Non-Identity arguments have a pervasive but sometimes counter-intuitive grip on certain key areas in ethics. As a result, there has been limited success in supporting the alternative view that our choices concerning future generations can be considered harmful on any sort of person-affecting principle. However, as the Non-Identity Problem relies overtly on certain metaphysical assumptions, plausible alternatives to these foundations can substantially undermine the Non-Identity argument itself. In this paper, I show how the pervasive force and nature of Non-Identity arguments (...) rely upon a specific adoption of a theory of modality and identity and how adopting an alternative account of modality can be used to reject many conclusions formed through Non-Identity type arguments. By using Lewis’s counterpart-theoretic account to understand ways we might have been, I outline the basis of a modal account of harm that incorporates a person-affecting aspect. This, in turn, has significant implications for ethical decision-making in areas such as reproductive choice and the welfare of future generations. (shrink)

Possible worlds represent you as being certain ways, as having a different lives, different hopes, and different friends. A foundational question in the philosophy of modality thus emerges: in virtue of what does a world represent you in these ways? In this paper, we focus on David Lewis's answer to this metarepresentational question: Counterpart Theory.

When attempting to determine which of our acts affect future generations and which affect the identities of those who make up such generations, accounts of personal identity that privilege psychological features and person affecting accounts of morality, whilst highly useful when discussing the rights and wrongs of acts relating to extant persons, seem to come up short. On such approaches it is often held that the intuition that future persons can be harmed by decisions made prior to their existence is (...) mistaken as identity is a most fragile thing with even the smallest differences in the conditions under which we procreate affecting not the interests of distinct future persons, but the identities of those who will come to exist in the future. Within this paper I reject this view, holding that a subscription to these two accounts need not result in the conclusion that virtually all acts relating to possible persons are permitted. Further, I argue that such accounts may in fact allow a great deal more scope for the determination of prenatal harms than accounts of personal identity that privilege physical features. Finally, by interpreting claims regarding causal identity such as Parfit’s Time Dependence Claim in terms of Counterpart Theory I suggest that a solution to the non-identity problem can be found in the acceptance of, as relevant in prenatal cases, three kinds of objective similarity relations: Biological, Environmental and Decisional counterpart relations. En este trabajo examino el argumento de McFetridge a favor de la necesidad de la creencia en la necesidad. El argumento pretende establecer un dilema fatal para el “nihilista” modal, aquel que no cree que al menos alguna proposición es necesaria. Mi objetivo principal es mostrar que el dilema que presenta el argumento de McFetridge no es sólido, pues tiene una limitación muy importante con respecto al segundo de sus cuernos, el cual es el más interesante. El segundo cuerno del (...) dilema plantea una especie de argumento trascendental: es necesario creer en la necesidad si es que vamos a ser capaces de razonar confiablemente bajo suposiciones contrafácticas. Sin embargo, este argumento asume que la suposición contrafáctica es una actividad esencial en nuestras vidas, lo cual señala, sostengo, un punto central alrededor del cual el nihilista modal intentaría reafirmar su posición. Así, pretendo mostrar que el segundo cuerno del dilema de McFetridge revela que el quid de la discusión entre creyentes y nihilistas modales debe moverse propiamente de la cuestión del rol de la creencia en la necesidad a la cuestión del rol de la suposición contrafáctica. Quine ha promovido una forma de escepticismo sobre los juicios de modalidad de re que cuestiona su función y sugiere, en consecuencia, su eliminación. Wiggins, por su parte, ha argumentado que nuestros juicios ordinarios de individuación de objetos nos comprometen con un cierto esencialismo, con la aceptación de ciertos juicios de modalidad de re. Si Wiggins tuviera razón, tendríamos una respuesta potencial al escepticismo quineano de la función. Sin embargo, en este trabajo argumento que la propuesta de Wiggins es incapaz (...) de proporcionar una respuesta satisfactoria al escepticismo quineano, pues presupone aquello mismo que está en cuestión: los compromisos esencialistas se siguen sólo de la adopción previa de otros juicios de modalidad de re cuya función está precisamente en entredicho. Asimismo, argumento que esta misma conclusión puede extraerse de la consideración de algunas otras teorías contemporáneas de la individuación, similares a la de Wiggins. (shrink)

According to Essentialism, an object’s properties divide into those that are essential and those that are accidental. While being human is commonly thought to be essential to Socrates, being a philosopher plausibly is not. We can motivate the distinction by appealing—as we just did—to examples. However, it is not obvious how best to characterize the notion of essential property, nor is it easy to give conclusive arguments for the essentiality of a given property. In this paper, I elaborate on these (...) issues and explore the way in which essential properties behave in relation to other related properties, like sufficient-for-existence properties and individual essences. The paper presents a dilemma for both epistemic and non-epistemic versions of conceivability-based accounts of modal knowledge. On the one horn, non-epistemic accounts do not elucidate the essentialist knowledge they would be committed to. On the other, epistemic accounts do not elucidate everyday life de re modal knowledge. In neither case, therefore, do conceivability accounts elucidate de re modal knowledge.

Kit Fine advanced a remarkable objection to the Modal Account of Essentialism. Fine’s concern is commonly thought to have put the modal account in serious jeopardy. I believe that Fine’s objection is mainly based on two intuitions. As a reaction to Fine’s argument, while many scholars have abandoned the modal account, others have attempted to save it. The main strategy in the last direction consists in adding to the modal criterion a condition that is supposed to hold universally. For different (...) reasons, this strategy ends up rejecting part of the first Fine’s intuition. I believe that a modal contextualist approach to essentialist claims, through the addition of a ‘particularist’ condition to the modal criterion, can provide an interesting alternative for those who wish to maintain a modal approachto essentialism. I will show that this approach, while rejecting the second Finean intuition, is able to account for his first intuition. (shrink)

This paper aims to build a bridge between two areas of philosophical research, the structure of kinds and metaphysical modality. Our central thesis is that kinds typically involve super-explanatory properties, and that these properties are therefore metaphysically essential to natural kinds. Philosophers of science who work on kinds tend to emphasize their complexity, and are generally resistant to any suggestion that they have “essences”. The complexities are real enough, but they should not be allowed to obscure the way that kinds (...) are typically unified by certain core properties. We shall show how this unifying role offers a natural account of why certain properties are metaphysically essential to kinds. (shrink)

It seems plausible to say that what changes an entity can or cannot survive depends on its persistence conditions, and that these depend, in turn, on its sortal kind. It might seem to follow that an entity cannot belong to two sortal kinds with potentially conflicting persistence conditions. Notoriously, though, this conclusion is denied by ‘contingent identity’ theorists, who hold, for example, that a permanently coincident statue and piece of clay are identical, although the persistence conditions associated with the kinds (...) statue and piece of clay are potentially conflicting. A clash with Leibniz’s Law is avoided by treating modal predicates as what Harold Noonan has called ‘Abelardian predicates’, as in the version of ‘inconstant’ counterpart theory developed by David Lewis. In addition to other difficulties, however, there is a question whether this ‘Abelardian’ theory does justice to the intuitions expressed in such statements as that the piece of clay could, while the statue could not, have survived a radical reshaping of its matter. I present an argument, which I call ‘the vacuous satisfaction argument’, for the conclusion that the theory does indeed fail to capture the significance of such de re modal statements. (shrink)

This paper examines the legitimacy of two common methodologies within philosophy: thought experiments and conceptual analysis. In particular, I examine the uses to which these two methodologies have been put within modal epistemology. I argue that, although both methods can be used to reveal conditional essentialist claims (e.g. necessarily: if x is water, then x is H20), neither can be used to reveal the de re essentialists claims (e.g. x is water and x is essentially H20) they’re often taken to (...) reveal. I compare a Lewisian defence of monism with Kit Fine's defence of pluralism. I argue that the Lewisian defence is, at present, the clearer in its explanatory intent and ontological commitments. I challenge Fine to explain more fully the nature of the entities that he postulates and the relationship between continuous material objects and the parts of those rigid embodiments in terms of which he proposes to explain crucial, modal and sortal, features of those objects.

We outline a theory of the cognitive role of belief in absolute necessity that is normative and intended to be metaphysically neutral. We take this theory to be unique in scope since it addresses simultaneously the questions of how such belief is (properly) acquired and of how it is (properly) manifest. The acquisition and manifestation conditions for belief in absolute necessity are given univocally, in terms of complex higher-order attitudes involving two distinct kinds of supposition (A-supposing and C-supposing). It is (...) subsequently argued that the proposed acquisition and manifestation conditions are rationally interdependent, and that such harmony affords explanations of connections between different facets of belief in necessity that otherwise remain mysterious. The phrase ‘in virtue of’ is a mainstay of metaphysical discourse. In recent years, many philosophers have argued that we should understand this phrase, as metaphysicians use it, in terms of a concept of metaphysical dependence called ‘grounding’.This dissertation explores a range of central issues in the theory of grounding. Chapter 1 introduces the intuitive concept of grounding and discusses some compulsory questions in the theory of grounding. Chapter 2 focusses on scepticism on grounding, according to which the recent philosophical (...) interest in the topic is misguided. In chapter 3 I discuss grounding’s explanatory roles. Chapter 4 focusses on the claim that if an entity is grounded then it is an ontological free lunch. Chapter 5 discusses and rejects the claim that groundingis a relation between facts. This conclusion raises a problem: if grounding is not a relation between facts it becomes difficult to specify the connections between grounding and explanation and grounding and necessity. But not only is it desirable to specify these relations, it is essential for establishing that grounding is able to play the explanatory roles that are discussed in chapter 3. Chapter 6 responds to this problem by outlining an approach to grounding based on David Lewis’s (2003) theory of truthmaking. Against this backdrop I discuss, in chapter 7, some issues in the logic of grounding. (shrink)
