This paper aims at creating an adequate theoretical basis for a systematic integration of institutional insights into the pragma-dialectical analysis of argumentative exchanges that occur in institutionalised contexts. The argumentative practice of Prime Minister’s Question Time in the British House of Commons is examined, as a case in point, in order to illustrate how the knowledge of the characteristics of an institution, its rules and conventions can be integrated into the pragma-dialectical analysis. Using the profiles of dialogue method we identify a species of ad verecundiam fallacy that works by forestalling of questioning in arguments from expert opinion. A profile of dialogue is a graph structure used to model a sequence of speech acts surrounding both the putting forward of an argument and the response to it at the next moves in a dialogue. The method is applied to a case of cross-examining a software engineer in a legal deposition in a case of (...) intellectual property litigation. (shrink)

In this paper, the author examines the burden of proof in the argu- mentative confrontations taking part in practices of political accountability. She does so by explaining how politicians maneuver strategically with the burden of proof in an attempt at winning the discussion in which they are involved. After making clear the role of the burden of proof in defining the difference of opinion in argumentative confrontations, the author outlines the constraints imposed by practices of political accountability on the burden (...) of proof. Finally, she analyzes in detail a concrete case in which a politician maneuvers in such a way that his burden of proof is significantly diminished. (shrink)

When interlocutors start to talk at cross purposes it becomes less likely that they will be able to resolve their differences of opinion. Still, a critic, in the confrontation stage of a discussion, should be given some room of manoeuvre for rephrasing and even for revising the arguer’s position. I will distinguish between licit and illicit applications of this form of strategic manoeuvring by stating three soundness conditions.
