  1. Reasons of Law: Dworkin on the Legal Decision.Anthony R. Reeves - 2016 - Jurisprudence 7 (2):210-230.
Ronald Dworkin once identified the basic question of jurisprudence as: ‘What, in general, is a good reason for a decision by a court of law?’ I argue that, over the course of his career, Dworkin gave an essentially sound answer to this question. In fact, he gave a correct answer to a broader question: ‘What is a good reason for a legal decision, generally?’ For judges, officials of executive and administrative agencies, lawyers, non-governmental organizations, and ordinary subjects acting in the (...)

  • À la Recherche de l’Arbitraire. Du Droit à la Sémiotique et Retour.Stefan Goltzberg - 2013 - International Journal for the Semiotics of Law - Revue Internationale de Sémiotique Juridique 26 (3):543-554.

  • Nonparty Participation as a (Partial) Remedy to Proceduralist Concerns Over Judicial Review.Geoffrey D. Callaghan - 2018 - Legal Theory 24 (4):255-290.
The argument I defend in this paper takes for granted that the proceduralist indictment against judicial review is at least partly justifiable, and that a complete theory of democratic legitimacy will therefore attempt to address it to the greatest possible degree. I examine how the indictment can be addressed via the practice of nonparty participation, whereby members of the general public may seek participatory involvement in a court proceeding despite not being directly implicated by the dispute at issue. Through this (...)

This paper is the result of my participation in a discussion event of Problema. Several colleagues with a vast knowledge on the subject of judicial precedent participated in this seminar, which also delved into the widely debated aspects of judicial precedent focused on the case of Chile. The entire discussion aimed at proposing solutions, as well as shedding some light on some (...)

El presente trabajo es el resultado de mi participación en el evento de discusión de la revista Problema. Todo ello, con (...)

  • A Puzzle About Vagueness, Reasons, and Judicial Discretion.Hrafn Asgeirsson - 2022 - Legal Theory 28 (3):210-234.
The following two theses seem both plausible and consistent: in cases where it is indeterminate whether the relevant legal language applies to the relevant set of facts, officials are not bound to decide the case one way rather than the other, but may reason either way; all reasons for action are—in some relevant sense—knowable. In this paper, I point out what I take to be a robust but unacknowledged tension between these two claims. The tension requires some careful teasing out, (...)
