ABSTRACTP.F. Strawson claimed that forgiveness is such an essential part of our moral practices that we could not extricate it from our form of life even if we so desired. But what is it about forgiveness that would make it such a central feature of our moral experience? In this paper, I suggest that the answer has to do with what I will call the normative significance of forgiveness. Forgiveness is normatively significant in the sense that, in its paradigmatic instances, (...) forgiving alters the operative norms bearing on the interaction between the victim and the wrongdoer in certain characteristic ways. My project here is, first, to clarify the ways that paradigmatic cases of forgiveness alter the norms of interaction between victim and wrongdoer and to argue that it is in this respect that forgiveness is a normatively significant feature of our moral responsibility practices. Philosophers writing on forgiveness typically defend the Resentment Theory of Forgiveness, the view that forgiveness is the overcoming of resentment. Rarely is much more said about the nature of resentment or how it is overcome when one forgives. Pamela Hieronymi, however, has advanced detailed accounts both of the nature of resentment and how one overcomes resentment when one forgives. In this paper, I argue that Hieronymi’s account of the nature of forgiveness is committed to two implausible claims about the norms (...) bearing on forgiveness. Her account is highly instructive, however, for it brings into relief how certain intuitive views about the norms of forgiveness should be used to constrain our theories about its nature. By the start of the twenty-first century, the notion of ‘the sublime’ had come to seem incoherent. In the last ten years or so considerable light has been shed by empirical psychologists on a related notion of ‘awe’, and a fruitful dialogue between aestheticians and empirical psychologists has ensued. It is the aim of this paper to synthesize these advances and to offer what I call a ‘two-tiered’ theory of the sublime that shows it to be a coherent aesthetic category. (...) On this theory, sublime experiences begin in an ‘awe response’ (the ‘thin sublime’) and might, with the additional element of temporally-extended reflection, turn into a ‘thick sublime’ response. Building on accounts of the sublime as a species of ‘aesthetic awe’ (Clewis, 2019a and 2019b; Arcangeli, et al., 2020) I aim to show that this two-tiered theory helps to explain why sublime experiences seem to have a basic, primordial core, but also seem to be historically and culturally quite variable (as Nicolson, 1963 [1959]; Battersby, 2007; and McMahon, 2017 have stressed). On this model, the cultural and historical variability comes in largely at the point of the temporally-extended reflection characteristic of the thick sublime, due to the cognitive stock that the subject brings to the encounter. Thus, sublime experiences really lend themselves to being interpreted quite variously by the subject (as well as by the theorist) of these experiences, as, for example, affording insight into the Divine, our moral vocation, or our metaphysical unity with the entire universe, among other lofty thoughts. Are we justified in keeping the demented in prison for crimes they committed when they were still healthy? The answer to this question is an issue of considerable practical importance. The problem arises in cases where very aged criminals exhibit symptoms of dementia while serving their sentence. In these cases, one may wonder whether lodging these criminals in penal institutions rather than in normal caretaking facilities is justifiable. In this paper, I argue that there are justificatory reasons for punishing the (...) demented for their past crimes. In part 2, I examine three theories of punishment—retributivism, prevention theories and expressivism—with regard to the question of whether they provide justificatory reasons for punishing the demented. I argue that only expressivism provides these reasons. In part 3, I defend the view that expressivism, though not convincing as a general theory of punishment, is plausible if applied only to a specific subclass of punitive actions. More precisely, expressivism, or so I argue, is plausible with regard to those acts of punishment that consist in intending to inflict suffering without actually inflicting suffering. Since the punishment of demented patients falls within this class, it can be justified on an expressivist basis. In part 4, I discuss six objections to my view and rebut them. (shrink)

What, if anything, gives us the right to ask the victim of our wrongdoing for forgiveness? After some conceptual clarifications, I attempt to lay open a paradoxical structure in apologies. Apologies are made in a spirit of humility: if the offender recognizes his guilt, he will see the victim᾽s negative emotions towards him as proper and justified. Nevertheless, by begging for forgiveness, he tries to change the victim᾽s negative feelings towards him. Thus, by apologizing, the offender tries to bring about (...) a state of affairs which, if genuinely repentant and remorseful, he has no reason to want to bring about. In what follows, I examine various attempts to dissolve this paradox. These include offering reasons for apologies that are independent of our wish to alter the victim᾽s feeling of resentment and construing apologies as expressive or as mixed speech acts. All of these attempts, or so I argue, fail. Some of them fail to provide justificatory reasons for asking for forgiveness, others fall short of explaining why apologies can be accepted or rejected, still others cannot give a convincing account of the relation between remorse and asking for forgiveness or fail to distinguish between redressing a harm and redressing a moral wrong. The upshot of the argument is that an offender who recognizes his own guilt has no rational reason for asking for forgiveness. In many cases, not offering one᾽s apologies is a sign of taking guilt seriously. (shrink)

Beim eingeschränkten Fokus auf Wahrheit und dem Hervorbringen von „Beweisen“ im Kontext der türkischen Leugnung des Genozids an den ArmenierInnen wurde einem wesentlichen ethischen Problem bisher keine sonderliche Beachtung geschenkt: Dass innerhalb dieser sozial situierten, kooperativen Praxis der Etablierung von Wissen über die historischen Tatsachen – also darüber, was passiert ist und wie diese Geschehnisse zu interpretieren sind – Ungerechtigkeiten im Hinblick darauf entstehen können, wen man als glaubwürdige epistemische Akteure anerkennt. Gemäss dieser Überlegung soll dieser Beitrag zeigen, inwiefern Nachfahren (...) von Genozidopfern durch institutionalisierte Genozidleugnung einer erneuten Dehumanisierung zum Opfer fallen, nämlich der epistemischen Ungerechtigkeit. Diese besagt, dass den Nachfahren der Opfergruppe die Glaubwürdigkeit und damit epistemische Autorität auf der Grundlage ihrer sozialen Zugehörigkeit abgesprochen wird. In diesem Sinne kann die Genozidleugnung als eine fortgesetzte Unterdrückung und Delegitimierung der Opfergruppe, respektive Herabwürdigung ihrer Mitglieder verstanden werden, diesmal im Gewand einer Aberkennung ihrer essentiellen menschlichen Fähigkeit, Wissen zu generieren und weiterzugeben, sowie ihre Unrechtserfahrungen sich und andern intelligibel zu machen. Particular conceptions of reconciliation vary across a number of dimensions. As section 1 explains, the kind of relationship at issue in a specific context affects the type of improvement in relations that might be necessary in order to qualify as reconciliation. Reconciliation is widely taken to be a scalar concept. Section 2 discusses the spectrum of intensity along which kinds of improvement in relationships fall, and indicates why, in particular contexts, theorists often disagree about the point along this spectrum that (...) is morally or politically most significant. Section 3 provides an overview of the processes commonly cited as contributing to reconciliation. These processes are often controversial; those praised by some commentators as appropriate and constructive responses to past conflict are dismissed by others as undermining the moral or political conditions for just and peaceful relations. Section 4 concentrates on the relationship between reconciliation and justice. While some see these values as compatible and mutually supporting, others argue that, especially in the immediate wake of conflict, parties must often choose between reconciliation and justice. In this article, I address the issue of whether we have an obligation to remember past immoral actions. My central question is: do we have an obligation to remember past moral transgressions? I address this central question through three more specific questions. In the first section, I enquiry whether we have an obligation to remember our own past transgressions. In the second section, I ask whether we have an obligation to remember the wrongful actions that others have committed against ourselves. (...) In the last section, I investigate whether we have a duty to remember the suffering of victims of crimes that have a political aspect, crimes such as state violence, oppression and racial discrimination, for example. Here I use the term ‘obligation’ in a board sense to refer to actions that are recommended from the moral point of view, that is, when we have moral reasons to act in a certain way. Here I decided to explore these issues from a Kantian perspective. At first glance, Kant does not seem to have much to offer to an ethics of memory since he does not ask these questions directly. Nevertheless, I was interested to explore to what extent Kant’s ethics, and Kantian ethics more generally, can give us tools to answer these questions. What I have discovered is that, despite my initial doubts, the Kantian framework can provide us with materials to build arguments that can help us to answer these questions. In fact, I will argue that in Kant’s ethics, we have an obligation to remember past immoral actions. With regard to our own transgressions, I argue that we ought to remember our past transgressions because this is an aspect of our moral development. With regard to others’ transgressions, I argue that we have a duty of self-respect to demand that others respect us (in the Kantian sense, that is, that others treat us in a morally correct way) and that this involves remembering others’ transgressions, particularly when there is no evidence of their repentance or if they have not apologized. However, if we have (fallible) reasons to think that the wrongdoer has repented, then there is certainly no need to continue to remind them of their offenses. Thus, in the first two sections, my arguments are based on a certain interpretation of Kant’s ethical texts. However, when I address the political dimension of the ethics of memory I have based my arguments on the work of contemporary authors, especially Jeffrey Blustein. In the last section then, the perspective is more ‘Kantian’ than Kant’s. I argue that we have a duty to remember the victims of social and political injustice (social and political violence, oppression, discrimination, atrocity and crimes against humanity). Defenders of the importance of political memory usually appeal to consequentialist arguments. However, these arguments have limits. A Kantian perspective (deontological) is relevant here because it allows us to provide new arguments in support of the importance of political memory and thus ultimately to provide a stronger defense of duties of memory. -/- The issues that arise in relation to an ethics of memory will no doubt require that we study other sources in addition to the materials and arguments provided from a Kantian perspective. Nevertheless, I conclude that perhaps a bit surprisingly, the Kantian tradition has more to offer than it initially seemed, and it can certainly provide part of the theoretical framework to develop an ethics of memory. I argue that political forgiveness is sometimes, but not always, compatible with public commemoration of politically motivated wrongdoing. I start by endorsing the claim that commemorating serious past wrongdoing has moral value and imposes moral demands on key actors within post-conflict societies. I am concerned with active commemoration, that is, the deliberate acts of bringing victims and the wrong done to them to public attention. The main issue is whether political forgiveness requires forgetting and conversely whether remembrance can be an (...) impediment to political forgiveness. The notion of political forgiveness, its definition, very possibility and desirability are contentious issues in the contemporary literature. I develop a multidimensional account of political forgiveness with a core element. The core element of political forgiveness involves taking a non-adversarial stance towards perpetrators in the sense of committing to stop holding their wrongdoing against them. The core element of forgiveness is usually combined with other attitudes and practices, which are appropriate depending on the circumstances. This is due to the fact that there are different ways of holding a wrong against an offender. I argue that forgiving perpetrators is not compatible with continue to punishing them, refusing to reconcile with them, and/or reminding them of their misdeed if perpetrators refuse to accept punishment, deny the importance of commemorating the past or wish to reconcile against the victim’s desires. I show that some forms of political forgiveness are not morally legitimate because they conflict with moral demands to punish perpetrators, commemorate atrocities and respect victims. This conclusion is less alarming than it might initially seem because the refusal to forgive politically motivated wrongdoing does not necessarily lead to the perpetuation of violence and conflict. I briefly draw on the example of Argentina in order to show how some forms of political un-forgiveness can be morally legitimate and effective ways for victims to uphold these demands. (shrink)
