  1. Why do We Need to Employ Exemplars in Moral Education? Insights from Recent Advances in Research on Artificial Intelligence.Hyemin Han - forthcoming - Ethics and Behavior.
In this paper, I examine why moral exemplars are useful and even necessary in moral education despite several critiques from researchers and educators. To support my point, I review recent AI research demonstrating that exemplar-based learning is superior to rule-based learning in model performance in training neural networks, such as large language models. I particularly focus on why education aiming at promoting the development of multifaceted moral functioning can be done effectively by using exemplars, which is similar to exemplar-based learning (...)

  7. Liberal egalitarianism and critical legal studies: articles of conciliation.Matthew McManus - forthcoming - Legal Ethics:1-18.
Liberal egalitarian jurisprudence and critical legal studies have often been at odds, despite sharing a core of set of political and analytical commitments. This paper makes the case for their conciliation in the 21st century on the basis that both traditions have much to offer one another. Liberal egalitarians offer the theoretical tools for developing an egalitarian normative approach to law, and critical legal theorists offer a vital realism about power.

  8. Consequentialism and problem of role morality in legal ethics.Martin Hapla - forthcoming - Legal Ethics:1-18.
One of the frequent philosophical problems of legal ethics is the conflict between common and role morality. This situation is where a lawyer's actions are evaluated differently by these two sets of moral norms. The article seizes on this as a conflict between two conventional moralities that need to be resolved with the help of a justificatory morality and thus an appropriate theory of normative ethics. It offers as a possible response a variant of consequentialism that draws on utilitarianism and (...)

It is not easy to find a fair balance between inappropriate speech on the one hand and the appearance of constraint and inaccessibility on the other. Also judges must deal with this difficult task. They must take care not to endanger values that are protected to secure the functionality of justice. This article deals with questions of why and how judges can fulfil this task and what might happen if they fail to do so. The article argues in favour of (...)

  11. Sensitivity to moral goodness under different aesthetic contexts.Chenjing Wu, Hongyan Zhu, Yameng Zhang, Wei Zhang & Xianyou He - 2024 - Ethics and Behavior 34 (4):279-293.
Does context influence our appreciation of beauty? To answer this question, two experiments were conducted to determine the effect of contextual aesthetics on the recognition of moral behavior. Experiment 1 demonstrated that individuals in a high-aesthetic context had a quicker recognition time for moral behavior than those in a low-aesthetic context. In a low-aesthetic context, individuals recognize immoral behavior more quickly than in a high aesthetic context. Individuals showed greater recognition rates for moral behavior in a high aesthetic context and (...)

  12. The effect of leader unethical pro-organizational behaviour on subordinate silence: the mediating role of moral ownership.Silu Chen, Chenling Tian, Huan Cheng & Jiaxin Lai - 2024 - Ethics and Behavior 34 (4):264-278.
This study explores the psychological mechanism underlying and the boundary condition affecting the relationship between leader unethical pro-organizational behavior (UPB) and subordinate silence. Drawing on social cognitive theory (SCT), we posit that leader UPB may decrease subordinate moral ownership, which in turn might trigger subordinate silence; we further hypothesize that corporate social responsibility (CSR) directed toward employees may weaken the relationship between leader UPB and subordinate moral ownership as well as the indirect relationship between leader UPB and subordinate silence via (...)

  14. Nature and causes of questionable research practice and research misconduct from a philosophy of science perspective.Bor Luen Tang - 2024 - Ethics and Behavior 34 (4):294-302.
Misconduct in science is often viewed and analyzed through the lenses of normative ethics and moral philosophy. However, notions and methods in the philosophy of science could also provide rather penetrative explanatory insights into the nature and causes of scientific misconduct. A brief illustration in this regard, using as examples the widely popular Popperian falsification and the Kuhnian scientific paradigm, is provided. In multiple areas of scientific research, failure to seek falsification in a Popperian manner constitutes a questionable research practice (...)

  15. The blind obedience of others: a better than average effect in a Milgram-like experiment.Laurent Bègue & Kevin Vezirian - 2024 - Ethics and Behavior 34 (4):235-245.
In two highly powered studies (total N = 1617), we showed that individuals estimated that they would stop earlier than others in a Milgram-like biomedical task leading to the death of an animal, confirming the relevance of the Better than Average Effect (BTAE) in a new research setting. However, this effect was not magnified among participants displaying high self-esteem. We also showed that participants who already knew obedience studies expected that others would be more obedient and would administer more damaging (...)

Section 75 of the Criminal Justice Act (CJA) of 2003 overturned the principle in English law that a person cannot be retried for an offense of which he has been acquitted, recognizing advances in forensic science that uses modern analysis of DNA in adducing in evidence. The special plea of autrefois acquit can be overturned based on finding of compelling evidence after a previous acquittal of a suspect who can now be tried again for the same offense. The double jeopardy (...)

  17. Population Aging and the Retirement Age.Daniel Halliday - forthcoming - Journal of Applied Philosophy.
Numerous jurisdictions have recently raised the age of retirement or plan to do so. Pressure to extend people's working lives is due to population aging, which makes it harder to fund retirement through existing methods. Raising the retirement age can improve the ‘dependency ratio’ by increasing the fraction of the population that works (and pays taxes) relative to the fraction retired. This article gives sustained attention to connecting the case for retirement with one view about wellbeing, according to which old (...)

  18. Moral Gratitude.Romy Eskens - forthcoming - Journal of Applied Philosophy.
There are many examples of persons who appear to be grateful to other people's benefactors. In at least some of these examples, such third-party gratitude also seems fitting. However, these observations conflict with a widespread assumption in the philosophical literature about gratitude: that only beneficiaries can be fittingly grateful to benefactors. In this article, I argue that third-party gratitude exists and can be fitting, and that the assumption is therefore mistaken. More specifically, I defend two claims: (i) that there exists (...)

The goal of this article is to motivate the idea of a social reason and demonstrate its usefulness in social theorizing. For example, in a society that values getting married young, the fact that one is young is a reason to get married. In racist and sexist societies, we have social reasons to be racist and sexist. Social reasons give rise to social requirements and obligations, where these requirements often conflict with prudential and moral requirements. My application of reasons to (...)

  20. Why Moral Agreement is Not Enough to Address Algorithmic Structural Bias.P. Benton - 2022 - Communications in Computer and Information Science 1551:323-334.
One of the predominant debates in AI Ethics is the worry and necessity to create fair, transparent and accountable algorithms that do not perpetuate current social inequities. I offer a critical analysis of Reuben Binns’s argument in which he suggests using public reason to address the potential bias of the outcomes of machine learning algorithms. In contrast to him, I argue that ultimately what is needed is not public reason per se, but an audit of the implicit moral assumptions of (...)

  21. The Complementary Relation Between the Right and the Good in Justice as Fairness: Implications for Liberal Democracies (PhD Thesis).P. Benton - 2023 - Dissertation, University of Pretoria
I claim that the revisions John Rawls made to his theory of justice—as seen in his political conception of justice as fairness in the revised edition of Political Liberalism and Justice as Fairness: A Restatement—result in him being able to secure justice for all persons even in their private lives. Thus, I defend his theory against common communitarian and feminist criticisms, viz the lack of moral community and inability to secure justice for individuals in the private domain. I demonstrate that (...)

  22. The Future of the Philosophy of Work.Markus Furendal, Huub Brouwer & Willem van der Deijl - forthcoming - Journal of Applied Philosophy.
Work has always been a significant source of ethical questions, philosophical reflection, and political struggle. Although the future of work in a sense is always at stake, the issue is particularly relevant right now, in light of the advent of advanced AI systems and the collective experience of the COVID-19 pandemic. This has reinvigorated philosophical discussion and interest in the study of the future of work. The purpose of this survey article is to provide an overview of the emerging philosophical (...)

  23. Do You Mind Violating My Will? Revisiting and Asserting Autonomy.Eli Benjamin Israel - forthcoming - In Georgi Gardiner & Micol Bez (eds.), The Philosophy of Sexual Violence. Routledge.
In this paper, I discuss a subset of preferences in which a person desires the fulfillment of a choice they have made, even if it involves the violation of their desires, as in rape fantasies. I argue that such cases provide us with a unique insight into personal autonomy from a proceduralist standpoint. In its first part, I analyze some examples in light of Frankfurt's endorsement theory and argue that even when we cannot endorse a practical decision that involves being (...)

  24. Some Philosophical Principles for Social Work Research in advance.Bruce A. Thyer - forthcoming - International Journal of Applied Philosophy.
As the applied field of social work attempts to become more of a sciencebased profession, it is relying more on the findings from empirical research studies. Within social work there is little discussion of the philosophy of science underlying conventional research inquiry. This paper introduces some major philosophical principles that undergird scientific investigations of the causes of societal and psychosocial problems and of the effectiveness of structured programs, policies and practices to ameliorate social ills. Among the principles introduced are the (...)

The DACA program, administered by the Department of Homeland Security, protects Dreamers—undocumented immigrants brought to the U.S. as children. However, without legislative support, Dreamers face the imminent threat of losing their homes, rights, and deportation. I argue for the passage of the DREAM Act, which would protect Dreamers from unfair targeting and provide a path to citizenship. Dreamers possess a unique social membership in American society, and it is ethically imperative to shield them from deportation and grant them equal rights (...)

The concept of ecofascism describes the distortion of ecology for the purpose of gaining greater and wider audience, popularising ideologies and fulfilling xenophobic and nationalistic goals by regimes such as the far-right agenda and the radical ecological groups. This study investigates the issue of ecofascism in Europe, using the example of Greece, by examining the views of the citizens of Greece on the links between the political parties and ecology and environment. A survey of 600 people was conducted in Greece, (...)

The rapid development of quantum technologies, such as quantum computing, quantum internet, and quantum sensing, has led to a growing awareness of the ethical issues surrounding these technologies. This literature review aims to analyze the existing research on these ethical issues using the PRISMA (Preferred Reporting Items for Systematic Reviews and Meta-Analyses) literature review approach. The literature search was conducted using the following databases: Scopus ArXiv, and IEEE Xplore, and the search terms used were “quantum computing,” “quantum internet,” “quantum sensing,” (...)

The Russian invasion of Ukraine on February 24, 2022, has already caused large amounts of greenhouse gas (GHG) emissions and will continue to do so for many years after hostilities have ceased mainly because of the emissions linked to the rebuilding of destroyed or damaged housing, public buildings, infrastructure, factories, and the like. My aim in this paper is to discuss how in a time of climate emergency such emissions of war should impact the political morality of states initiating, continuing, (...)

In the 21st century, discussions on the environment actively intersect with religious discourse, purposefully incorporating religious texts and spiritual perspectives to propose effective solutions for addressing the pressing global environmental crisis. Within this context, this study employs a narrative analysis approach, conducting fifteen semi-structured interviews with students pursuing undergraduate course in science, aged 18–21 years, representing diverse cultural and religious backgrounds. The primary aim is to understand how traditional values embedded in micro-level activities and rituals, drawn from their culturally and (...)

  30. Ethical Resource Allocation in Policing: Why Policing Requires a Different Approach from Healthcare.Hannah Maslen & Colin Paine - forthcoming - Criminal Justice Ethics.
This article examines the inherently ethical nature of resource allocation in policing. Decision-makers must make trade-offs between values such as efficiency vs. equity, individual vs. collective benefit, and adopt principles of distribution which allocate limited resources fairly. While resource allocation in healthcare has been the subject of extensive discussion in both practitioner and academic literature, ethical resource allocation in policing has received almost no attention. We first consider whether approaches used in healthcare settings would be suitable for policing. Whilst there (...)

  31. A bioecological systems review of ethical practice in educational and school psychology.Paula Prendeville & William Kinsella - forthcoming - Ethics and Behavior.
This narrative scoping review examines ethical practice in educational and school psychology from a bioecological systems’ perspective. A search of four databases yielded 34 articles in the final narrative synthesis. Informed by Bronfenbrenner and Morris’ bioecological systems theory, the ethical experiences of educational and school psychologists were analyzed using the concepts of Process, Person, Context and Time. The complexity, intensity and frequency of ethical dilemmas are reviewed in Process. The demand, resource, and force characteristics impacting on psychologists as Person are (...)

  32. Enhancing comprehension of online informed consent: the impact of interactive elements and presentation formats.Bree Holtz, Katharine Mitchell, Robyn Adams, Caitlin Grier & Jason Wright - forthcoming - Ethics and Behavior.
Informed consent, a cornerstone of research ethics, ensures participant protection and informed participation, particularly in online settings. Despite its significance, engagement with online consent forms remains low, underscoring the need for improved presentation strategies. This study investigates the impact of interactive elements and diverse presentation formats on the comprehension and engagement of online informed consent documents among a broad demographic beyond the commonly studied student populations. Employing a between-subjects experimental design, we explored six versions of online consent forms varying in (...)

  33. The ‘Good Kiwi’ and the ‘Good Environmental Citizen’?: Dairy, national identity and complex consumption-related values in Aotearoa New Zealand.E. L. Sharp, A. Rayne & N. Lewis - forthcoming - Agriculture and Human Values:1-13.
Alongside concerns for animal welfare, concerns for land, water, and climate are undermining established food identities in many parts of the world. In Aotearoa New Zealand, agrifood relations are bound tightly into national identities and the materialities of export dependence on dairying and agriculture more widely. Dairy/ing identities have been central to national development projects and the politics that underpin them for much of New Zealand’s history. They are central to an intransigent agrifood political ontology. For the last decade, however, (...)

  34. Educating against intellectual vices.Noel L. Clemente - forthcoming - Ethics and Education.
Intellectual character education has been primarily expressed in terms of educating for intellectual virtues (EFIV). This aim of teaching intellectual virtues has received some challenges, such as how it fails to articulate adequate action guidance through exemplarist pedagogy, and how it neglects the pervasiveness of intellectual vice among students. To respond to these challenges, this paper considers the aim of educating against intellectual vices (EAIV) – teaching students not to develop intellectual vices or weakening those that they have already developed (...)

  35. The role of rationales for and criticisms of ethical decisions in the development of meta-moral cognitive skills.Reena Cheruvalath, Emmanuel Manalo & Hiroaki Ayabe - forthcoming - Ethics and Behavior.
Meta-moral cognitive skills consist of identifying reasons behind ethical decisions, potential criticisms for such reasons, and constructing counterarguments for these criticisms. We assessed the relationship among these three elements of ethical judgment justification using ethical dilemmas. A mixed-methods research design was used to investigate university students from India and Japan. Critical thinking skills, knowledge of professional ethics, discipline, perspective-taking, common sense, and culture influenced the respondents’ meta-moral cognitive skills. There was a correlation between the number/strength of reasons and criticisms and (...)

  36. Justice in Hiring: Why the Most Qualified Should Not (Necessarily) Get the Job.Brian Carey - forthcoming - Journal of Applied Philosophy.
In this article I argue that justice often requires that candidates who are sufficiently qualified for jobs be hired via lottery on the basis that this is the best way to recognise each candidate's equal moral claim to access meaningful work. In reaching this conclusion I consider a variety of potential objections from the perspectives of the employer, of the most qualified candidate, and of third parties, but ultimately reject the idea that a person's status as the most qualified candidate (...)

  38. The Emotion of Gratitude and Communal Relationships.Coleen Macnamara - forthcoming - Journal of Applied Philosophy.
Emotions are typically dual-faced: they involve both an evaluative and a practical aspect. What is more, an emotion's evaluative and practical aspects tend to exhibit a kind of fit. For example, Sakshi's fear of the bear involves apprehending the bear as a threat to something she cares about, i.e., her wellbeing. And it motivates her to act on behalf of this care: it motivates her to act in ways that protect her wellbeing. Both dimensions of Sakshi's fear are about her (...)

  40. Job prospects, useful knowledge, and the ‘rip-off’ University: returning to John Henry Newman in our post-pandemic moment.Áine Mahon & Judith Harford - forthcoming - Ethics and Education.
This paper re-examines the tension between professional and liberal education by revisiting The Idea of the University (1852), the seminal mid-nineteenth century treatise of John Henry Newman. In returning to Newman’s classic text, we are interested in the significance of his lectures for a contemporary Higher Education increasingly under pressure to be ‘useful:’ on this understanding, ‘useful’ denotes an arguably limited and utilitarian sense where the university guarantees its students a well-paying job on graduation. In pressing on this distinction between (...)

  41. On the Ethics of Interacting.Kimberley Brownlee - forthcoming - Journal of Applied Philosophy.
Ordinary interactions are the primary vehicle through which we show respect, give social pleasure, and grease the wheels of healthy sociality. When we do an interactional wrong to someone, we not only convey disrespect by disregarding their interactional needs, but also cause them social pain and erode healthy social relations. Interactional ethics – the study of the ethics of interacting – concerns both our conduct within our interactions and our broader interactional style. The existing philosophical literature in this area has (...)

  42. The drivers of academic cheating in online learning among Filipino undergraduate students.Jeannie A. Perez, Reinier Dave Zapanta, Rowena P. Heradura & Silfa C. Napicol - forthcoming - Ethics and Behavior.
The susceptibility of online learning to cheating behavior remains a contentious and unresolved issue. A cross-sectional explanatory research design was utilized to test the hypothesized factors influencing academic cheating in online learning. Our study involved 562 participants, selected through a non-probability sampling technique, who were surveyed using online questionnaires designed to measure the identified factors. We tested the hypotheses by utilizing path analysis through the partial least square regression approach within the SMART-PLS software. The demographics such as gender and age (...)

  43. Life’s potentiality as multispecies gift.João Aldeia - 2024 - Ethics in Science and Environmental Politics 24:15-30.
Contemporary political ecological problems reduce possibilities for future human and non-human life. These problems are the result of modern capitalist humans’ attempt to break away from multispecies bonds and turn non-humans into resources to be appropriated. These bonds are crucial for the continued generation of life, which can only result from intergenerational and interspecies shared time, effort, and energy. By expanding the works of Mauss’ intellectual heirs and Levinas towards multispecies interactions, this gift of life can be better understood. Life (...)

Looking back at the "War on Terror" and its policies, actions, and the violence that followed, this book analyzes the resulting changes in international power structures and the relationship between citizens and their representatives. It defines our shortcomings in opposing this type of violence by demonstrating how the notion of legitimate violence has been broadened. -/- The impact of the "War on Terror" on the public view of Liberalism is explored, as well as its effects on the role of state (...)

Research assessment and grant funding are vital to higher education. However, the reliance on quantitative metrics in these processes has raised concerns about their validity and potential negative consequences. This study aims to investigate the game of numbers in research assessment and grant funding, focusing on the perspectives of experienced researchers from around the globe. Accidental sampling elicited responses from more than 15 experienced researchers across different academic disciplines, institutions, and countries. The data were collected from the popular “Reviewer 2 (...)

DuBois - 2023 - Journal of Law, Medicine and Ethics 51 (4):941-953.
State Medical Boards (SMBs) can take severe disciplinary actions (e.g., license revocation or suspension) against physicians who commit egregious wrongdoing in order to protect the public. However, there is noteworthy variability in the extent to which SMBs impose severe disciplinary action. In this manuscript, we present and synthesize a subset of 11 recommendations based on findings from our team’s larger consensus-building project that identified a list of 56 policies and legal provisions SMBs can use to better protect patients from egregious (...)

  47. Quantifying “Community Power” and “Racial Justice” in the Medical-Legal Partnership Literature.Alicia Turlington, Jonathan Young & Dina Shek - 2023 - Journal of Law, Medicine and Ethics 51 (4):748-756.
Medical-Legal Partnerships (MLPs) have been widely acclaimed for promoting health equity and achieving meaningful outcomes. Yet, little to no research has analyzed if this critical work has been done with communities — through meaningful engagement and building power — or if it has been done for communities without their involvement.

  49. Camden Coalition Medical-Legal Partnership: Year One Analysis of Civil + Criminal MLP Model in Addiction Medicine Setting.Jeremy S. Spiegel, Matthew S. Salzman, Iris Jones & Landon Hacker - 2023 - Journal of Law, Medicine and Ethics 51 (4):838-846.
In 2022, the Camden Coalition Medical-Legal Partnership began providing civil and criminal legal services to substance use disorder patients at Cooper University Health Care’s Center for Healing. This paper discusses early findings from the program’s first year on the efficacy of the provision of criminal-legal representation, which is uncommon among MLPs and critical for this patient population. The paper concludes with takeaways for other programs providing legal services in an addiction medicine setting.

  50. Leveraging Academic-Medical Legal Partnerships to Advance Health Justice.Vicki W. Girard, Yael Z. Cannon, Deborah F. Perry & Eileen S. Moore - 2023 - Journal of Law, Medicine and Ethics 51 (4):798-809.
Unmet legal needs contribute to housing, income, and food insecurity, along with other conditions that harm health and drive health inequity. Addressing health injustice requires new tools for the next generations of lawyers, doctors, and other healthcare professionals. An interprofessional group of co-authors argue that law and medical schools and other university partners should develop and cultivate Academic Medical-Legal Partnerships (A-MLPs), which are uniquely positioned to leverage service, education, and research resources, to advance health justice.
