The relationship between Rawls’s theory of justice and Quine’s philosophy constitute an almost entirely new topic of discussion. The analysis undertaken in this article aims to show that some fundamental epistemological traits of Rawls’s theory of justice may be causally explained by referring to Quine’s influence on him. Rawls’s assumptions, methods of theory-building and evaluation criteria are addressed and a close nexus between the methods of ethics and natural science is made explicit. In the light of the historical and epistemological (...) analysis presented in this article it may be argued that Rawls’s theory of justice as fairness satisfies scientific requirements of evidence and objectivity within the sphere of ethics to the extent it is constructed and justified in accordance to Quine’s epistemology. Various theories have been put forward in an attempt to explain what makes moral judgments justifiable. One of the main theories currently advocated in bioethics is a form of coherentism known as wide reflective equilibrium. In this paper, I argue that wide reflective equilibrium is not a satisfactory approach for justifying moral beliefs and propositions. A long-standing theoretical problem for reflective equilibrium has not been adequately resolved, and, as a result, the main arguments for wide reflective equilibrium are unsuccessful. Moreover, (...) practical problems that arise in using the method of wide reflective equilibrium undermine the idea that it is a viable approach for justifying moral judgments about cases and policies. Given that wide reflective equilibrium is the most prominent version of coherentism, these considerations call into question the coherentist approach to justification in bioethics. (shrink)

Artikkel käsitleb kriitiliselt üht viimaste kümnendite vastandust poliitilises filosoofias — ‘poliitilise liberalismi’ (Rawls) ja ‘radikaalse demokraatia’ (Laclau ja Mouffe) vahel. Artikkel püüab käivitada potentsiaalset dialoogi nende kahe näiliselt lahkneva lähenemise vahel. Kokkuvõttes näitab artikkel, et vastandus on möödarääkimine vähemalt ühes fundamentaalses mõttes: mõlemad lähenemised jagavad ühiskonnastmõtlemisel sama aluseetost. Artiklis nimetatakse seda ‘sattumuslikkuse eetoseks’ ning väidetakse, et see on kõige fundamentaalsem alusveendumus nii Laclau ja Mouffe’i ‘radikaalse demokraatia’ kui ka Rawlsi ‘õigluse kui ausameelsuse’ idee jaoks. Artikkel osutab ka ühele kesksele kitsaskohale (...) Laclau ja Mouffe’i lähenemises: nende suutmatusele kontseptualiseerida institutsioonilisi korraldusi tulenevalt nende ülemäärasest rõhuasetust demokraatia dekonstruktiivsele potentsiaalile. Selles suhtes osutatakse ka Rawlsi käsitluse ilmselgetele eelistele, kuna see pakub juhiseid organiseerimaks demokraatlikke institutsioone. The paper concentrates on a controversy in recent decades’ political thought between ‘political liberalism’ of Rawls and ‘radical democracy’ (represented in this paper by Laclau and Mouffe). The article tries to initiate a potential dialogue between these seemingly divisive approaches. In conclusion the paper maintains that the whole controversy is misguided in one fundamental respect: both approaches share the same underlying ethos in envisioning society—‘the ethos of contingency’. It is argued that it is the most fundamental tenet informing both Laclau and Mouffe’s theory of hegemony with its complementary idea of ‘radical democracy’, and justice as fairness conceived in terms of reciprocity with its accompanying idea of public justification and reflective equilibrium. _e article points to a central impasse in Laclau and Mouffe’s approach: its incapability to conceptualize institutional arrangements due to their overemphasis on the deconstructive potential of democracy. In this respect the obvious merits of Rawls’ conception are highlighted in view of his proposals for organizing democratic institutions. (shrink)

It is undeniable that people have beliefs about what actions are morally right. These beliefs play an important role in guiding moral action. Is it possible however to justify beliefs about what actions are morally right? How can beliefs of this sort be justified? Sinnott-Armstrong has advanced an epistemic regress argument against the justification of moral beliefs with the consequence that moral beliefs cannot be justified. This essay addresses the issue of the justification of moral beliefs to answer the question (...) about how moral beliefs can be justified in response to Sinnott-Armstrong’s epistemic regress argument. It argues for the plausibility of Rawls’ reflective equilibrium as an adequate method of justification of moral beliefs. Three problems arise in the attempt to show that reflective equilibrium can adequately respond to Sinnott-Armstrong’s regress argument. These are vicious circularity, arbitrariness and epistemic moral disagreement. It is shown in this essay that these problems can be satisfactorily dealt with. (shrink)

There is more rationality in our lives than there is in our philosophy. There is more morality in our lives than there is in our philosophy. Those claims undoubtedly are startling, perhaps even incomprehensible, given that the Western philosophical tradition from Plato on is devoted to rationality, in morality and everywhere else. The narrowly circumscribed account of rationality in that philosophical tradition—formal reason—is, however, the source of both claims. The formal reason of philosophy is rule-governed reasoning, the kind of inferential (...) reasoning used in logic and mathematics. This view percolates through ordinary understandings of rationality as well, exemplified by the familiar use of the expression .. (shrink)

I address the worry that reflective equilibrium is too weak as an account of justification because it fails to let differing views converge. I take up informal aspects of convergence and operationalise them in a formal model of reflective equilibrium. This allows for exploration by the means of computer simulation. Findings show that the formal model does not yield unique outputs, but still boosts agreement. I conclude from this that reflective equilibrium is best seen as a pluralist account of justification (...) that cannot be accused of resulting in an “anything goes” relativism. (shrink)

The method of reflective equilibrium starts with a set of initial judgments about some subject matter and refines that set to arrive at an improved philosophical worldview. However, the method faces two, trenchant objections. The Garbage-In, Garbage-Out Objection argues that reflective equilibrium fails because it has no principled reason to rely on some inputs to the method rather than others and putting garbage-in assures you of getting garbage-out. The Circularity Objection argues that reflective equilibrium fails because it has no principled, (...) non-circular way of sorting whatever is put into the method. The moves required to avoid both objections are instructive. Reflective equilibrium requires a meta-justification, and we offer one that appeals to the epistemic goods that underwrite a view known as phenomenal conservatism. Reflective equilibrium calls on us to start with what seems most likely to be true and to alter that collection of judgments in the ways that seem most likely to get us to the truth. Proceeding in this way is epistemically defensible and unavoidable. Hence, reflective equilibrium is not just good, it’s phenomenal. (shrink)

Abstract: In this article the author develops the view, held by some, that political constructivism is best interpreted as a pragmatic enterprise aiming to solve political problems. He argues that this interpretation's structure of justification is best conceived in terms of two separate investigations—one develops a normative solution to a particular political problem by working up into a coherent whole certain moral conceptions of persons and society; and the other is an empirically based analysis of the political problem. The author (...) argues that the empirically based analysis can generate criteria for assessing whether the normative theory successfully works out a solution, thereby developing a functionalist structure of justification. He further argues that this interpretation overcomes a longstanding criticism of constructivism, namely, that the use of substantive moral concepts in the hypothetical choice procedure biases the defense of principles in a particular direction and therefore begs important philosophical questions. In this paper, I analyze the particular conception of reciprocal justification proposed by Nelson Goodman and incorporated by John Rawls into what he called reflective equilibrium. I propose a way of avoiding the twin dangers which threaten to push this idea to either of two extremes: the reliance on epistemically privileged observation reports (or moral judgments in Rawls version), which tends to disrupt the balance struck between the two sides of the equilibrium and to re-establish a foundationalism; and the denial (...) of any privileged status to such reports (or judgments), which makes the equilibrium into a theoretical monolith. An important goal of teaching ethics to engineering students is to enhance their ability to make well-reasoned ethical decisions in their engineering practice: a goal in line with the stated ethical codes of professional engineering organizations. While engineering educators have explored a wide range of methodologies for teaching ethics, a satisfying model for developing ethical reasoning skills has not been adopted broadly. In this paper we argue that a principlist-based approach to ethical reasoning is uniquely suited to engineering ethics education. (...) Reflexive Principlism is an approach to ethical decision-making that focuses on internalizing a reflective and iterative process of specification, balancing, and justification of four core ethical principles in the context of specific cases. In engineering, that approach provides structure to ethical reasoning while allowing the flexibility for adaptation to varying contexts through specification. Reflexive Principlism integrates well with the prevalent and familiar methodologies of reasoning within the engineering disciplines as well as with the goals of engineering ethics education. Non è un caso che l’enhancement umano, cioè il potenziamento di capacità fisiche, cognitive ed emotive degli esseri umani con l’ausilio di tecnologie, sia diventato un tema centrale nei dibattiti etico-applicativi e nei tentativi contemporanei di arrivare a una comprensione più adeguata della natura umana. John Rawls recommends a reflective equilibrium method for evaluating which principles institutions should abide by. In this paper, I identify and challenge three assumptions that he makes.

This paper proposes a Rawlsian conception of moral justification as a social activity. Through a close reading, Rawls’ view of ethical justification is shown to be significantly more dialogical and deliberative than is commonly appreciated. The result is a view that emphasizes the social nature of ethical justification and identifies information sharing between persons as the crux of justification in metaethics, in contrast to normative ethics. I call it Rawlsian reflective equilibrium to distinguish it from other varieties.

G.A. Cohen argues that Rawlsian constructivism mistakenly conflates principles of justice with optimal rules of regulation, a confusion that arises out of how Rawls has us think about justice. I use the concepts/conceptions distinction to argue that while citizens may reasonably disagree about the substance and demands of justice, some principled convergence may be possible: we can agree upon regulative principles consistent with justice, as each of us understands it.
