Care ethicists have long insisted that Kantian moral theory fails to capture the partiality that ought to be present in our personal relationships. In her most recent book, Virginia Held claims that, unlike impartial moral theories, care ethics guides us in how we should act toward friends and family. Because these actions are performed out of care, they have moral value for a care ethicist. The same actions, Held claims, would not have moral worth for a Kantian because of the (...) requirement of impartiality. Although Kantian moral theory is an impartial theory, I argue that the categorical imperative in the Formulation of Humanity as an End and the duty of respect require that we give special treatment to friends and family because of their relationships with us. Therefore, this treatment does have moral value for a Kantian. (shrink)

This paper develops a Kantian account of the moral assessment of institutions. The problem I address is this: while a deontological theory may find that some legal institutions are required by justice, it is not obvious how such a theory can assess institutions not strictly required (or prohibited) by justice. As a starting-point, I consider intuitions that in some cases it is desirable to attribute non-consequentialist moral value to institutions not required by justice. I will argue that neither consequentialist nor (...) virtue-ethical accounts account for these intuitions, suggesting that a distinctive deontological account is needed. The account I give is drawn from Kant’s Metaphysics of Morals; I distinguish it from Kantian views of institutions developed by Barbara Herman and Onora O’Neill. In this paper, I try to make sense of the possibility of several forms of voluntarily undertaken “sexual obligation.” The claim that there can be sexual obligations is liable to generate worries with respect to concerns for gender justice, sexual freedom, and autonomy, especially if such obligations arise in a context of unjust background conditions. This paper takes such concerns seriously but holds that, despite unjust background circumstances, some practices that give rise to ethical sexual obligations can actually ameliorate some (...) of the problems caused by such background conditions. Similarly, despite a surface appearance that sexual obligation and sexual autonomy are in tension, this need not be the case. By understanding how practices and conventions regulate the way such obligations can arise, this paper shows how supporting the possibility of sexual obligation can actually facilitate individual efforts to achieve sexual autonomy. Resumen: Este texto se concentra en el valor de las relaciones de cuidado y en la política pública que debe adoptarse en relación con ellas. Defiendo que, en consonancia con lo que argumenta Elizabeth Brake, debido a que las RC son una de las bases sociales del respeto propio, el mismo marco de apoyo que las leyes maritales ofrecen actualmente a las relaciones biamorosas debe ser accesible a otras RC consensuadas entre adultos -como las amistades a largo plazo, las relaciones (...) entre cohabitantes y las poliamorosas-. Sin embargo, a diferencia de lo que sostiene Brake, argumento que debemos evitar usar el término "matrimonio" para referirnos legalmente a cualquier RC. En concreto, mi propuesta es extender los derechos asociados con el matrimonio a otras RC entre adultos y suprimir dicho término por completo en la legislación.: This paper focuses on the value of caring relationships and the public policy that should be adopted regarding them. I defend that, as Elizabeth Brake has argued, considering that such relationships are one of the social bases of self-respect, the same legal protective framework that it is now accessible to bi-amorous relationships under marriage law should be available to other caring relationships between adults -such as long-term friendships, long-term cohabitations and poli-amorous relationships. However, unlike Brake, I hold that we should avoid referring legally by the term 'marriage' to any caring relationship. In short, my proposal is to extend the rights associated to marriage to other caring relationships between adults and to eliminate such term from legislation all together. (shrink)
