Автор статті виходить з того, що філософія Томаса Гоббса не втрачає своєї актуальності. Саме життя за доби «вірусократії», боротьби як за безпеку, так і за свободу, потребує відповідей на питання про співвідношення прав, свободи, страху, безпеки, тобто тих проблем, до яких постійно звертався Томас Гоббс. Означені аспекти філософської спадщини Гоббса стануть предметом даної статі та поглиблять роздуми вітчизняних дослідників про сенс ідеї суспільного угоди Гоббса та закладених в ній ще малодосліджених алгоритмів формування справедливої правової держави. Адже саме з політичної філософії (...) Гоббса розпочинається притаманне модерній політичній філософії та філософії права глибинне зрушення в розумінні природи людини та її свободи. Запропонована Гоббсом політична антропологія виходить з тези про природну рівність людей, а також з прагнення обґрунтувати необхідність усвідомлення індивідом обмеження власного егоїзму та свободи заради колективної волі інших громадян. Йдеться також про актуальність для сучасної філософії та нашого вітчизняного простору розробленого Гоббсом принципу суспільної угоди як нового суспільного принципу регуляції людського буття, який став втіленням істотного переходу від телеологічних до правових уявлень про людину, її свободу та справедливість. У політичній філософії Т. Гоббса було розроблено ідею про внутрішню непокору, свободу совісті як «права людини і громадянина», про те, що державна влада мусить визнавати, а не просто дозволяти персональну незалежність своїх громадян, їх права діяти на власний розсуд. Проте для подальшого розвитку цієї ідеї потрібно було вийти за межі філософії Т. Гоббса, що й судилося зробити Ж.-Ж. Руссо. (shrink)

Tyrimu keliami klausimai, kokiu būdu tokio pobūdžio (...) atsiminimų visuma kuria įvairialypį atminties turinį ir ar turi galimybių tapti atminties kultūros dalimi. This article considers a central ethically relevant interpersonal emotion, guilt. It is argued that guilt, as an irreducible moral category, has a constitutive role to play in our ways of conceptualizing our relations to other people. Without experiencing guilt, or being able to do so, we would not be capable of employing the moral concepts and judgments we do employ. Elaborating on this argument, the paper deals with what may be described as the "metaphysics of guilt." More generally, it is (...) suggested, through a case study on the concept of guilt, that a moral theory avoiding naïve emotivism yet emphasizing the role of emotions in morality can and should pay attention to the transcendental status of emotions such as guilt--emotions constitutive of our concept of moral seriousness. Instead of psychologizing moral emotions, the paper employs Raimond Gaita's Wittgenstein-inspired way of examining the place of the concepts of guilt and remorse in our ethical language-use. Finally, some methodological remarks on the possibility of transcendental reflection in moral philosophy are presented. While it is not necessary to commit oneself to any specific religious tradition in order to emphasize the constitutive role of guilt in the way suggested in the paper, it turns out that the moral depth of this concept requires that one is least open to religiously relevant ways of using moral language. In the fundamental metaphysical sense examined in the paper, guilt is a concept whose home language-game is religious rather than secular ethics. (shrink)

The Article focuses on the concept of social solidarity, as it is used in the Report of the International Bioethics Committee On Social Responsibility and Health. It is argued that solidarity plays a major role in supporting the whole framework of social responsibility, as presented by the IBC. Moreover, solidarity is not limited to members of particular groups, but potentially extended to all human beings on the basis of their inherent dignity; this sense of human solidarity is a necessary presupposition (...) for a genuinely universalistic morality of justice and human rights. Political theorists tend to dismiss the concept of constitutional patriotism for two main reasons. On the one hand, constitutional patriotism — understood as a post-national, universalist form of democratic political allegiance — is rejected on account of its abstract quality. On the otherhand, it is argued that constitutional patriotism, while apprearing universalist, is in fact particular through and through. According to this genealogical critique, it is held that constitutional patriotism might have been appropriate in the context when it originated — (...) namely West Germany, a half-nation with a deeply compromised sense of nationality on account of the Nazi past — but it is not universally applicable. This article reconstructs the origins of constitutional patriotism arguing that both the ‘protective’ and state-centred patriotism of Dolf Sternberger, and the ‘purifying’ patriotism of Jurgen Habermas — focused mainly on the public sphere — can indeed be understood as relying on ‘supplements of particularily’. However, there are also normative connections between universalist constitutional morality and militant democracy on the one hand, and universalist constitutionalist morality and an imperative to remember on the other. Thus, the genealogical critique by itself is insufficient to invalidate the idea of constitutional patriotism. (shrink)

Résumé Après la fin de la Seconde guerre mondiale, un débat s’est instauré autour de la question du temps mémoriel qui lie passé et présent. Avec le statut historique acquis par la mémoire collective, une contradiction apparaît alors entre une mémoire multiple et une histoire univoque qui a suscité la défiance d’historiens. Ils optent pour « une histoire critique de la mémoire » et scrutent les « filtres des expériences vécues ». Après une décennie de refoulement du passé, une rupture (...) s’opère au début des années 1960. À la question d’une « histoire critique de la mémoire » des années trente, du IIIe Reich et de ses crimes, les historiens répondent par des théories des fascismes et des analyses de la fin de la République de Weimar. À la fin des années 1970 – alors qu’apparaît le terme Holocauste – le débat sur le temps mémoriel prend en compte la thématique victimes-bourreaux. S’ouvre dès lors en Allemagne de l’Ouest des lieux de mémoire locaux ou régionaux, des itinéraires mémoriels inscrits dans le pavé des villes avec mention nominative des victimes et des « acteurs » directs de l’époque. De vives polémiques apparaissent. Le travail de mémoire reste alors pour l’historien un travail critique qui doit intégrer dans la remémoration volontaire du passé l’interrogation du futur. (shrink)
