Some physicians refuse to perform life-sustaining interventions, such as tracheostomy, on patients who are very likely to remain permanently unconscious. To explain their refusal, these clinicians often invoke the language of “futility”, but this can be inaccurate and can mask problematic forms of clinical power. This paper explores whether such refusals should instead be framed as conscientious objections. We contend that the refusal to provide interventions for patients very likely to remain permanently unconscious meets widely recognized ethical standards for the (...) exercise of conscience. We conclude that conscientious objection to tracheostomy and other life-sustaining interventions on such patients can be ethical because it does not necessarily constitute a form of invidious discrimination. Furthermore, when a physician frames their refusal as conscientious objection, it makes transparent the value-laden nature of their objection and can better facilitate patient access to the requested treatment. Parallax, or the change in the position of an object viewed along two different lines of sight and more precisely, the assumption that this adjustment is not only due to a change of focus, but a change in that object's ontological status has been a key philosophical concept throughout history. Building upon Slavoj Žižek's The Parallax View, this volume shows how parallax is used as a figure of thought that proves how the incompatibility between the physical and the theoretical touches (...) not only upon the ontological, but also politics and aesthetics. While in neo-Aristotelian conceptions of virtue and Bildung the concept of “second nature” describes the successful completion of human education, Hegel uses this term in order to analyze the irresolvably ambiguous, even conflictive nature of spirit. Spirit can only realize itself, in creating (1) a second nature as an order of freedom, by losing itself, in creating (2) a second nature—an order of externality, ruled by the unconscious automatisms of habit. In the second meaning of the term, “second nature” refers (...) to spirit’s inversion of itself: the free enactment of spirit produces an objective, uncontrollable order; "second nature" is here a critical term. On the other hand, the very same inversion of free positing into objective existence is the moment of the success of ("absolute") spirit. The paper exposes this undecidable ambiguity of second nature and claims that its acceptance and development are the conditions of an adequate understanding of the constitution and forms of second nature. The „left Hegelian” interpretation of Hegel′s theory of Sittlichkeit has shown that the claim of the concept of autonomy to establish an internal connection between normativity and freedom can only be carried out, if the subject of autonomy is defined by its participation in social practices. While the left Hegelian interpretation thereby solves the paradoxes of the Kantian tradition of understanding autonomy, it is destined to repeat the paradoxical structure of autonomy in a new and fundamental form. This follows from (...) the insight – articulated by Hegel′s anti-Aristotelian concept of “second nature” – that participation in social practices is at the same time the medium and the other of autonomy. This book brings a new perspective—mainly out of German intellectual discussions rooted in Hegel—to bear on the problems of equality as discussed in Anglo-American conceptions of liberalism.

Hannah Arendt's 1949 essay on the critique of human rights was published in English and German in the same year under two quite different titles: while in English the title asks the skeptical question: "'The Rights of Man'. What Are They?", the German title claims: "Es gibt nur ein einziges Menschenrecht " - "there is only one human right". The article shows that the English title's skepticism and the German title's assertion represent two internally connected moves of Arendt's argument. For (...) Arendt aims at a fundamental critique of the modern natural law tradition of human rights which, at the same time, hints at a possible alternative understanding of a " right to have rights" in terms of a political anthropology - a new understanding of human dignity. Tragic Play explores the deep philosophical significance of classic and modern tragedies in order to cast light on the tragic dimensions of contemporary experience. Romanticism, it has often been claimed, brought tragedy to an end, making modernity the age after tragedy. Christoph Menke opposes this modernist prejudice by arguing that tragedy remains alive in the present in the distinctively new form of the playful, ironic, and self-consciously performative. Through close readings of plays by William Shakespeare, Samuel Beckett, Heiner (...) Müller, and Botho Strauss, Menke shows how tragedy re-emerges in modernity as "tragedy of play." In Hamlet, Endgame, Philoktet, and Ithaka, Menke integrates philosophical theory with critical readings to investigate shifting terms of judgment, curse, reversal, misfortune, and violence. (shrink)

This essay examines how Joseph Beuys uses the social plastic concept (›soziale Plastik‹) to think about the relationship between art and democracy. To this end, the first part analyzes the oppositions that define this concept in order to read them as the basic determinations of a dialectical concept of democracy. Against this background, the second part of the essay deals with how Beuys understands the contribution of art to democracy. Is wanting not to be right – the endeavor that Martin Seel not only explores and defends but practices in his eponymous book (›Nichtrechthabenwollen‹) – the expression of a paradox, a self-contradictory undertaking? It is indeed if to want something means to judge it as right. The text proposes to understand the wanting Martin Seel speaks of differently. This can be done with the help of the figure of »active passivity,« in which Seel sees the essential thought of Adorno.

In Philosophy and Real Politics, Raymond Geuss outlines the program of a “realistic” investigation of politics and develops a critique of the normativistic approach that defines the mainstream of contemporary analytic political philosophy. The paper discusses the question of how these two elements, “realism” and “critique”, are related in Geuss. Drawing on some of Geuss′ considerations in Outside Ethics the paper argues that the very existence of “real politics” depends on the critique of those normativistic forms of thinking that threaten (...) to dissolve the reality of politics. Hermann Pfütze und Christoph Menke stellen in dem Podiumsgespräch die Frage nach den widerständigen Potentialen der Kunst. Was ist das Spezifische der Kunst gegenüber anderen sozialen Feldern oder Praxisformen? Was lässt sich unter Ästhetischem Widerstand genau verstehen? Auch wenn die Kunst nicht über Gewaltmittel verfügt, so könnte es doch einen Wettstreit um die Idee der Kunst geben. Ästhetischer Widerstand ist dann der Widerstand einer Kunstform gegen eine andere. Oder ist die ästhetische Erfahrung gerade nicht antagonistisch organisiert? Dann könnte (...) Kunst als eine heilende Praxis erscheinen, die anderen Antagonismen entgegenwirkt und so Angst und Schrecken bannt. Nach Hermann Pfütze weist das Ästhetische eine Nähe zur Demokratie auf, da Kunst wie Demokratie die Unabgeschlossenheit der Welt betonen und von Angst und Schrecken befreien wollen. Dieser an Judith Shklar gewonnene Demokratiebegriff ist für Christoph Menke zu defensiv. Kunst scheint für Menke in unserer Gegenwartsgesellschaft eher der spezifische Ort eines utopischen Potentials zu sein, denn die Kunst kritisiert durch ihren Versuch der Darstellung von Lebendigkeit unbelebte Praxisformen, wie etwa die entfremdete Arbeit. Besides human beings, such a functional concept of legal subjectivity can in principle also be applied to other autonomous agents as holder of rights and obligations, e.g. techno- logical artifacts and other non-human agents. Christoph Menke in turn points out that the invention of new rights was the actual law of motion of political emancipation in modern times. This began with the bourgeois revolutions and is still the general model with which politics and theory operate to claim new rights for non-human creatures and artifacts. Just as in the 19th and 20th centuries, the legal emancipation initially led beyond the limits of bourgeois subjectivity and in- vented social and cultural rights, so should we make a further consequent step and break with the dependence of juridical recognition on the category of human subjectivity. Also bio- and artifacts are to be reconstructed as independent legal entities. However, they lack something that was absolutely fundamental in the emancipatory struggles of the past: to be a subject of rights meant to have demanded rights, indeed, to have been a fighter for rights. One could not be a legal person and holder of rights without having been a political subject as fighter and thinker of rights. To suspend the dependence of legal personhood on human subjectivity so that there may be bio- and artifact-rights also means to dissolve the unity between legal personality and political subjectivity that once defined the modern idea of rights. This paper argues that modernity can only be properly understood when tragedy is viewed as one of the conditions internal to it. Modernity and tragedy are not mutually exclusive, as Hegel and Schlegel, for example both argue, but mutually inclusive. Each is determined by the other—as tragic modernity and as modern tragedy.
