Carl Schmitt, one of the most influential legal and political thinkers of the twentieth century, is known chiefly for his work on international law, sovereignty, and his doctrine of political exception. This book argues that greater prominence should be given to his early work in legal studies. Schmitt himself repeatedly identified as a jurist, and Hugo E. Herrera demonstrates how for Schmitt, law plays a key role as an intermediary between ideal, conceptual theory and the messiness and complexity of practical, (...) concrete situations. Law is concerned precisely with balancing the extremes of theory and reality, and in this respect, Schmitt associates it with philosophical thinking broadly as being able to understand and explain the tensions in human experience. Reviewing and analyzing prevailing interpretations of Schmitt by Jacques Derrida, Heinrich Meier, and others, Herrera argues that the importance of Schmitt's legal framework is both significant and overlooked. Event of Signature formulates a new philosophical problem which focuses on the handwritten signature as sign of legal identification. Author Michaela Fišerová works with three metaphysical expectations, which are shared in discourses of graphology and forensic analysis. The first expectation tends to reveal the signer's soul: a handwritten signature "naturally" mirrors the unique psychological qualities of the signer. The second expectation tends to guarantee the originality of the signer's trace: a handwritten signature proves physical contact between the signed document and (...) the writing tool "authentically" moved by the signer's hand. The third expectation tends to recognize the signer's legal identity: a handwritten signature is expected to reproduce the signer's personal style, which enables identification by legal authorities. In a methodologically inventive and semiotically-based dialogue with Derrida's deconstruction, Fišerová situates this triple expectation in the interval between life and law. Challenging coverage of this topic finally shows that none of the metaphysical expectations will ever be fulfilled in the event of manual signing. Legal uses of handwritten signature are characterized by the complex aporia of repeating the unrepeatable. (shrink)

This article examines the issue of the paradoxicality of institution, de-institutionalization, or the counter-institutionalization in classical Chan thought by focusing on the texts of Hongzhou School. It first analyzes the problem of 20th century scholars in characterizing the Chan attitude toward institution as iconoclasts, and the problem of the recent tendency to return to images of the Chan masters as traditionalists, as opposed to iconoclasts. Both problems are examples of imposing an oppositional way of thinking on the Chan masters. The (...) essay then introduces a new paradigm for interpreting the Chan attitude toward institution, the model of de-institutionalization, which borrows certain insights from Derrida’s idea of the counter-institutional. However, the new model is supported by the Chan heritage of Mahayana Buddhist philosophy. This model can more consistently construe the Chan understanding of the paradoxicality of institution, the subtle Chan relationship of being “with and against” institution, and the Chan “middle way” to make institution remain open to its outside and to transformation. This article enquires into the value of 'concepts' as a framework for the school curriculum by questioning their contribution towards our responsibilities for thinking about the earth. I take Derrida's deconstructive reading of Plato's Timaeus to show how spaces in meaning can be revealed, and more transgressive ways of knowing invited in. Derrida's Kh ra marks the opportunity for something new, productive and unforeseeable to arise as the play of traces unfurls. A deconstructive reading of the geography national curriculum policy (...) exposes the impracticality and impossibility of following the text as a definitive scheme and basis for curriculum planning. The paper ends with a spacing of a real place for the geography curriculum by appropriating four different ways of knowing Whitby, a harbour town in north-east England, outside the conceptual scheme. The paper contrasts an approach that is essentially general, conceptual and at the level of the plan, map or net, with a deconstructive approach that welcomes in other, more ethically responsible and imaginative meanings. This paper is concerned with tracing how the notion of place circulates and is understood in literature from the 1980s and 1990s on computer-mediated information and communications technologies. It provides a brief account of at least two ways that the notion of place circulates in the discourse of the virtual. The first is that these technologies enable 'new' spaces that are claimed to be separate from conventional spaces and places. The second, contradictorily, is that the metaphor of place is crucial (...) as a setting for online social interaction. The paper also explores how we might understand the 'place' of place in the discourse of the virtual. It does this by drawing parallels from Jacques Derrida's critique of spatial metaphor in the text of philosophy with the use of place-based metaphors in the discourse of the virtual. This examination reveals that the reduction of place to metaphor in writing on virtual technologies belies the persistent and subtle force that is exerted by metaphor in general. Furthermore, the prevalence of place-based metaphors in the discourse of the virtual points to the ongoing importance of place as a wider concept. In particular, the notion of place is in fact fundamental to how virtual technologies are framed and understood. The paper concludes by sketching some of the possibilities and potential implications that emerge from this argument. (shrink)

The majority of those who comment upon the theories of Ernesto Laclau and Chantal Mouffe - both supporters and critics - treat the work of the two authors as a coherent unity. I see acute differences that demarcate the ideas of Laclau and Mouffe: differences that impede any straightforward delimitation of the authorial identity `Laclau and Mouffe'. The purpose of this paper is to bring to the fore the incommensurate political differences that separate the work of the two authors, and (...) to establish the superiority of Mouffe's position. At its most basic both authors view politics as described in their co-authored Hegemony and Socialist Strategy: i.e. `as a practice of creation, reproduction and transformation of social relations' (Laclau and Mouffe, 1985: 153). This agreement, however, conceals the fact that the authors describe the political articulation of social relations in distinct ways, and that those descriptions are implicated in, and reinforce, contrasting ethico-political commitments and prescriptions. These differences reflect the differences between the politics of the Marxist tradition retained by Laclau - albeit understood as a negative apparition of its former (ultimately) fully positive self - and Mouffe's radical democratic pluralism. This latter perspective - in its more recent formulations - represents a political compound of civic-republicanism with a defense of liberalism; this is a political imaginary that retains little if anything from the Marxist tradition. This paper explores the semiotic status of algebraic variables. To do that we build on a structuralist and post-structuralist train of thought going from Mauss and L vi-Strauss to Baudrillard and Derrida. We import these authors' semiotic thinking from the register of indigenous concepts (such as mana), and apply it to the register of algebra via a concrete case study of generating functions. The purpose of this experiment is to provide a philosophical language that can explore the openness of mathematical (...) signs to reinterpretation, and bridge some barriers between philosophy of mathematics and critical approaches to knowledge. One criticism of pragmatism, forcefully articulated by Stanley Cavell, is that pragmatism fails to deal with mourning, understood in the psychoanalytic sense as grief-work (Trauerarbeit). Such work would seemingly be as pertinent to philosophical investigations (especially ones conducted by pragmatists) as to psychoanalytic explorations. Finding such themes as mourning and loss in R. W. Emerson's writings, Cavell warns against assimilating Emerson's voice to that of American pragmatism, especially Dewey's instrumentalism, for such assimilation risks the loss or repression of Emerson's voice (...) in not only professional philosophy but also American culture. While granting Emerson's distinctive voice, this essay argues that the way Cavell insists on differences problematically represses recognition of the Emersonian strains in Dewey's own philosophical voice. In doing so, Cavell falsely flattens the resounding depth of Dewey's philosophical voice and narrows the expansive range of pragmatic intelligence. But Dewey all too often lends himself to such a misreading, for his writings at once repress and embody the strains of a distinctively Emersonian voice. (shrink)

This study explores Big Data practices at Facebook through an investigation of the role of commensuration or ‘the transformation of different qualities into a common metric’ in the structuration of analysis and interaction with a major online social media platform. It proposes a conceptual framework and demonstrates the empirical potential of a pragmatic approach based on reading published materials and available documentation. Facebook’s Data Warehousing and Analytics Infrastructure serves as an illustrative example to begin tracing out and describe data assemblages (...) in more detail. In being attentive to the motivations, drivers and challenges engineers face when dealing with Big Data, it is argued that their solutions can enable and support but also constrain specific analytical and transactional capabilities or data flows between various devices and actors. The analysis thus moves beyond methodological critiques of the utility of Big Data that lack empirical support and specificity. It is further argued that analytics not just describe but also actively participate in the enactment of social worlds, thereby opening possibilities for new markets or market segments to arise. Online sociality accounts for a model of the social that makes it visible and measurable qua markets inviting data recontextualisation and the creation of value along multiple axes. Contra Facebook’s claim to make the web more ‘social’, an investigation of commensuration brings to the fore the question how the social is accounted for in the first place. (shrink)

This essay explores Derrida's work on repetition in psychoanalysis and what Freud, in Beyond the Pleasure Principle, called the ‘compulsion to repeat’. Revising the model of the psyche that had to that point dominated his theory, Freud began in 1920 to ascribe greater significance to experiences of trauma and unpleasure, and to their recurrence in the analytic treatment. This type of repeated repetition ultimately suggested to Freud the existence of a ‘death drive’ antithetical to life. I examine here how Derrida (...) re-reads Beyond in The Post Card, analysing the way uncontrollable effects of repetition repeatedly undo Freud's efforts to make any progress on what lies beyond the pleasure principle. Another ‘logic’ of repetition, other than the one Freud invokes, inhabits Freud's text, threatening the fundamental opposition between the life drives and the death drive. But in reading Freud in this way, Derrida himself cannot quite ‘do justice to’ Freud, to the ambivalence at work in Freud's text. At certain key moments in his reading of Beyond the Pleasure Principle, I show, Derrida seems to restrict an ambiguity in Freud's thinking around the relation between life and death. What Derrida's reading makes legible in part, then, is Derrida's resistance to psychoanalysis, the tension inhabiting Derrida's dealings with Freud in The Post Card and beyond. (shrink)

This “irreality” of the noematic correlate is conceived by Derrida as the origin of sense and experience. Already in his _Of Grammatology_, Derrida maintained that the difference between the appearing and the appearance, between (...) the world and the lived experience, is the condition of all other differences. Unfortunately, Derrida limits himself to a few self-evident remarks, without further elaborating.The aim of this paper is twofold: on the one hand, to contextualize Derrida’s interpretation of the noema from a theoretical and historical perspective; on the other hand, to show its effects on the early moments of Derrida’s philosophy. The result will shed light on a neglected issue in the relationship between deconstruction and phenomenology. (shrink)

This article seeks to explore the metaphor ‘darkness and light’ and its relevance to education through hauntological study. It draws on the ideas of Derrida and Fisher to reveal that the metaphor functions in binary form and holds significations of truth, goodness and knowledge to subordinate oppositional ideas of darkness. Despite the everyday usage of this metaphor, the subordination of darkness is shown to be less positive than it would appear. Darkness and light also shows itself to be an archetypal (...) metaphor, meaning that it is founded in our depth-experiences of the world and is applicable in many varied contexts, therefore granting it a power to remain in everyday usage. The archetypal nature of this metaphor is uncovered through its utilisation in Plato’s ‘Allegory of the Cave’, thus opening a discussion about how it continues to haunt education today. Broadly, it is the faith in the supposed betterment available through education that is exposed. Finally, in a Derridean manner, this article explores how the metaphor of darkness and light could be overturned in relation to education, thus destabilising a foundational metaphor on which education currently lies. Such status is never fully understood, nor clear, due in part to its inutility. In a goal-oriented world, philosophizing is pointless if it does not produce material results. One point of philosophy though is not only to recognize, but promote activities which are uniquely human and which therefore artificial intelligence could not possibly simulate. Improvisation, as one such activity, can reveal the importance of philosophy as a discipline by maintaining the relevance of subjectivity. In order to justify the presence of philosophy in the university, one important way is to have philosophy maintain the notion that the mental cannot be reduced to the material or physical. Consequently, phenomenology in philosophy’s defense becomes more relevant the more we realize that philosophy is threatened by the interdependency of materialism, A.I. research, and the corporatization of the university. This essay advances an interpretation of early Christian codex books, which goes beyond Catherine Pickstock’s critique of Jacques Derrida. Firstly, it summarizes Derrida’s deconstruction of Plato’s Phaedrus and introduces his understanding of writing as différance. Secondly, it outlines Pickstock’s After Writing in order to understand her emphasis upon the liturgical nature of platonic dialogue. It is here that an ambiguity emerges between writing and codex books in Pickstock’s account. In response, the insights of book historians such as Roger Chartier will (...) be brought to bear in order to understand the longer history of the codex, which sees the printing press as a continuation of the early transition from roll to codex in the second century of the Common Era. It has long been noted that Christians of this period were early and pervasive adopters of codex binding for their sacred literature. By summarizing the reasons why, it will be shown how the codex expressed early Christian religious concerns. (shrink)

In this essay I address Derrida’s influential readings of the Course in General Linguistics attributed to Ferdinand de Saussure in Of Grammatology and Glas. I complicate Derrida’s charge of phonocentrism, that is, the charge that Saussure privileges the medium of sound and/or speech as a site of unmediated signifying presence, by re-examining the relevant sections from the Course in light of the materials related to Saussure’s linguistics from the Nachlass, some of them recently discovered. I document especially the extent of (...) editorial involvement in the sections discussed by Derrida that deal with the purportedly ‘natural’ expressions like onomatopoeias and interjections, and with the relation between speech and writing. I make the case that ultimately Derrida’s charge that Saussure’s linguistics is burdened by an allegiance to the metaphysics of presence carries limited force, and that Derrida’s and Saussure’s understanding of signification turn out to be closer related than previously thought: they share the view that entrainment and contamination are inevitable. Contemporary theorizations of neoliberalism are framed by a false dichotomy between, on the one hand, studies influenced by Foucault in emphasizing neoliberalism as a form of governmentality, and on the other hand, inquiries influenced by Marx in foregrounding neoliberalism as a hegemonic ideology. This article seeks to shine some light on this division in an effort to open up new debates and recast existing ones in such a way that might lead to more flexible understandings of neoliberalism as a discourse. (...) A discourse approach moves theorizations forward by recognizing neoliberalism is neither a ‘top-down’ nor ‘bottom-up’ phenomena, but rather a circuitous process of socio-spatial transformation. Food policy increasingly attempts to accommodate a wider and more diverse range of stakeholder interests. However, the emerging influence of different communities and networks of actors with localized concerns and interests around how food should be produced and traded, can challenge attempts to achieving more open, sustainable and globally-integrated food chains. This article analyses how cultural factors internal to a developed country can disrupt the export of food to a developing country. A framing analysis is applied to examine how activists (...) using social media to interact with the traditional news media in Australia were able to inflame public opinion and provoke outrage to disrupt the policy agenda. The paper contains a case study analysis of the media controversy in 2011 around the slaughter of beef cattle in Indonesian abattoirs and the subsequent banning of live cattle exports to Indonesia by Australia. The analysis draws on the theory of binary cultural oppositions to examine how practices in relation to the slaughter of beef cattle in Indonesia were reframed, through extensive media coverage of moral outrage into a critique of the values and cultural practices of Indonesian society. This essay is a critique of Derrida's ethical works, using Camus's last novella The Fall as a critical sounding board. It argues that a danger pertains to any such highly self-reflexive position as Derrida's: a danger that Camus identified in The Fall, and staged in his character, Jean-Baptiste Clamence. Clamence is a successful Parisian lawyer, on top of his personal and professional life, whose equanimity is troubled after he is the unwitting passer-by as a young woman suicides one night on (...) the Seine. After this time, he comes to consider all his former virtues as concealed vices. He also becomes acutely aware of what he terms the 'duplicity' of human beings as such. In Part I, I consider how Clamence's fall from innocence can be read 'with' Derrida's deconstructive registration of a 'double bind' pertaining to our standing vis-á-vis what he terms 'logocentrism'. I argue that Derrida's is a post-lapsarian philosophy, which challenges all attempts to construct closed conceptual systems that would confer an epistemic and/or moral certitude upon their expositors. In Part II, I then enter into a more detailed exposition of Derrida's 'later' works broaching friendship, the invitation, the gift, and other 'matters moral'. I read these texts in the light of an examination of what is involved, for Camus, in being a 'judge-penitent' (what Clamence in The Fall calls his profession). I suggest that Derrida runs the risk of a certain 'puritanism of difference' in his moral reflections, which defend the aporetic formulation: 'tout autre est tout autre' [every other is every bit other] (The Gift of Death). The problem is that, while Derrida's position allows one (everywhere) to say what one is against, it problematizes any affirmative moral stance. Like Clamence, who assumes the right to judge everyone else because he has subjected himself to a severe penitence, I suggest that we have a right to wonder whether Derrida's deconstructive critique of metaphysics can validate only endless repetitions of itself. This paper argues, first, that the legal construction of transsexualism is a matter of interest, not only to members of the trans community, but to all students of gender, including feminists. The paper then proceeds to explain and analyse, using feminist perspectives, key aspects of the Gender Recognition Act 2004 in the light of the recent caselaw concerning the rights of trans persons. The 2004 Act, it is argued, is a conservative move, which attempts to deny the threat transsexualism poses (...) to the binary system of gender, by instigating a system to formally ‘recognise’ only men and or women. However, the way in which the Act constructs the public/private divide and the mind/body relation carries potential for legal recognition of subject positions which may in a variety of ways be ‘beyond’ the binary system that is currently orthodox. The paper can as such be read as a case study in the legal (re)construction of gender, the gender/sex relation, and the widespread tendency to construct gender conservatively. (shrink)

This paper examines the relation or, more precisely, tension between postmodern deconstruction and ethics by elaborating upon the ethico-political dimensions of deconstructionism. It embarks on a critical assessment of postmodern discourse on ethics in view of its political implications by analyzing Jacques Derrida''s and Richard Rorty''s arguments with an assumption that their positions represent a certain logic in the postmodern discourse on ethics. Postmodern ethics is based on incredulity with regard to traditional metanarratives, and it defines ethics in terms of (...) sensitivity or responsibility to otherness and difference. Its proponents believe that the negation of modern metanarratives opens a way to the Other which has been marginalized and suppressed both in thought and in social practice. Derrida and Rorty represent this position with their emphasis on the ethical nature of deconstruction and the need to elaborate new languages for ethics. Despite postmodern appeal to ethics of this sort, however, postmodern thinking shows its limits in dealing with most ethical-political matters in the contemporary world. The postmodern approach to ethics, being restricted within the perspective of the individual, does not provide any determinate framework for deciding how to adjudicate conflicting ethical claims or how to link the unconditional affirmation of emancipatory ideals, enlightened social criticism, and democratic accountability in determinate political terms. In the main, this paper contends that philosophical deconstruction and responsibility to otherness undermine each other in the public sphere. (shrink)

Jeffrey Tulis’s The Rhetorical Presidency is deceptively titled. It is not about rhetoric or political symbolism or even about the American presidency as such, as were many postmodern studies produced in the Reagan era. Rather, Tulis re‐situates rhetoric: a minor theme in a story about the presidency becomes an important avenue into profound questions of political order and republican governance. Like Tulis, I approach my thesis obliquely; I distinguish his from other, seemingly similar, works to underscore what I see as (...) the book’s lasting legacy: its explication of the double binds and central paradoxes of republican governance , and its articulation of the role of rhetoric in institutional transformation. The deconstructing angel: nursing, reflection and evidence‐based practice This paper explores Jacques Derrida's strategy of deconstruction as a way of understanding and critiquing nursing theory and practice. Deconstruction has its origins in philosophy, but I argue that it is useful and relevant as a way of challenging the dominant paradigm of any discipline, including nursing. Because deconstruction is notoriously difficult to define, I offer a number of examples of deconstruction in action. In particular, I focus on three critiques of reflective (...) practice by the meta‐narrative of evidence‐based practice (EBP) and attempt to show how those critiques can be directed back at EBP itself. I conclude with the observation that EBP is open to many of the criticisms that it directs at other discourses, including problems of a lack of empirical evidence, of distortions due to memory, and of falsification of the ‘facts’. Patient education materials have the potential to strengthen the health literacy of patients. Previous studies indicate that readability and suitability may be improved. The aim of this study was to explore and analyze discourses inherent in patient education materials since analysis of discourses could illuminate values and norms inherent in them. Clinics in Sweden that provided colorectal cancer surgery allowed access to written information and ‘welcome letters’ sent to patients. The material was analysed by means of discourse analysis, embedded in (...) Derrida's approach of deconstruction. The analysis revealed a biomedical discourse and a hospitality discourse. In the biomedical discourse, the subject position of the personnel was interpreted as the messenger of medical information while that of the patients as the carrier of diagnoses and recipients of biomedical information. In the hospitality discourse, the subject position of the personnel was interpreted as hosts who invite and welcome the patients as guests. The study highlights the need to eliminate paternalism and fosters a critical reflective stance among professionals regarding power and paternalism inherent in health care communication. (shrink)

It is our contention that a foundational relation with assessment organises contemporary education. Here we draw on a 'way of thinking' that is deconstructive in its intent. Such thinking makes clear the vicious circularity of the argument for improvement, wherein assessment valorised in discourses of improvement provides not only a rationalisation for improvement via assessment, but also the very (...) means of achieving such possibilities via targets grounded in limited specifications of assessment. On reading Heidegger's 'question concerning technology' we sought to reconsider the vicious circle of improvement in relation to Being. We claim that the means-ends driven technology of assessment, rather than being at our disposal and under our control, only serves to reveals the Real to us in accordance with the restricting principle of reason. The principle of reason, we argue, grounds 'Enframing' that ranks and orders the very beings of education as objects to produce an objective 'world as picture', rather than opening the possibility of their identity as belongings with a movement of difference. So, 'improvement' becomes normative and binding for institutions and practices on grounds of the principle of assessment, and renders agents of education as functionaries of 'Enframing'. (shrink)

This paper considers a key text in the field of Cultural Studies for its relevance to questions about the identity of knowledge in education. The concept of ‘aura’ arises as being of special significance in ‘The Work of Art in the Age of Mechanical Reproduction’ as a way of understanding the change that occurs to art when mass reproduction becomes both technologically possible and industrially realised. Aura seems to signify something of the symbolic halo generated by objects of special significance (...) that is both powerful and indefinite. This paper argues that aura is in fact the necessary property of symbolic representation—and that it attaches as much to the figure of Walter Benjamin as it does to any canonical work of art. But the paper also claims that Benjamin’s argument about the significance of popular forms of art—particularly photography and film—can be updated and applied to critical questions about the established order of knowledge in education. This is particularly relevant to those curriculum domains where specific objects—texts, for example—are invested with powerful auras. Marx's call for a materialism capable of engaging reality as ‘sensuous human activity’ opens a question about the role of representation in relation to data. Images have increasingly been seen as significant forms of data in the history of education. Derrida's theory of the spectre—a variation on the positions established in his earlier works on the trace, the supplement and differance—offers a way of rethinking visual images, their relations with existing discourses of knowledge and with positioned subjects who makes sense. Derrida's early reluctance to spell out political implications of deconstruction gave way during the course of the 1980s to a series of analyses of political concepts and issues. This article identifies the principal intellectual strategies of Derrida's political engagements and provides a detailed account of his concept of ‘democracy to come’. Finally, it suggests several points of contact between Derrida and recent liberal political philosophy, as well as some areas in which deconstructive analyses require further refinement if fruitful exchange is (...) to occur. My aim in this article is to analyse the incrimination of ontology and ontological manifestations in reason, articulated speech and social order and argue that such an incrimination, which is characteristic of traditional philosophy, can be explained as a phenomenon of onto-theology. Then I demonstrate that the ideas of Levinas - and to some degree the Derridean response to them - suffer from residues of onto-theology to the extent that they preserve and promote the assumption that ontology is essentially violent. (...) I claim that the Levinasian priority of ethics over ontology and the Derridean treatment of the opposition ‘ethics vs ontology’ rest on an epochal understanding of being. Such an understanding arrests time and echoes old religious doctrines that traditional philosophy preserved in a secular form and handed down to contemporary philosophical thinking. By charging Levinasian and Derridean ideas with onto-theology, I unveil what I consider to be one of the last dogmas of Occidental thought, i.e. the assumption that self-interest and violence are somehow endemic in the human condition. I suggest that we overcome this assumption, if we truly wish to view the I-Thou relation Other-wise.
