The article tries to inquire a third way in normative ethics between consequentialism or utilitarianism and deontology or Kantianism. To find such a third way in normative ethics, one has to analyze the elements of these classical theories and to look if they are justified. In this article it is argued that an adequate normative ethics has to contain the following five elements: (1) normative individualism, i. e., the view that in the last instance moral norms and values can only (...) be justified by reference to the individuals concerned, as its basis; (2) consideration of the individuals' concerns and interests—aims, desires, needs, strivings—insofar as they have a justificatory function; (3) a pluralism of references of these concerns and hence of moral norms and values to all possible elements of actions; (4) the necessity of a principle of aggregation and weighing with regard to these concerns; (5) finally, as a central principle of aggregation and weighing, the principle of relative reference to self and others, operating as a generalizing meta-principle that guides the application of concrete principles and decisions. Analytic philosophy has recently been challenged from a perspective advocated by Richard Rorty: this favours edifying philosophy against systematic philosophy comprising also analytic philosophy. In Rorty's presentation analytic philosophy is one more variant of the Cartesian—Kantian epistemology which, being committed to a permanent framework of inquiry rooted in our human subjectivity, implies the uniqueness of one conceptual scheme.Against this tenet I argue in two ways. First, I show that analytic philosophy of mind and language with the Fregean background and possible (...) world semantics implies the pluralism of conceptual schemes on logical-conventionalist grounds. Secondly, I show that although analytic philosophy shares the claim for legitimation of a conceptual scheme with Kantian epistemology, it is critical of the latter in that the uniqueness-claim is refuted. The reconstructive theory of the procedural legitimacy of modern law developed on the basis of the theory of discourse ethics has limited itself solely to the deontological, moral‐normative aspects of the validity claims of legal norms and judgments. However, teleological and axiological aspects are also intertwined with legal validity claims and with the procedures in which legal norms and judgments are produced. The discursive‐procedural concept of legitimacy seems to require as its support, instead of the theory of discourse ethics, a (...) general theory of practical discourses or, more generally, of rational collective will‐formation. It has become extremely questionable whether, in the flux of life, it is a genuinely worthwhile intellectual problem to seek to discover fixed and immutable ideas or absolutes.

This text reconstructs the Kohlberg/Gilligan controversy between a male ethics of justice and a female ethics of care. Using Karl-Otto Apel's transcendental pragmatics, the author argues for a mediation between both models in terms of a reciprocal co-responsibility. Against this backdrop, she defends the circular procedure of an exclusively argumentative-reflexive justification of a normative ethics. From this it follows for feminist ethics that it cannot do without either of the two types of ethics. Frank L. Tipler's book The Physics of Immortality is a striking attempt by a scientist to resolve the conflict between theology and science on the basis of a physicalist position that identifies theology as a branch of physics, and that calculates God “in exactly the same way as physicists calculate the characteristics of electrons.” Tipler's work may be seen as a scientistic myth, and its critique is organized around the three basic characteristics of such myths: (1) it is illogical in (...) that it argues as if physics were in fact metaphysics; (2) it is grim in that its glorification of technology is insensitive to ethical issues; (3) it is meaningless in that its espousal of a strong theory of artificial intelligence empties concrete personal histories by subsuming them under abstractions that distort our understandings both of God and of resurrection. In this paper I want to show that a main theme of Neurath’s philosophical work was the formulation of a radically empiricist theory of science. His approach, dubbed "encyclopedism", can be characterized by the following five theses: scientific knowledge is (1) fallible, (2) pluralistic, (3) holistic, (4) can be systematized only locally, and (5) does not give us a faithful description of the real world. In his Encyclopedia, the late Hegel makes the highest demands on truth and justification from the first paragraph onward. With this, Hegel takes up the skeptical challenge and believes that he can overcome this problem. However, it is not easy to see how Hegel tries to meet this challenge in the Science of Logic, which plays a fundamental role in Hegel’s encyclopedic project. The present article argues that the question of the justification of the claim to truth is a fruitful (...) perspective for the interpretation of the Science of Logic. For this purpose Hegel’s answer to the Agrippan Trilemma is examined, which P. Franks analyzed as a basic problem for Classical German Philosophy. One possible interpretation of Hegel sees him solving the skeptical trilemma at the beginning of the Logic. The article argues against this possibility that the Logic of the Concept contains Hegel’s actual solution. This solution consists in that the concept represents the principle of logic and that the concept itself must be presented in the form of an apagogical argument. Finally, the article gives a reason why Hegel sees an analogy to the ontological argument in this attempt of an ultimate justification. (shrink)

At the World Economic Forum meeting in year 2000 in Davos the economic challenges for the next millennium were presented and analysed. The role of the Internet and communications in the development of the global economy were the central theme of the meeting and the evident inefficiency of traditional control mechanisms was highlighted. This situation implies greater responsibility for management for two fundamental reasons: first because management are ultimately responsible for the fortunes of their organizations, and second because they have (...) more freedom to act. I believe that the Davos manifesto (1973) of discourse is of incalculable value, but we also believe that it has a series of important weaknesses from the ethical point of view. My proposal is for a transformational review centred on the ethics of discourse and using as a starting point a conviction of the important role of the manager in the development of ethics in organizations. In this article I intend to examine the need, and the opportunity, to develop an ethical code for professional managers based on discourse ethics. (shrink)

The current economic crisis is forcing us to reflect on where we have gone wrong in recent years. In the search for responsibilities some have looked to Business Schools and Administration Departments. It is surprising that this situation has come about despite the fact that Business Ethics and Social Corporate Responsibility have been taught in business schools for years. Without wanting to place all the blame on higher education institutions, but from a critical perspective and assuming responsibility, we believe it (...) is necessary to reflect rigorously on how to train leaders for the future and how we can best educate responsible Managers. In this article our objective is to reflect on the two factors which influence the training of responsible Managers: management discourse theory and the ethos of the institutions training future Managers. The central point of our article will be to argue for the need to develop an institutional ethos in Administration Faculties and business schools which is consistent with the responsibility discourse we propose and with the aim of providing high quality technical and moral training. Our central argument is that institutional ethos has enormous educational power and that the moral climate of an institution has a major influence on students' ideas, values and behaviours. The second argument for this main point is that corporate ethos can be managed and modulated. It is a process of cultural change which requires time and the setting up of specific initiatives to achieve the organisation that we want. (shrink)

This article argues that a pragmatist ambition to transcendence undergirds Richard Rorty’s metaphilosophy. That transcendence might play a positive role in Rorty’s work might seem implausible given his well-known rejection of the idea that human practices are accountable to some external, Archimedean standpoint, and his endorsement of the historicist view that standards of rationality are products of time and chance. It is true that Rorty’s contributions to epistemology, philosophy of mind and metaphysics have this anti-transcendentalist character. But in his metaphilosophy, (...) Rorty shows great respect for pre-philosophical impulses aimed at transcendence of some kind, in particular the romantic (and indeed religious) experience of awe at something greater than oneself, and the utopian striving for a radically better world. These impulses do not disappear in Rorty’s metaphilosophy but are reshaped in a pragmatist iteration of transcendence which, we argue, can be characterised as horizontal (rather than vertical) and weak (rather strong). We use this characterization to distinguish Rorty’s metaphilosophy from other accounts that share a postmetaphysical ambition to transcendence. (shrink)

A course in professional ethics for civil engineers was taught for the first time in Spain during the academic year 2007/08. In this paper a survey on the satisfaction and expectation of the course is presented. Surprisingly the students sought moral and ethical principles for their own ordinary lives as well as for their profession. Students were concerned about the law, but in their actions they were more concerned with their conscience, aware that it can be separate from the law.

Language-Game vs. Complete Language. The article formulates a criticism of Wittgenstein's later philosophy which, in its substance, I would like to think, is fairly the same as the (hermeneutic) criticism issued by Apel and Habermas in the sixties. Contrary to these philosophers, however, I try to make the point by focusing on the distinction between language game and language, respectively between intralanguage relations of 'family resemblance' (between language games) and interlanguage translation relations. The notion of a 'complete language' is introduced (...) - 'completeness' of a language being, roughly, its possibility in principle of being translated into any (other) language - and the criticism of Wittgenstein is formulated as the allegation that he does not, or will not, acknowledge such a concept of completeness. So far the contents of the first part of the article. The rest of it assembles some hints, remarks and reminders which bear upon the question of the 'completeness' of a language. These considerations include comments on the conditions of translatability, on the performative (agent's) knowledge or 'intention-in-action' of the acting person, on Habermas' concept of communicative competence and on the notion of a responsible subject of action. It is alleged that to speak of 'translation' and 'reporting an event' as language games is misleading. (shrink)

Are culture driven ethical conflicts apparent in the discourse of the protagonists? A multi-year, multi-cultural study of managers by Trompenaars and Hampden-Turner resulted in two conclusions relevant to business ethics. The first is that intercultural business conflicts can often be traced to a finite set of cultural differences. The second is that enough similarities exist between cultures to provide the grounds for conflict resolution. The research reported here gives credence to their study when applied to an ethical conflict viewed from (...) French and American perspectives. (shrink)

My discussion addresses the differences between analytic and continental philosophy concerning the use of logic and exact reasoning in philosophical practice. These differences are mainly examined in the light of the controversial dominance of Hegel's concept of logic in twentieth-century continental philosophy. The inquiry is developed in two parts. In the first, I indicate some aspects of the analytic -continental divide, pointing to the role that the topic 'logic and philosophy' plays in it. In the second part, I give a (...) short account of the views of logic which are typical of the three main trends of continental philosophy. I also suggest how, with the aid of some typical analytical devices, some continental 'anti-logical' attitudes may be corrected, on their own terms. (shrink)

El artículo sostiene que Heidegger en los años veinte del pasado siglo puede verse como un continuador de la filosofía trascendental kantiana. Sostiene que ambos proponen un programa crítico que busca romper con la tradición metafísica, e investigan por ello lo sintético apriori en las condiciones de la experiencia o en la facticidad. En ambos se advierten las tensiones propias de la filosofía trascendental relativas a la constitución del mundo, la necesidad de postular un sujeto y la auto-reflexión. Se concluye (...) que, en el caso de Heidegger, la renuncia a pensar en la universalidad de la factidad lo conduce a aporías ausentes en Kant, para quien la racionalidad no está sometida al tiempo. Transcendental Pragmatics and Discourse Ethics. Elements and Perspectives of Apel's Discourse-Philosophy. The author follows Apel's intellectual biography and shows the conception of a critique of meaning qua ‘reflection upon the discourse within the discourse’ to be the centre of Apel's language-pragmatic ‘Transformation of Philosophy’. Beginning with an explication of the situation of a speaker/thinker, especially of the situation of a philosophising speaker/thinker, Apel reconstructs a two fold apriori of communication: Every thought is situated within the context of a particular, historically (...) evolved, community of language and interaction. At the same time, however, the validity-claims of thoughts transcend the context of their origin towards an unlimited community of argumentation. On the basis of the first apriori Apel criticises the methodical solipsism as well as the objectivism of modern philosophy and theory of science. Drawing upon the second apriori he develops a universalist critique of meaning of relativism and contextualism. In the sixties and seventies Apel worked out a differentiated theory of the – more or less – communicatively cognizing humanities and set it apart from the theory of the causal-explanatory natural sciences, thus challenging the objectivism of a Theory of Unified Science. Building upon this work Transcendental Pragmatics, as developed by Apel and others, sets philosophy primarily two tasks: firstly, a internal reconstruction of argumentative discourse as the situation of speech and thought which seeks to elucidate the conditions of the meaningfulness, i. e. the presuppositions, of discourse. These presuppositions comprise, thus Apel with Habermas, the four validity-claims to intelligibility, sincerety/credibility, truth and normative rightness/legitimacy. Their moral content consists, thus Apel, not only in the recognition of the equality of all beings capable of discursive reasoning but also in their recognition of a co-responsibility for the realizability of discourses and of responsibility. The author argues that the existence of a co-responsibility of this kind is indisputable because the discursive claims to validity are intertwined with a set of ‘primordial promises of dialogue’. Only with the elucidation and explication of these promises can the reconstruction of the internal conditions of discourse be completed.The second task of a pragmatics of argumentation isthe strict resp. actual reflection of the thinker upon the presuppositions of the discourse in which he currently engages. This reflection has a Socratic character and can only be done in the form of discussion and debate with critics of the reconstruction. In this context, the author proposes a method of Socratic reflection upon the presuppositions of dialogue which suspends the usual, theoretically oriented, attitude of the scientist and the philosopher in favour of an actual reflective attitude. Within a dialogue with a sceptic who doubts one of the results of the internal reconstruction of dialogical presuppositions, say X, it is tested whether his doubt as to the unrestricted validity of X can be understood as a sincere contribution to the current dialogue or whether this particular sceptical thesis does not make sense, because it is incompatible with the role of a sincere participant of argumentation which, after all, the sceptic cannot refuse to claim for himself.Finally the author explains Apel's characterization of the tension between “Discourse and Responsibility”. In the course of discussions with Max Weber, Lawrence Kohlberg, Hans Jonas et al., Apel formulates and justifies an ethics of responsibility and gives an affirmative answer to the crucial question of whether the fulfilment of the moral obligations connected with the recognition of co-responsibility can be demanded within the non-dialogical circumstances of social reality. Apel's answer employs the idea of counter-strategies which are morally legitimate in virtue of their being worthy of argumentative consensus. (shrink)

Eger's contribution towards a reapprochment of Hermeneutics, Science and Science Education is very welcome. His focus on the problem of misconceptions is relevant. All the same in our opinion some not minor points need a clarification. We will try to argue that: a) Hermeneutics cannot be reduced to a semantical interpretation of science texts; its phenomenological aspects have to be taken in account. b) Science has an unavoidable historical dimension; original papers and advanced textbooks are the real depositaries of scientific (...) research. Standard textbooks are a caricature not worth it of a hermeneutical analysis. c) A parallelism can be traced between two dicothomies: the lifeworld of hermeneutics and the scienceworld of epistemology on one side and the extraordinary and the normal science on the other. d) For an overcoming of the misconceptions' problem we propose that the previous dicothomies be bridged through a hermeneutical phenomenological approach to science education that stresses the alternative, historical interpretations of natural phenomena. This article aims to highlight the theoretical and philosophical debate on hospitality underlining the normative elements of framing migrants and refugees as individual agents in the light of hospitality theory and migration governance. It argued the critiques of the neo-Kantian hospitality approach and the EU welcome culture with regard to refugees in the EU from a philosophical perspective. The “No human being is illegal” motto is proposed to be conceived as a principle of the EU Charter of Fundamental Rights. The (...) cosmopolitan right to visit and the universal right to reside were discussed in the context of human rights and co-responsibility. Linking the hospitality approach with migration governance enables the reconstruction of reception policies and practices, diversification of non-state actors that engage in migration governance mechanism, and polarization of political initiatives (e.g., politics of allocation and dispersal, readmission negotiations, convergence/divergence of priorities and strategic interests). The research findings highlight that the EU adopted a neo-Kantian hospitality approach that combines both “co-responsibility” and “vertical/heterarchical relations.” The EU’s “New Pact on Migration and Asylum” was considered proof of how the EU follows neo-Kantian hospitality that is manifested in dualism and contradictory approach. The study presents a typology that splits co-responsibility into individual/institutional actions and human rights/migration governance. (shrink)

The author's thesis is that human rights can be substantiated on the basis of discourse theory. The argument has two steps. The first step is the justification of the rules of discourse. The second step consists in the foundation of human rights.

Contemporary discussions about practical reason or practical rationality invoke four competing views which can be named as follows by reference to their historical models: Aristotelian, Hobbesian, Kantian and Nietzschean. The subject-matter of this article is a defence of the Kantian conception of practical rationality in the interpretation of discourse theory. At the heart, lies the justification and the application of the rules of discourse. An argument consisting of three parts is pre sented to justify the rules of discourse. The three (...) parts are as follows: a transcen dental-pragmatic argument; an argument which takes account of the maximisation of individual utility and an empirical premise about an interest in correctness. Within the framework of the problem of application, the article outlines a justification of human rights and of the basic institutions of the democratic constitutional state on the basis of discourse theory. Hegel's Science of Logic makes the just not low claim to be an absolute, ultimate-grounded knowledge. This project, which could not be more ambitious, has no good press in our post-metaphysical age. However: That absolute knowledge absolutely cannot exist, cannot be claimed without self-contradiction. On the other hand, there can be no doubt about the fundamental finiteness of knowledge. But can absolute knowledge be finite knowledge? This leads to the problem of a self-explication of logic (in the sense of Hegel) (...) and further, as will be shown, to a new definition of the dialectical procedure. The stringency of which results from the fact that always exactly that implicit content is explicated that was generated by the preceding explication step itself and is thus concretely comprehensible. At the same time, a new implicit content is generated by this act of explication, which requires a new explication step, and so forth. In the dialectical procedure reinterpreted in this way, dialectical arguments are not beheld, guessed at or even surreptitiously obtained, but are methodically accountable. Thereby dialectics is understood as a self-explication of logic by logical means and thus as a proof of the possibility of ultimate-grounding in the form of absolute and nevertheless finite – and thus also fallible – knowledge. El presente artículo pretende acercarse a la propuesta de una concepción republicana de la ética empresarial realizada por la Escuela de Erlangen que se ha convertido en una referencia ineludible a nivel europeo. Esta propuesta, fundamentada en el constructivismo de la Escuela de Erlangen y la ética del discurso de la Escuela de Frankfurt, empezó a fraguarse a finales de los años ochenta en Alemania y define a la empresa como una institución con responsabilidades y deberes públicos. Con este artículo (...) se pretende mostrar una concepción de la ética empresarial sólida y coherente, tanto desde el punto de vista teórico como práctico, dada su capacidad de integrar las exigencias éticas con los aspectos organizativos, su proximidad a la praxis y su sistematicidad. The main purpose of this paper is to present the proposals of the Erlangen School for a republican conception of business ethics, which has become a key reference in the European context. Republican business ethics, based on the constructivism of the Erlangen School and the discourse ethics of the Frankfurt School, began to take shape at the end of the eighties in Germany and defines the company as "an institution with public responsibilities and duties". Throughout this article I will attempt to present a solid and coherent conception of business ethics, from both the theoretical and the practical points of view. Republican business ethics is capable of integrating ethical claims with organizational aspects, it comes close to praxis and it is systematic. (shrink)

Purpose: Demonstrate that cognitive and social approaches towards understanding do not at all oppose but rather they complement each other. Constructivist concepts of understanding paved the way to conceive of understanding as a cognitive-social "mechanism" which mutually regulates processes of social structuration and, at the same time, cognitive constructions and processing. Findings: Constructivist approaches bridge the gap between the cognitive and the social faces of understanding. They demonstrate how comprehension and cultivation, cognition and cultural reproduction are mutually linked to each (...) other by the cognitive-social "mechanism" of understanding. As a consequence, the unavoidable immunisation against communicative demands from others jeopardizes the achievements of our communicative culture. Practical implications: Communicators are even more responsible for success or failure of communication than recipients. Moreover, as educators they are responsible for both cultural reproduction and the reinforcement of creativity and innovation. This double bind can only be managed with strong and resistant personal relations. All construction of meaning and all interpretation should be conceived of as a pro-construction, a hypothetical provisional reading made for the tough going of public or scholarly discourse. This study seeks to trace the boundaries of the sign in the phenomenological tradition of Edmund Husserl. The approach adopted here is largely historical and has no other ambition that to identify those questions that pertain to the sign and have been of interest for phenomenology. The article is divided in four parts : the first examines an essay from 1890 entitled Semiotik and situates it in the context of the young Husserl's work in the philosophy of mathematics ; the (...) second part concerns the first section of the Logical Investigations ; the third one seeks to account for the changes that testify to the evolution of Husserl's thinking regarding the sign between the Logical Investigations (1900-01) and "Origins of Geometry" (1936) ; the last part considers the contribution of post-Husserlian phenomenology, from Martin Heidegger to Merleau-Ponty and beyond, to semiotics. -/- Résumé. Notre étude vise à délimiter l'espace dans lequel la question du signe s'est posée à la tradition phénoménologique depuis Edmund Husserl. Cette étude est largement historique et elle n'a d'autres ambitions que d'identifier certains aspects de la question du signe qui ont suscité l'intérêt de la phénoménologie.
