This article focuses on a number of cases in international law in which US domestic courts have produced judgments that conflict with those given by the International Court of Justice. The nature of these courts’ judgments has been extremely closely tied to the interpretation given by the US national Executive to a certain international norm. This situation raises a number of questions, which can be broadly categorized into two spheres: the legal (regarding the overall legality of the courts’ decisions) and (...) the semiotic (regarding the manner in which a ‘meaning’ for the norm has been claimed by the courts). In this article we aim to provide answers to a number of these questions, both from the standpoint of international law and from that of a reader-response model of semiosis. ABSTRACT Although dominant discourses of various kinds are frequently reproduced on talk radio, the fundamentally collaborative nature of the medium also means that it is able to serve as a channel through which to challenge these discourses. Using Critical Discourse Analysis, this article examines how neoliberal ideology structures discussions around ‘service delivery protest’ on South African talk radio, and explores some of the roles that talk radio is, and is not, able to play in constructing resistance to neoliberal ideology. Our (...) analysis yielded two discourses, namely: naturalisation of the commodification of everyday life, and market over welfare – both of which seemed to cohere with neoliberal frameworks and rationalities in different ways. We conclude by suggesting how radio can be used to denaturalise neoliberalism’s impulse towards making common sense conditions that enable economic oppression and exploitation. (shrink)

It is popularly believed within sport's practice communities that a contest fails if the competitor who performs most skilfully in it does not win. The belief is rarely acknowledged explicitly, and therefore deserves to be considered ideological in a sense. In this paper I challenge that belief. For conceptual reasons, I confine the discussion to the purposive sports, e.g. football and tennis. The concept of skill is approached by articulation of a set of platitudes about skill in the purposive sports. (...) The first is the conceptual wedge between skill and success. The second is the distinction between skill and other performance-relevant qualities such as courage, strength and luck. The third is the fact that skill deficits can be compensated by sufficient amounts of the other performance relevant qualities. The fourth is the dispositional and dynamic character of skill. The relation between skill and final objectives in the purposive sports means that (i) qualities such as nerve and courage can trump the more skilful performance; and (ii) poor execution of a narrow range of skills can result in the competitive failure of the more skilful performance. There is no viable ideal of sport that would ground regret about the realisation of the immediately preceding possibilities. The inclination towards such regret might be partly motivated by the wish to take a gratifying view of ourselves. An end to this response, and a more inclusive, less hierarchical conception of sport skills, is worth recommending. (shrink)

This paper introduces a formal concept of ideology and ideological system. The formalization takes ideologies and ideological systems to be situated in agent societies. An ideological system is defined as a system of operations able to create, maintain, and extinguish the ideologies adopted by the social groups of agent societies. The concepts of group ideology, ideological contradiction, ideological dominance, and dominant ideology of an agent society, are defined. An ideology-based concept of social group is introduced. Relations between the proposed formal (...) concept of ideology and the classical concepts of ideology elaborated in social sciences are examined. A computational notation is presented, to support the realization of ideological systems in computationally implemented agent societies. The adequacy of the approach for the formal modeling and analysis of ideological issues is illustrated through three case studies. (shrink)

The proponents of critical pedagogy criticize the earlier Neo‐Marxist theories of education, arguing that they provide only a ‘language of critique’. By introducing the possibility of human agency and resistance, critical pedagogists attempt to develop not only a pedagogy of critique, but also to build a pedagogy of hope. Fundamentally, the aim of critical pedagogy is twofold: 1) to correct the pessimistic conclusions of Neo‐Marxist theories, and 2) to transform a ‘language of critique’ into a ‘language of possibility’ . Then, (...) what political projects do critical pedagogies present to us? What alternative visions of schooling do critical pedagogies offer against the mainstream pedagogy? The purpose of this paper is to identify main projects of critical pedagogy, and to explore overarching politics that underlie the field of critical pedagogy. Although there are diverse theories and approaches in critical pedagogy, three overarching projects can be identified, which I call: 1) the project of experience, 2) the project of anti‐system, and 3) the project of inclusion. Based on an examination of the general trends and characteristics of these three projects of critical pedagogy, I argue that three prominent politics that underlie the field of critical pedagogy are culturalist politics, self/identity politics, and grassroots politics. In trying to better understand why and how critical pedagogy has developed the political stances as it has, the last part of the paper links these three politics to the historical developments of the New Left and the New Social Movements. This review-essay analyses John Beverley’s post-subalternist perspective on the intertwinement of theoretical discourse and politics – so-called Latinamericanism – in the Latin American context. This conjuncture is characterised by themarea rosada, or pink tide, of moderate leftist governments. I contend that Beverley grasps the change introduced by this trend and lucidly criticises the neoconservative, moderate, and deficient political implications of different theoretical views. This contribution notwithstanding, I argue that Beverley’s theoretical project fails effectively to conceptualise this political tide as an (...) object of theoretical inquiry: namely, to grapple with themarea rosada’s Latinamericanism as a populist political logic that simultaneously neutralises and drives socialist transformation. This paper comments on ‘Critique and Negativity: Towards the Pluralisation of Critique in Educational Practice, Theory and Research’ by Dietrich Benner and Andrea English. Negativity is a disquieting ghost for teachers, educational researchers, administrators and other professionals of this field, including those involved in the design of policy. First, I make some remarks in response to the essay by Benner and English in order to draw attention to the importance of dealing with negativity. Second, I introduce a further problematisation of (...) negativity: I deal with the practical issues that emerge from the conceptual reactivation of negativity and the possible consequences that result from this in the context of teaching graduate seminars. I am especially concerned with the ways in which negativity is inscribed in the process of knowledge production (that is, research), and in the possible consequences of subscribing to one or the other concept of negativity (teleological negativity, parasitic negativity, and relational negativity as the sine qua non condition for any ontology). Lastly, I raise some points for discussion with regard to certain possible consequences of the use of one or another notion of negativity in teaching and research. (shrink)

The relationship betweendiscourse and ideology can be described as thatof process and effect [Purvis and Hunt (1993)British Journal of Sociology 44: 473–499].Discourse, used within relations of domination,can result in the formation of ideology. Tostudy this relationship systematically requiresa methodology that contextualizes discoursewithin social relations and examines when suchdiscourse becomes an ideology. I use Thompson'stheory/methodology of ``depth hermeneutics'' tostudy documents produced by agriculturalinterest groups concerning the 1996 FederalAgriculture Improvement and Reform (FAIR) Actand I assess the ideological status of thediscourses contained in (...) these documents. Thefindings suggest that the organizationsrepresenting the small-to-medium-sized farmerstended to use more agrarian themes, fewermarket themes, and fewer linguistic strategiesindicative of ideology. The organizationsrepresenting more concentrated,vertically-integrated interests andagribusinesses use fewer agrarian themes, moremarket themes, and more linguistic strategies.Therefore, market themes, not agrarian themes,form an ideology in this context. This article seeks to examine how religious ideas that are not the focus of a particular halakhic question become the crux of the ruling, thereby molding it and dictating its bias. We will attempt to demonstrate this through a study of Jewish medical ethics, based on some of the rulings of one of the greatest halakhic decisors of the previous generation: Rabbi Eliezer Yehuda Waldenberg (1915–2006). Rabbi Waldenberg molds his rulings on the basis of a religious principle asserting that the (...) legitimacy of any medical procedure is qualified and limited. Rabbi Waldenberg rejects certain accepted medical practices, including plastic surgery, in vitro fertilization, and organ transplants. Even if these procedures are regarded by other halakhic decisors as being legitimate, for Rabbi Waldenberg they are ethically and religiously improper, and therefore they are halakhically forbidden. Ideology is commonly defined along functional, epistemic, and genetic dimensions. This article advances a reasonably unified account that specifies how they connect and locates the mechanisms at work. I frame the account along a recent distinction between anchoring and grounding, endorse an etiological reading of functional explanations, and draw on current work about the epistemology of delusion, looping effects, and structuring causes to explain how ideologies originate, reproduce, and possibly collapse. This eventually allows articulating how the legitimating function of ideologies (...) relates to the constitutive and causal role they play when embedded into the facts they are originally designed to anchor. This paper considers the trajectory of Althusser's Spinozism pre- and post-May ‘68. Where Althusser's application of Spinoza would often lead him into unknown or non-Marxist territory, one alternative way to think this relation is through the figure of Mao, whose concept of non-antagonistic contradiction I propose to read in terms of Spinoza's “determinate negation.” Although not going so far as to suggest that a certain combination of Mao and Spinoza would have enabled Althusser to “complete” Marx, this paper speculates on (...) this omission from his work and what positive insights we can draw from it retrospectively for developing Althusser's political philosophy. Abstract In criticising the Italian idealist philosopher Benedetto Croce ? described by Eric Hobsbawm as the first ?post?Marxist? ? Antonio Gramsci elaborated a distinct theory of history. For Gramsci, philosophers such as Croce developed a subjective account of history based on the progression of philosophical thought rather than problems posed by historical development. This essay develops a ?double reading? of Gramsci. First, it presents an overview of a dominant post?Marxist reading of Gramsci?s approach to historical materialism, which constructs a closed (...) and particularistic understanding of his theory of history. Second, it offers a reading that exposes and unsettles problems within post?Marxism by demonstrating how Gramsci?s focus on changes in social relations threatens the assumptions about both traditional idealism and materialism. It is this theory of history that throws into relief certain features necessary to understanding history as more than just a completely contingent system of articulatory practices. The method of a double reading therefore affords insight into the internal tensions and questionable assumptions of history understood as an association of discourses (first reading). It also avoids developing an account that relies on an ?extrinsic history? of objective forces by combining an appreciation of ethico?political principles alongside economic factors within the struggle over hegemony relevant to contemporary global political economy (second reading). The publication in theJournal of the American Medical Association of a narrative entitled “It's Over, Debbie,” in which a gynecology resident apparently performs euthanasia, has stirred considerable debate characterized by varying interpretations not only of the ethical issues involved but of the meaning of the text itself. Formal analysis reveals the narrative to be strikingly literary in its ambiguity, its foregrounding of its own textuality, and its dominant structure of repetition and reversal. The analysis points to features that account for (...) some of the varying interpretations in the debate, and it calls into question the relation of the text to whatever events it may represent and to how the resident may have perceived these events. This study explored the transcending experience as described by visual artists that sometimes occurs during the art-making process. The exploration was conducted within a philosophical framework informed by the researcher's practice of Transcendental Meditation (TM). From this perspective, transcending is related to personal, inner (subjective), and ephemeral aesthetic experiences which never-the-less make a powerful contribution to the visual artist's experience of the creative process and to a lesser extent, the final product. The focus of the study was on the identification (...) and documentation of the personal and subjective aspects of art-making. The study consisted of two parts; (a) this written thesis that elucidates and supports the argument, and (b) an exhibition of paintings, drawings, and journals which represent a personal narrative. The research questions for the written document are directed towards extracting artists' statements that describe the nature and benefits of transcending during art-making. Document analysis techniques were employed to study the writings of a variety of artists and to create a mosaic of insightful commentary. As a visual arts educator, the significance of the study related to the benefits of the art-making process for students of all ages. Both the exhibition and written document are presented to demonstrate that art-making and the viewing of art can provide access to silent (inner) experiences of the human mind. Strengthening the students' spiritual/aesthetic experience through art-making may bring the benefits of personal enrichment for some students by promoting the development of stronger self-concepts and self-esteem. This study presents research about an aspect of visual arts education that has to date been largely ignored. Arguments for the development of self-realization and a fuller understanding of the aesthetic experience may contribute to a case for strengthening the place of the visual arts within the curriculum. This paper specifies competences and skills of methodologically rational decision making and their impact on security of organisations. The study indicates some reasons for developing the competencies and skills in education, professional development and taking them into account in the recruitment. It is the practical aim of this paper. Its scientific aim is to formulate and to partly justify general hypotheses concerning the impact of methodologically rational and irrational attitudes of members of organisations on their security. The contextual interpretation of conceptual art under politically oppressive regimes as a politicized art practice seems dominant in the current revisionist discourse of art history. At a closer inspection, this discourse seems to illustrate Rainer Rochlitz’s comments on the use of political criteria for instrumentally evaluating contemporary art, favoring political engagement as a relational artistic value instead of a set of aesthetic values. Using art historical analysis of the context of artistic production and reception as well as case studies, I (...) intend to show that what we may praise as being critically efficient conceptual artworks are also aesthetically relevant in a particular sense. The political character they may acquire and the instrumental value attached to it depends on the production of artistic autonomy as a field of semiotic experiments with language and social communication. It is the aesthetic function of that part of conceptual art engaged in useless artistic labor and pointless communication, criticizing the inherent rationality of the modernist project, which obliquely acquires political overtones in times of straightforward ideological engagement of art. This essay is a response to Askegaard and Linnet’s : 381–404) call for a greater epistemological plurality within consumer culture theory. The article begins with a brief review of what these authors refer to as the dominant existential–phenomenological perspective and their Morinian alternative and then presents contemporary political philosophy as another alternative. Political philosophy has experienced quite a renaissance in recent years, and the school of thought has inspired major epistemological and ontological interventions throughout the academy. Here, I provide a (...) general introduction to this field of social inquiry and then focus specifically on the contributions of French philosopher Alain Badiou. Badiou’s work is particularly valuable for fields such as CCT, as it presents a unified epistemological framework for developing knowledge of social structures, cultural forms and subjectivities. The utility of political philosophy in general as well as the Badiouian framework is then demonstrated with recourse to the extant CCT literature. Ultimately, a Badiouian perspective has the potential to fulfil Askegaard and Linnet’s call for epistemologies that can attend to everyday experience while also considering the operation of cultural, political and sociological forces. The prominent literary theorist, Terry Eagleton, is one of a limited number of Marxist theorists to have taken Wittgenstein’s ideas seriously. He wrote the script for Derek Jarman’s film about Wittgenstein and his work in cultural theory is clearly indebted, to some extent, to Wittgenstein. His Ideology: an Introduction employs the Wittgensteinian notions of ‘family resemblance’ and ‘forms of life’ and he also leans on Wittgenstein’s remarks about epistemological matters in it. Among the novels inspired by Wittgenstein there is one (...) by Eagleton—Saints and Scholars—that has a semi-fictionalised version of Wittgenstein meeting in Dublin with James Connolly, Nikolai Bakhtin and Leopold Bloom. Eagleton has clearly both endeavoured to understand Wittgenstein as a person and engaged with Wittgenstein’s philosophical work. In this paper I will argue that Eagleton’s interpretation of Wittgenstein, in his paper ‘Wittgenstein’s Friends’, is defective in various respects, but I will conclude that the project of uniting the insights of Wittgenstein and Marx is nonetheless a sound one.
