Clarice Lispector puts forth nothing less than a complete philosophy of time in her writings, that is, a cohesive philosophical examination of what time is, of its physics and metaphysics, of how humans and animals perceive time, and even an innovative aesthetic theory in which time is the inspiring force giving rise to literary and artistic creation. Her view of time is unique in the Western philosophical canon, offering original solutions to many of time’s classic difficulties. For Lispector, time is (...) pure actuality. Reality is an unwavering present that never stops being, is fully material, and is ceaselessly attentive to itself. The present, matter, and attention form the unquestionable unit of the real and the core of Lispector’s philosophy of time. This paper analyzes the ergodic hypothesis in the context of Boltzmann’s late work in statistical mechanics, where Boltzmann lays the foundations for what is today known as the typicality account. I argue that, based on the concepts of stationarity (of the measure) and typicality (of the equilibrium state), the ergodic hypothesis, as an idealization, is a consequence rather than an assumption of Boltzmann’s account. More precisely, it can be shown that every system with a stationary measure and an equilibrium state (...) (be it a typical state with respect to the phase space or the time average) behaves essentially as if it were ergodic. I claim that Boltzmann was aware of this fact as it grounds both his notion of equilibrium, relating it to the thermodynamic notion of equilibrium, and his estimate of the fluctuation rates. This article aims to contribute to a (post)extractivist aesthetics at a time of ontological shifts, meaning an aesthetics that focuses on the role of art in struggles for (post)extractivist worlds. First, it argues for a contextualized approach to the use of the extractivism framework and proposes that this framework is particularly productive for approaching the socio-environmental crisis due to the way it allows us to engage with the ontological basis of this crisis. The article then builds on empirical research conducted (...) in Argentina to develop the concept of prefigurative ontological design, one of the key functions, it is proposed, of artistic practice in anti- and post-extractivist movements. In this way, the article aims to expand our understanding of the potential of extractivism as a framework of analysis and contributes to the theorization of the relationship between art and extractivism through the lens of political ontology, offering new concepts for developing a (post)extractivist aesthetics. Roberto Marchesini presents a timely proposal within post-human philosophy in order to overcome the centuries-long separation between human beings, non-human animals and technology. This book highlights the inspiring nature of the relationship with non-human beings - what Marchesini calls "Epiphany" - and how its enhancement can open new existential dimensions. Technology is also reinterpreted, no longer as a performative tool, but as a virus that infiltrates the human dimension and changes its predicates. Technopoietic events are not just the (...) product of human intelligence, but they arise from an epiphany (a becoming alterity), thus positioning technology well within the ontological and somatic dimension of human beings. This narrative scoping review examines ethical practice in educational and school psychology from a bioecological systems’ perspective. A search of four databases yielded 34 articles in the final narrative synthesis. Informed by Bronfenbrenner and Morris’ bioecological systems theory, the ethical experiences of educational and school psychologists were analyzed using the concepts of Process, Person, Context and Time. The complexity, intensity and frequency of ethical dilemmas are reviewed in Process. The demand, resource, and force characteristics impacting on psychologists as Person are (...) reviewed. Within Context, studies identified dilemmas that arose for psychologists across systems. In Time, issues including implications of the Fourth Industrial Revolution on psychologists’ ethical practice with the emergence of Artificial Intelligence are examined. This paper demonstrates the synergies and the interrelated influences on psychologists’ ethical practices arising from a systematic review of their experiences and their professional training needs. This paper is a response to H. Siegel’s “Arguing with Arguments” from a rhetorical perspective on argumentation. First I address Siegel’s concept of ‘argument in its abstract propositional sense’ and attempt to show that it is not at all an obvious object that should unquestionably be the privileged focus of argumentation theory. I then defend C. W. Tindale’s rhetorical perspective on argumentation against some of Siegel’s misreadings and also some of his legitimate disagreements regarding the relations between _persuasion_ and _rational_ (...) _justification_ and the way we should understand the source of argumentative normativity. Social robots are an increasingly integral part of society, already appearing as customer service assistants, care-home helpers, teaching assistants and personal companions. This book argues that the wider inclusion of social robots in our society is having a revolutionary impact on some of our key intuitions regarding ethics, metaphysics and epistemology and, as such, will put pressure on many of our best theories. Social robots elicit an emotional and social response in humans that some have taken to be evidence that (...) robots deserve moral consideration. Others have argued that, as robots are only machines, we should avoid designing robots that encourage emotional engagement. The fictional dualism model provides a new way for us to view social robots and a new route for our continued relationship with them. When we engage with a social robot, we create a fictional overlay that has wants, needs and desires. Our emotional attachment to social robots is a natural continuation of our relationship to fiction: a life-enhancing and important connection, but not one that prompts moral consideration for the fictional entity. In this book, Paula Sweeney shows how the fictional dualism model of social robots differs from other popular models. In addition to providing a distinctive and ethically appropriate framework for emotional engagement without moral consideration, the model provides conditions for trusting social robots and, uniquely, allows us to individuate social robots as distinct persons, even in contexts in which they share a collective mind. In this article, the author describes sweeping changes in the gender system and offers explanations for why change has been uneven. Because the devaluation of activities done by women has changed little, women have had strong incentive to enter male jobs, but men have had little incentive to take on female activities or jobs. The gender egalitarianism that gained traction was the notion that women should have access to upward mobility and to all areas of schooling and jobs. But persistent (...) gender essentialism means that most people follow gender-typical paths except when upward mobility is impossible otherwise. Middle-class women entered managerial and professional jobs more than working-class women integrated blue-collar jobs because the latter were able to move up while choosing a “female” occupation; many mothers of middle-class women were already in the highest-status female occupations. The relationship between law and morality is a topic which receives special importance and attention, especially in "liberal democracies" in which the law is supposed to regulate highly pluralized and fragmented societies. Under conditions of plurality of values, many social forces and legal theories require a certain kind of neutrality from the legal system, a means of compatibility of the many "world views" and "moral systems" that are present within the same social space. Such a conciliating commitment sounds particularly relevant (...) in times of the doctrinal ubiquity of ideas such as "peace based on human rights". This was the title of the 28th World Congress of the IVR in Lisbon, with the special workshop "Law and Morals" on which this book is based. Le sens dépend-il de la sensibilité? De quelle manière ou en quel sens? La phénoménologie reconnaît au sens une part de sensibilité, contre la thèse de son autonomie. Le sens ne serait pas un phénomène de connaissance, ni un phénomène de langage, mais un phénomène sensible : un contenu de perception, propre au rapport que le corps sentant entretient au monde senti. Nos discours, nos actes et nos existences perdraient alors leur sens à mesure qu’ils s’autonomisent et se trouvent partiellement (...) privés de leur dimension sensible, corporelle et mondaine. Mais cette thèse ne s’impose pas d’un seul tenant dans l’histoire de la phénoménologie. De l’autonomie à la sensibilité et de la sensibilité à l’autonomie, l’analyse phénoménologique du sens implique chaque fois des régressions qui, en retour, ouvrent de nouvelles avancées. In this paper, I present two presumed alternative definitions of metavalidity for metainferences: Local and Global. I defend the latter, first, by arguing that it is not too weak with respect to metainference-cases, and that local metavalidity is in fact too strong with respect to types. Second, I show that although regarding metainference-schemas Local metavalidity is always stable, Global metavalidity is also stable when the language satisfies reasonable expressibility criteria.

La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Es crucial que la regulación sea integral y adaptable para garantizar un sistema jurídico justo y equitativo en la era digital. (shrink)

There is growing evidence to support the claim that we react differently to robots than we do to other objects. In particular, we react differently to robots with which we have some form of social interaction. In this paper I critically assess the claim that, due to our tendency to become emotionally attached to social robots, permitting their harm may be damaging for society and as such we should consider introducing legislation to grant social robots rights and protect them from (...) harm. I conclude that there is little evidence to support this claim and that legislation in this area would restrict progress in areas of social care where social robots are a potentially valuable resource. Testimony is a source of knowledge. A speaker asserts what a hearer may therefore come to know. Assertion has widely been treated as the exclusive or at least the paradigmatic vehicle for testimony. I argue that we testify not only by asserting something, but also by taking something for granted within some other utterance. In philosophy of language, this is called semantic presupposition. The very reasons leading theorists of testimony have for thinking that assertion can be testimony are equally reasons (...) for thinking semantic presupposition can be testimony. (shrink)

Inspired by discussions with a number of nurse philosophers at the 2008 Knowledge Conference in Boston, two of the original Manifesto authors and two colleagues discussed the need to explicate emancipatory knowing as it emerged from the Manifesto . (...) Our analysis yielded an epistemological framework based on liberation principles to advance praxis in the discipline of nursing. This paper adds to what is already known on this topic, as there is not an explicit contribution to the literature of this specific Manifesto , its significance, and utility for the discipline. While each of us have written on emancipatory knowing and social justice in a variety of works, it is in this article that we identify, as a unit of knowledge production and as a direction towards praxis, a set of critical values that arose from the emancipatory conscience-ness and intention seen in the framework of the Nursing Manifesto. In this paper I propose a Fictional Dualism model of social robots. The model helps us to understand the human emotional reaction to social robots and also acts as a guide for us in determining the significance of that emotional reaction, enabling us to better define the moral and legislative rights of social robots within our society. I propose a distinctive position that allows us to accept that robots are tools, that our emotional reaction to them can be important to (...) their usefulness, and that this emotional reaction is not a direct indicator that robots deserve either moral consideration or rights. The positive framework of Fictional Dualism provides us with an understanding of what social robots are and with a plausible basis for our relationships with them as we bring them further into society. Recent application of theories of embodied or grounded cognition to the recognition and interpretation of facial expression of emotion has led to an explosion of research in psychology and the neurosciences. However, despite the accelerating number of reported findings, it remains unclear how the many component processes of emotion and their neural mechanisms actually support embodied simulation. Equally unclear is what triggers the use of embodied simulation versus perceptual or conceptual strategies in determining meaning. The present article integrates behavioral research (...) from social psychology with recent research in neurosciences in order to provide coherence to the extant and future research on this topic. The roles of several of the brain's reward systems, and the amygdala, somatosensory cortices, and motor centers are examined. These are then linked to behavioral and brain research on facial mimicry and eye gaze. Articulation of the mediators and moderators of facial mimicry and gaze are particularly useful in guiding interpretation of relevant findings from neurosciences. Finally, a model of the processing of the smile, the most complex of the facial expressions, is presented as a means to illustrate how to advance the application of theories of embodied cognition in the study of facial expression of emotion. Forgiveness as a positive response to wrongdoing is a widespread phenomenon that plays a role in the moral lives of most persons. Surprisingly, Kant has very little to say on the matter. Although Kant dedicates considerable space to discussing punishment, wrongdoing and grace, he addresses the issues of human forgiveness directly only in some short passages in the Lectures on Ethics and in one passage of the Metaphysics of Morals. As noted by Sussman, the TL passage, however, betrays some ambivalence. (...) Kant establishes a duty of virtue to be forgiving (TL, 6:460), yet he immediately warns against its excess: meek toleration of recurrent wrongs could manifest a lack of self-respect and a violation of a duty to oneself (TL, 6:461). Sussman claims that this ambivalence ultimately arises from the fact that forgiveness sits uncomfortably in Kant’s moral thought. First, forgiveness has an ‘ineluctably elective aspect’ that makes it, to a certain extent, arbitrary and dependent on particular features of the forgiver’s psychology and, as such, in tension with Kant’s central claims that human beings are autonomous agents capable of determining their own moral status. Second, according to Sussman, Kant’s moral retributivism, i.e. ‘the particular moral position that every moral wrong against another deserves punishment of the wrongdoer’ seems to be in tension with the possibility of a ‘truly redemptive forgiveness’. Moreover, forgiveness also seems to be in tension with a passage of the Religion in which Kant argues that the moral guilt from our original evil disposition cannot be understood as a debt or liability that can be compensated, erased, transferred or otherwise wiped out by others (Rel, 6:72). Thus, to the extent that forgiveness might be thought to involve the forgoing of moral guilt, it seems incompatible with Kant’s views on culpability and punishment. This chapter seeks to clarify Kant’s views on forgiveness in order to show that, although not often appreciated, personal forgiveness plays an important role in the lives of ordinary human agents as understood by Kant. In particular, I aim to show there is a conception of forgiveness available to Kant that is not incompatible with Kant’s views of punishment and culpability. In Section 1, I argue that, for Kant, far from being merely ‘elective,’ forgiveness is, under certain conditions, morally required. I provide a brief summary of an interpretation of Kant’s theory of forgiveness that I have defended in recently published work , in order to argue that Kant’s duty to be forgiving should be understood as an imperfect duty of virtue which is conditional on repentance. Kant is not ambivalent about this duty because he maintains that when the relevant conditions are not met, we have a perfect duty to ourselves not to forgive unrepentant wrongdoers. The TL passage thus identifies two different duties. In Section 2, I show that forgiveness, as conceptualised by Kant, does not require the forgoing of punishment or the overcoming of moral guilt and that this could, in fact, be seen as an attractive feature of Kant’s position. According to one of the most powerful paradigms explaining the meaning of the concept of natural number, natural numbers get a large part of their conceptual content from core cognitive abilities. Carey’s bootstrapping provides a model of the role of core cognition in the creation of mature mathematical concepts. In this paper, I conduct conceptual analyses of various theories within this paradigm, concluding that the theories based on the ability to subitize (i.e., to assess anexactquantity of the elements in a (...) collection without counting them), or on the ability to approximate quantities (i.e., to assess anapproximatequantity of the elements in a collection without counting them), or both, fail to provide a conceptual basis for bootstrapping the concept of an exact natural number. In particular, I argue that none of the existing theories explains one of the key characteristics of the natural number structure: the equidistances between successive elements of the natural numbers progression. I suggest that this regularity could be based on another innate cognitive ability, namely sensitivity to the regularity of rhythm. In the final section, I propose a new position within the core cognition paradigm, inspired by structuralist positions in philosophy of mathematics. (shrink)
