This article provides background and analysis of this critical distinction by placing it in conversation with the works of Henry Parker and in the context of the English Civil War, especially as regards the discussion of prudence, interests and crisis. First, it (...) becomes clear that for both Parker and Hobbes, counsel serves as a foundation to their arguments about the placement and function of sovereignty. Second, in grounding their arguments about sovereignty in the discourse of counsel, both authors – intentionally or unintentionally – undermine the previously critical discourse of counsel. Finally, we see that especially Hobbes’s engagement with and overthrow of the discourse of counsel profoundly alters of the terms and focus of modern political debate, moving from a ‘monarchy of counsel’ to a discussion of political sovereignty. The literature contains two concepts of corruption which are often confused with one another: corruption as twisted character (pollution), and corruption as disloyalty. It also contains two sites for corruption: the corruption of individuals, and the corruption of entire institutions such as a state or a legislature.This paper first draws a clear distinction between the pollution and disloyalty concepts of corruption in the individual context, and then defends a conception of disloyalty corruption according to which the distinguishing feature is an (...) agent who uses powers delegated to her from her principal as her own. Then, the paper shifts gears to the institutional context, arguing that the best account of institutional corruption in the extant literature is of the pollution kind. It then fills the remaining logical space by laying out a conception of institutional corruption as disloyalty and explaining its moral significance for the political legitimacy of a democracy. Intellectual history is usually seen as essentially historical. It is – but it is also essentially philosophical, both when theorising intellectual history, which some intellectual historians do, and when interpreting texts, which all intellectual historians do. I demonstrate this symbiosis between history and philosophy via critical reflections on Martin Jay’s recent book Genesis and Validity. Philosophical analysis, closely integrated with historical examples, suggests that we should significantly rethink Jay’s theorisation of the relationship between genesis and validity (e.g. whether ideas from (...) one context are valid in others). But the symbiosis between history and philosophy matters more when interpreting texts. Philosophical analysis is a powerful tool for recovering what authors meant, understanding how their ideas fit together, and seeing similarities and differences between ideas, as I show with examples from Quentin Skinner’s interpretations of Machiavelli, Hobbes and others. Yet even Jay and Skinner – two of the world’s most philosophically astute intellectual historians – overlook the crucial symbiosis between history and philosophy. (shrink)

This paper offers a systematic analysis of Hobbes’s practical political thought. Hobbes’s abstract philosophy is rightly celebrated, but he also gave much practical advice on how to avoid disorder. Yet he is typically interpreted too narrowly in this respect, especially by those who only read him economistically. Other scholars supplement this economistic focus with sociological or political interpretations, but to my knowledge, no one stresses all three aspects of his thought. This paper thus examines each of Hobbes’s practical proposals for (...) avoiding corruption and a state of nature. Hobbes clearly uses economistic, sociological and political approaches, which involve shaping incentives, desires/preferences, and opportunities, respectively. This intentionally anachronistic framework helps us see further, highlighting Hobbes’s rich and wide-ranging practical proposals for avoiding disorder – a crucial part of his theory. (shrink)

The article surveys the history of “terror” vis a vis the development of international humanitarian and human rights law. During the French Revolution, the word “terror” was coined to describe a deviation from the laws of war. Justified by a mixture of ideology and necessity. People who resort to terrorism either suspends or rejects the laws of war (jus in bellum) in the name of an alternative and heightened sense of truth. However, the terrorists’ strong sense of probity and mission (...) is also an opening for re-establishing communication, arbitration and mitigation of cruelty and destruction. This paper represents International Humanitarian Law (IHL) as an “abstract Leviathan”, submission to which is the contemporary norm of pacification. From the perspective of radical terrorism, it is tyrannical. From other perspectives, it is open to criticism and change. Most importantly, it is on the side of rational arbitration rather than arbitrary ordeal. Even radical terrorism, which refuses to recognize the legitimacy of the abstract Leviathan, seeks to communicate its radical messages rather than to seek victory my means of physical annihilation of its opponents.
