Is it possible to justify territorial rights? Provided a justification for territorial rights can be found, does it ground claims toparticularterritories? And provided a claim to particular territories can be justified, what kind of claim is it? Is it a claim to jurisdiction? A claim to control resources? A claim to control the movement of people across borders? In this paper I review some prominent accounts seeking to answer these questions. The article examines the role of apology in a process of reconciling with historic injustice. As with so many other facets of the politics of reconciliation, official apologies are controversial, at times strenuously resisted, and their purpose and significance not always well understood. The article, therefore, seeks to articulate the key moral and practical resources that official apologies can bring to bear in a process of national reconciliation and to defend these symbolic acts against some of the more influential criticisms (...) from the skeptics. The analysis is developed in relation to apologies offered in the context of state-indigenous reconciliation processes in the Americas, Australasia, and other regions of the globe. (shrink)

A serious problem confronting discourses on recognition is that of showing equal respect for citizens’ diverse cultural identities whilst at the same time attending to feminist concerns. This article focuses on the complex issues emerging from the recent legislation prohibiting the Muslim veil in French state schools. I respond to these problems by defending two conditions of a postcolonial and feminist approach to the politics of recognition. This approach should be, first, transformative, in the sense of widening its conception of (...) core values through an engagement with cultural difference. Second, it should be critical in its orientation to practices affecting women adversely within any social group. An integration of these concerns is proposed in terms of ‘affective citizenship’. This approach supports the different components of women’s autonomous functioning, through a universalistic commitment to the creative expression of their hybrid identities. (shrink)

Despite the amount of public investment in nanotechnology ventures in the developed world, research shows that there is little public awareness about nanotechnology, and public knowledge is very limited. This is concerning given that nanotechnology has been heralded as ‘revolutionising’ the way we live. In this paper, we articulate why public engagement in debates about nanotechnology is important, drawing on literature on public engagement and science policy debate and deliberation about public policy development. We also explore the significance of timing (...) in engaging the public, and we make some suggestions concerning how to effectively engage publics. Our conclusions indicate the significance of scientific researchers, policy makers and representative consumer groupings in public reasoning towards a better public policy framework for debate about technological development. In South Africa, the notion of an African Philosophy of Education emerged with the advent of post-apartheid education and the call for an educational philosophy that would reflect this renewal, a focus on Africa and its cultures, identities and values, and the new imperatives for education in a postcolonial and post-apartheid era. The idea of an African Philosophy of Education has been much debated in South Africa. Not only its content and purpose but also its very possibility have been, and (...) continue to be, the subject of understandably passionate exchanges. In this paper, after discussing some of the constitutive features of African Philosophy of Education, we indicate aspects with which we are sympathetic. Our central question is whether African Philosophy of Education is the revisioned, ‘typically African’ philosophy of education that it is claimed to be. We argue that it has revealed certain tendencies that are remarkably similar to characteristics of Fundamental Pedagogics, the repressive doctrine complicit in apartheid education that it claims to replace. More substantially still, African Philosophy of Education, by labeling itself uniquely and distinctly ‘African’, runs the risk of insulating itself not only from interaction with the wider world but also from any critical interrogation. Indigenous conservation through patrimonialization is the product of political and legal decisions made by a non-indigenous agent: the liberal state, using the law to retain a form of bios. We propose that patrimonialization is the device by which liberal states have processed and integrated indigenous claims into a form of bios ultimately designed to safeguard state legal structures. We argue that, to uphold the rule of law in contexts (...) of struggle and resistance that challenge the very understanding of the law, states respond by wielding the law in the form of the rule by law, that is, pushing the law to the limit to give normative content to the criteria by which the state conducts its affairs, without straying from the individual rights framework. We hold that the rule by law is an operation that defines the patrimonialization of indigenous peoples. It increases their visibility while imposing limits on political action to keep them from becoming sui juris subjects capable of breaching the distinction between zoe and bios. In this article, we try to understand the political–ideological intent of these decisions, the intentions beyond the letter of the law of patrimonialized peoples. (shrink)

A crucial imperative for decolonial praxis in the liberal settler colony is to radically delegitimise the prevailing social order. This is regarded as necessary to achieving genuinely decolonial forms of social transformation rather than merely the ongoing modification of colonial rule. I propose here, however, that such objectives depend not simply on delegitimising the colonial regime as such, but also on finding ways to expose and challenge its resources of legitimating power, that is, the capacity to shape and reshape perceptions (...) of legitimacy in the public sphere, and thus render legitimacy a moving rather than static target for opponents. I explore, here, the potential for a basic democratic grammar of contestation to be utilised in this task. The promise of such a grammar lies in its permanent availability to problematise rule arranging powers in the public sphere, and thus work to expose their unjustified nature. It also carries a threat, however, in that its public activation always arouses a broader array of normative forces, some aspects of which might oppose or undermine decolonial objectives. Whilst the democratic grammar holds promise for challenging liberal legitimating power, then, it must also be treated with caution from a decolonial perspective. (shrink)

Zusammenfassung: Die Passage über das Mittelmeer ist in den letzten Jahren zu einer der tödlichsten Migrationsrouten der Welt geworden. Während die Mitgliedsstaaten der Europäischen Union gegen die sogenannte „Flüchtlingskrise“ eine militärische und diskursive Fluchtabwehrpolitik betreiben und die Seenotrettung geflüchteter Menschen aussetzen und kriminalisieren, begreifen normative politische Theorien der Migration Fluchtbewegungen als ein politisches oder moralisches Problem sowie als Krise für etablierte Demokratien. Gegen den Topos der „Flüchtlingskrise“ und die implizite Normalisierung von Grenzen in einem Großteil gegenwärtiger politiktheoretischer Debatten zu Migration (...) und Flucht entwickelt der vorliegende Beitrag eine politische Theorie der Grenze aus der Perspektive postkolonialer und Schwarzer kritischer Theorie. Dazu werden zunächst Kolonialität und Rasse als bislang vernachlässigte analytische Kategorien in die politische Theorie eingeführt, um die koloniale Gegenwart von Grenzregimen und die Rassifizierung von Grenzen zu rekonstruieren. Im Rückgriff auf die Figur des Schwarzen Mittelmeers, die aus der radikalen Schwarzen Tradition stammt und im Kontext gegenwärtiger Migrationsrouten von Afrika nach Europa aktualisiert wird, wird sodann ein alternatives Register für eine politische Theorie der Grenze entwickelt: Erstens wird das europäische Grenzregime als eine rassistische Politik der Vergrenzung verstanden; zweitens werden die postkolonialen Ambivalenzen und rassifizierten Dimensionen einer Politik der Solidarität mit geflüchteten Menschen problematisiert; drittens werden Fluchtbewegungen als widerständige politische Imaginationen und Praktiken nachgezeichnet, die die Widersprüche hegemonialer Konzeptionen von Demokratie und Zugehörigkeit aufzeigen. Abschließend wird die Epistemologie des Schwarzen Mittelmeers für eine Kritik des dominanten Krisennarrativs der Demokratie und für eine selbstreflexive Auseinandersetzung mit den kognitiven Grenzen der politischen Theorie selbst produktiv gemacht. ABSTRACT In establishing National Bioethics Organisations (NBOs), liberal democracies seek to acknowledge the diversity of strongly held ethical positions and the imperative to engage in public debate about important bioethical decisions. NBOs are typically given a range of responsibilities, including contributing to and stimulating public debate; providing expert opinion on relevant issues for policy deliberations; and developing public policy. The state is now found to have an interest in areas previously thought to be a matter of individual choice. NBOs can (...) provide one way of opening up public debate to allow the diversity of views to be heard in a manner that is well‐informed, articulate and responsive to both expert and ‘lay’ public views. We draw on debates in political theory about democratic decision‐making and on the policy making roles of some key NBOs. We are particularly interested in examining the capacity of NBOs to meet the democratic ideal of effective participation by the public, or citizenry, especially by those who are directly affected by the policies, in the development of effective public policy. We provide a basic framework for policy development involving NBOs that can begin to meet this ideal, a process of ‘contested deliberation’. (shrink)
