In this paper1 i intend to elucidate a thesis that lies at the heart of Fichte’s theory of rights. This thesis states that rights are the essential foundation of rational political order not only because they govern relations among human beings but also because they help them to realize themselves as free agents. J. G. Fichte held that a form of intersubjectivity—what he called a ‘summons’—is a condition of possibility of self-consciousness. This thesis is widely taken to be one of Fichte’s most influential contributions to the European philosophy of the last two centuries. But what the thesis actually states is far from obvious; and existing interpretations either are poorly supported by the texts or else render the thesis trivial or implausible. Während Nietzsche in der Debatte um Anerkennung bisher vorwiegend in Bezug zur Verkennungslinie interpretiert wird, geht es in dem Beitrag dagegen um die Abgrenzung Nietzsches zu dieser vorwiegend französisch geprägten Verkennungslinie. Dies soll an der sozialen Praktik der Scham als distinktes Beispiel für eine konkrete Situation von Anerkennungsbeziehungen im Lebenszusammenhang gezeigt werden. Für die Verkennungslinie wird exemplarisch Jean Paul-Sartres Verständnis von Scham aus Das Sein und das Nichts als Anerkennungsbeziehung herangezogen. Dazu kontrastierend soll auf Nietzsches Beschreibung des „Scham-Ersparens“ als konkrete (...) Form von Anerkennungsverhältnissen eingegangen werden. Hierbei geht es Nietzsche um eine grundsätzliche Fragilität, durch die das Anerkennungsgeschehen stets in eine Form von Verletzung und Verkennung umzuschlagen droht. Dabei soll gezeigt werden, dass Nietzsche nicht Sartres Weg einschlägt, in dem der Andere sein Gegenüber immer schon durch seinen Blick verdinglicht und dadurch die Freiheit des Anderen verunmöglicht. Wie schwierig die Umsetzung im konkreten Fall bei Nietzsche auch sein mag, so gesteht Nietzsche ihr dennoch grundlegend eine gelingende Möglichkeit im ‚Scham-Ersparen’ zu, oder anders gewendet: Es geht Nietzsche um ein Anerkennen im Angesicht der wechselseitigen Verletzlichkeit. In his critical and his later work, Kant recommends apathy to the moral agent faced with pathological phenomena. Notoriously, Kant even rejects compassion (Mitleiden) as pathological. A deconstruction of Kant's 'apathology', i.e. of his systematic treatment of compassion, reveals disgust as quasi-transcendental affect at the roots of the moral agent's apathy.

resumo O artigo pretende revisitar a interpretação hegeliana dos Fundamentos do Direito Natural de Fichte, não propriamente seus elementos críticos, presentes na Differenzschrift e no Naturrechtaufsatz, mas antes a possibilidade de uma assimilação positiva. Em primeiro lugar, oferecemos uma interpretação da passagem entre os §3 e §4 da obra de Fichte, entre a discussão da Aufforderung e a dedução do reconhecimento jurídico, que procura articulála como interface entre educação e direito. Na segunda parte, procuramos revelar o pano de fundo “histórico-espiritual” (...) que permite considerar, no jovem Hegel, um embate entre formas inclusivas e excludentes de intersubjetividade. Na terceira parte, o objetivo é considerar a relação entre a eticidade, enquanto Einssein do universal e do singular, o direito e a educação. Finalmente, pretende-se mostrar que a assimilação positiva de Fichte por Hegel pode ser visualizada na articulação entre formas excludente e participativa de intersubjetividade no conceito de eticidade natural do System der Sittlichkeit, a qual sugere uma mediação entre amor e direito oferecida pela formação. palavras-chave direito; eticidade; reconhecimento; formação; educação.
