neighbours than to strangers, when properly understood, extends to all human beings, that economic and safety considerations play only a limited role in ethically underwriting an exclusionary policy, and that medical immigration criteria should be harmonized with treatment eligibility (...) criteria for citizens of the relevant countries themselves. What should be enforced by or expected from or required of the institutional actors in the health care system to do in order to preserve these values? Seit der Einführung der G‑DRGs als Instrument zur Vergütung von Krankenhausleistungen steht das Gesundheitswesen als System unter Kritik. Denn die Ausrichtung der Krankenhäuser auf wirtschaftlichen Erfolg relativiert den Anspruch aller Bürgerinnen und Bürger auf gute medizinische Versorgung. Der Artikel geht der Frage nach, von welchem Akteur im System welche Aktivität erzwungen, erwartet, oder verlangt werden kann, dem entgegenzuwirken. Die genannten alltagsmoralischen Urteile werden unter Rückgriff auf Kants Moralphilosophie validiert und auf die wichtigsten Akteure angewandt. Ergebnis: Der Kern des Ökonomisierungs‑/Kommerzialisierungs-Problems besteht (...) in der Entwertung der Professionalität der patientennahen Berufe. Die Neujustierung des Systems kann vom Gesetzgeber nur dann verlangt werden, wenn die verfasste Ärzteschaft sich dazu bekennt, mit den ihr zu Gebote stehenden Mitteln gegen professionswidrige Handlungsanreize vorzugehen. The present article sets out to defend the thesis that among the more or less familiar enemies or challenges an adequate theory of virtue has to cope with is another, less obvious one – virtue ethics itself. The project of establishing virtue ethics as a third paradigm of normative ethics at eye level with consequentialism and deontological approaches to ethics threatens to distort not just our ethical thinking but the theory of virtue itself. A theory of virtue that is able (...) to meet the demands of a full-blown virtue ethics necessarily has to face three fundamental dilemmas and thus seems to fail as an adequate theory of virtue. And vice versa: An ontologically and normatively viable theory of virtue will be unsuited to provide a promising starting point for virtue ethics as the “third kid on the block” among the options of self-standing paradigms of normative ethics. The concept of human dignity and the relationship between dignity and human rights have been important subjects in contemporary international academia. This article first analyzes the different understandings of the concept of dignity, which has left great influences in history (including the “theory of attribution-dignity”, the “theory of autonomy-dignity” or the “theory of moral completeness/achievement-dignity”, and the “theory of end-in-itself-dignity”); it then exposes the obvious defects of these modes of understanding; finally, it tries to define dignity as a moral right (...) to be free from insult. Meanwhile, the relationship between human dignity and human rights is clarified as a result of this research: Rather than being the foundation of human rights, human dignity is one of human rights. The idea of dignity nevertheless has a particular status in ethics in that it embodies a kind of core moral concern, representing a basic demand rooted in the human self or individuality, and hence representing an important aspect of human rights. We may anticipate that sooner or later, the idea of human dignity will become, together with other human rights, the only intangible cultural heritage of human society. (shrink)

This article will provide an illustration of Max Weber’s theory of rationalization with a specific impetus on its interdependency with the development of capitalism. Following Horkheimer, I shall critically draw on Weber to outline a theory of human freedom, showing that rationalization not only implies economic and social liberation but entails a totalizing tendency that invades all spheres of socio-political life including people’s mental infrastructure. This mental colonization can be framed as a process of substituting value rationality with instrumental rationality. (...) I will claim that this substitution can be understood as an impediment for human freedom. Following contemporary theories of action, I will show the centrality of value orientation for understanding human freedom. Therefore, I propose a critical theory of freedom that centers value rational action as realization of freedom and can be understood as emancipative. (shrink)

The article has the aim to show that Kant’s “standard” conception of the highest good does not represent his last word about the problem. Kant moves from a conception of the highest good close connected with the metaphysical tradition and with the aim of a new, moral justification of traditional metahysical concepts such as God and immortality of the soul. This view does find many difficulties and oscillations in the Critiques, looking for different formulations of a moral “proof” for the (...) metaphysical concepts, grounded upon the need of justice and of a rational solution to the question of theodicy. The failure of this project is apparent with the essay on theodicy. In the last decade of Kant’s intellectual activity, the expression “highest good” occurs few times and the concept looses its systematic relevance, as shown by the last works up to the Opus postumum. ZusammenfassungDie gegenwärtige Debatte um die normativen Grundlagen kritischer Gesellschaftstheorie weist eine große Bandbreite ethischer Positionen auf: vom ethischen Negativismus, der gänzlich auf einen positiven Kritik-Maßstab verzichtet, über Entfremdungs- und Resonanztheorien, die zumindest eine grobe Vorstellung des guten Lebens vermitteln wollen, bis hin zu deontologischen Ansätzen, die Gesellschaftskritik in intelligibler Freiheit begründet sehen. Der folgende Beitrag zeigt, dass diese drei Grundpositionen sich mit Problemen konfrontiert sehen, die der hegelsche Freiheitsbegriff zu lösen vermag.

The paper presents, firstly, a brief review of the long history\nof information ethics beginning with the Greek concept of parrhesia\nor freedom of speech as analyzed by Michel Foucault. The recent concept\nof information ethics is related particularly to problems which arose\nin the last century with the development of computer technology and\nthe internet. A broader concept of information ethics as dealing\nwith the digital reconstruction of all possible phenomena leads to\nquestions relating to digital ontology. Following Heidegger{\textquoteright}s\nconception of the relation between ontology and metaphysics, (...) the\nauthor argues that ontology has to do with Being itself and not just\nwith the Being of beings which is the matter of metaphysics. The\nprimary aim of an ontological foundation of information ethics is\nto question the metaphysical ambitions of digital ontology understood\nas today{\textquoteright}s pervading understanding of Being. The\nauthor analyzes some challenges of digital technology, particularly\nwith regard to the moral status of digital agents. The author argues\nthat information ethics does not only deal with ethical questions\nrelating to the infosphere. This view is contrasted with arguments\npresented by Luciano Floridi on the foundation of information ethics\nas well as on the moral status of digital agents. It is argued that\na reductionist view of the human body as digital data overlooks the\nlimits of digital ontology and gives up one basis for ethical orientation.\nFinally issues related to the digital divide as well as to intercultural\naspects of information ethics are explored {\textendash} and long\nand short-term agendas for appropriate responses are presented. The neurosciences not only challenge assumptions about the mind’s place in the natural world but also urge us to reconsider its role in the normative world. Based on mind-brain dualism, the law affords only one-sided protection: it systematically protects bodies and brains, but only fragmentarily minds and mental states. The fundamental question, in what ways people may legitimately change mental states of others, is largely unexplored in legal thinking. With novel technologies to both intervene into minds and detect mental activity, (...) the law should, we suggest, introduce stand alone protection for the inner sphere of persons. We shall address some metaphysical questions concerning physical and mental harm and demonstrate gaps in current doctrines, especially in regard to manipulative interferences with decision-making processes. We then outline some reasons for the law to recognize a human right to mental liberty and propose elements of a novel criminal offence proscribing severe interventions into other minds. (shrink)

Nesse ensaio, vou analisar o que denomino de rupturas do Estado de Direito no caso do Brasil pós-2016. Meu objetivo não é examinar detalhadamente a concepção de Estado nos vários autores, mas utilizar alguns conceitos que nos permitam lançar luz sobre o que ocorreu no Brasil Inicialmente, vou apresentar a ideia do Estado de direito tal como Kant a define. A partir dessa concepção ampla, analisarei a ideia de estado de exceção, baseada em Agambem. Mostrarei igualmente a sugestão de Rafael (...) Valim de que vivemos no Brasil num período de vários estados de exceção, caracterizado por áreas do direito onde é mantida a normalidade e áreas onde não há respeito à Constituição. Num terceiro momento, tentarei identificar alguns momentos de ruptura do estado de direito brasileiro, com ênfase no processo ocorrido na UFSC, que levou o Reitor ao suicídio, e na prisão do Presidente Lula. Por fim, mostrarei que as rupturas do nosso estado de direito derivam, não de leis de exceção, mas da perversão dos processos legais com propósito político. (shrink)

El presente ensayo se fija como propósito precisar la crítica hegeliana del Derecho natural y del Derecho abstracto y determinar una doctrina propiamente hegeliana del Derecho. En este sentido, nuestra hipótesis es que es en el contexto de la doctrina de la Sittlichkeit,que el Derecho debe ser comprendido según Hegel. En efecto, en sus Lecciones sobre la filosofía de la historia, Hegel define la Sittlichkeit como un “orden de lo sustancial de suerte que todo sujeto singular tiene la universalidad por (...) propósito, por espíritu y por costumbre ética, y que es en y por este espíritu que él quiere, actúa, vive y goza, si bien que es su naturaleza, a saber su naturaleza segunda y espiritual”2. Luego para Hegel la normatividad jurídica debe ser comprendida al interior de este campo, en un sentido social más amplio de normatividad constituido por la praxis de una comunidad que configura un campo inmanente de objetividad que estructura cotidianamente la vida de los individuos. Lejos entonces de una separación de deber y ser, Hegel nos llama a comprender la forma cómo la norma está presente en el corazón del mundo de la vida como reconciliación de lo racional con lo real en la efectividad. The problem of act individuation is a debate about the identity conditions of human acts. The fundamental question about act individuation is: how do we distinguish between actions? Three views of act individuation have dominated the literature. First, Donald Davidson and G.E.M. Anscombe have argued that a number of different descriptions refer to a single act. Second, Alvin Goldman and Jaegwon Kim have argued that each description designates a distinct act. Finally, Irving Thalberg and Judith Jarvis Thomson have averred that (...) some acts are sequences of causally related events, which include both a primitive bodily action and some of its effects. All of these accounts have assumed that a simple invariantist account of act individuation captures how ordinary people distinguish between acts. For my dissertation, I devised an experiment to test the action theorists' assumptions. My data show that people's intuitions seem to depend on the valence of the consequences of the action under consideration. So, an invariantist account is not possible. In light of the empirical results, I argue that if we seek a folk account of act individuation, then that account should be able to explain the variability that seems to be present in people's intuitions about different cases. In this paper, I aim at explaining the difference Kant makes between emotion, the beautiful and the sublime. I begin by explaining what an emotion is, showing that it refers to feelings that are related to desire. In contrast, I show that the feeling of beautiful and the sublime give us an inactive delight, that is not related to an interest in the object. The feeling of beautiful is related to the judgment of taste, and it has a universal validity (...) for everyone. I ask then if we can judge art without any emotion at all. According to Kant, not only one can, but one should, since pure judgment of taste is independent from charm and commotion. At the end, I ask if it is possible to enjoy music without emotion. For a lover of music, perhaps the emotion it provokes is the main reason to like it. I show that this is probably the reason why music is considered to have the last place in the beautiful arts for Kant. (shrink)

The well-known Kantian passage on misology in the Foundations of the Metaphysics of Morals starts making fuller sense when located within the framework of Kant writings on philosophy of history where he contrasts civilization with moralization as two different phases in the growth of humankind. In this context, the growth of commerce and manufactures plays a distinctive role, namely that of means of fostering civilization, while pursuing a deceptive goal, namely happiness. Deception plays a basic role in the growth of (...) mankind, in so far as it allows for a hidden twofold teleology in human action. Men, while following the dictates of self-love, are systematically mistaken about the results they actually contribute in bringing about. Commerce brings different peoples into mutual relationship and thus paves the way to a cosmopolitan society. The growth of the arts and sciences provides preconditions for the growth of learned institutions, a free press, and a public opinion that are the basis on which reason may start being used in its critical capacities. This, that is Enlightenment, is a preliminary step to moralization, that is the jump of individuals from a state of minority to a state where they are masters of themselves. The twofold teleology of human action makes room for a system of "pragmatic" ends, and of laws connected to the former, that may be studied rationally in themselves and yet are connected to the higher ends established by reason in its "practical" capacities. In this chapter, I propose the mechanism of cognitive enhancement based on studies of cognitive-enhancing drugs and behavioral training. I argue that there are mechanistic differences between cognitive-enhancing drugs and behavioral training due to their different enhancing effects. I also suggest possible mechanisms for cognitive-enhancing drugs and behavioral training and for the synergistic effects of their simultaneous application.

Since its 1929 publication, philosophers have been more or less unsure what to make of Heidegger's Kant and the Problem of Metaphysics. Although it wielded more than its fair share of influence over the course of the twentieth century, its chief interpretive claims are mostly untenable today. Of course, it has always been recognized that the book was never intended as a straightforward piece of Kant interpretation. But neither does it appear to be a reliable presentation of Heidegger's own thought. (...) The result has been that, for all its influence, Heidegger's book has fallen into a kind of academic limbo, a concern for neither scholars of Heidegger nor scholars of Kant. My goal is to help return to Heidegger's reading of Kant its provocative power. I do so by means of a conceptual genesis of Heidegger's reading of Kant that takes both thinkers, as far as possible, on their own terms, but includes an investigation into why Heidegger was so convinced--for a few decisive years, at least--that he had to be able to find in Kant a precedent for his own path of thinking. El problema ético de la huelga de hambre ha dado cabida a soluciones contrapuestas, incluso en el contexto de teorías éticas que rechazan el suicidio. Algunos piensan que la sola honestidad del fin subjetivo basta para justificar la acción del huelguista. Otros, aunque son minoría, sostienen que la huelga de hambre es un acto reprobable per se, porque implica un atentado directo contra la vida o salud del sujeto. En este trabajo se defiende esta última interpretación. A juicio de los (...) autores, la huelga de hambre es un caso de suicidio intencional. Luego, nunca es lícito, bajo ningún aspecto, llevar adelante una acción de esta naturaleza. (shrink)
