The world has changed in the last few decades. While the enforcement of international issues may once have been undermined by differences in transnational institutions, the onset of globalisation has led to a greater willingness amongst states to cooperate with each other. It is suggested that this could be a positive development for, amongst other things, gradually tackling climate change, global poverty and the greater realisation of human rights. Technology is changing the world in which we live and this includes the legal profession. This change has been remarked from many different standpoints. However, as technology is increasingly integrated into the fabric of legal practice, the very act of lawyering is likely to change and this will give rise to very important ethical questions.

Although the Refugee Convention 1951 generally provided that contracting states should recognise those who came within its definition as refugees, it did not prescribe how contracting states should determine this in order to enable them to balance this obligation with their national interests. However, evidence from the background and drafting of the Refugee Convention 1951 suggests that the provisions that a contracting states would implement in order to protect its interests would be commensurate with the human rights spirit of the (...) treaty. This implied that contracting states would act fairly in balancing the competing interests in devising status determination policies and would take into account decent considerations. But, from a theoretical viewpoint, it is arguable that some recent asylum determination policies have been based on the threats posed by asylum seekers. Asylum seekers have come to be blamed for contributing to the national issues that some contracting states face and as such, some contracting states have adopted draconian measures as a result. The law consists of both internal and external rules, but in both cases they regulate the behaviour of the subjects towards each other. This can be viewed from a phenomenological perspective in the sense that people have a drive to make sense of their world, and the rules that are developed essentially enable them to relate to the world in this way. If anything interferes with this drive, then it causes peoples’ existential upset. That is why the state both enforces (...) these rules between its own nationals, but also with regards to the outsiders. However, in doing so, the state must also be mindful of ensuring that it interprets the rules fairly. If it does not do so, then this may negate the purpose of law by causing the existential unrest. Although in the past this may have been done on a national basis, in that it has been necessary to maintain just the national values of a state in order to ensure that people could lead their lives, globalisation has altered the identity of people. They are no longer just national citizens, but also global citizens, and are increasingly relying on global values to fulfil their existential nature. (shrink)

Although people establish norms that enable them to live together, some of these have to be coupled with a system of enforcement. This conforms to broad social contract theory and can also be applied to the international sphere. The international community is also based on a system of norms. However, unlike the domestic context, there is no overreaching authority to direct states on what they should do. Rather it is left to states themselves to police this framework. However, this has (...) resulted in one of the conditions envisaged by social contract theorists, namely a stasis between the command order and the state of nature. This may explain, for instance, the indifference to some modern human rights violations. Hence the current system of International law, with its insistence on the Westphalian principle of equality of states has caused a substantial fracture in the enforcement of international law, particularly when it comes to serious human rights breaches, and caused something akin to the state of nature envisaged by social contract theorists. While it may be practically impossible to provide a command system in the international sphere similar to the one in the domestic life, there is some hope that a revised deontological ethic founded on global integration may provide one impetus for change. This is part of a proposed monograph on the Law, and jurisprudence and is to be used for understanding punishment through wergild to the early Modern and to even the post-modern. The paper is just a draft and in the future will be published as a monograph.

A wide body of research in the field of happiness economics shows that individuals adapt to both prosperity and to adversity and return to their usual levels of happiness. In this paper we used novel methods and data to assess the effects of the deep economic crisis of 2008-2009 on well-being in the United States. We found, as expected, that the crisis had profound effects on happiness levels, as well as on individuals' assessments of their standards of living and of (...) their future. These attitudes varied significantly depending on respondents' socioeconomic cohort, the industry that they were employed in, and their pre-existing states of mental and physical health. Our most notable finding, though, is a clear, U-shaped trend in reported happiness, with levels falling sharply with the onset of the crisis in mid-08 and trending downward until late March 2009 — around the time that stock markets stopped their free fall. From that point on, happiness levels increased, eventually surpassing the levels that they were in the pre-crisis period of early 2008. This general pattern supports our previous research suggesting that although people react negatively to unpleasant events, they adapt to unpleasant certainty better than they do to uncertainty. In this work, we have investigated the validity of the generalized second law of thermodynamics in logamediate and intermediate scenarios of the universe bounded by the Hubble, apparent, particle and event horizons using and without using first law of thermodynamics. We have observed that the GSL is valid for Hubble, apparent, particle and event horizons of the universe in the logamediate scenario of the universe using first law and without using first law. Similarly the GSL is valid for all horizons (...) in the intermediate scenario of the universe using first law. Also in the intermediate scenario of the universe, the GSL is valid for Hubble, apparent and particle horizons but it breaks down whenever we consider the universe enveloped by the event horizon. In this article, we observe the possibility of ‘practicing’ cosmopolitanism in three distinct experiential spaces intrinsic to human existence: knowledge spaces, habitation spaces and marketplaces. Although cosmopolitanism has been overwhelmingly deliberated upon across multiple disciplines, it has been confined to ‘conceptualisms’ in the Western scholarship. On the other hand, we find that some of the works of thinkers, such as, Rabindranath Tagore’s Creative Unity, Aurobindo Ghosh’s The Ideal of Human Unity and Mikhail Bakhtin’s Rabelais and His World, open the possibilities (...) of experiencing cosmopolitanism in lived human spaces. Cosmopolitanism emerges through knowledge generation and exchanges in the academic vision of Tagore’s ideal Visva-Bharati, in the everydayness of city life through Aurobindo’s Auroville and in the cultural spaces of the Bakhtinian marketplace. Further, we find that cosmopolitanism in these thinkers interweaves the physical place with spaces of the mind. The individual emerges as a core of their cosmopolitan worldview. We argue that these thinkers not only pave the way for recognizing cosmopolitanism in real, lived spaces but also inspire a future vision, practicable in the society through academic institutions, human habitats and regular interactions at marketplaces. The implementation of international human rights law has traditionally been undermined by the dichotomy between universalism and cultural relativism. Some groups regard human rights as more reflective of other culture’s and are unwilling to subscribe to them. One response to this is to enable groups to take co-ownership of human rights. Quality Circles based on institutions and technology, and the collaboration they encourage, provide one such means for doing so. What is required is for states to facilitate rather than undermine (...) and censor these processes. Human Rights Quality Circles at different levels represent one way in which the cultural relativism and universalism division can be addressed, particularly in an ever-globalising world. (shrink)

We identify the ways the policies of leading international bioethics journals limit the participation of researchers working in the resource-constrained settings of low- and middle-income countries in the development of the field of bioethics. Lack of access to essential scholarly resources makes it extremely difficult, if not impossible, for many LMIC bioethicists to learn from, meaningfully engage in, and further contribute to the global bioethics discourse. Underrepresentation of LMIC perspectives in leading journals sustains the hegemony of Western bioethics, limits the (...) presentation of diverse moral visions of life, health, and medicine, and undermines aspirations to create a truly “global” bioethics. Limited attention to this problem indicates a lack of empathy and moral imagination on the part of bioethicists in high-income countries, raises questions about the ethics of bioethics, and highlights the urgent need to find ways to remedy this social injustice. The field of bioethics continues to struggle with the problem of cultural diversity: can universal principles guide ethical decision making, regardless of the culture in which those decisions take place? Or should bioethical principles be derived from the moral traditions of local cultures? Ten Have and Gordijn and Bracanovic defend the universalist position, arguing that respect for cultural diversity in matters ethical will lead to a dangerous cultural relativity where vulnerable patients and research subjects will be harmed. We challenge the (...) premises of moral universalism, showing how this approach imports and imposes moral notions of Western society and leads to harm in non-western cultures. (shrink)

This reviewer had read Kristeva in October, 2016 in this Journal (and the review is freely available online and had garnered some small publicity). Over the last one year this reviewer has taken a very short view of her tautological work. Having read her carefully this reviewer has decided that she should be rejected as a psychoanalyst, notwithstanding her huge popularity as a feminist. But this reviewer through a nuanced critique of theoretical psychoanalysis find her and her ilk lacking caritas.

The reviewer connects Derrida's Gloss of the Genesis event to the book under review and discusses the topic of the book under review as an important site for discussing our zeitgeist.

Modern bioethics was born in the West and thus reflects, not surprisingly, the traditions of Western moral philosophy and political and social theory. When the work of bioethics was confined to the West, this background of socio-political theory and moral tradition posed few problems, but as bioethics has moved into other cultures – inside and outside of the Western world – it has become an agent of moral imperialism. Alexander Pope's An Essay on Man is part of a long tradition of meditating on the human person. In this review the antecedents of Modernism are revised and the Pope's Essay is reinstated as a tour de force which is all the more pertinent today.

Adamson has written a very readable history of philosophy in times when the discipline of philosophy is under unprecedented threat of annihilation.

The author shows how phenomenologists from Edmund Husserl to Edith Stein are indebted to Samkhya. He reiterates the case for Bhagavan Buddha, the Sakya Muni, for being a Samkhya Yogi. The editor specially commissioned this essay from the author.

This was presented as part of an assignment, and like all assignments, this is a work in a hurry. Nonetheless, it has interesting points on the three Gunas. This was written in 2018.
