  2. Rescuing Public Reason Liberalism’s Accessibility Requirement.Gabriele Badano & Matteo Bonotti - 2020 - Law and Philosophy 39 (1):35-65.
Public reason liberalism is defined by the idea that laws and policies should be justifiable to each person who is subject to them. But what does it mean for reasons to be public or, in other words, suitable for this process of justification? In response to this question, Kevin Vallier has recently developed the traditional distinction between consensus and convergence public reason into a classification distinguishing three main approaches: shareability, accessibility and intelligibility. The goal of this paper is to defend (...)

  3. If You’re a Rawlsian, How Come You’re So Close to Utilitarianism and Intuitionism? A Critique of Daniels’s Accountability for Reasonableness.Gabriele Badano - 2018 - Health Care Analysis 26 (1):1-16.
Norman Daniels’s theory of ‘accountability for reasonableness’ is an influential conception of fairness in healthcare resource allocation. Although it is widely thought that this theory provides a consistent extension of John Rawls’s general conception of justice, this paper shows that accountability for reasonableness has important points of contact with both utilitarianism and intuitionism, the main targets of Rawls’s argument. My aim is to demonstrate that its overlap with utilitarianism and intuitionism leaves accountability for reasonableness open to damaging critiques. The important (...)

Recent epidemiological research on the social determinants of health has been used to attack an important framework, associated with Norman Daniels, that depicts healthcare as special. My aim is to rescue the idea that healthcare has special importance in society, although specialness will turn out to be mainly limited to clinical care. I build upon the link between Daniels's theory and the work of John Rawls to develop a conception of public justification liberalism that is suitable to the field of (...)

  5. The Principle of Restraint: Public Reason and the Reform of Public Administration.Gabriele Badano - 2020 - Political Studies 68 (1):110-127.
Normative political theorists have been growing more and more aware of the many difficult questions raised by the discretionary power inevitably left to public administrators. This article aims to advance a novel normative principle, called ‘principle of restraint’, regulating reform of established administrative agencies. I argue that the ability of public administrators to exercise their power in accordance with the requirements of public reason is protected by an attitude of restraint on the part of potential reformers. Specifically, they should refrain (...)

This article discusses the growth of the populist radical right as a concrete example of the scenario where liberal democratic ideas are losing support in broadly liberal democratic societies. Our goal is to enrich John Rawls’ influential theory of political liberalism. We argue that even in that underexplored scenario, Rawlsian political liberalism can offer an appealing account of how to promote the legitimacy and stability of liberal democratic institutions provided it places partisanship centre stage. Specifically, we propose a brand-new moral (...)

Unlike his theory of justice as fairness, John Rawls’s political liberalism has generally been spared from critiques regarding what is due to the disabled. This paper demonstrates that, due to the account of the basic ideas of society and persons provided by Rawls, political liberalism requires that the interests of numerous individuals with disabilities should be put aside when the most fundamental issues of justice are settled. The aim is to accommodate within public reason the due concern for the disabled (...)

  8. Substance in bureaucratic procedures for healthcare resource allocation: a reply to Smith.Gabriele Badano - 2019 - Journal of Medical Ethics 45 (1):75-76.
William Smith’s recent article criticises the so-called orthodox approaches to the normative analysis of healthcare resource allocation, associated to the requirement that decision-makers should abide by strictly procedural principles of legitimacy defining a deliberative democratic process. Much of the appeal of Smith’s argument goes down to his awareness of real-world processes and, in particular, to the large gap he identifies between well-led democratic deliberation and the messiness of the process through which the intuitively legitimate Affordable Care Act was created. This (...)

Originally proposed by John Rawls, the idea of reasoning from conjecture is popular among the proponents of political liberalism in normative political theory. Reasoning from conjecture consists in discussing with fellow citizens who are attracted to illiberal and antidemocratic ideas by focusing on their religious or otherwise comprehensive doctrines, attempting to convince them that such doctrines actually call for loyalty to liberal democracy. Our goal is to criticise reasoning from conjecture as a tool aimed at persuasion and, in turn, at (...)

  11. Equality, Liberty and the Limits of Person-centred Care’s Principle of Co-production.Gabriele Badano - 2019 - Public Health Ethics 12 (2):176-187.
The idea that healthcare should become more person-centred is extremely influential. By using recent English policy developments as a case study, this article aims to critically analyse an important element of person-centred care, namely, the belief that to treat patients as persons is to think that care should be ‘co-produced’ by formal healthcare providers and patients together with unpaid carers and voluntary organizations. I draw on insights from political philosophy to highlight overlooked tensions between co-production and values like equality and (...)

The involvement of the public in the governance of genomics has become a topic of growing interest among scholars, practitioners and policy-makers. The implementation of public involvement programmes may be quite expensive, and the design and evaluation of public participation is a matter of controversy. Thus, this paper examines the justifications for public participation in the governance of genomic research to help understand whether public involvement is worthwhile and to provide a guide to the design of public participation. This thesis discusses how societies should allocate clinical care resources. The first aim of the thesis is to defend the idea that clinical care resource allocation is a matter for deliberative democratic procedures. I argue that deliberative democracy is justified because of its ability to implement equal respect and autonomy. Furthermore, I address several in-principle objections to the project of applying deliberative democracy to clinical care resource allocation. Most notably, I respond to the narrow view of the scope of deliberative (...)

Notes on substantance in orthodox theory: a reply to Badano.William R. Smith - 2019 - Journal of Medical Ethics 45 (4):275-276.
Gabriele Badano offers three criticisms of my challenge to the orthodox family of theories of legitimacy in bioethics. First, I assumed an ‘oversimplified version of the orthodoxy’. Second, I failed to appreciate its domain of application. Third, I only addressed the ways in which orthodox theorists incorporate substance as an ‘afterthought’—and, even then, only by rehashing Gopal Sreenivasan’s argument. Here, I respond to each, taking up the first and third before ending with reflections on the second. The first (...)

  18. Kant's Critique of Pure Reason and the Method of Metaphysics.Gabriele Gava - 2023 - Cambridge: Cambridge University Press.
In two often neglected passages of the Critique of Pure Reason, Kant submits that the Critique is a 'treatise' or a 'doctrine of method'. These passages are puzzling because the Critique is only cursorily concerned with identifying adequate procedures of argument for philosophy. In this book, Gabriele Gava argues that these passages point out that the Critique is the doctrine of method of metaphysics. Doctrines of method have the task of showing that a given science is indeed a science (...)

In this chapter, I investigate a problem for Kant’s claim that metaphysics can reach the status of science. The problem arises when one considers Kant’s account of the “architectonic unity” of metaphysics in the Architectonic of Pure Reason. Attaining architectonic unity is a condition for becoming a science for any body of cognitions that purports to be such. This is achieved when the cognitions belonging to a science are systematically organized according to the “idea of reason” which lies at the (...)

An ardent republican loyal to Florence’s free institutions? The father of political realism? A revolutionary populist? A calculating rationalist? A Renaissance humanist? A prophet of Italian unification? A theorist of mixed government? A forerunner to authoritarianism? The master of the dark arts of intrigue? This book provides a vivid and engaging introduction to Machiavelli’s life and works that sheds (...)

During the oppressive reign of Louis XIV, Gabrielle Suchon (1632–1703) was the most forceful female voice in France, advocating women’s freedom and self-determination, access to knowledge, and assertion of authority. This volume collects Suchon’s writing from two works—Treatise on Ethics and Politics (1693) and On the Celibate Life Freely Chosen; or, Life without Commitments (1700)—and demonstrates her to be an original philosophical and moral thinker and writer. Suchon argues that both women and men have inherently similar intellectual, corporeal, and spiritual (...)

Carnap’s seminal ‘Empiricism, Semantics and Ontology’ makes important use of the notion of a framework and the related distinction between internal and external questions. But what exactly is a framework? And what role does the internal/external distinction play in Carnap’s metaontology? In an influential series of papers, Matti Eklund has recently defended a bracingly straightforward interpretation: A Carnapian framework, Eklund says, is just a natural language. To ask an internal question, then, is just to ask a question in, say, English. (...)

This chapter analyzes two short texts in which Peirce sketches out an anti-skeptical argument inspired by Kant’s refutation of idealism. The chapter will first consider why Peirce found Kant’s argument interesting and promising, given that it is often regarded as problematic and unsuccessful. It will then briefly reconstruct Kant’s refutation, highlighting its most problematic passages. Moreover, since Peirce’s own version of the argument relies on Kant’s views regarding the temporal structure of consciousness, the chapter will explain how Peirce tackles this (...)

This paper takes a close look at the thought that mereological relations on material objects mirror, and are mirrored by, parallel mereological relations on their exact locations. This hypothesis is made more precise by means of a battery of principles from which more substantive consequences are derived. Mereological harmony turns out to entail, for example, that atomistic space is an inhospitable environment for material gunk or that Whiteheadian space is not a hospitable environment for unextended material atoms.

In Kant’s Critique of Pure Reason and the Method of Metaphysics (CUP 2023), I argue that the first Critique is not only a ‘propaedeutic’ to metaphysics, but actually already establishes parts of metaphysics. These parts belong to what Kant calls transcendental philosophy. Additionally, I also provide an account of Kant’s critique of dogmatism and Wolff as its main defender. In this paper, I take up Luigi Filieri’s and Davide Dalla Rosa’s invitation to further develop my characterization of transcendental philosophy and (...)

It is common to distinguish two great families of representation. Symbolic representations include logical and mathematical symbols, words, and complex linguistic expressions. Iconic representations include dials, diagrams, maps, pictures, 3-dimensional models, and depictive gestures. This essay describes and motivates a new way of distinguishing iconic from symbolic representation. It locates the difference not in the signs themselves, nor in the contents they express, but in the semantic rules by which signs are associated with contents. The two kinds of rule have (...)
