Recently, a number of Kantians have argued that despite Kant’s own disparaging comments about same-sex intercourse and marriage, his ethical and legal philosophy lacks the resources to show that they are impermissible. I go further by arguing that his framework is in fact more open to same-sex than to different-sex marriage. Central is Kant’s claim that marriage requires equality between spouses. Kant himself thought that men and women are not equal, and some of his more insightful remarks on the issue (...) reveal that he was also aware that, as a matter of fact, women were disenfranchised by society, and suffer legal and other forms of discrimination. Kant, according to his own account, cannot approve of heterosexual marriage. Same-sex couples, by contrast, can satisfy the crucial equality condition. I conclude with a suggestion for refocus with respect to the issues at hand, calling for attention to more complex and insidious forms of inequality than deprivation of rights and full civil participation. The account of marriage Kant presents in the Rechtslehre strikes most readers as cold, legalistic and obsessed with sex. It seems to ignore at least nearly all of the morally valuable aspects of marriage. Consequently, most have felt that this is a feature of Kant 's theory best ignored. Against this view, this article argues that Kant 's focus is appropriate, that his understanding of marriage is much more romantic than is commonly thought and that it presents a thought-provoking alternative (...) to the picture of marriage found in the modern law. Resumen: Este texto se concentra en el valor de las relaciones de cuidado y en la política pública que debe adoptarse en relación con ellas. Defiendo que, en consonancia con lo que argumenta Elizabeth Brake, debido a que las RC son una de las bases sociales del respeto propio, el mismo marco de apoyo que las leyes maritales ofrecen actualmente a las relaciones biamorosas debe ser accesible a otras RC consensuadas entre adultos -como las amistades a largo plazo, las relaciones (...) entre cohabitantes y las poliamorosas-. Sin embargo, a diferencia de lo que sostiene Brake, argumento que debemos evitar usar el término "matrimonio" para referirnos legalmente a cualquier RC. En concreto, mi propuesta es extender los derechos asociados con el matrimonio a otras RC entre adultos y suprimir dicho término por completo en la legislación.: This paper focuses on the value of caring relationships and the public policy that should be adopted regarding them. I defend that, as Elizabeth Brake has argued, considering that such relationships are one of the social bases of self-respect, the same legal protective framework that it is now accessible to bi-amorous relationships under marriage law should be available to other caring relationships between adults -such as long-term friendships, long-term cohabitations and poli-amorous relationships. However, unlike Brake, I hold that we should avoid referring legally by the term 'marriage' to any caring relationship. In short, my proposal is to extend the rights associated to marriage to other caring relationships between adults and to eliminate such term from legislation all together. (shrink)

Kant argues that sex is only permissible under the condition of marriage. In this paper, I argue that Kant’s argument for the impermissibility of non-marital sex commits him to the impermissibility of all sex. I then show how he might alter his account of sexuality in such a way that it would both allow him to avoid the conclusion that all sex is impermissible and be more consistent with his broader ethical and anthropological thought.

Intentar explicar el origen, evolución y violación de un tabú considerado casi universal en las sociedades humanas no es una empresa sencilla dado su carácter polifacético; sin embargo, ello no ha impedido que en muchos ordenamientos jurídicos sea empleado ese sentimiento de repulsión o asco como un elemento para criminalizar una relación sexual aparentemente ofensiva. El artículo sostiene que el matrimonio es la única forma en que las prácticas sexuales entre parientes en condición de igualdad pueden tener lugar. Para ello: (...) I. Presentaremos algunas teorías que ofrecen respuestas a las incógnitas en torno al tabú, II. Veremos por qué para Kant el incesto es un crimina carnis contra naturam en un caso, y secundum naturam en el otro. III. Examinaremos qué es el matrimonio para el filósofo y por qué constituye un ideal regulativo-práctico de las relaciones sexuales humanas.
