Drawing on the work of Jacques Derrida, I propose a deconstructive reading of Gutmann and Thompson’s theory of deliberative democracy. The deconstructive reading starts from their concept of provisionality, and I argue that provisionality has consequences beyond those admitted by Gutmann and Thompson. While provisionality is an essential part of Gutmann and Thompson’s theory of deliberative democracy, it also dislocates the principles and distinctions on which their theory rests. Although Gutmann and Thompson try to control the effects of provisionality – (...) for instance, through a distinction between deliberative and non-deliberative disagreements – ultimately this is only possible by suppressing contingency and disagreement, which are otherwise part of the motivation for introducing provisionality. Thus, Gutmann and Thompson’s deliberative democ- racy is marked by a tension between their affirmation of provisionality and their attempts to limit the effects provisionality. Out of the deconstructive reading emerges an alternative deconstructive conception of democracy and provisionality in terms of Derrida’s concept of democracy to-come. (shrink)

Christian Kock’s essays show the essential interconnectedness of practical reasoning, rhetoric and deliberative democracy. They constitute a unique contribution to argumentation theory that draws on – and criticizes – the work of philosophers, rhetoricians, political scientists and other argumentation theorists. It puts rhetoric in the service of modern democracies by drawing attention to the obligations of politicians to articulate arguments and objections that citizens can weigh against each other in their deliberations about possible courses of action.

In order to be exercised meaningfully, political freedom requires the capacity to actually identify available policy options. To ensure this, society ought to engage in deliberation as a discussion oriented towards mutual learning. In order to highlight this issue, I define deliberation in terms of the participants’ openness to preference change, i.e. the deliberative stance. In the context of the systemic approach to deliberative theory, I find several factors causing the atrophy of such a deliberative stance. I note that this (...) state can occur not only when debaters are representatives or are in the presence of an audience, but also when they face the prospect of a binding decision. It is the latter effect that is a serious challenge to the micro-deliberative strategy, one that strives towards decisional powers being granted to deliberative minipublics. Presenting my findings, I propose—as an alternative to the power-oriented ‘ladder of participation’—a distinction between traditional co-decision and deliberative consultation, the latter one being an environment that is more conducive to deliberative stance. This new typology highlights factors that lead to preference petrification and allows for the appreciation of the non-decisional character of micro-deliberation. All of it leads to the conclusion that, in order to preserve their deliberative character in the systemic context, deliberative minipublics should not always be required to have decision-making powers. El objetivo de este trabajo es proponer un concepto de agente crítico que dialogue con una práctica democrática deliberativa, considerando qué significa el acto de dar razones. Para tal efecto, en este trabajo se discute, primero, qué significaría ser crítico o tender hacia la criticidad tanto autorreferente como hacia terceros. Esta sección está apoyada principalmente con ideas provenientes de la teoría de la argumentación y de la lógica informal. En segundo término, se aborda el concepto de democracia deliberativa a la (...) luz de la sinergia conceptual que habría entre la participación -potencial- de un agente crítico en tal contexto sociopolítico. En esta sección se pasa revista a algunas de las ideas centrales de la teoría de la democracia deliberativa. Y en la tercera y última parte, se aborda el problema de dar y recibir razones discutiendo la propuesta semántica inferencialista de Brandom (2002, 2005) para observar de qué manera este acercamiento puede aportar a una teoría de la deliberación y a un concepto -y educación- de agente crítico. En las conclusiones se sintetizan las ideas principales y, además, se hace un contrapunto entre la noción de agencia, concepto que es importante en mi propuesta, y la noción de persona, concepto de especial valor en la teoría de la democracia deliberativa. While the volume of material inspired by Rawls’s reinvigoration of the discipline back in 1971 has still not begun to subside, its significance has been in serious decline for quite some time. New and important work is appearing less and less frequently, while the scope of the work that is appearing is getting smaller and more internal and its practical applications more difficult to discern. The discipline has reached a point of intellectual stagnation, even as real-world events suggest that the (...) need for what political philosophy can provide could not be more critical. What follows then is a set of statements about how I believe that we, as political philosophers, should approach what we do. It contains my view as to what political philosophy should be about, how political philosophy should be done, and how courses in political philosophy should be taught, interlaced with commentary on the current state of the profession. A range of developing countries and international advocacy organizations have argued that wealthy countries, as a result of their greater historical contribution to human-induced climate change, owe a ?climate debt? to poor countries. Critics of this argument have claimed that it is incoherent or morally objectionable. In this essay we clarify the concept of climate debt and assess its value for conceptualizing responsibilities associated with global climate change and for guiding international climate negotiations. We conclude that the idea of a (...) climate debt can be coherently formulated, and that while some understandings of the idea of climate debt could lead to morally objectionable conclusions, other accounts would not. However, we argue that climate debt nevertheless provides an unhelpful frame for advancing global justice through international climate negotiations ? the only existing means of resolving political conflict over the collective action problems posed by human-induced climate change ? due to its retrospective and potentially adversarial emphasis, and to problems of measurement. Political science is divided between methodological individualists, who seek to explain political phenomena by reference to individuals and their interactions, and holists (or nonreductionists), who consider some higher-level social entities or properties such as states, institutions, or cultures ontologically or causally significant. We propose a reconciliation between these two perspectives, building on related work in philosophy. After laying out a taxonomy of different variants of each view, we observe that (i) although political phenomena result from underlying individual attitudes and behavior, (...) individual-level descriptions do not always capture all explanatorily salient properties, and (ii) nonreductionistic explanations are mandated when social regularities are robust to changes in their individual-level realization. We characterize the dividing line between phenomena requiring nonreductionistic explanation and phenomena permitting individualistic explanation and give examples from the study of ethnic conflicts, social-network theory, and international-relations theory. ABSTRACTThe normative ideals and feasibility of deliberative democracy have come under attack from several directions, as exemplified by a recent book version of a special issue of this journal. Critics have pointed out that the complexity of the modern world, voter ignorance, partisanship, apathy, and the esoteric nature of political communications make it unlikely that deliberation will be successful at creating good outcomes, and that it may in fact be counterproductive since it can polarize opinions. However, these criticisms were aimed (...) at “micro” theories of deliberative democracy. The new “systemic” turn in deliberative democracy avoids these problems by positing a system-wide division of labor in a nation-state: experts and ordinary citizens “check” each other's opinions; partisanship and even ignorance can spur deliberation among citizens; and citizens may remain apathetic about some issues but deliberate about others. So long as the overall level of systemic deliberation increases, instead of decreases, the ideal of deliberation is still relevant in a society as complex as ours. (shrink)

If there is a specifically rhetorical approach to argumentation, I believe it is one that studies argumentation that is specifically rhetorical. So if we want to ask, “What is the rhetorical approach to argumentation?” we should first ask, “What is rhetorical argumentation?” It is worthwhile focusing on this question because various misleading definitions of rhetorical argumentation have been in circulation for almost as long as rhetoric has existed. Some misleading definitions see the defining property of rhetorical argumentation in the arguer’s (...) aim. On the systemic approach, rhetorical modes of political speech are (...) legitimate within public deliberation, just so long as they result in net benefits to the deliberative system. I argue that neither of these two approaches adequately meets the unjust exclusion charge. Whereas the supplementing approach does not go far enough to incorporate rhetorical speech into public deliberation, the systemic approach goes too far by legitimising forms of rhetoric that risk only exacerbating the problem of unjust exclusion. More constructively, I draw on Aristotle’s conception of rhetoric, as an art that is a counterpart to dialectic, to argue for a constitutive approach to rhetoric. This article investigates how communities experiencing poverty can exercise their deliberative agency in a media-saturated society. While empirical research on deliberative democracy tends to focus on the role of mini-publics in giving low-income households the opportunity in small-scale, carefully designed forums to characterise, justify, and reflect on their views, such conception of deliberative agency gets lost in the picture once deliberative theory begins thinking in systemic terms. This article proposes a remedy to this theoretical and analytical gap by characterising the (...) hypermediated character of the deliberative system and identifying possibilities for communities experiencing poverty to maximise the affordances of digital media for them to make an appearance in the public sphere, speak in their own voice, and carry the embodied and storied character of their arguments. I present two illustrative cases drawing on the experiences of families with low income directly affected by the bloody war on drugs in the Philippines who utilise photojournalism and online music streaming to break in the public sphere and engage in systemic deliberations about the drug war. These examples demonstrate how communities experiencing poverty express their deliberative agency amidst fear, trauma and deprivation and democratise a media-saturated deliberative system under an increasingly authoritarian regime. Overall, this article hopes to strengthen the link between normative media studies and democratic theory and offering possibilities for reforming the public sphere that recognises the poor’s deliberative agency. The chapters in this book deal with different, though related, topics concerning the tense relationship between democracy and diversity. On the one hand, social diversity represents an opportunity, widening the horizon of social options and perspectives of innovation, but, on the other hand, it creates problems for the social cohesion and peaceful coexistence of many groups, be they majority or minority. The chapters depart from the intrinsic connection between democracy and diversity – and the unavoidable challenges that pluralism poses to (...) decision-making procedures – investigating, from different perspectives, how the normative requirement of fully respecting agents’ reflexive agency impacts the revision of democratic decision-making procedures and the way in which institutions react to citizens’ justice-based claims. How is the tension between conflict and deliberation resolved in shareholder engagement? We address this question by studying shareholder engagement as a deliberative process with three stages: establishing dialogue, solution development, and solution implementation. We theorize that two interactionist mechanisms, deliberative interaction and the voicing of disagreement, play different roles at different stages of the process. We test our hypotheses with a proprietary database of 169 environmental, social, and governance engagements with US public companies over 2007–12. We find that while (...) deliberative interaction does not help advance the engagement process, it positively moderates the effect of disagreement in the solution development stage. By contrast, in the solution implementation stage, deliberative interaction amplifies the negative effect of disagreement, thus hindering progress in the engagement. Our article contributes to shareholder engagement, deliberation theory, and interactionist organization theory by establishing that engagement effectiveness is an interactional achievement shaped by both deliberation and disagreement. The urgent need to address climate change poses a range of complex moral and practical concerns, not least because rising to the challenge will require cooperation among countries that differ greatly in their wealth, the extent of their contributions to the problem, and their vulnerability to environmental and economic shocks. This thesis by publication in the field of climate ethics aims to characterise a range of national responsibilities associated with acting on climate change (Part I), and to identify proposals for (...) fulfilling those responsibilities through fair and feasible institutional arrangements (Part II). I aim not only to address substantive gaps in scholarly understanding of those responsibilities, but also to strengthen the ability of climate ethics to engage meaningfully with climate policy. Chapter 2 addresses the question of whether wealthy countries owe a “climate debt” to poor countries. It finds that even if climate debt (suitably interpreted) may provide a coherent and morally plausible concept, its political value as a discursive frame that can provide a basis for cooperation is limited. Chapter 3 investigates the role that equity may play in negotiations on a long-term climate change agreement. It argues that developed and developing countries may reach a “principled bargain” if both converge on a way of differentiating their responsibilities that places less emphasis on a rigid dichotomy between the two groups and more emphasis on objective criteria relating to their contribution to the problem and capacity to address it. Chapter 4 explores a question largely overlooked in climate ethics, namely whether wealthy countries owe compensation to those who are adversely affected by the climate policies which they enact. I find that enacting countries have responsibilities to compensate both domestic and foreign citizens who would suffer disproportionate losses from the effects of policies. Chapter 5 assesses whether wealthy countries may legitimately adopt unilateral (or “fragmented”) rather than multilaterally coordinated approaches to raising climate finance for developing countries. It finds that coordinated target-setting, effort sharing and oversight arrangements are essential, but that a mix of unilateral and coordinated approaches to raising funds will be necessary for securing legitimacy. In Chapter 6, through addressing the broader question of what should count as official aid, I consider whether wealthy countries may draw on aid budgets to support developing countries’ efforts to address climate change. I find that the current definition of official aid should be retained but supplemented by specified exclusions from eligibility in order to preserve the aid regime’s integrity. Nevertheless, some climate finance may justifiably be counted as aid provided that concerns relating to the diversion of aid funding are addressed. In addressing these research questions, the thesis seeks not only to make original theoretical contributions to climate ethics but also to strengthen broader scholarly understanding of the ways in which ethics and international public policy may inform one another, particularly by highlighting the role of framing considerations (Chapter 2), feasibility considerations (Chapter 3), and the ways in which principles of fairness and legitimacy map onto institutional functions (Chapters 4, 5 and 6). Since its inception, a core aspiration of deliberative democracy has been to enable more and better inclusion within democratic politics. In this article, we argue that deliberative democracy can achieve this aspiration only if it goes beyond verbal forms of communication and acknowledges the crucial role of non-verbal communication in expressing and exchanging arguments. The article develops a multidimensional approach to deliberative democracy by emphasizing the visual, sonic and physical dimensions of communication in public deliberation. We argue that non-verbal modes (...) of communication can contribute to public deliberation when they (1) are used as part of reason-giving processes, (2) enable the inclusion of marginalized actors in public debates and (3) induce reflection and encourage new ways of thinking about the public controversies at hand.
