One of the most notable features in recent Confucian political theory is the advocacy of political meritocracy. Though Confucian meritocrats’ controversial institutional design has been subject to critical scrutiny, less attention has been paid to their underlying normative claims. This paper aims to investigate the two justificatory conditions of Confucian political meritocracy—the service condition and the reciprocity condition—in light of classical Confucianism and with special attention to moral disagreement. Finding the normative argument for Confucian political meritocracy both incomplete (in light (...) of classical Confucianism) and implausible (under the circumstances of moral disagreement), it proposes Confucian constitutional democracy as an alternative that can meet the three conditions of the good Confucian polity—service, reciprocity, and remedy—by reconceiving the people's well-being in terms of their basic rights, as well as by promoting constitutional dialogue among the three branches of the government. Some democratic theorists have argued that contemporary people should practice only a civility that recognizes others as equal persons, and eschew any form of deference to authority as a feudalistic cultural holdover that ought to be abandoned in the modern era. Against such views, this essay engages early Confucian views of ethics and society, including their analyses of different sorts of authority and status, in order to argue that, properly understood, deference is indeed a virtue of considerable importance for contemporary (...) democratic societies and the citizens who constitute them. The debate over the future of East Asian democracy centers largely on the fit between democratic values and the Confucian way of life. Some interpret Confucianism's hierarchical, communitarian, and anti-pluralistic values as a roadblock to democratic consolidation. Others interpret the Confucian traditions of dissent and accountability as comparable to liberal institutions. This article surveys this scholarly debate by dividing the literature into three theoretical camps: compatibility, incompatibility, and convergence. Additionally, the few available empirical works on the Confucian-democratic dynamic are discussed (...) and the findings are applied to the three categorizations. This review article maintains that a consensus on the relationship between Confucianism and democracy remains elusive due to the divergent conceptualizations and operationalizations of the two doctrines. The Western liberal view of human rights has been imposed by the West on the rest of the world as universal values applicable to all cultures and traditions. This paper argues that the Chinese Marxist approach provides an alternative conceptualization of human rights, which entails anti-hegemonic sovereignty, and prioritization of social and economic rights over others. It begins with distinction between false universal and genuine universal to illustrate that the West-promoted universal is false rather than genuine. Western liberal view of (...) human rights is critiqued, followed by different perspectives on sovereignty and human rights. Anti-hegemonic sovereignty, this paper maintains, is a prerequisite for human rights improvements. The right to socio-economic well-being is a top priority for the Chinese government, as Chinese cultural traditions, Confucianism for example, value social and economic rights. The West-touted human rights discourse is intended to retain Western hegemony and seek global dominance. The Communist Party of China (CPC) has strived for human rights on behalf of the Chinese people through such projects as reform and opening-up, poverty alleviation, common prosperity, and Belt and Road Initiative, among other programs. This paper concludes that the Chinese Marxist approach goes beyond the debates over cultural relativism and Western-style “universalism”, and provides an alternative that features genuine universality and privileges the right to socio-economic well-being. The emerging field of comparative political theory (CPT) seeks to expand our understanding of politics through intercultural dialogues between diverse systems of political thought. CPT acknowledges diverse modes of political understanding, yet the field is still methodologically focused on textual forms of political practice and learning. I argue that the privileging of political literature in CPT has been inherited from orthodox political theory and the history of political thought and that the prioritizing of text over oral and enactive practices places (...) constraints on intercultural dialogue. First, methodological focus on texts inhibits dialogue with Indigenous traditions that do not prioritize text in the same way or to the same extent in the reproduction of political culture. Second, the incorporation of oral traditions tends to conflate orality with text in ways that obfuscate the contribution of enactive performance. One result of these methodological oversights is that CPT risks recapitulating some of the historical exclusionary logics that it seeks to overcome. (shrink)

This article argues that in order to make Confucian communitarianism a viable political vision, namely, Civil Confucianism, its emphasis on civility must be balanced with what I call ‘Confucian incivility’, a set of Confucian social practices that temporarily upset the existing social relations and yet that, ironically, help those relations become more enduring and viable. The central argument is that ‘Confucian civility’ encompasses both social-harmonizing civilities that buttress the moral foundation of the Confucian social order and some incivilities that upset (...) that foundation, albeit temporarily, in order to revise and thereby revitalize it. The article presents Confucian civility as both deferentially remonstrative and respectfully corrective (in the familial relations) and uncompromising and even intractable (in the political relations). It concludes by examining the implications of the virtue of Confucian incivility for constructing a less conservative and more socio-politically vibrant version of Confucian communitarianism than the prevailing suggestions of it. This essay critically revisits Jiwei Ci’s prudential argument for political democracy in China from the very Tocquevillian standpoint on which Ci’s core theoretical argument is predicated. I argue that Ci’s underlying assumption and argument regarding the enabling conditions of democracy actually depart significantly from Tocqueville’s own view due to Ci’s overly positive understanding of equality of conditions as directly constitutive of a democratic society and his assumed causal connection between capitalist society and political democracy. After clarifying what Tocqueville meant by (...) equality of conditions and discussing his prudential remedy for the perils of democracy, I conclude by suggesting an alternative pragmatic and prudential justification for democracy in China that is more consistent with the Tocquevillian conception of democracy. In his recent book, Zhuoyao Li presents one of the most pointed criticisms of Confucian democracy from a political liberal standpoint. Li’s central argument is that liberal democracy, predicated on Rawlsian political liberalism, is the only legitimate form of democracy in East Asia’s pluralist societal context. Li advances his normative argument against Confucian democracy, first by reaffirming Rawls’s public conception of morality, then shifting his point of reference from Rawls to Alessandro Ferrara, and finally, defending a multivariate democracy in East (...) Asia’s pluralist societal context from the viewpoint of Ferrara’s idea of hyperpluralism. In this paper, I defend Confucian democracy as a viable political theory in pluralist East Asia by critiquing Li’s change of the point of reference from Rawls to Ferrara, his imposition of the condition of hyperpluralism on East Asia, and his sweeping logical framework that allows no normative space for Confucian democratic theory. _Ren, the Confucian virtue par excellence, is often explained on two different accounts: on the one hand, filiality, a uniquely Confucian social-relational virtue; on the other hand, commiseration innate in human nature. Accordingly there are two competing positions in interpreting ren: one that is utterly positive about the realization of universal love by the graduated extension of filial love, and the other that sees the inevitable tension between the particularism of filial love and the universalism of compassionate love and champions (...) the latter in that filial love appears to create a serious obstacle to modernizing Confucianism. Nevertheless, both interpretations agree that compassion, given its universal and humanist implications, can be unquestionably conducive to the modern project of 'Confucian democracy'. This paper counters this shared view by arguing that in order to make Confucian democracy culturally meaningful and politically viable, it must accommodate uniquely Confucian relational virtues, particularly filiality_. In the last two decades, an ever-increasing number of scholars have challenged the conceptual borders of political philosophy and the supposed universalism of its normative pre-commitments. Surprisingly enough, the normative underpinnings of this debate have had very little impact on contemporary disputes about pluralism. This article asks how contemporary disputes about the conceptual borders of political theory can help in constructing a more plural theory of pluralism. It shows that such contributions inspire three ways of constructing a more plural political (...) theory of pluralism: a self-transformative approach, a dialogical approach and a pre-relational approach. While all three approaches progress towards less exclusionary theories of pluralism, I argue that a pre-relational approach can lead to a normative theory that is more plural than the alternatives. A central issue in Chinese philosophy today is the relationship between Confucianism and democracy. While some political figures have argued that Confucian values justify non-democratic forms of government, many scholars have argued that Confucianism can provide justification for democracy, though this Confucian democracy will differ substantially from liberal democracy. These scholars believe it is important for Chinese culture to develop its own conception of democracy using Confucian values, drawn mainly from Kongzi (Confucius) and Mengzi (Mencius), as the basis. This essay (...) describes some obstacles to this form of Confucian democracy. It argues that considering the political philosophies of Kongzi and Mengzi in the context of their views on personal cultivation reveals that they oppose some of the central assumptions of democracy. They do not trust the public to make good decisions, and advocate government for the people, but not by the people. These philosophies alone cannot generate democracy. (shrink)

We find a wide spectrum of views on the matter: some deny that Confucians value or even conceive of freedom, while others celebrate uniquely exalted forms of Confucian freedom. This paper examines the range of proposals, finding consensus among these diverse views in that all identify distinctive Confucian emphases on (i) subjective affirmation of the good and (ii) the cultivation of desires and intentions to align with that good. The variation among views of (...) Confucian freedom does not result from disparate interpretations of Confucian teachings. Rather, their divergence lies in affirming or denying that these core aspects of Confucian thought should be seen as ‘freedom.’ This reveals an undiscussed, fundamental question regarding Confucian freedom: Can and should we see the traditional Confucian moral ideal—that is, Confucian goodness and sagely virtue—as versions of freedom?
