Intersexuality

[NOTE: I now disavow this essay, which was too accommodating of trans ideology.] Surprisingly, it follows from commonplaces about sex and gender that there is a widely-practiced variety of transgenderism achievable through sex/gender “exaggerating.” Recognizing exaggeration as trans---or at least its moral equivalent---has several important consequences. One is that, since most traditional cultures endorse exaggeration, trans lifestyles have often been mainstream. But more importantly, recognizing that gender exaggeration is trans (or its moral equivalent) reveals a number of sex- and gender-discriminatory (...) practices and intolerant attitudes: from pathologizing hypergender to legally restricting androgenic hormones, many people who consider themselves trans allies are less consistent in their support of transgender lifestyles than they realize. Thus, seeing exaggerators as trans not only follows from a better grasp of transgenderism, but also reveals new arguments in favor of greater gender freedom against gender-policing by both conservatives and progressives. Ein naturalistisches Menschenbild sieht uns Menschen und unsere geistigen Fähigkeiten als materielle Phänomene und durch Evolution entstanden. Dies ist immer wieder der Anlass zu Menschenbildkonflikten, insbesondere mit religiös fundierten Menschenbildern. Aber auch innerhalb der Verhaltens- und Kognitionswissenschaft kann man suspekte Menschenbilder finden, die kulturell bedingte Verhaltensmuster und soziale Organisationsformen als biologisch-genetisch bestimmt sehen. Zum Beispiel kann die heutige evolutionäre Psychologie behaupten, dass aufgrund unterschiedlicher sozialer Rollen während der Evolution Männer und Frauen unterschiedliche verhaltenspsychologische Tendenzen und unterschiedliche kognitive Fähigkeiten haben. Dahingegen (...) würde ein naturwissenschaftlich und evolutionsbiologisch haltbares Menschenbild die gesamte Bandbreite menschlicher Vielfalt und kognitiver Diversität betonen. (shrink)

Response to Anne Fausto-Sterling's New York Times Op-Ed, in which she purports to explain why sex isn't binary.

It has been argued that competitive elite sport both (i) reduces the humanity of athletes by turning them into beings whose sole value is determined in relation to others, and (ii) is motivated by a celebration of the genetically superior and humiliation of the weak. This paper argues that while (i) is a morally reproachable attitude to competition, it is not what competitive elite sport revolves around, and that (ii) simply is not the essence of competitive elite sport. Competitive elite (...) sport is an exploration of the physical and mental demands of sport. Finally, the paper explores a number of consequences of the different views of sport with respect to the problem of intersexual women. (shrink)

Diskriminierung und Menschenrechtsverletzungen gegenüber LSBTI-Personen werden heute international thematisiert und angeprangert – ein vergleichsweise neues Phänomen. Dennoch tragen die herrschenden Normen von Zweigeschlechtlichkeit und Heterosexualität weiterhin zur Diskriminierung bei: So sind gleichgeschlechtliche Partnerschaften in fast allen Staaten schlechter gestellt als heterosexuelle. Transgeschlechtliche Menschen erfahren Gewalt, weil ihr Verhalten und Äußeres nicht geltenden Normen entsprechen.

This article discusses the ethics of the use of preimplantation genetic diagnosis to prevent the birth of children with intersex conditions/disorders of sex development , such as congenital adrenal hyperplasia and androgen insensitivity syndrome . While pediatric surgeries performed on children with ambiguous genitalia have been the topic of intense bioethical controversy, there has been almost no discussion to date of the ethics of the use of PGD to reduce the prevalence of these conditions. I suggest that PGD for those (...) conditions that involve serious medical risks for those born with them is morally permissible and that PGD for other “cosmetic” variations in sexual anatomy is more defensible than might first appear. However, importantly, the arguments that establish the latter claim have radical and disturbing implications for our attitude toward diversity more generally. (shrink)

Wir - als Queers - sollten uns schämen. Denn Scham ist, so verspricht „Gay Shame“, ein Weg zu einer neuen Radikalisierung von queerer Kritik. Gay Shame ist der wörtliche Gegensatz zu Gay Pride und kritisiert, dass der stolze Mainstream der LGBT-Community in den letzten Jahren immer angepasster, bürgerlicher, kapitalistischer und homonormativer geworden ist. Stolz ist man vor allem darauf, endlich dazuzugehören und mitheiraten oder mitkämpfen zu dürfen. Was Scham ist und welche queerpolitische Bedeutung sie hat wird in dem Sammelband von (...) Akademiker_innen, Aktivist_innen und Künstler_innen diskutiert. Sie öffnen den Blick für „beschämende“ Aspekte des queeren Lebens, die in der LSBT-Forschung weitgehend verdrängt wurden, um bestehende homophobe Ideen und Klischees nicht noch zu bestärken. Im Mittelpunkt steht der Versuch, neue und auf Scham basierende queere Gruppenidentitäten zu denken, die nicht-normalisierend wirken, also nicht Menschen bestimmte moralische Konzepte und Ideen aufdrängen und diejenigen ausschließen, die davon abweichen. Cheryl Chase has argued that “the problem” of intersex is one of “stigma and trauma, not gender,” as those focused on medical management would have it. Despite frequent references to shame in the critical literature, there has been surprisingly little analysis of shame, or of the disgust that provokes it. This paper investigates the function of disgust in the medical management of intersex and seeks to understand the consequences—material and moral—with respect to the shame it provokes.Conventional ethical approaches may not (...) provide quite the right tools to consider this affective dimension of the medical management of intersex, but we find in Nietzsche's Genealogy of Morality a framework that allows us a profound appreciation of its moral significance (Nietzsche 1887/1998). Understanding doctors' disgust—and the disgust that they promote in parents of those born with atypical anatomies—as a contemporary expression of ressentiment directs us to not focus on the bodies of those born with intersex conditions, which have been the privileged objects of attention both in medical practice and in criticisms of it, but moves us to consider instead the bodies of those whose responses constitute the motivating force for normalizing practices in the first place. Based on the case of Caster Semenya, I argue in this paper that the practice of Gender Verification Testing (GVT) in professional sports is unethical and pointless. The presumed benefit of GVT—ensuring fair competition for female athletes—is virtually nonexistent compared to its potential harms, in particular the exposure of individual athletes to a largely interphobic public. GVTs constitute a serious incursion on the athlete’s dignity, autonomy, and privacy; an incursion that cannot be justified by the appeal to fairness. My argument (...) will proceed in four steps. In sections 1-5, I provide background information on the definition of intersexuality, the history and methods of Gender Verification Testing, and the performance gap between men and women in professional athletics. In sections 6 and 7, I develop my main argument against GVT. In section 8, I offer a supplementary argument against GVT from the history of “gender engineering” in professional sports in the 1970s and 1980s. In section 9, I briefly consider the suggestion that the presence of intersex athletes in professional sports would force us to abandon gender segregation. (shrink)

The influence of pervasive cultural norms on people’s actions constitutes a longstanding problem for autonomy theory. On the one hand, such norms often seem to elude the kind of reflection that autonomous agency requires. On the other hand, they are hardly entirely beyond the pale of autonomy: people do sometimes reflect critically on them and resist them. This paper draws on phenomenological accounts of embodiment in order to reconcile these observations. We suggest that pervasive cultural norms exert a strong and (...) elusive, but occasionally resistible, influence because they are incorporated – they operate on the largely pre-reflective bodily level of human existence. As an illustration we discuss parental decisions about surgery for children born with unclear sex, decisions permeated by deeply entrenched norms about sexual difference and genital appearance.
