Individualist normative theories appear inadequate for the complex moral challenges of climate change. In climate ethics, this is especially notable with the relative marginalization of Kant. I argue that Kant’s philosophy, understood through its historical and cosmopolitan dimensions, has untapped potential for the climate crisis. First, I situate Kant in climate ethics and evaluate his marginalization due to perceived individualism, interiority and anthropocentrism. Then, I explore aspects of Kant’s historical and cosmopolitan writings, which present a global, future-orientated picture of humanity. (...) In this paper I argue that Kant’s pre-critical ontology, though generally dismissed by environmental philosophers, provides ecological lessons by way of its metaphysical affinities with environmental philosophy. First, I reference where environmental philosophy tends to place Kant and highlight his relative marginalization. This marginalization makes sense given focus on his critical works. I then outline Kant’s pre-critical ontological framework and characterize the ways in which it is ecological. According to indirect duty views, human beings lack direct moral duties to non-human organisms, but our direct duties to ourselves and other humans give rise to indirect duties regarding non-humans. On the orthodox interpretation of Kant’s account of indirect duties, one should abstain from treating organisms in ways that render one more likely to violate direct duties to humans. This indirect duty view is subject to several damaging objections, such as that it misidentifies the moral reasons we have to treat (...) non-humans in certain ways and that it sanctions only weak obligations vis-à-vis organisms. I develop an alternative indirect duty view: given a direct duty to oneself to cultivate virtuous dispositions, one has an indirect duty to abstain from treating organisms in ways that erode one’s virtues or develop vices. I argue that this indirect duty view strictly proscribes knowingly causing unnecessary harm to organisms, and I show that it is not subject to the damaging objections directed against the indirect duty view attributed to Kant by the orthodox interpretation. This suggests that indirect duty views are more worthy of consideration than is often supposed. (shrink)

Im Beitrag wird die übliche, intuitionsbasierte Bewertung ethischer Gedankenexperimente hinterfragt und stattdessen für ein neo-kantisches Verfahren der Bewertung argumentiert. Hierzu wird nach einer kurzen systematisch-historischen Verortung zunächst eine grobe Kategorisierung vorgenommen, die erstens nach der Funktion, zweitens nach der Fragestellung erfolgt, auf die Gedankenexperimente antworten. Das vorgeschlagene, neo-kantische Verfahren eignet sich insbesondere zur Bewertung einer bestimmten Kategorie von Gedankenexperimenten: Dilemmatische Situationen, in denen eine Abwägung von Menschenleben zur Debatte steht, weil nicht alle Beteiligten überleben können. Anhand von drei ausgewählten Gedankenexperimenten (...) wird das jeweilige Bewertungsverfahren betrachtet. Im Zuge des neokantischen Verfahrens wird ein „Rollentausch“ vorgenommen und danach gefragt, was alle Betroffenen „rationalerweise wollen“ können. Während die Präferenzen der Täter, die das Dilemma erst verursachen, nicht in die Überlegung eingehen, hängt die Bewertung der Perspektive der Opfer von Art und Ausmaß ihrer Bedrohung ab. Passagiere und Crew des entführten Flugzeugs, deren Tod unausweichlich bevorsteht, könnten einem Abschuss, der vielen anderen das Leben rettet, rationalerweise zustimmen. Beim Gedankenexperiment von Jim und den Indianern ist dies nur bedingt der Fall. In fast allen Varianten des Trolley-Experiments kann nicht davon ausgegangen werden, dass die jeweilige Person der Opferung ihres Lebens für andere zustimmt. In einem letzten Punkt wird auf den Einwand Humes eingegangen, dass weder ein radikal egoistisches noch ein übertrieben altruistisches Wollen als „irrational“ bezeichnet werden kann. (shrink)

This paper examines the resources of Kantian ethics to establish corporate moral responsibility. I defend Matthew Altman’s claim that Kantian ethics cannot hold corporations morally responsible for corporate malfeasance. Rather than following Altman in interpreting this inability as a reason not to use Kantian ethics, however, I argue that the Kantian framework is correct: business ethicists should not seek to hold corporations morally responsible. Instead, they should use Kantian resources to criticize the actions of individual businesspeople. I set forth a (...) model for decomposing business actions into their individual parts and reconstituting them in a context-specific “maxim” that Kantian ethics can evaluate. The reconstituted form of Kantian ethics that I defend is better able to manage decision-making complexity than traditional interpretations. To demonstrate the usefulness of my approach, I apply it to the recent Wells Fargo bogus-accounts scandal. (shrink)

The paper understands the rise of ethical codes and professional ethics from the point of view of their contribution to the formation of a democratic citizenship. Various aspects of professional ethics are analyzed from the perspective of an agent-based ethics for which goods, norms and virtues are complementary factors for intelligence and individual judgment development. Through a conception of democracy understood as a way of life, professional ethics acquire a renewed meaning as a central element for individual self-realization and social (...) emancipation. In short, under the label of democratic professionalism, and following Dewey’s moral and political philosophy, it is shown that professional ethics are more than a field of application, a constituent element of a civic ethic within the framework of a democratic society. This paper examines the ethical implications of the Clean Development Mechanism, the United Nation’s climate change initiative that provides incentives to countries and firms in developed countries to motivate investments in greenhouse gas reduction projects in developing countries. Using the tenets of agency theory, we present a solid waste management project in El Salvador as an illustrative example of how the CDM can produce a disproportionately high social cost for the most marginalized populations in the developing world. We suggest that (...) the UN needs to reformulate the CDM so that it more effectively aligns the divergent goals of multiple actors and upholds the UN’s principles for sustainable development, including ethical firm-level behavior. By providing incentives for environmental, economic, and social value creation, the CDM would not only promote ethical norms for profit-seeking firms that participate in the program but also reinforce the UN’s twin pro-poor and environmental objectives. Great technological advances in such areas as computer science, artificial intelligence, and robotics have brought the advent of artificially intelligent robots within our reach within the next century. Against this background, the interdisciplinary field of machine ethics is concerned with the vital issue of making robots “ethical” and examining the moral status of autonomous robots that are capable of moral reasoning and decision-making. The existence of such robots will deeply reshape our socio-political life. This paper focuses on whether such highly (...) advanced yet artificially intelligent beings will deserve moral protection once they become capable of moral reasoning and decision-making. I argue that we are obligated to grant them moral rights once they have become full ethical agents, i.e., subjects of morality. I present four related arguments in support of this claim and thereafter examine four main objections to the idea of ascribing moral rights to artificial intelligent robots. (shrink)

Thanks to recent scholarship, Kant is no longer seen as the dogmatic opponent of suicide he appears at first glance. However, some interpreters have recently argued for a Kantian view of the morality of suicide with surprising, even radical, implications. More specifically, they have argued that Kantianism requires that those with dementia or other rationality-eroding conditions end their lives before their condition results in their loss of identity as moral agents, and requires subjecting the fully demented or those confronting future (...) dementia to non-voluntary euthanasia. Properly understood, Kant’s ethics has neither of these implications. wrongly assumes that rational agents’ duty of self-preservation entails a duty of self-destruction when they become non-rational. further neglects Kant’s distinction between duties to self and duties to others and wrongly assumes that duties can be owed to rational agents only during the time of their existence. Referring to Kant’s arguments addressing the moral relationship between our bodies and ourselves is quite common in contemporary debate about organ selling, although he does not provide us with any specific arguments related to this debate. It is widely argued that the most promising way to show the moral impermissibility of organ selling is to mount an argument on Kantian grounds. This paper asks whether it is possible to argue coherently against organ selling in a Kantian framework. It will be (...) shown that by mounting the argument on Kantian grounds no compelling argument can be given against sale of organs, either because the arguments apply to donation of organs, too, or the arguments are not convincing for other independent reasons. In the first section, it will be argued that donation and selling are not distinguishable in a Kantian framework, since the concern about commodification of the body and its parts shall be raised by both actions. In the second section, some contemporary accounts inspired by Kant will be presented and discussed separately. Immanuel Kant (1724–1804) argued that moral requirements are based on a standard of rationality he dubbed the “Categorical Imperative” (CI). Immorality thus involves a violation of the CI and is thereby irrational. Other philosophers, such as Locke and Hobbes, had also argued that moral requirements are based on standards of rationality. However, these standards were either desirebased instrumental principles of rationality or based on sui generis rational intuitions. Kant agreed with many of his predecessors that an analysis of practical reason (...) will reveal only the requirement that rational agents must conform to instrumental principles. Yet he argued that conformity to the CI (a non-instrumental principle) and hence to moral requirements themselves, can nevertheless be shown to be essential to rational agency. This argument was based on his striking doctrine that a rational will must be regarded as autonomous, or free in the sense of being the author of the law that binds it. The fundamental principle of morality — the CI — is none other than the law of an autonomous will. Thus, at the heart of Kant's moral philosophy is a conception of reason whose reach in practical affairs goes well beyond that of a Humean ‘slave’ to the passions. Moreover, it is the presence of this self-governing reason in each person that Kant thought offered decisive grounds for viewing each as possessed of equal worth and deserving of equal respect. Environmental philosophers have argued that Kant’s philosophy offers little for environmental issues. Furthermore, Kant scholars typically focus on humanity, ignoring the question of duties to the environment. In my dissertation, I turn to a number of underexploited texts in Kant’s work to show how both sides are misguided in neglecting the ecological potential of Kant, making the case for the green Kant at the intersection of Kant scholarship and environmental ethics. I build upon previous literature to argue that the green (...) Kant matters for both sides. Rather than a liability, Kant is indeed a conceptual resource. Though many conceive of Kant’s philosophy as environmentally problematic, I argue that underappreciated evolutionary, aesthetic, and holistic sides of Kant’s philosophy can provide conceptual resources for issues in climate change and environmental ethics. Some aspects, such as the pre-critical view of nature, are quite green and merely require an application, while others, such as Kant’s philosophy of history, require a green appropriation to be relevant. The theoretical foundations I develop in these texts will allow Kantians to articulate duties regarding nature and duties for sustainability. This re-thinking of Kant redresses the complaints environmental thinkers hold against Kant. By means of a philosophical interpretation, defense, and application of particular texts from Kant’s works such as Universal Natural History, Critique of Judgment, and Idea for a Universal History, I show how the greening of Kant is not only helpful for contemporary issues, but also defensible. This will make the green Kant agreeable to Kant scholars yet all the while relevant for today with regard to environmental ethics and, more importantly, climate change. (shrink)

Kant develops his political philosophy in the context of a teleological conception of both nature and human history. For Kant, political thought must be undertaken in the context of a progressive historical view of humanity’s place in nature. For this reason Kant would strongly agree with John Rawls’s claim that one of the key roles that political philosophy plays in a society’s political culture is that of ‘probing the limits of practicable political possibility. In this role, we view political philosophy (...) as realistically utopian’ (Rawls 2007, pp. 10-11). The fact that political philosophy has this public role helps to explain the close links that exist between politics and teleology in Kant’s work. Teleology is the study of ends and of the purposiveness of both nature and history. One of the key roles of political philosophy is, for Kant, to probe what politics and human societies more generally can, will and should become in the context of the historically developing and purposive natural systems of which humans are part. Politics must be understood in its natural and historical context, but nature (especially human nature) and history must in turn be understood from a progressive political perspective. For Kant, the historical outcome of this purposive natural system, the end of history, is the full development of humanity’s predispositions for the use of reason within a moral and just society.
