Este artículo analiza las concepciones pluralista, deliberativa y participativa sobre la democracia que centran los debates actuales sobre el tema. Son modelos que parten de presupuestos distintos y llegan a diferentes conclusiones. Se analiza la noción de racionalidad y razonabilidad de los individuos. Y también, el concepto de egoísmo y la posibilidad del altruismo y el tránsito de la autonomía individual al autogobierno colectivo. In this article, we develop a non-rights-based argument based on beneficence (i.e., the welfare of individuals and communities) and justice as the disposition to act justly to promote equity in health care resource allocation. To this end, we structured our analysis according to the following main sections. The first section examines the work of Amartya Sen and his equality of capabilities approach and outlines a framework of health care as a fundamental human need. In the subsequent section, we provide a (...) definition of health equity based on the moral imperative to guarantee that every individual ought to have the freedom to pursue health goals and well-being. In the later part of the article, we outline a non-right approach to health care based on three pillars: (1) human flourishing, (2) justice as a disposition not a process, and (3) solidarity. We should seek to justify, from a moral perspective, policies associated with serious and irreversible risks to the health of human beings, their societies, and the environment for these risks may have great impacts on the autonomy of both existing and future persons. The ideal of discursive democracy provides a way of morally justifying such policies to both existing and future persons. It calls for the inclusive, informed, and uncoerced deliberation toward an agreement of both existing and future persons, which (...) can serve as a justificatory basis for such public policies. This agreement best protects their fundamental interests and basic needs, and garners their general acceptance. It does so by upholding their agency in decision-making processes and, more specifically, by counseling a maxim of precaution in their public reasoning. The aim of this maxim is to protect the social and environmental conditions that will enable members of existing and future generations to review and, if necessary, revise decisions made in the past but that impact upon them in the present. Precautionary public reasoning thus serves to uphold the decisional agency of existing and future persons, which is a necessary condition of their democratic involvement in the policies that affect them and thus of their autonomous existence defined by their conceptions of the good. This work studies the issue of political representation from the perspective of a specific legal culture, the exercise of political rights in the context of the occidental democratic system, a concept that has undergone a profound evolution to the present day. The essential aspects for an analysis of this progression are voting, decision making, and the relationship between representatives and their constituents. Overall, the phenomena making up the crisis of representation have been explained as a result of changes that have (...) affected the operation and structure of modern states constituted as representative democracies. In recent years a growing number of democratic theorists have proposed ways to increase citizen engagement, while channeling those democratic energies in positive directions and away from systematic marginalization, exclusion and intolerance. One novel answer is provided by a strain of democratic theory known as agonistic pluralism, which valorizes adversarial engagement and recognizes the marginalizing tendencies implicit in drives to consensus and stability. However, the divergences between competing variants of agonistic pluralism remain largely underdeveloped or unrecognized. In this article, I (...) address this shortcoming, examining these strains of agonism around the constraints placed upon democratic discourse. I argue that the ‘associative agonism’ of theorists such as Bonnie Honig and William Connolly offers the best means for cultivating virtues necessary to revitalize a contentious democratic politics which also fosters receptivity to pluralism and difference. La démocratie délibérative s’oppose fréquemment à une conception rationnelle du citoyen qui, selon ses théoriciens, ne permet pas d’atteindre une authentique démocratie. Pourtant, la démocratie délibérative souffre elle-même de difficultés théoriques importantes dont une partie des solutions a déjà été abordée dans la théorie du choix rationnel. Nous voulons montrer que le choix rationnel, dans sa version « étendue », peut servir à améliorer la démocratie délibérative sans pour autant en ébranler ses fondements. Nous effectuerons d’abord un survol de la (...) démocratie délibérative, en insistant sur les questions de formation et d’expression des préférences des citoyens dans l’agora. Nous y découvrirons certaines difficultés théoriques que nous tenterons par la suite de résoudre par un ensemble de mécanismes issus de la théorie du choix rationnel. Parallèlement, nous verrons que la délibération raisonnable est possible dans un paradigme rationnel, que nous appelons la « délibération circonstancielle ».Deliberative democracy frequently rejects the rational citizen model since, according to its proponents, it would not yield a proper democracy. And yet, deliberative democracy contains important theoretical difficulties, some of which have been dealt with by rational-choice theory. We intend to show that a “broad” version of rational-choice theory can actually improve deliberative democracy without condemning its foundations. First, we will briefly examine deliberative democracy, focusing on the formation and expression of citizens’preferences in the agora. Some theoretical problems will be identified; several mechanisms drawn from rational-choice theory will be used to try to solve them. Simultaneously, we will see that reasonable deliberation is possible in a rational-choice paradigm, in a model I call “circumstantial deliberation”. (shrink)

Flagging labor governance in far-flung supply networks has prompted greater scrutiny of instrumental CSR and calls for models that are tethered more closely to accountability, constraint, and oversight. Political CSR is an apt response, but this paper seeks to buttress its deliberative moorings by arguing that the agonist notion of ‘domesticated conflict’ provides a necessary foundation for substantive deliberation. Because deliberation is more viable and effective when coupled with some means of coercion, a concept of CSR solely premised on reciprocal (...) corporate-stakeholder engagement is pre-mature; efforts should first be directed toward the antecedents of reciprocity and how it is to be achieved, and only then does deliberation become a reliably substantive exercise. The resulting account of agonistic CSR is generated through agonistic principles of realism, pro-action, contestation, and countervailence, and illustrated by the Bangladesh Accord. (shrink)

This study surveys debates on citizenship, the state, and the bases of political stability. The survey begins by presenting the primary sense of 'citizenship' as a legal status and the question of the sorts of political communities people can belong to as citizens. (Multi)nation-states are suggested as the main site of citizenship in the contemporary world, without ignoring the existence of alternative possibilities. Turning to discussions of citizen identity, the study shows that some of the discussion is motivated by a (...) perceived need for citizens to have a sense of political belonging, on the assumption that such a sense promotes political activity and has other personal and social benefits. But there are serious problems with the strategy of understanding the relevant sense of belonging in terms of identification with the nation-state. The study explores a more promising way to generate this sense of belonging. First, societies should function, to a sufficiently high degree, in accord with political principles of justice and democratic decision making. Second, there should be a general consensus on political principles among citizens, as well as high levels of engagement in democratic deliberation. (shrink)

However, casting protest as legitimate in the framework of deliberative politics and as serving deliberative democracy obscures its own value in endeavors to achieve social, economic, and environmental justice. Being sympathetic to Dupuis- D � ri � s work, I wish to make several, (...) interrelated conceptual and practical clarifications in order to bring back to the fore the fundamental importance of protest, in terms of contributions not to deliberative politics and deliberative democracy but to public discourse. The classical Greek term pistis is presented as a relevant norm in the analysis of parliamentary debate. Through exploration of pistis apparent similarities to the term ethos have appeared. It is proposed that pistis can be viewed as the equivalent to ethos, concerning the common space or connection between the speaker and the audience. Tentatively "truth", "faith" and "respect" are proposed as the elements equivalent to phronesis, areté and eunoia.

Étant sympathique aux travaux de Dupuis-Déri, je tiens à faire plusieurs clarifications conceptuelles et pratiques en vue de ramener à l’avant-scène l’importance fondamentale des protestations, en terme de contributions non pas à la démocratie délibérative, mais au discours public. The paper focuses on John Rawls’ theory of political obligation. Rawls bases political obligation on our natural duties of justice, which are mediated to us by our sense of justice. Therefore the justification of political obligation also requires moral justification: the justification of the principles of justice. In the paper I first investigate that part of Rawls’ argument that has the role of justification: the method of reflective equilibrium. This method raises several problems, the most severe of which is that (...) it neglects the fact of pluralism. The second part of the paper deals with this problem. I analyse how Rawls’ theory and his method of justification has changed as a result of taking into account the fact of pluralism. Finally, building on the demands of pluralism and the shortcomings of the Rawlsian answer, I present a possible theory of political obligation. This theory is grounded in the interpretation of the community’s political culture while fitting it into a discourse-based theoretical framework. (shrink)
