Legitimacy is a concept that has been largely forgotten by the deconstructive discourse on law and politics. This article seeks, on the one hand, to reassess the role of legitimacy in deconstruction and, on the other hand, to bring deconstructive thinking to bear on the concept of legitimacy. By re-reading Derrida’s “Declarations of Independence” through the lenses of his later texts on sovereignty and (counter)signature, it is argued that, rather than being deconstructible, legitimacy is deconstructing any self-founding of law and (...) power. As such, legitimacy functions not as an evaluative concept of law and order but as a constantly insisting demand that facilitates the principles of responsibility and responsiveness. (shrink)

The article revisits the theory of hegemony of Ernesto Laclau and Chantal Mouffe and shows how a normative injunction, which according to Laclau is not compatible with the hegemonic logic, is not only possible but a necessary condition for hegemony to function. The article claims that the path to demonstrate this involves rethinking the relationship between the theory of hegemony and Derridean deconstruction. Following criticisms that the theory of hegemony overlooks the aporetic nature of Derridean undecidability that it nevertheless relies (...) upon, the hegemonic logic is submitted to a deconstructive reading, which reveals an internal aporia in it. It is further argued that the unaccounted aporia in the logic of hegemony explains the theory’s inability to satisfactorily account for its essential theoretical underpinning, the radical exclusion. However, the article also demonstrates that the aporia does not destroy hegemonic logic but, instead, supplements it by a normative dimension, by a demand of opening to the other as other. (shrink)

Cet article est un témoignage de l’équipe de pédopsychiatrie de Caen qui a adapté ses dispositifs de soins pour mieux accueillir ces publics spécifiques que sont les familles migrantes. Après un rappel sur les notions de migration, de culture et (...) de périnatalité en contexte migratoire, les deux dispositifs seront présentés et explicités au regard de leur fondation théorique qu’est la clinique transculturelle. In this essay, I shall explore a reading of the Republic which does not buy into, but rather specifically brackets out and excludes, the institutional structure of the ideal state -- and by ‘institutional structure’ here I mean such things as the way the guardians live, the place and ownership of private property, the way the family is demoted, the fact that philosophers as such are the rulers, and the hierarchical social order as this is exemplified in, for example, the (...) distinction between guardians, auxiliaries and ordinary citizens. Much of the commentary on Plato's Republic focuses on just these elements. Many recent and contemporary commentators on the Republic are given to asking questions like, Is the ideal state totalitarian? Interesting as these issues and questions about the ideal state and its explicit institutions may be, they are for my purposes the least useful. To focus too much on these is to obscure other important elements in the Republic. (shrink)

Prior research suggests brokers do not always act in the best interests of clients, although morally obligated to do so. We empirically investigated this issue focusing on trades executed at best execution price, before and after the introduction of electronic limit-order trading, on the London Stock Exchange. As a result of limit-order trading, the proportion of trades executed at the best execution price for the customer significantly increased. We attribute this to a sustained increase in the liquidity of stocks as (...) a result of limit-order trading, regardless of market capitalisation. We discuss the ethical implications of our findings and conclude that market structures that enhance market competitiveness may help reconcile broker and client interests. (shrink)

Background The first COVID-19 wave started in February 2020 in France. The influx of patients requiring emergency care and high-level technicity led healthcare professionals to fear saturation of available care. In that context, the multidisciplinary Ethics- Support Cell (EST) was created to help medical teams consider the decisions that could potentially be sources of ethical dilemmas. Objectives The primary objective was to prospectively collect information on requests for EST assistance from 23 March to 9 May 2020. The secondary aim was (...) to describe the Cell’s functions during that period. Research design This observational, real-time study of requests for Cell consultations concerned ethical dilemmas arising during a public health crisis. The EST created a grid to collect relevant information (clinical, patient’s/designated representative’s preferences and ethical principles strained by the situation), thereby assuring that each EST asked the same questions, in the same order. Participants and research context Only our university hospital’s clinicians could request EST intervention. Ethical considerations The hospital Research Ethics Committee approved this study (no. CER-2020-107). The patient, his/her family, or designated representative was informed of this ethics consultation and most met with EST members, which enabled them to express their preferences and/or opposition. Findings/results 33 requests (patients’ mean age: 80.8 years; 29 had COVID-19: 24 with dyspnea, 30 with comorbidities). 17 Emergency Department solicitations concerned ICU admission, without reference to resource constraints; others addressed therapeutic proportionality dilemmas. Discussion Intervention-request motives concerned limited resources and treatment intensity. Management revolved around three axes: the treatment option most appropriate for the patient, the feasibility of implementation, and dignified care for the patient. Conclusions COVID-19 crisis forced hospitals to envisage prioritization of ICU access. Established decision-making criteria and protocols do not enable healthcare professionals to escape ethical dilemmas. That acknowledgement highlights ethical risks, enhances the added-value of nursing and encourages all players to be vigilant to pursue collective deliberations to achieve clear and transparent decisions. Seize plaques de marbres du gymnase d’Andros ont été trouvées à l’état fragmentaire. De longueur et largeur irrégulières, mais de hauteur constante, elles vont s’épaississant régulièrement d’un long côté à l’autre. Des graffiti sont inscrits sur le côté vertical et étroit de ces plaques, plus rarement aussi sur un autre côté. Ces plaques rappellent les bancs des gymnases et des palestres où, dans ce que l’on appelle l’ephebeion, les jeunes gens assistaient aux leçons. Les graffiti trouvés dans cette pièce reflètent (...) la vanité des éphèbes. Le soin de la gravure sur deux des plaques (n° 1-2) permet de déduire que les graffiti ont d’abord été inscrits sous les auspices d’un magistrat tel que le gymnasiarque. Le nom de l’éphèbe parvenu à l’âge adulte pouvait être effacé et remplacé par un autre nom, mais la gravure ne révèle plus le même soin. L’étude de la prosopographie d’Andros et du contexte historique permet de dater les plaques du début du IIe s. av. J.-C. leur utilisation s’étendant au cours des IIe et Ier s. av. J.-C. (shrink)

Following tropes of light and dark in Amanda Gorman’s poem ‘The Hill We Climb’, the article explores, from a feminist perspective, who counts as a truth-teller. Against the backdrop of Hannah Arendt’s and Michel Foucault’s works on truth-telling, the article theorizes feminist modes of truth-telling. It scrutinizes truth-making in politics while unearthing the andro-centrism in truth-telling. Under the impression of post-truth rhetoric in recent populist landscapes, the article argues for a feminist and intersectional articulation of truth-telling to disclose the (...) gendered and racialized power relations in contemporary masculinist populism. I argue that the problem of normative foundations is insoluble. I discuss how and why the apparent problem arose, particularly within the Frankfurt School. Then, I describe various theories of normative foundations and the criticisms that such theories have faced, such as ethno- and andro-centrism, imperialism, and the failure to fulfill their own aims. I make my main argument by way of an analogy: theories of knowledge have wrestled with the question of whether a “given”’ could act as a (...) certain foundation for knowledge. The conclusion is often that no given can function in that way, because the given, which supposedly does not require justification, is therefore necessarily unable to justify knowledge. For similar reasons, I argue, nothing can function as a normative foundation for a critical social theory, because any such normative foundation would have to both stand in no need of normative justification but also justify normative social criticism. I conclude by suggesting that more recent critical theory that does not focus on normative foundations can be understood as justifying their critique by appeal to what people do actually want, rather than what they should rationally want. El presente trabajo se inscribe en el cruce que intersecta nodos centrales de la filosofía contemporánea en el llamado giro posthumano con las experiencias y producciones teóricas transfeministas. Consideramos que tal intersección se encuentra dada en la medida en que ambos términos suponen el resquebrajamiento de las lógicas identitarias en tanto políticas del deseo que promueven formas de sujeción andro-antropocéntricas y tanato-bio-políticas. Nuestro objetivo es mostrar en qué medida estos ámbitos se retroalimentan, pero enfoncándonos especialmente en dilucidar cuáles han (...) sido los aportes de los transfeminismos al pensamiento posthumanista. Concretamente, a través de abordajes metodológicos inscriptos en el horizonte de una genealogía crítica, analizaremos la implicación que las experiencias trans y el pensamiento feminista tuvieron para la postulación del dispositivo de sexualidad en Foucault y para el devenir-mujer en Deleuze y Guattari. Como resultado de tales análisis llegamos a la formulación de lo que denominamos filosóficas transfeministas en tanto prácticas de pensamiento y pensamiento en práctica que, en el ocaso de lo humano, buscan generar políticas del deseo para nuevos devenires simpoiéticos. Resumen: Propongo una lectura de los relatos eróticos de Di Giorgio, según este, el hibridismo genérico textual y sexual ampliamente reconocido por la crítica, así como la recurrencia de transformaciones y metamorfosis a impulsos de un deseo que cancela las fronteras entre lo humano, lo animal, lo vegetal y lo material, realiza una profunda crítica epistemológica a la racionalidad moderna, andro y antropocéntrica, y su forma de concebir identidad y diferencia. El eje de esta ruptura epistemológica es la desarticulación (...) de las estructuras binarias sexo/género y Naturaleza/Cultura, que disloca la alineación de cuerpo-género-deseo y la oposición clásica bios/zoé, bases fundamentales de los órdenes políticos y simbólicos de Occidente.: I propose a reading of Di Giorgio's erotic stories according to which generic textual and sexual hybridism widely recognized by critics, as well as the recurrence of transformations and metamorphosis at the urging of a desire that cancels the boundaries between the human, animal, vegetable and material, he makes a deep epistemological critique of modern rationality, andro and anthropocentric, and his way of conceiving identity and difference. The axis of this epistemological rupture is the disarticulation of the sex/gender and nature/culture binary structures, which dislocate the alignment of body-gender-desire and the classic bios/zoé opposition, fundamental bases of the political and symbolic orders of the West. Mokslininkai sprendžia klausimus: kas lemia, kad žmonės jaučiasi laimingi; ar esame laimingi vienodai; ką tai atskleidžia apie mus kaip visuomenę; ar skirtingų kartų žmonėms laimė reiškia tuos pačius dalykus; ar laisvoje aukštesnio gerbūvio visuomenėje formuojasi laimingesnių žmonių karta.Šiame straipsnyje, pasitelkiant 1990, 1999, 2008 ir 2017 metų Europos vertybių tyrimo duomenis, analizuojama laimės lygio dinamika Lietuvoje, siekiant išsiaiškinti, kaip skirtingi sociodemografiniai (...) ir kultūriniai veiksniai susirikiuoja į subjektyvios gerovės lygtį ir kaip tai susiję su gyventojų kartų kaita, ypatingą dėmesį skiriant vadinamosios Pirmosios nepriklausomybės kartos specifikai. Atlikta statistinė empirinių duomenų analizė atskleidė reikšmingus laimės jausenos skirtumus skirtingose Lietuvos gyventojų socialinėse kartose, net ir kontroliuojant kitus jai įtaką darančius veiksnius. La découverte d’un nouveau mois à Ténos et l’identification d’un graveur à Paros conduisent à formuler de nouvelles hypothèses sur le problème des sûretés réelles en droit grec. L’examen du registre de Ténos (IG XII 5, 872) en vue de sa réédition a fait apparaître une erreur de découpage entre les actes 17 et 18 chez les éditeurs antérieurs, qui n’ont pas reconnu le nom d’un mois, Èrès[iôn], équivalent du mois délien Arèsiôn attesté depuis peu à Andros, l’île voisine. En (...) faisant disparaître une clause obscure de ce document, cette découverte invite à réexaminer le fonctionnement d’un gage hypothécaire d’un type particulier, l’apotimèma dotal, auquel l’un des actes du registre fait allusion. Ce point acquis, on aborde ce qui fait par contraste la spécificité de la vente avec faculté de rachat (prasis épi lysei) : à Ténos comme à Athènes, elle se caractérise par un transfert de propriété immédiat au profit du créancier, au moyen d’un acte de vente complété le cas échéant par un contrat de location. Le rapprochement entre une borne récemment découverte à Paros (SEG 54, 794) et une célèbre loi sur les archives, gravée par le même lapicide, permet en dernier lieu de préciser la relation entre la prasis épi lysei et les pratiques d’archivage public à l’époque hellénistique. In a vigorously argued passage of the oration Pro L. Flacco, Cicero defends his client L. Valerius Flaccus against the charge that he had acted improperly during his governorship of Asia three years previously in claiming as heres legitimus the estate of one Valeria, wife of Sextilius Andro, who had died intestate in the province. This section of the speech involves Cicero in a brief display of his knowledge of the civil law concerning tutela, the forms of acquiring manus (...) in marriage by usus and coemptio and inheritance ah intestate, and it is described by the scholiast as ‘negotialis quaestiuncula’. The passage is regularly cited in the handbooks to illustrate those features of the civil law which Cicero treats, but the Valeria in question is otherwise wholly obscure. (shrink)

Prônant la réappropriation féministe du sexe féminin, cette performance subvertit les codes andro et hétérocentrés de l’iconographie pornographique.
