In this study I defend an account of 'dispositional coercion' and coercive offers which hinges primarily on the intentions of both the coercer and the victim. In doing so I argue against various baseline accounts of coercion. ;Baseline accounts center on the victim's estimation of a proposal's effect, the determination of coercive threats and offers primarily hinging on the victim's beliefs and preferences. I believe that it is the intended action of the individual making the proposal that provides the core (...) consideration for defining coercive threats and offers. ;The following is my set of jointly necessary and sufficient conditions for 'dispositional coercion' wherein X coerces Y to do A: X threatens Y, that is, X intentionally attempts to create the belief in Y that X will be responsible for harm coming to Y should Y fail to do A. X's motive for attempting to create this belief is his desire to bring about a state of affairs in which Y's recognition of this possible harm to himself influences Y to do A. X successfully creates the belief in Y that Y may be harmed if he fails to do A, that is, X is successful in causing Y to recognize that harm may come to him should he fail to do A. Y intends to do A, and Y's motive for intending to do A is Y's desire to avoid harm to himself. Y does A. ;I also argue that X makes Y a coercive offer if and only if: ; X either intentionally attempts to create the following beliefs in Y, or for cases in which X believes that Y already holds beliefs and , attempts to create belief in Y: X is able to prevent some harm from coming to Y. Y needs X's assistance in preventing this harm. X will not assist Y in preventing this harm if Y does not do A. ; X's motive for attempting to create beliefs - in Y, or for cases in which Y already holds beliefs and , to attempt to create belief in Y is his desire to bring about a state of affairs in which Y's recognition of this possible harm to himself influences Y to do A. Scott Forschler defends R. M. Hare's rationalist-universalizing-utilitarian moral approach against Jens Timmermann's critique of it. He argues that Timmermann fails to see that Kant's ethical rationalism might be consistent with utilitarianism, and argues that Timmermann merely assumes that Kant's deontology follows logically from his ethical rationalism. In Forschler's estimation, it has not been established that either Kant's or Hare's ethical rationalism is inconsistent with utilitarianism. This article, however, argues that, in his response to Timmermann on behalf of Hare's rationalist-universalizing-utilitarian approach, (...) Forschler has overlooked something very significant at the foundational level of Hare's moral approach, and that this oversight undercuts his response to Timmermann. The analysis also invites a metaethical investigation of preference satisfaction as it is found in Hare's moral approach. The article uncovers some fundamental metaethical presuppositions in Hare's normative approach, presuppositions overlooked by Forschler. (shrink)

ABSTRACT: In Ideal Code, Real World, Brad Hooker seeks to offer a version of ideal rule consequentialism that is immune from standard criticisms. I will attempt to challenge Hooker’s ideal rule-consequentialist theory by arguing that there are philosophical problems at the ultimate foundation of his maximizing consequentialist and pluralist approach toward well-being and other basic goods. I find that no amount of revision is likely to insulate his approach from standard criticisms. I suggest that any maximizing rule-consequentialist approach toward well-being, (...) taken in a rich and pluralist sense, is likely to fall prey to standard criticisms. In later work, Hooker drops ideal rule consequentialism in favor of an incremental rule-consequentialist approach. That piecemeal approach is also challenged in this paper. RÉSUMÉ: Avec Ideal Code, Real World, Brad Hooker cherche à offrir une version du conséquentialisme de la règle qui serait à l’abri des critiques habituelles. Nous tentons de la mettre en question en soutenant que le principe fondateur de son approche, qui non seulement maximise le conséquentialisme, mais est aussi pluraliste envers le bien-être et les autres nécessités, repose sur des problèmes philosophiques. Il semble qu’aucune adaptation ne puisse protéger cette approche des critiques habituelles. Je suggère que toute approche qui maximise le conséquentialisme de la règle envers le bien-être, interprété dans un sens riche et pluraliste, sera probablement susceptible de tomber sous les critiques habituelles. I argue that the moral right to privacy is the moral right to consent to access by others to one’s personal information. Although this thesis is relatively simple and already implicit in considerations about privacy, it has, nevertheless, been overlooked by philosophers. In the paper, I present and defend my account of the moral right to privacy, respond to possible objections to it, and attempt to show its advantages over two recent accounts: one by Steve Matthews and the other by (...) Adam Moore. I also offer reasons to think that my account can be assimilated into a broad range of fundamental ethical approaches (i.e., a variety of consequentialist,deontological, and natural law approaches). Given the number and variety of such approaches, however, I can only attempt to make a prima facie case for the adaptability of the proposed account. (shrink)

In a paper in this journal (Wall 2016), the author of the present paper critiqued Scott Forschler's attempt (2013) to establish that Jens Timmermann's argument (2005) against R. M. Hare's attempt (1981) to bridge the Kantian-consequentialist gap is unsuccessful. Forschler's thesis is that Hare's utilitarianism is strictly normative, not metaethical. In Hare's ethical rationalism, which is metaethical but contains no intrinsic ends (Forschler 2013), reason determines the proper ends, and preference satisfaction has no value prior to reason's determinations (Forschler (...) 2013). The present author responded that Hare's moral approach presupposes that preference satisfaction is the ultimate end (Wall 2016) and that an analysis of preference satisfaction in Hare's moral approach cannot be confined to normative ethics. Forschler's rejoinder (2017) suggests that Hare's moral theory was misinterpreted by the author, who now shows that such a judgment results from significant oversights concerning the foundation of Hare's moral theory and utilitarian foundations. Jonathan Dancy, who defends a version of moral particularism, is committed to the view that any feature or reason for action might, in logical terms, have a positive moral valence in one context, a negative moral valence in a different context, and no moral valence at all in yet another context. In my paper, I attempt to demonstrate that, despite the denial by Dancy that proposed grounding properties with invariant moral valences may play a foundational role in morality, his own (...) approach toward moral reasoning unknowingly assumes such foundational grounding properties. I argue that Dancy's moral particularism is unknowingly directed toward moral absolutism, and, in making that argument, uncover reasons, admittedly inconclusive, to favor an absolutist ethic. This book examines the foundations of morality and criticizes various philosophical justifications that have been offered for basic moral principles or values throughout the years. This book introduces and defends what is designed to be a sure justification for a natural morality and its basic moral principles.

There would appear to be enormous philosophical differences between some influential exponents in contemporary natural law ethics. It would appear that there are deep and irresolvable philosophical differences between Ralph McInerny, on the one side, and Germain Grisez, Joseph Boyle, and John Finnis, on the other, with regard to both the contents of the basic goods of natural law, and as to whether there is an objective hierarchy among the basic goods themselves. The second of these apparently unbridgeable philosophical differences (...) seems to account for the apparent differences between them on the starting point of morality. All of these putative philosophical differences seem to depend on what appear to be very different approaches by the two camps toward ultimate ends in ethics. I argue that the philosophical differences between the two camps on these fundamental matters are not considerable, and that whatever philosophical differences do exist lack philosophical support from either of the two sides. I attempt to identify a problem running through the foundation of R. M. Hare’s ethical prescriptivism and the more recent sentimentalism/ethical expressivism of Simon Blackburn. The non-cognitivism to which Hare and Blackburn’s approaches are committed renders them unable to establish stable contents for basic moral principles and, thus, incapable of conducting a logical analysis of moral terms or statements. I argue that objective-descriptive- natural ethical theories are in a much better position to provide a satisfying account of the logical analysis (...) of moral terms or statements. Such ethical theories can arrive at basic moral principles with stable contents, thus paving the way for the kind of descriptive approach that can accommodate stable truth conditions. This, in turn, provides stable grounds for the logical analysis of moral terms and statements. (shrink)

In his paper, How to Derive ‘Ought’ From ‘Is,’ John R. Searle made a valiant attempt to derive an ought-statement from purely descriptive statements. In a recent issue of Philosophia, Scott Hill has offered criticisms of that proposed derivation. I argue that Hill has not established any errors in Searle's proposed derivation.

Some philosophers have maintained that even if John R. Searle’s attempted derivation of an evaluative proposition from purely descriptive premises is successful, moral ought would not have been derived. Searle agrees. I will argue that if Searle has successfully derived “ought,” then, based on various approaches taken towards the content of “morality,” this is moral ought. I will also trace out some of the benefits of a successful derivation of moral ought in relation to natural law ethics. I sketch a (...) possible derivation of moral obligations based on one of the basic goods in natural law ethics (i.e., friendship) that resembles Searle’s attempted derivation of an individual’s obligation to keep her promise to someone else. I also sketch a possible derivation of moral obligations based on another of the basic goods in natural law ethics – knowledge. This derivation may not parallel Searle’s attempted derivation as closely as the derivations based on friendship, but it seems to at least involve the derivation of moral obligations from all non-moral premises. I locate possible fertile common ground among the “new natural law theory” of Finnis, Grisez, and Boyle, the “traditional” Thomism of McInerny, and natural law derivationism. I respond to Murphy’s contention that the “inclinationism” of Finnis cannot be successfully asserted along with what Murphy takes to be a basic requirement of natural law ethics, namely that basic practical principles are to be “strongly grounded” in human nature. I argue that the tension between the inclinationism of Finnis and Murphy’s basic requirement (...) is not irresolvable. In response to objections by Murphy to natural law derivationism, I argue, basedin part on Searle’s attempt to derive an “ought” from an “is,” that the new natural law theorists and McInerny can and should investigate natural law derivationismfor possible adoption. Edmund Wall's criticism of the author's earlier analysis of Hare's consequentialism and Kantian ethics claims that the author overlooked Hare's commitment to preference satisfaction as an “ultimate good.” This rejoinder points out that Hare never uses the phrase in question, nor any equivalent phrase or concept, in presenting his own arguments and refers only to the standard of “universalizability” as ultimate, in contexts that support the author's original argument. Hence Wall has only given us yet another example (...) of how Hare's views can be misunderstood by philosophers who fail to attend to the details of Hare's approach. (shrink)

Edmund Gettier is Professor Emeritus at the University of Massachusetts, Amherst. This short piece, published in 1963, seemed to many decisively to refute an otherwise attractive analysis of knowledge. It stimulated a renewed effort, still ongoing, to clarify exactly what knowledge comprises.

The "Cartesian Meditations" translation is based primarily on the printed text, edited by Professor S. Strasser and published in the first volume of Husserliana: Cartesianische Meditationen und Pariser Vorträge, ISBN 90-247-0214-3. Most of Husserl's emendations, as given in the Appendix to that volume, have been treated as if they were part of the text. The others have been translated in footnotes. Secondary consideration has been given to a typescript (cited as "Typescript C") on which Husserl wrote in 1933: "Cartes. Meditationen (...) / Originaltext 1929 / E. Husserl / für Dorion Cairns". Its use of emphasis and quotation marks conforms more closely to Husserl’s practice, as exemplified in works published during his lifetime. In this respect the translation usually follows Typescript C. Moreover, some of the variant readings n this typescript are preferable and have been used as the basis for the translation. Where that is the case, the published text is given or translated in a foornote. The published text and Typescript C have been compared with the French translation by Gabrielle Pfeiffer and Emmanuel Levinas (Paris, Armand Collin, 1931). The use of emphasis and quotation marks in the French translation corresponds more closely to that in Typescript C than to that in the published text. Often, where the wording of the published text and that of Typescript C differ, the French translation indicates that it was based on a text that corresponded more closely to one or the other – usually to Typescript C. In such cases the French translation has been quoted or cited in a foornote. (shrink)

Bei der Grundfragestellung Descartes’ einsetzend, entfaltet Husserl die transzendentale Phänomenologie als »Umbildung und Neu­bildung« des Cartesischen Programms der prima philosophia im Sinne einer Reform der Philosophie zu einer absoluten Wissenschaft aus absoluter Begründung. Eine französische Ausgabe, in der Übersetzung von Emmanuel Levinas und Gabrielle Pfeiffer, erschien 1931 bei A. Colin in Paris. Husserls Arbeiten an dem Manuskript für die deutsche Ausgabe, die (...) gegenüber der französischen erheblich erweitert werden sollte, blieben, nicht zuletzt wegen der 1933 veränderten politischen Situation, unvollendet. In the first edition of The Gay Science (GS), Nietzsche proposes that we treat knowledge as unconditionally valuable and life as a tragic quest for truth. In the second edition of GS, he seems to retract this proposal, suggesting that we substitute “incipit parodia” for “incipit tragœdia.” But Nietzsche does not say what he means by “parody,” or what role he believes it should play in our evaluative lives. This article proposes that by introducing parody into GS, Nietzsche intends not (...) only to correct the original text by mocking his earlier treatment of science as tragic, but also to designate parody as a basis for new tasks, duties, and values beyond what science can offer. This article speculates that parodic value creation might consist in the imitation of behaviors and practices associated with preexisting values without the reproduction of the beliefs and feelings corresponding to those practices. In the twenty-first century the wonders of science show its magnificent potential for good. The scientific successes we enjoy are rooted in the modern way of thinking about physics. But success has fostered a myth that the dialectic of physics should be used in other areas; thus contributing to global calamities, such as Dialectical Materialism in politics and Behaviorism in psychology. In the opening paragraph of The Modern Mind the author proclaims-and indeed others agree-a crisis has been reached in our (...) evolving Western worldview. So the first requirement is a clear understanding of this development! In this work Kevin Wall illuminates this development in the light of philosophy, theology, science, art, and with reference to Greek and Scholastic minds-showing the real-world implications of Western speculative thought. In the target article, we presented the hypothesis that parasite-stress variation was a causal factor in the variation of in-group assortative sociality, cross-nationally and across the United States, which we indexed with variables that measured different aspects of the strength of family ties and religiosity. We presented evidence supportive of our hypothesis in the form of analyses that controlled for variation in freedom, wealth resources, and wealth inequality across nations and the states of the USA. Here, we respond to criticisms (...) from commentators and attempt to clarify and expand the parasite-stress theory of sociality used to fuel our research presented in the target article. (shrink)

A recent innovation in the study of methods in the history of ideas is the introduction of elements of semantic externalism from the philosophy of language. Studies that rely on semantic externalism have done so to address particular questions of method in political theorising, including the interpretation of ‘essentially contested concepts’, and the issue of relativism in historical contextualism. In this paper, I critically review the use of semantic externalism, and associated methods such as Kripke’s causal theory of reference, in (...) the history of ideas. I explore the barriers that might prevent the use of externalism, and how studies relying on externalism seek to overcome such barriers. I then assess both the implications of relying on externalism, as well as a set of limitations. (shrink)

There is no author's introduction to Phenomenology and the Foundations of the Sciences,! either as published here in the first English translation or in the standard German edition, because its proper introduction is its companion volume: General Introduction to Pure Phenomenology. 2 The latter is the first book of Edmund Husserl's larger work: Ideas Toward a Pure Phenomenology and Phenomenological Philosophy, and is commonly referred to as Ideas I (or Ideen 1). The former is commonly called Ideen III. Between (...) these two parts of the whole stands a third: Phenomeno 3 logical Investigations of Constitution, generally known as Ideen II. In this introduction the Roman numeral designations will be used, as well as the abbreviation PFS for the translation at hand. In many translation projects there is an initial problem of establish ing the text to be translated. That problem confronts translators of the books of Husserl's Ideas in different ways. The Ideas was written in 1912, during Husserl's years in Gottingen (1901-1916). Books I and II were extensively revised over nearly two decades and the changes were incorporated by the editors into the texts of the Husserliana editions of 1950 and 1952 respectively. Manuscripts of the various reworkings of the texts are preserved in the Husserl Archives, but for those unable to work there the only one directly available for Ideen II is the reconstructed one.
