Kants Kritik der praktischen Vernunft (1788) steht zu Unrecht oft im Schatten der Kritik der reinen Vernunft und der Grundlegung zur Metaphysik der Sitten. Tatsächlich sind die Grundelemente der Kantischen Moralphilosophie im Gegensatz zu vielen Thesen der ersten Kritik bis heute weitgehend anerkannt, und erst der Nachweis der zweiten Kritik, dass Freiheit wirklich ist, macht "den Schlussstein von dem ganzen Gebäude eines Systems der reinen, selbst der spekulativen Vernunft aus". Entlang der Stichworte reiner Wille, gesetzgebende Form der Maxime, transzendentale Freiheit, (...) Autonomie und Faktum der Vernunft zeigt Kant in der "Analytik", dass reine Vernunft "für sich" praktisch sein, nämlich den Willen bestimmen kann. Die "Dialektik" sichert den Ideen von der Existenz Gottes und der Unsterblichkeit der Seele objektive Realität und untersucht das Verhältnis von theoretischer und praktischer Vernunft. Die "Methodenlehre" schließlich skizziert eine Theorie moralischer Erziehung, die für den heutigen Ethikunterricht noch aktuell ist. Die zwölf Beiträge dieses kooperativen Kommentars, der anlässlich des 300. Jubiläums Immanuel Kants in einer 3., überarbeiteten Auflage erscheint, rekonstruieren die Argumente eines Schlüsseltextes der Moralphilosophie und prüfen die sachliche Überzeugungskraft. _Essays on Beauvoir’s influences, contemporary engagements, and legacy in the philosophical tradition._.

Contemporary Kant-scholarship has a tendency to allign Kant’s understanding of depravity closer to Erasmus than Luther in their famous debate on the freedom of the will (1520–1527). While, at face value, some paragraphs do warrant such a claim, I will argue that Kant’s understanding of the radical evil will draws closer to Luther than Erasmus in a number of elements. These elements are (1) the intervention of the Wille for progress towards the good, (2) a positive choice for evil, (3) (...) the inscrutability of moral progress, (4) the rejection of prudence as a means for salvation and (5) the rejection of moral sentimentalism. I believe that Kant-scholarship mistakenly pegs Kant’s rational Enlightenment optimism for an existential optimism while Kant’s view of fallen nature draws closer to Lutheran than Erasmusian depravity. A tacit Lutheran influence pervades Kant’s moral philosophy which could explain the influence Kant’s has had on some more pessimistic 19th century philosophers such as Arthur Schopenhauer and Friedrich Nietzsche. Kant’s chapter “On the Typic of the Pure Practical Power of Judgement” is one of the most obscure passages of the Critique of Practical Reason and it has often been regarded as a mere appendix. However, it deals with a fundamental question, namely, how can the pure practical law be applied to particular cases. In this paper, I would like to make an original contribution towards a better understanding of this chapter by comparing it to the Schematism chapter on the (...) basis of their analogical relation and suggesting how the reference to a sensus communis could help in solving the aim of the Typic chapter. We often make a distinction between what we owe as a matter of repayment, and what we give or offer out of charity. But how shall we describe our obligations to fellow citizens when we are in a position to be charitable because of a past injustice on the part of the state? This essay examines the moral implications of past injustice by considering Immanuel Kant's remarks on this phenomenon in his lectures and writings. The main purpose of this article is to bring into relief the difficulties faced by generous interpretations of the Kantian problem of poverty and to propose an alternative interpretation which (a) agrees with some generous interpretations that Kant's juridical treatment of poverty is to be understood by analogy with his juridical treatment of slavery, but which (b) departs from generous interpretations in general by arguing that this analogy is not to be understood in terms of “dependence” as such, but in (...) terms of “depersonification.” More specifically, it argues that what makes slavery and poverty unjust for Kant is not that they entail a human being finding herself (completely) dependent on the choice of another human being, but that they entail a human being being deprived of her juridical personality. The Kantian problem of poverty is ultimately a problem of juridical depersonification, and this problem of juridical depersonification does not arise in all (complete) dependence relations. (shrink)

I want to distinguish between maxims at three levels of abstraction. At the first level are what I shall call individual maxims, or i‐maxims: maxim tokens as adopted by particular rational beings. At the second level are abstract maxims, or a‐maxims: abstract principles distinct from any individual who adopts them. At the third level are maxim kinds, or k‐maxims: sets of various action‐guiding principles that are grouped on the basis of their content. I criticize two ways of interpreting Kant's claim that property rights are merely ‘provisional’ in the state of nature.Weak provisionalityholds that in the state of nature agents can make rightful claims to property. The coercive authority of the Kantian state is rationally grounded in the ideal of equal external freedom, which is realized when each individual can choose and act without being constrained by another's will. This ideal does not seem like it can justify state-mandated economic redistribution. For if one is externally free just as long as one can choose and act without being constrained by another, then only direct slavery, serfdom, or other systems of overt control seem to threaten external freedom. (...) Yet Kant endows the freedom-based state with considerable powers of economic redistribution. I argue that recent commentary has misunderstood both Kant's account of why poverty is a form of freedom-threatening dependence and the extent of the Kantian state's powers for remedying poverty. Criticizing Arthur Ripstein and the Kantianism of the “Toronto-School,” I argue that the most salient notion of dependence at issue within the Kantian framework is not the direct control of the choice-making capacities of another but asymmetrical influence in a power relationship. For Kant, poverty is fundamentally a problem of structural disempowerment. (shrink)

Kant distinguishes between ‘active’ and ‘passive’ citizens and holds that only the former are civilly self-sufficient and possess rights of political participation. Such rights are important, since for Kant state institutions are a necessary condition for individual freedom. Thus, only active citizens are entitled to contribute to a necessary condition for the freedom of each. I argue that Kant attributes civil self-sufficiency to those who are not under the authority of any private individual for their survival. This reading is more (...) textually grounded than the dominant reading, which understands civil self-sufficiency in terms of economic relations alone. I further argue that Kant was interested in relations of authority because he was concerned to eliminate certain forms of corruption. This indicates that Kant’s contested distinction between active and passive citizens was a response to a key problem of any account of public lawgiving. (shrink)

This paper argues that substantive ethical rules serve a critical ethical function, even in those cases where we should deviate from those rules. Assuming that the rules are valid provides decision-makers with the context essential to reaching a well-justified decision. Recognizing this helps to reconcile two attractive but incompatible positions regarding the evaluation of healthcare ethics consultants. The first position is that ethical rules can validly be used to evaluate the quality of consultants’ advice, ensuring conformity to standards promoted by (...) a significant portion of medical ethicists. The second position—the message of ethical particularism—is that we should not evaluate consultants according to strict rules, since good ethical advice may deviate from even the most carefully wrought moral rules. Steering a path between these extremes, I argue that we should evaluate the quality of consultations by examining whether consultants have communicated the relevant ethical rules to participants as ethical presumptions. In communicating presumptions, a consultant provides an indispensable ingredient to ethical decision-making, while leaving open the possibility that the ethical course of action involves violating the very ethical rules that one should presume. The two best known objections to Kant's first defense of the duty of beneficence are examined and found to be fallacious. The first objection relies on the possibility of imagining an individual who would be willing for the maxim of nonbeneficence to be a universal law (but it fails to recognize that such an individual is not a rational person and thus not subject to morality at all); and the second objection, while granting the nonuniversalizability of the maxim of nonbeneficence, (...) puts forth the maxim of “occasional” benefit in place of the maxim of beneficence as an alternative to the maxim of nonbeneficence (but it fails to recognize that the maxim of “occasional” benefit is disqualified by Kant's first moral principle). In his early writings, Kant says that the solution to the puzzle of how morality can serve as a motivating force in human life is nothing less than the “philosophers’ stone.” In this dissertation I show that for years Kant searched for the philosophers’ stone in the concept of “respect” (Achtung), which he understood as the complex effect practical reason has on feeling. -/- I sketch the history of that search in Chapters 1-2. In Chapter 3 I show that Kant’s (...) analysis in Groundwork I is incomplete because it does not explain how respect functions as a feeling in motivating choice. In Chapter 4 I argue that Kant’s subsequent attempt to sidestep this explanation in Groundwork III is unsuccessful, and that his position remains open to a skeptical threat. The argument in the second Critique, which I reconstruct in Chapters 5-6, overcomes this threat, and in doing so explains how the feeling of respect is both painful and pleasurable. -/- In the course of defending these claims, I provide an alternative reading of the shift in Kant’s ethical project from the Groundwork of 1785 to the second Critique of 1788 Against a common view in the literature, I argue that the shift does not concern the direction of Kant’s deduction (from freedom to morality, or morality to freedom); rather, it concerns his view of human sensibility and the resources he thinks we have to make our practical self-understanding intelligible. In the second Critique, I argue, Kant develops a novel approach to moral feeling from the perspective of the human agent; and this in turn clears room in his ethics for a new kind of a priori knowledge—namely, knowledge of what the activity of practical reason must feel like. By way of conclusion, I offer a few reasons for why the form of Kant’s argument in the second Critique is still relevant today, as it shows why we can only address moral skepticism from a first-personal perspective. This dissertation concerns the methodology Kant employs in the first two sections of the Groundwork of the Metaphysics of Morals (Groundwork I-II) with particular attention to how the execution of the method of analysis in these sections contributes to the establishment of moral metaphysics as a science. My thesis is that Kant had a detailed strategy for the Groundwork, that this strategy and Kant’s reasons for adopting it can be ascertained from the Critique of Pure Reason (first Critique) and his (...) lectures on logic, and that understanding this strategy gains us interpretive insight into Kant’s moral metaphysics. At the most general level of methodology, Kant says there are four steps for the establishment of any science: 1) make distinct the idea of the natural unity of its material 2) determine the special content of the science 3) articulate the systematic unity of the science 4) critique the science to determine its boundaries The first two of these steps are accomplished by the genetically scholastic method of analysis, paradigmatically the method whereby confused and obscure ideas are made clear and distinct, thereby logically perfecting them and transforming them into possible grounds of cognitive insight that are potentially complete and adequate to philosophical purposes. The analysis of Groundwork I is a paradigmatic analysis that makes distinct what is contained in common understanding, i.e. its Inhalt or intension, making distinct the higher partial concepts that together define the concept of morality. The analysis of Groundwork II is an employment more specifically of the method of logical division, which makes distinct what is contained under the concept, i.e. its Umfang, by which the extension or object of morality is determined. Part I introduces Kant’s conception of moral metaphysical science and why he took it to be in need of establishment, explains the general method for establishing science and the scholastic method of analysis by which its first two steps are to be accomplished, then provides an interpretation of Groundwork I as an execution of this method. Part II details Kant’s determination of the special content of moral science in Groundwork II in relation to the central problem for moral metaphysics – how synthetic a priori practical cognition is possible. Durante décadas, los teóricos interesados en la discusión de Kant sobre el bienestar han estudiado la postura de Kant sobre la cuestión de la redistribución de bienes en la sociedad. Lo han hecho tanto para aclarar su postura como para una fuente de inspiración para problemas conceptuales actuales, frente a filósofos políticos contemporáneos que intentan reconciliar el ideal de la libertad igualitaria con la necesaria interferencia asimétrica para la redistribución y la provisión social. En este artículo, comienzo por la breve (...) discusión kantiana sobre el estado del bienestar en la Doctrina del derecho e identifico cuatro premisas que Kant afirmó con claridad como características de su postura. Posteriormente, propongo las cinco vías interpretativas principales en la interpretación de la obra de Kant, las evalúo y las ordeno. La interpretación más acertada de la justificación kantiana del bienestar, que llamo la postura “genuinamente kantiana” no llega a explicar, sin embargo, la naturaleza del deber del bienestar que propone. Propongo una solución, retrotrayéndome en los textos kantianos, que unida a otras consideraciones y cuestiones, se puede entender como el punto de partida de una nueva vía de interpretar este tema.
