Patients have received experimental pharmaceuticals outside of clinical trials for decades. There are no industry-wide best practices, and many companies that have granted compassionate use, or ‘preapproval’, access to their investigational products have done so without fanfare and without divulging the process or grounds on which decisions were made. The number of compassionate use requests has increased over time. Driving the demand are new treatments for serious unmet medical needs; patient advocacy groups pressing for access to emerging treatments; internet platforms (...) enabling broad awareness of compelling cases or novel drugs and a lack of trust among some that the pharmaceutical industry and/or the FDA have patients’ best interests in mind. High-profile cases in the media have highlighted the gap between patient expectations for compassionate use and company utilisation of fair processes to adjudicate requests. With many pharmaceutical manufacturers, patient groups, healthcare providers and policy analysts unhappy with the inequities of the status quo, fairer and more ethical management of compassionate use requests was needed. This paper reports on a novel collaboration between a pharmaceutical company and an academic medical ethics department that led to the formation of the Compassionate Use Advisory Committee. Comprising medical experts, bioethicists and patient representatives, CompAC established an ethical framework for the allocation of a scarce investigational oncology agent to single patients requesting non-trial access. This is the first account of how the committee was formed and how it built an ethical framework and put it into practice. (shrink)

The earlier volume in this series dealt with two religions of Indian origin, namely, Buddhism and Jainism. The Indian religious scene, however, is characterized by not only religions which originated in India but also by religions which entered India from outside India and made their home here. Thus religious life in India has been enlivened throughout its history by the presence of religions of foreign origin on its soil almost from the very time they came into existence. This volume covers (...) three such religions—Zoraoastrianism, Judaism, and Islam. In the case of Zoraostianism, even its very beginnings are intertwined with India, as Zoroastrianism reformed a preexisting religion which had strong links to the Vedic heritage of India. This relationship took on a new dimension when a Zoroastrian community, fearing persecution in Persia after its Arab conquest, sought shelter in western India and ultimately went on to produce India’s pioneering nationalist in the figure of Dadabhai Naoroji ( 1825-1917), also known as the Grand Old Man of India. Jews found refuge in south India after the destruction of the Temple by the Romans in 70 C.E. and have remained a part of the Indian religious scene since then, some even returning to Israel after it was founded in 1948. Islam arrived in Kerala as soon as it was founded and one of the earliest mosques in the history of Islam is found in India. Islam differs from the previously mentioned religions inasmuch as it went on to gain political hegemony over parts of the country for considerable periods of time, which meant that its impact on the religious life of the subcontinent has been greater compared to the other religions. It has also meant that Islam has existed in a religiously plural environment in India for a longer period than elsewhere in the world so that not only has Islam left a mark on India, India has also left its mark on it. Indeed all the three religions covered in this volume share this dual feature, that they have profoundly influenced Indian religious life and have also in turn been profoundly influenced by their presence in India. If the Mitchell ordering of normal measures over \(\lambda \) is also linear, then by reflection (and without any use of indestructibility), \(A_1= \{\delta is a measurable cardinal and the Mitchell ordering (...) of normal measures over \(\delta \) is linear \(\}\) is unbounded in \(\kappa \) as well. The large cardinal hypothesis on \(\lambda \) is necessary. We demonstrate this by constructing via forcing two models in which \(\kappa \) is supercompact and \(\kappa \) exhibits an indestructibility property slightly weaker than full indestructibility but sufficient to infer that \(A_0\) is unbounded in \(\kappa \) if \(\lambda > \kappa \) is measurable. In one of these models, for every measurable cardinal \(\delta \), the Mitchell ordering of normal measures over \(\delta \) is linear. In the other of these models, for every measurable cardinal \(\delta \), the Mitchell ordering of normal measures over \(\delta \) is nonlinear. (shrink)

Arthur O. Lovejoy famously referred to thirteen pragmatisms. If he were called on to enumerate postmodernisms, no doubt he would increase this number tenfold.1 Fortunately I need not follow his lead for the task at hand, namely, to discuss whether the pragmatic tradition can narrow the divide between modernism and postmodernism on the topic of cosmopolitanism. To do so I will focus on specific sets of ideas that have been associated with these terms. So, for example, modernists have been (...) viewed as defenders of some form of universality, ethical or conceptual, and of a responsible, self-actuating, authentic subject. Postmodernists look toward particularity and alterity, and stress that notions of a unitary subject .. (shrink)

Art theory has consistently emphasised the importance of situational, cultural, institutional and historical factors in viewers’ experience of fine art. However, the link between this heavily context-dependent interpretation and the workings of the mind is often left unexamined. Drawing on relevance theory—a prominent, cogent and productive body of work in cognitive pragmatics—we here argue that fine art achieves its effects by prompting the use of cognitive processes that are more commonly employed in the interpretation of words and other stimuli presented (...) in a communicative context. We describe in particular how institutional factors effectively co-opt these processes for new ends, allowing viewers to achieve cognitive effects that they otherwise would not, and so provide cognitivist backing for an Institutional Theory of Art, such as that put forward by Arthur Danto. More generally, we situate and describe the Western fine art tradition as a phenomenon that is a consequence of both the cognitive processes involved in communication, and of cultural norms, practices and institutions. We summarize the known methods of producing a non-supercompact strongly compact cardinal and describe some new variants. Our Main Theorem shows how to apply these methods to many cardinals simultaneously and exactly control which cardinals are supercompact and which are only strongly compact in a forcing extension. Depending upon the method, the surviving non-supercompact strongly compact cardinals can be strong cardinals, have trivial Mitchell rank or even contain a club disjoint from the set of measurable cardinals. We determine exact consistency strengths for various failures of the Singular Cardinals Hypothesis (SCH) in the setting of the Zermelo-Fraenkel axiom system ZF without the Axiom of Choice (AC). By the new notion of parallel Prikry forcing that we introduce, we obtain surjective failures of SCH using only one measurable cardinal, including a surjective failure of Shelah's pcf theorem about the size of the power set of $\aleph _{\omega}$ . Using symmetric collapses to $\aleph _{\omega}$ , $\aleph _{\omega _{1}}$ , (...) or $\aleph _{\omega _{2}}$ , we show that injective failures at $\aleph _{\omega}$ , $\aleph _{\omega _{1}}$ , or $\aleph _{\omega _{2}}$ can have relatively mild consistency strengths in terms of Mitchell orders of measurable cardinals. Injective failures of both the aforementioned theorem of Shelah and Silver's theorem that GCH cannot first fail at a singular strong limit cardinal of uncountable cofinality are also obtained. First published in 1818, The World as Will and Representation contains Schopenhauer's entire philosophy, ranging through epistemology, metaphysics, philosophy of mind and action, aesthetics and philosophy of art, to ethics, the meaning of life and the philosophy of religion, in an attempt to account for the world in all its significant aspects. It gives a unique and influential account of what is and is not of value in existence, the striving and pain of the human condition and the possibility of (...) deliverance from it. This new translation of the first volume of what later became a two-volume work reflects the eloquence and power of Schopenhauer's prose and renders philosophical terms accurately and consistently. This book brings together an international group of scholars to discuss the ramifications of Heidegger's Black Notebooks for philosophy and the humanities. In contrast to both those who seek to exonerate Heidegger and those who simply condemn him, they urge careful reading and rereading of his work to turn Heideggerian thought against itself.

The focus of this article is J. Leslie Mitchell’s Spartacus (1933), his fictional representation of the slave rebellion in ancient Rome led by the eponymous gladiator. The article begins by examining Mitchell’s contribution to debates over the role of the revolutionary writer in Left Review in the mid-1930s and his place in the British Left in this era, before going on to survey the ways in which the figure of Spartacus and the German Spartacists are represented across (...) class='Hi'>Mitchell’s oeuvre. It then explores key source material utilized in the writing of the novel, as well as outlining comparisons between Mitchell’s representation of Spartacus and those of his fellow novelists Howard Fast and Arthur Koestler. Including close readings of Spartacus and informed by archival research and previously unpublished manuscript items, the article argues that at the same time as denouncing the cruelties of Roman rule, Spartacus also signals Mitchell’s passionate opposition to what he considered the violent histories of oppression suffered by the commons of the earth of all times, culminating in the capitalist crisis of Mitchell’s own period in the 1930s. Mitchell creates this effect of historical simultaneity by writing a work of myth-history – as opposed to historical realism or political propaganda – that employs the utopian legend of the Golden Age to inspire radical dissent against modern deprivation. Metaphysics is largely an a priori business, albeit a business that is sensitive to the findings of the physical sciences. This chapter has two aims. The first is to defend a particular conception of the methodology of a priori metaphysics by, in part, exemplifying that methodology and revealing its results. The second is to present a new account of holes. These two aims dovetail nicely. The chapter provides a better analysis of the concept ′hole′ that yields a more plausible metaphysical (...) story about holes. The authors defend a new, functionalist, analysis of holes, which, unlike its rivals, neither misidentifies nor renders them implausibly eliminativist about holes under various different metaphysical suppositions about the nature of space. In the process, the authors set out the complex relations between the intension of "hole," and its extension at various worlds under different suppositions about the nature of space. (shrink)
