While theorists of cultural pluralism have generally supported tribal sovereignty to protect threatened Native cultures, they fail to address adequately cultural conflicts between Native and non-Native communities, especially when tribal sovereignty facilitates illiberal or undemocratic practices. In response, I draw on Jürgen Habermas' conceptions of dis-course and the public sphere to develop a universalist approach to cultural pluralism, called the 'intercultural public sphere', which analyzes how cultures can engage in mutual learning and mutual criticism under fair conditions. This framework accommodates (...) cultural diversity within formally universalistic parameters while avoiding four common criticisms of universalist approaches to cultural pluralism. But this framework differs from that of Habermas in two ways. First, it includes 'subaltern' publics, open only to members of cultural subgroups, in order to counter relations of 'cultural power'. Second, it admits 'strong' publics, democratic institutions with decision-making powers. Finally, I show how the subaltern, strong institutions of tribal sovereignty contribute to the fair discursive conditions required for mutual learning and mutual critique in an intercultural public sphere. Para responder a esta paradoja, varios filósofos ubicados en el espacio teórico del antihumanismo se han visto forzados a repensar, y en cierto modo a recuperar, lo humano. Judith Butler ofrece uno de los tratamientos más sofisticados de esta cuestión en la (...) medida en que propone, según nuestra hipótesis, no un nuevo concepto de lo humano o un nuevo humanismo, sino distintas figuras de lo humano articuladas en torno a dos vértebras fundamentales: la impropiedad y la precariedad. Al explorar la tensión que modula la relación entre estas dos vértebras, sostenemos que Butler estaría sentando las bases para una antropología política crítica, antihumanista y no antropocéntrica. The paper traces the role of ‘women’ in Seyla Benhabib's work. It argues that this tracing helps to make clear the way that Benhabib's latest work relies on assuming distinctive political temporalities between the international (cosmopolitan and moral) and the domestic (democratic and political) spheres. The international is characterised by an unlocatable linear temporality of moral learning that draws on Habermas's reading of Kant's philosophy of history. In contrast, in the domestic, cosmopolitan temporality enters into a dialectical relation with an (...) Arendtian, republican temporality that is open and unpredictable and is clearly located within the (revisable) boundaries of political community. (shrink)

ABSTRACT:Organization theory and business ethics are essentially the positive and normative sides of the very same coin, reflecting on how human cooperative activities are organized and how they ought to be organized respectively. It is therefore unfortunate that—due to the relatively impermeable manmade boundaries segregating the corresponding scholarly communities into separate schools and departments, professional associations, and scientific journals—the potential symbiosis between the two fields has not yet fully materialized. In this essay we make a modest attempt at establishing further (...) connectivity by surveying the terrain covered by the two disciplines jointly, as if the boundaries between them did not matter. We commence by providing a concise overview of the organization theory discipline for interested non-specialists from the field of business ethics. Next, we proceed to point out four research themes commonly investigated by members of both communities, and also a variety of organization-theoretical perspectives on each. In the final part of this essay we explore what organization theory has to offer business ethics, and what the boundaries of that potential contribution are. We warn skeptical readers in advance that the spirit and tone of our essay is most definitely upbeat, as we are convinced that the potential for symbiosis between the two fields is vast and inspiring, even though it has only been unleashed partially and incidentally thus far. ABSTRACT:Partnerships between companies and NGOs have received considerable attention in CSR in the past years. However, the role of NGO legitimacy in such partnerships has thus far been neglected. We argue that NGOs assume a status as special stakeholders of corporations which act on behalf of the common good. This role requires a particular focus on their moral legitimacy. We introduce a conceptual framework for analysing the moral legitimacy of NGOs along three dimensions, building on the theory of deliberative democracy. (...) The current health legislation recognizes minors’ capacity to make decisions or, at least, to take part in those that affect them, according to their age and maturity. But this capacity is not promoted. Capacitating minors to make their own decisions is still a challenge, because it requires something that today is not happening: autonomy has to be understood not as a state, but as a process that needs support. Our proposal is that this support should be based on recognizing minors (...) as vulnerable persons, that is to say, as persons with emotional needs, who are the subjects of rights and duties, and who have social needs of self-fulfillment. All in all, autonomy has to be understood as a process based on recognizing minors’ dignity as a previous condition to help them acquire those typical capabilities of autonomous persons. This concept of support requires, in the first place, a change of the social view of minors. (shrink)
