Este trabajo explora el concepto moral kantiano de autonomía a partir de su entorno conceptual, resaltando las diferencias y similitudes con los conceptos de independencia personal y autenticidad. A la luz de la filosofía moral kantiana, autenticidad e independencia personal parecen ser ideales de vida próximos a la autonomía; sin embargo, a partir de un análisis más detallado se revelan como sus patologías. La autonomía kantiana se define más bien como la capacidad del animal humano de autolegislarse de acuerdo con (...) las mejores razones, siempre abiertas a la crítica y sin otro límite en la argumentación que el de la dignidad de las personas. Post-mortem reproduction is a complex and contested matter attracting attention from a diverse group of scholars and resulting in various responses from a range of countries. Vietnam has been reluctant to deal directly with this matter and has, accordingly, permitted post-mortem reproduction implicitly. First, by analysing Vietnam’s post-mortem reproduction cases, this paper reflects on the manner in which Vietnamese authorities have handled each case in the context of the contemporary legal framework, and it reveals the moral questions arising therefrom. The (...) article then offers an account of Vietnamese social norms as an explanation for the tendency to conduct post-mortem reproduction. In arguing that a deeper and more thorough examination of the moral and ethical reasoning is required, the paper advocates in favour of supportive post-mortem reproduction regulation. In doing so, the paper seeks to reconcile the Vietnamese legal framework and post-mortem reproduction experiences of other countries. The article concludes that Vietnam and countries sharing the similar cultural traits should permit post-mortem reproduction explicitly. This would require full engagement with the ethical and legal issues arising, and careful promulgation of regulations and guidelines based on comparative experiences of a range of countries in handling this matter. Im diesem Aufsatz nehme ich die Popularität des Verantwortungsbegriffs in der Alltagssprache zum Anlass, um seinem Verhältnis zum Pflichtbegriff auf den Grund zu gehen. Dabei unterziehe ich den Verantwortungsbegriff zunächst einer allgemeinen Analyse. Anschließend diskutiere ich in Gestalt von Indeterminismus, Amoralismus und Interaktionismus drei Modi der missbräuchlichen Verwendung dieses Begriffs. Dabei handelt es sich jedoch bei genauerer Betrachtung um allgemeine rhetorische Verschleierungsstrategien, die nicht an die Verwendung des Verantwortungsbegriffs gebunden sind, sondern in der kommunikativen Bezugnahme auf moralische Forderungen generell auftreten (...) können. Dies verdeutlicht auch die anschließende Analyse des Pflichtbegriffs, der einige grundlegende Ähnlichkeiten zum Verantwortungsbegriff aufweist. Ex negativo zeigt sich so jedoch, wie ein nicht missbräuchlicher Rekurs auf beide philosophischen Grundbegriffe möglich ist. Darüber hinaus werden auch die Unterschiede dieser Termini deutlich. Der Pflichtbegriff ist trotz einiger wesentlicher Gemeinsamkeiten weniger vielseitig als der Verantwortungsbegriff und daher zumindest in der Auseinandersetzung mit einigen Themen der praktischen Philosophie weniger gut als Grundbegriff geeignet. Gleichwohl zeigt sich, dass die Frage „Verantwortung oder Pflicht?“ uns vor eine falsche Alternative stellt, wenn sie im ausschließenden Sinn verstanden wird. (shrink)

Naturalism, as Binmore understands the term, is characterized by a scientific stance on moral behavior. Binmore claims that a naturalistic account of morality necessarily goes with the conviction “that only hypothetical imperatives make any sense”. In this paper it is argued that this claim is mistaken. First, as Hume’s theory of promising shows, naturalism in the sense of Binmore is very well compatible with acknowledging the importance of categorical imperatives in moral practice. Moreover, second, if Binmore’s own theory of moral (...) practice and its evolution is correct, then the actual moral practice does-and in fact must-incorporate norms, which have the form of a categorical imperative. Categorical imperatives are part of social reality and, therefore, any (normative) moral theory that adequately reflects moral practice must also include categorical imperatives. (shrink)

This essay argues that Rawls’s recent constructivist approach waivers between a relativist defense and a more Kantian account which grounds his conception of justice in the idea of an agreement between free and equal moral persons. It is suggested that this ambiguity lies at the center of his attempt to provide a “political not metaphysical” account which is also not “political in the wrong way”.

Die Simmel-Cassirer-Kontroverse behandelt den grundlegenden technikphilosophischen Gegensatz zwischen Kulturpessimismus und Kulturoptimismus. Diesen virtuellen Dialog beider Denker arbeitet Oliver Honer neu auf und entwickelt in einem aufsteigenden Reflexionsgang die Simmel'sche Rede von der »kulturellen Logik der Objekte« zum Begriff. Damit modelliert er das Verhältnis agierender Individuen zu ihren jeweiligen Möglichkeitsräumen und zeigt deren prekären Subjektstatus in diesen Räumen auf. Die dabei freigelegten Verhältnisse eröffnen angesichts technisch induzierter Eigenlogiken neue Wege einer dialektischen Kulturkritik.

According to many criteria, agency, intentionality, responsibility and freedom of decision, require conscious decisions. Freud already assumed that many of our decisions are influenced by dynamically unconscious motives or that we even perform unconscious actions based on completely unconscious considerations. Such actions might not be intentional, and perhaps not even actions in the narrow sense, we would not be responsible for them and freedom of decision would be missing. Recent psychological and neurophysiological research has added to this a number of (...) phenomena (the "new unconscious") in which behavior is completely unconscious or in which the decision or its execution is influenced by unconscious factors: priming, automatic behavior, habitualized behavior, actions based on plain unconscious deliberations, intrusion of information from the dorsal pathway, etc. However, since this makes up the largest part of the behavior which is generally regarded as action, intentionality, yet agency, responsibility and even compatibilist freedom of decision for the largest part of our behavior may be threatened. Such considerations have led to a lively debate, which, however, suffers from generalizations that lump all these unconscious phenomena together. In contrast, the aim of this article is to discuss individual unconscious influences on our behavior separately with respect to what extent they require changes in traditional conceptualizations. The first part (2-4) of the article outlines the "traditions" and their elaborations: the intentional causalist concept of action, an associated empirical theory of action and standard concepts of responsibility and compatibilist freedom of decision, as well as the challenges for them. In the second part (5-9), the aforementioned unconscious influences on our actions (except for automated and habitualized actions, which I discuss elsewhere) are examined: 1. unconscious priming, 2. dynamically unconscious motives, 3. dorsal pathway information influencing conscious decisions, 4. unconsciously altered execution of conscious intentions, 5. unconscious deliberations and decisions. To what extent do these phenomena C1. require a change in the concept of action, C2. curtail intentionality or agency, C3. responsibility and C4. freedom? The result is: The curtailments prove to be far less dramatic than they initially appear; they require more watchfulness but no conceptual change. (shrink)

Demokratien geraten zunehmend unter Druck. Dabei wird die Bedeutung von Demokratie selbst zum Gegenstand der Auseinandersetzung. Diese Auseinandersetzungen nimmt der vorliegende Band zum Anlass, die Bedeutung von Demokratie grundsätzlich zu untersuchen. Mit dem Begriff der Konstituenzien sind dabei jene wesentlichen Bedingungen gemeint, die Demokratie ausmachen. Die meisten dieser Bedingungen sind normativ. Was Demokratie ist, wird auch und gerade dadurch bestimmt, was Demokratie sein sollte. Damit geht es um jene Normen, deren Verwirklichung politische Praktiken zu demokratischen Praktiken macht. Sind diese Normen (...) nur eingeschränkt verwirklicht, mindert sich der demokratische Gehalt von Politik. Inwieweit ist dann nun aber eigentlich der Fall? Und was können wir dagegen tun? Don Ihde is one of the world's foremost thinkers on the place of technologies in our lives. Over the course of a long career, he has built a unique and useful perspective by expanding on phenomenological and American pragmatist philosophy and has developed wide-ranging insights and conceptual tools for describing the details of our experience across the various areas of human activity, including scientific practice, anthropological history, computer interface, design, art history, and the technologies of everyday life. The Critical Ihde (...) brings together many of Ihde's most influential writings, as well as a number of under-recognized gems. Across these works are examples of his influential contributions to the phenomenology of human auditory and visual experience, his foundational work on the phenomenology of technology, and his thoughts on the technologies of scientific practice, including laboratory and medical imaging. Further, these chapters reveal the development of "postphenomenology," Ihde's original philosophical perspective, one that continues to flourish today across the work of a growing interdisciplinary and international collective of scholars. Widmer sheds light on a neglected aspect of the Western philosophical tradition. Following an era of Hegelianism, the members of the neo-Kantian "Marburg School," such as Friedrich Albert Lange, Hermann Cohen, Rudolf Stammler, Paul Natorp, and Ernst Cassirer defended socialism or left-wing ideals on Kantian principles. In doing so, Widmer breaks with two mistaken assumptions. First, Widmer demonstrates that the left-Hegelian and Marxist traditions were not the only significant philosophical sources of socialist critique in nineteenth-century Germany, as the left-Kantians identified (...) problems of normativity that the left-Hegelians could not adequately address. Second, Widmer challenges the prevailing assumption that the political philosophies developed in the Marburg School can be comprehensively characterized as a unified school of "ethical socialism." By showing that they varied fundamentally regarding their political views and their philosophical foundations of socialism, Widmer fills a gap in the studies of neo-Kantianism that is long overdue. What is normativity? It is argued here that normativity is best understood as a property of certain concepts: normative thoughts are those involving these normative concepts; normative statements are statements that express normative thoughts; and normative facts are the facts (if such there be) that make such normative thoughts true. Many philosophers propose that there is a single basic normative concept—perhaps the concept of a reason for an action or attitude—in terms of which all other normative concepts can be defined. (...) It is argued here that this proposal faces grave difficulties. According to a better proposal, what these normative concepts have in common is that they have a distinctive sort of conceptual role—a reasoning-guiding conceptual role. This proposal is illustrated by a number of examples: different normative concepts differ from each other in virtue of their having different conceptual roles of this reasoning-guiding kind. Eine allgemeine Verzukünftigung unseres Weltbezuges mit spezifischen weitreichenden Problemen ist die Folge und lässt klassische Agenturen des Risikomanagements und der Unsicherheitsbewältigung an ihre Leistungsgrenzen stoßen. Bruno Gransche zeigt, dass Philosophie und Zukunftsforschung gemeinsam großes Potenzial aufweisen, hier zu helfen.

I argue that Kant took from Moses Mendelssohn the idea of a distinction between geometry of morals and a practical ethic. He was drastically misunderstood by his followers precisely on this point. He had learned from the sceptics and the Jansenists the lesson that men are prompted to act by deceptive ends, and he was aware that human actions are also empirical phenomena, where laws like the laws of Nature may be detected. His practical ethics made room for judgment as (...) a holistic procedure for assessing the salience of relevant moral qualities in one given situation; this procedure yields the same results as the geometry of morals does for abstract cases, but does so immediately and without balancing conflicting duties with each other, since what makes for the salient quality of a situation is perceived from the very beginning. In fact, however, the stuff is not gin but petrol. So if you drink the stuff (even mixed with tonic), it will be decidedly unpleasant, to say the least. Should you choose to drink the stuff or not?

Eso permite entender por qué los seres orgánicos son inexplicables mecánicamente y, de esta manera, justificar la necesidad de los juicios teleológicos sobre la naturaleza.

Do we need a new ethics? And if so: why? Just because Kant's Categorical Imperative (Cat. Imp.) seems to be no longer valid? Are there, nevertheless, values that survive the so-called "decay of values"? And if there are limits of ethics, e.g. in system conditions, one can ask if new legit requests are to be made. Or can ethics even be absorbed (or "abolished") in anthropology and philosophy of history?

In this book some options concerning the greenhouse effect are assessed from a welfarist point of view: business as usual, stabilization of greenhouse gas emissions and reduction by 25% and by 60%. Up to today only economic analyses of such options are available, which monetize welfare losses. Because this is found to be wanting from a moral point of view, the present study welfarizes (among others) monetary losses on the basis of a hedonistic utilitarianism and other, justice incorporating, welfare ethics. (...) For these welfarist evaluations information about the social consequences of the four options are collected from the literature and eventually corrected; then the consequences for individual well-being are assessed based on psychological research about well-being dependent on the social situation of the individual; finally the aggregation formulas of the respective welfare ethics are applied to these data. Assessments by other types of ethics, e.g. Kantian ethic, are included. The strongest abatement option is found to be optimum with great unanimity. - In addition a cost-welfare analysis of greenhouse gas abatement is undertaken revealing efficient cost-welfare ratios for these measures and the most efficient ratio for the strongest option. - A final, more theoretical part discusses the moral obligations following from such evaluations. The notion of 'moral obligation' is explained in a way that, apart from moral goodness of the required act, reinforcement by formal or informal sanctions is another necessary condition for moral obligations. This leads to a conception of a historical morality according to which the demands of morality rise in the long run. Applying this conception to the greenhouse effect implies that presently we have the moral duty to raise the standards of greenhouse gas abatement as much as is politically feasible. (shrink)

Opvallend is echter dat filosofen, wanneer ze toch aandacht schenken aan muziek, hun aandacht bij voorkeur op één bepaald genre richten, namelijk de opera. Filosofen zoals Søren Kierkegaard en Friedrich Nietzsche lieten hun gedachten over Don Giovanni, Parsifal en Carmen gaan, terwijl omgekeerd de filosofie van Arthur Schopenhauer de opera heeft beïnvloed via Wagner. Diens werk lijkt zich op het snijpunt van het grensverkeer tussen moderne filosofie en moderne muziek te bevinden. Het was zijn (...) ambitie de menselijke existentie en de menselijke geschiedenis in één panoramisch oeuvre te vatten, vanaf het primordiale begin tot en met de dramatische finale die ophanden leek: een catastrofale apotheose die een geheel nieuwe toekomst mogelijk zou maken. Dat is althans de verhaallijn van zijn meesterwerk Der Ring des Nibelungen. Aan het slot van Götterdämmerung lijkt zich een algehele verwoesting te hebben voltrokken: ‘Everything is destroyed and there is an enigmatic kind of hovering over the scene of destruction’ (Badiou 2010, p. 106), een ambivalente stemming van hoop en destructie zette Wagner op muziek. Voor Wagner is dan ook een hoofdrol in deze studie weggelegd: voor zijn muziektheoretische geschriften (waarin hij over een ‘muziek van de toekomst’ filosofeerde), maar meer nog voor de muzikale totaalkunstwerken die hij daadwerkelijk componeerde. This book has two objectives: to be a contribution to the understanding of Frege's theory of truth – especially a defence of his notorious critique of the correspondence theory - and to be an introduction to the practice of interpreting philosophical texts.

One interesting aspect of the Hwang-case has been the way in which this affair was assessed by academic journals such as Nature. Initially, Hwang’s success was regarded as evidence for the detrimental effects of research ethics, slowing down the pace of research in Western countries. Eventually, however, Hwang’s debacle was seen as evidence for the importance of ethics in the life sciences. Ironically, it was concluded that the West maintains its prominence in science (as a global endeavour) precisely because it (...) has its ethics in place. Bioethics was now seen as an indispensable part of quality control. In this article, I will claim that the Hwang case rather reveals that there is no reason for complacency and that there are substantial challenges awaiting us. They have to do with major transformations in the way knowledge is produced and research in the life sciences is conducted (such as the increase in pace and scale, globalisation and the growing importance of ICT and bioinformation). These transformations call for a different kind of bioethics. The focus must shift from duties of autonomous researchers concerning visible research subjects (“micro-ethics”) to responsibilities of institutionalised research networks in managing and processing large amounts of bioinformation (“macro-ethics”). Concepts such as transparency, reliability and benefit-sharing will become more important than concepts such as informed consent. Basically, it is a resurgence of the tension between the Kantian and the Hegelian view of ethics. The contours of macro-ethics will be elaborated notably as it is emerging in bioethical debates over biobanking and genetic databanks. (shrink)

Based on the dispute between Protagoras and Socrates on the origin of ethics, one can ask the question of whether the principle of ethics is reason orfeeling/emotion, or whether ethics is grounded on reason or feeling/emotion. The development of Kant’s thoughts on ethics shows the tension between reason and feeling/emotion. In Kant’s final critical ethics, he held to a principle of “rational a priori.” On the one hand, this is presented as the rational a priori principle being the binding principle (...) of judgment. On the other hand, it is presented as the doctrine of “rational fact” as the ultimate argument of his ethics. Husserl believed that Kant’s doctrine of a rational a priori totally disregarded the a priori essential laws of feeling. Like Husserl, Scheler criticized Kant’s doctrine of a rational a priori, and therefore developed his own theory of an “emotional a priori”. Both of them focused their critiques on the grounding level of ethics. Scheler, however, did not follow Husserl all the way, but criticized him and reflected on his thoughts. At last, he revealed the primary status of a phenomenological material ethics of value. (shrink)

This paper is concerned with the competing and complimentary relationships between intersubjectivity and discursive logic. It contends that the ultimate failure of Husserlian phenomenology is a testament to the dilemma of subjectivist philosophy. Indeed, political philosophy requires a paradigm-shift from subjectivity to intersubjectivity. With this in mind, this paper examines the classical encounter between morality and ethical life in connection with discursive ethics. While it argues that Habermas still retains a strong residue of subjectivist philosophy, it attempts to clarify the (...) discursive analysis of Foucault and probes into its applicability to practical philosophy. I offer a reconstruction of J. Margolis’ article on the question of the meaning and place of religion in our time proposing that one of its main subjects is the question of religious tolerance. I hint at the possible gains of a religiously less attenuated picture of religious belief than that which Margolis paints.

The aim of this paper is to investigate whether or not ethical conflicts can be identified, analysed and solved using ethical principles. The relation between the physician and the patient with ischemic heart disease (IHD) as life style changes are recommended in a secondary prevention program is used as an example. The principal persons affected (the patient and his or her spouse) and the ethical principles (respect for autonomy, non-maleficence, beneficence and justice) are combined in a two dimensional model. The (...) most important person affected by the recommendations is the patient. His or her autonomy is challenged by the suggested life style changes, the purpose of which is to promote the future wellbeing and health of the patient. The spouse is indirectly involved in and affected by the process. He or she often feels neglected by caregivers. Ethical conflicts can both be identified and analysed using ethical principles, but often no solution is implied. Most (if not all) physicians would strongly encourage life style changes, but surprisingly there is no uncontroversial justification for this conclusion using principles. (shrink)

This article investigates the deep-rooted logical structures underlying our thinking about other animals with a particular focus on topics relevant for cognitive primate research. We begin with a philosophical propaedeutic that makes perspicuous how we are to differentiate ontological from epistemological considerations regarding primates, while also accounting for the many perplexities that will undoubtedly be encountered upon applying this difference to concrete phenomena. Following this, we give an account of what is to be understood by the assertion of a thesis (...) of anthropological difference, identifying, inter alia, a property that fulfils the exclusivity, universality, and constitution criteria and demarcates the differentia specifica between humans and other animals. Also, we systematically develop how such theses can be formulated more moderately. Furthermore, we account for different theoretical frameworks, argumentative schemes, and sociological factors whose employment is associated with theses as such. This endeavor is carried out under the guise of anthropomorphism and anthropodenial. Doing so, we show that both are favored by the logic of cognitive primate research. Put briefly, concepts like cladistic parsimony and arguments by analogy favor anthropomorphism whereas concepts like traditional parsimony and Morgan’s canon favor anthropodenial. We close by framing these topics in the light of the self-other category mistake that lies in ascribing exclusive self-properties to some other. Lastly, we probe this category mistake for potency and scope of implications and find it to be central to and unavoidably ingrained in our thinking about other animals. (shrink)

In this paper, I explore how to accommodate non-consequentialist constraints with a broadly value-based conception of reasons for action. It turns out that there are two grades of non-consequentialist constraints. The first grade involves attaching ethical importance to such distinctions as the doing/allowing distinction, and the distinction between intended and unintended consequences that is central to the Doctrine of Double Effect. However, at least within the value-based framework, this first grade is insufficient to explain rights, which ground weighty reasons against (...) infringing those rights that need not be outweighed even when infringing those rights is necessary for preventing a larger number of people from having their rights infringed in the same way. Such rights form a second grade of non-consequentialist constraints: within the value-based framework, this second grade is best explained in terms of the intrinsically relational values and disvalues of interpersonal interactions and relationships. . Gustav Radbruch is one of the most important German-speaking philosophers of law of the twentieth century. This paper raises the question of how to classify Radbruch's theories in the international context of legal philosophy and philosophy in general. Radbruch's work was mainly influenced by the southwest German school of Neo-Kantianism, represented by Windelband, Rickert, and Lask. Their theories of culture and value show an affirmative-holistic understanding of philosophy as a source of wisdom and meaningfulness. English title: Kant and the Right to Vote The article is a contribution to the ongoing debate in NFT about the moral responsibility of voters. Kristian Skagen Ekeli has argued that politically ignorant citizens have a duty to abstain from voting. He argues that such a duty fol- lows from Kant’s duty to respect other persons. I analyze Ekeli’s proposed duties by considering how they might fit into Kant’s system of duties. I conclude, contra Ekeli, that the Kantian duty to (...) respect persons does not give rise to a duty for politically ignorant voters to abstain from voting. -/- Denne artikkelen er et bidrag til debatten om velgeres moralske ansvar. Kristian Skagen Ekeli har i to artikler argu- mentert for at uvitende borgere har en plikt til ikke å stemme, noe han begrunner ut fra en kantiansk pliktetikk. Det er imidlertid uklart hvordan en uvitende borgers plikt til å avstå fra å stemme skulle følge av Kants plikt til å respek- tere personer, noe Cornelius og Herman Cappelen kort antyder i sin kommentar til Ekeli. I denne artikkelen foretar jeg en analyse av de pliktene som Ekeli tar til orde for, og undersøker hvordan disse eventuelt kunne passe inn i Kants system av plikttyper. Tomando como ponto de partida a discussão sobre a coerção em Kant e Schelling, tenho a intenção de explicar como eles provam a possibilidade da liberdade em conexão com a coerção. Comparando ambas teorias da liberdade e da coerção,. duas formas diferentes de conceber o Direito e a Moralidade serão identificadas.De acordo com Kant, as leis jurídicas são leis morais ou leis da liberdade, de · tal forma que há uma mediação entre Direito e Moralidade. Schelling se opõe radicalmente ao (...) pensamento de Kant. O Direito tem seus próprios princípios de conhecimento e ele não depende de imperativos morais. Por um lado, esta oposição caracteriza uma controvérsia dentro do próprio Idealismo alemão, entre Hegel, que concorda com a tese kantiana, e Fichte, que segue a concepção schellinguiana. Por outro lado, esta discussão não está limitada à filosofia kantiana ou ao Idealismo alemão. Lançando mão do legado kantiano, Habermas crítica a interpretação weberiana do poder legítimo nas sociedades ocidentais modernas. De acordo com Weber, o poder nestas sociedades está baseado na racionalidade interna e formal do Direito. Ao contrário, Habermas tem a intenção de mostrar que a ideia do estado democrático deve sua legitimidade à ligação entre Direito e Moral. (shrink)

Can the theory of conceptual spaces developed by Peter Gärdenfors and others be applied to moral issues? Martin Peterson argues that several moral principles can be construed as regions in a shared similarity space, but Kristin Shrader-Frechette and Gert-Jan Lokhorst question Peterson’s claim. They argue that the moral similarity judgments used to construct the space are underspecified and subjective. In this paper, we present new data indicating that moral principles can indeed be construed as regions in a multidimensional conceptual space (...) on the basis of moral similarity judgments. Four hundred and seventy-five students taking a course in engineering ethics completed a survey in which they were presented with ten cases featuring ethical issues related to technology and engineering. Participants were asked to judge the moral similarity of each pair of cases and to select which moral principle they believed should be applied for resolving the case. We used interval multidimensional scaling as well as individual differences scaling for analyzing the moral similarity judgments. Despite noteworthy individual variations in the judgments, the five moral principles included in the study were discernable in the aggregate multidimensional spaces, even for participants with no previous exposure to the principles. Participants tended to apply the same moral principles to cases rated as morally similar. Our overall conclusion is that moral similarity judgments, and their representation in multidimensional spaces, can help us identify moral principles that are relevant for assessing difficult moral choice situations. Aesthics: Art and moral attuning. Art can help us understand everyday moral deliberation. Better perhaps than ethics. People don’t just act randomly in moral situations nor do they argue internally about which ethical principle to follow before deciding what to do. We built our moral sensitivity whilst living our lives, adhering to aesthetic norms of interaction. Regular engagement with works of art educates our moral sensitivity.

Husserl develops his reflection on ethics mainly in his lecture courses. These lectures can be divided into two parts, according to a principle that is both chronological and pertaining to content, and following thus the respective editions in the Gesammelte Werke.1 The common aspect of the two different phases of Husserl’s research can be detected in the critical confrontation with Kant’s practical philosophy, starting with the question concerning the formality.

A human right to freedom of religion is not equivalent to a right to tolerance. Human rights and tolerance-rules serve for different purposes and are based on different justifications. Tolerance-rules serve to protect a peaceful living together with strangers who share no common values. Human rights serve to protect every individual’s personhood. Religion can only be a matter of human rights, if and so far as it is a condition of development and maintenance of personhood. Discussion about a human right (...) to freedom of religion makes sense only if we can identify a particular scope of protection which concerns only religion and if the freedom of religion is not embraced by wider-framed freedoms. The freedom of religious thoughts and the freedom of religious speech are embraced by the general human rights to freedom of thoughts and freedom of speech. Here, there is no need for a special human right to freedom of religion. The right not to be forced to act contrary to religiously founded moral rules is embraced by the general human right to freedom of conscience. And again, there is no need for a special human right. The target of religious practices in a narrower sense is to become flexible and porous and not to resist the threats of the sacral in order to avoid the destruction of personhood. Therefore, we have to recognize a human right to freedom of religious rites. It protects only the actions of accommodation to the overwhelming power of the sacral. It does not protect, however, any action with which it is intended to rule the world or to rule over others, to organize certain practical challenges, or to discover or to maintain scientific theories or technical means. Informed by a search of the literature about the usage of genetic testing information (GTI) by insurance companies, this paper presents a practical ethical analysis of several distinct public policy options that might be used to govern or constrain GTI usage by insurance providers. As medical research advances and the extension to the Human Genome Project (2016, https://en.wikipedia.org/wiki/human_genome_project_-_write) moves to its fullness over the next decade, such research efforts will allow the full synthesis of human DNA to be connected to (...) predictive health dispositions. As testing costs fall, there will be ever more pressure for citizens to disclose GTI. Genetic testing information is integral to future medical care because it can be used to better assess individually tailored medical therapies as well as to allow a more informed risk analysis by the insurance industry, which in some countries such as the USA underwrites a majority of citizen medical expenses. As discussed in this examination, the revelation of people’s uniquely personal GTI to insurers has enormous societal implications. The major contribution of the paper is to offer policy makers and concerned citizens a nuanced articulation of the basic options to regulate GTI, with a special consideration for ethical fairness and equity. As genetic-based medicine blossoms and pressures to reduce healthcare costs increase, there will be an ever greater impetus for countries to revisit their genetic testing policies. Organizations and policy makers striving to create GTI oversights perceived to be both “fair and effective” need to be aware of the ethical perspectives discussed in this paper. (shrink)

We investigate how social comparison processes in leader treatment quality impact group members’ self-worth, affect, and behavior. Evidences from the field and the laboratory suggest that employees who are treated kinder and more considerate than their fellow group members experience more self-worth and positive affect. Moreover, the greater positive self-implications of preferentially treated group members motivate them more strongly to comply with norms and to engage in tasks that benefit the group. These findings suggest that leaders face an ethical trade-off (...) between satisfying the moral standard of treating everybody equally well and satisfying individual group members’ desire to be treated better than others. This paper seeks to contribute to the literature on political judgment by proposing that the faculty of judgment is essential for responsibly coping with the undeniable fact of distant suffering and the controversial duty of humanitarian intervention. To achieve this end, Mahmood Mamdani’s text ‘The Politics of Naming: Genocide, Civil War, Insurgency’ will be mobilized for a constructive dialogue about which specific conception of political judgment is at stake when we debate a situation like Darfur today. The main claim is (...) that political judgment in times of acute crisis requires the members of the public sphere to strike a precarious balance between two contradictory impulses: the deliberative impulse to enlarge the pool of particular standpoints, and the decisionist impulse to finally bring the conversation to a halt and adopt a normative stance. The theoretical framework for this balanced view of the faculty of judgment will be articulated through a hybridization of Hannah Arendt’s notion of an ‘enlarged mentality’ and Jacques Derrida’s concept of an ‘aporetic decision’. What will become of Rousseau when read in a non-transcendent way, as a line of some of the most prominent contemporary theorists of the philosophy of education would suggest as inevitable? To answer this question, the position and analytical tools of Jacques Derrida are clarified, and Rousseau’s “Émile ou De l’éducation” is read non-transcendentally, which implies a challenge and a deconstruction of the way Rousseau has built the argument for his educational project. The article concludes with a critical discussion of (...) its own method, and challenges the asserted unavoidability of the deconstructive readings of Rousseau’s text. (shrink)
