Questions regarding the moral responsibility of Internet accessand service providers relating to information on the Internetcall for a reassessment of the ways in which we think aboutattributing blame, guilt, and duties of reparation andcompensation. They invite us to borrow something similar to theidea of strict liability from the legal sphere and to introduceit in morality and ethical theory. Taking such a category in thedistribution of responsibilities outside the domain of law andintroducing it into ethics, however, is a difficult thing. Doingso (...) seems to conflict with some broadly shared and deeply feltintuitions regarding the individuality of responsibility and therelationship between responsibility and guilt. These convictionscoincide with some basic ideas in Kantian moral theory and theascriptive theory based on these ideas. Nevertheless, theproblems to which the proposed liabilities / responsibilitiesrelate are so serious that they do not seem to leave room foraloofness. At least, they encourage us to reconsider the idea ofstrict liability carefully and to assess its merits. (shrink)

We present a developmental perspective regarding the difference in perceptions toward privacy between young and old. Here, we introduce the notion of privacy conceptions, that is, the specific ideas that individuals have regarding what privacy actually is. The differences in privacy concerns often found between young and old are postulated as the result of the differences found in their privacy conceptions, which are subsequently linked to their developmental life stages. The data presented have been obtained through a questionnaire distributed among (...) adolescents, young adults, and adults and provide support for this developmental perspective. This study is one of the first to include adolescents when investigating the privacy concerns among young and old. The results show that the privacy conceptions held by adolescents indeed differ from those held by young adults and adults in keeping with the expectations as seen from a developmental perspective. In addition, the areas in which the differences in privacy conceptions are found also reflect the strongest relationship with concerns. As such, these findings present an alternative perspective to the commonly held notion that young people are less concerned about privacy. (shrink)

In this contribution, we identify and clarifysome distinctions we believe are useful inestablishing the reliability of information onthe Internet. We begin by examining some of thesalient features of information that go intothe determination of reliability. In so doing,we argue that we need to distinguish contentand pedigree criteria of reliability and thatwe need to separate issues of reliability ofinformation from the issues of theaccessibility and the usability of information.We then turn to an analysis of some commonfailures to recognize reliability orunreliability.

This article discusses some rather formal characteristics of possible obligations to enhance. Obligations to enhance can exist in the absence of good moral reasons. If obligation and duty however are considered as synonyms, the enhancement involved must be morally desirable in some respect. Since enhancers and enhanced can, but need not coincide, advertency is appropriate regarding the question who exactly is addressed by an obligation or a duty to enhance: the person on whom the enhancing treatment is performed, or the (...) controller or the operator of the enhancement. Especially, the position of the operator is easily overlooked. The exact functionality of the specific enhancement, is all-important, not only for the acceptability of a specific form of enhancement, but also for its chances of success for becoming a duty or morally obligatory. Finally and most importantly, however, since obligations can exist without good moral reasons, there can be obligations to enhance that are not morally right, let alone desirable. (shrink)

Informed consent bears significant relevance as a legal basis for the processing of personal data and health data in the current privacy, data protection and confidentiality legislations. The consent requirements find their basis in an ideal of personal autonomy. Yet, with the recent advent of the global pandemic and the increased use of eHealth applications in its wake, a more differentiated perspective with regards to this normative approach might soon gain momentum. This paper discusses the compatibility of a moral duty (...) to share data for the sake of the improvement of healthcare, research, and public health with autonomy in the field of data protection, privacy and medical confidentiality. It explores several ethical-theoretical justifications for a duty of data sharing, and then reflects on how existing privacy, data protection, and confidentiality legislations could obstruct such a duty. Consent, as currently defined in the General Data Protection Regulation – a key legislative framework providing rules on the processing of personal data and data concerning health – and in the recommendation of the Council of Europe on the protection of health-related data – explored here as soft-law – turns out not to be indispensable from various ethical perspectives, while the requirement of consent in the General Data Protection Regulation and the recommendation nonetheless curtails the full potential of a duty to share medical data. Also other legal grounds as possible alternatives for consent seem to constitute an impediment. (shrink)

One of the most significant aspects of Internet, in comparison with other sources of information, such as libraries, books, journals, television, radio etcetera, is that it makes expert knowledge much more accessible to non‐experts than the other traditional sources. This phenomenon has often been applauded for its democratizing effects. Unfortunately, there is also a disadvantage. Expert information that was originally intended for a specific group of people ‐ and not in any way processed or adapted to make it fit for (...) a broader audience ‐ can easily be misunderstood and misinterpreted by non‐experts and, when used as a basis for decisions, lead to unhappy consequences. Can these risks be diminished without limiting the informational freedoms of the information providers and without imposing paternalistic measures regarding the receivers of the information? Big data and Machine learning Techniques are reshaping the way in which food safety risk assessment is conducted. The ongoing ‘datafication’ of food safety risk assessment activities and the progressive deployment of probabilistic models in their practices requires a discussion on the advantages and disadvantages of these advances. In particular, the low level of trust in EU food safety risk assessment framework highlighted in 2019 by an EU-funded survey could be exacerbated by novel methods of analysis. The variety of processed (...) data raises unique questions regarding the interplay of multiple regulatory systems alongside food safety legislation. Provisions aiming to preserve the confidentiality of data and protect personal information are juxtaposed to norms prescribing the public disclosure of scientific information. This research is intended to provide guidance for data governance and data ownership issues that unfold from the ongoing transformation of the technical and legal domains of food safety risk assessment. Following the reconstruction of technological advances in data collection and analysis and the description of recent amendments to food safety legislation, emerging concerns are discussed in light of the individual, collective and social implications of the deployment of cutting-edge Big Data collection and analysis techniques. Then, a set of principle-based recommendations is proposed by adapting high-level principles enshrined in institutional documents about Artificial Intelligence to the realm of food safety risk assessment. The proposed set of recommendations adopts Safety, Accountability, Fairness, Explainability, Transparency as core principles (SAFETY), whereas Privacy and data protection are used as a meta-principle. KDD (Knowledge Discovery in Databases) confronts us withphenomena that can intuitively be grasped as highly problematic, but arenevertheless difficult to understand and articulate. Many of theseproblems have to do with what I call the ``deindividualization of theperson'': a tendency of judging and treating persons on the basis ofgroup characteristics instead of on their own individual characteristicsand merits. This tendency will be one of the consequences of theproduction and use of group profiles with the help of KDD. Currentprivacy law and regulations, (...) as well as current ethical theoryconcerning privacy, start from too narrow a definition of ``personaldata'' to capture these problems. In this paper, I introduce the notionof ``categorical privacy'' as a starting point for a possible remedy forthe failures of the current conceptions of privacy. I discuss some waysin which the problems relating to group profiles definitely cannot besolved and I suggest a possible way out of these problems. Finally, Isuggest that it may take us a step forward if we would begin to questionthe predominance of privacy norms in the social debate on informationtechnologies and if we would be prepared to introduce normativeprinciples other than privacy rules for the assessment of newinformation technologies. If we do not succeed in articulating theproblems relating to KDD clearly, one day we may find ourselves in asituation where KDD appears to have undermined the methodic andnormative individualism which pervades the mainstream of morality andmoral theory. This paper takes a stand on Hamblin semantics and its relation to the semantics-to-pragmatics interface. Biased questions, where the speaker finds one of the options more likely and expects the confirmation that p is true, raise a concern about the limits of Hamblin semantics. I argue that biased questions have modified Hamblin semantics, while unbiased questions have unconstrained Hamblin semantics. The optional bias feature explains compositionally. It is triggered by likelihood presuppositions ranging Hamblin sets and highlighting the preferred alternative(s). Biased (...) effects are exceptionally possible in alternative and wh-questions, but only in polar questions, they can be encoded lexically and grammatically. I argue that Hamblin semantics covers all core types of questions, while some of its applications for non-questions are problematic. (shrink)

Anscombe holds that a proper account of intentional action must exhibit “a ‘form’ of description of events.” But what does that mean? To answer this question, I compare the method of Anscombe’s Intention with that of Frege’s Foundations of Arithmetic—another classic work of analytic philosophy that consciously opposes itself to psychological explanations. On the one hand, positively, I aim to identify and elucidate the kind of account of intentional action that Anscombe attempts to provide. Foucault’s twofold attack on the modem concept of power gives us something to think about. Backed by ingenious historical analyses he devises an idea of systemic and productive power, abstracted from the conceptual connections between power and individual power-sources, viz. power and restrictions of freedom. The article probes Foucault’s historical sketches on. these two tasks. It defends the less radical view of power as constraining interests and freedom.

Since Hobbes' Leviathan was published in 1651, the 'problem of order' has been known for some time. Despite this long gestation period for social theory even today we do not have a universally agreed upon answer to this 'problem'. One of the reasons behind this lacuna may be the overly dispersed work being done in the economic and sociological traditions. Whereas one tradition favours 'collective action' as a central answer, the other thinks of the problem itself being dissolved by the (...) acceptance of 'socialized man'. Here, an attempt is made to offer the phenomenon of 'cooperation' as a promising middle ground for both traditions. To underline the importance of cooperation as an elementary social activity, first, cooperation is shown as working in tandem with its rival 'competition'. Secondly, several conceptual analyses of what is included in collective action and cooperation are offered. These analyses, thirdly, are deepened by an overview of the motivational bases potentially advancing cooperation. Overall, an awareness of the self-creating character of cooperation is explored, and put forward as the most feasible way of answering the classical problem of order. (shrink)

In contrast to the theories of relativity, quantum mechanics is not yet based on a generally accepted conceptual foundation. It is proposed here that the missing principle may be identified through the observation that all knowledge in physics has to be expressed in propositions and that therefore the most elementary system represents the truth value of one proposition, i.e., it carries just one bit of information. Therefore an elementary system can only give a definite result in one specific measurement. The (...) irreducible randomness in other measurements is then a necessary consequence. For composite systems entanglement results if all possible information is exhausted in specifying joint properties of the constituents. (shrink)

We discuss the difference between formal and natural languages, and argue that should the language metaphor have any foundation, it’s analogy with natural languages that should be taken into account. We discuss how such operation like reading, writing, sign, interpretation, etc., can be applied in the realm of the living and what can be gained, by such an approach, in order to understand the phenomenon of life.

This paper introduces and discusses three models of future: a determinist model, a stochastic model, and the model of True Prophetic Knowledge. All three models coexist in natural languages and are represented both in their grammatical systems and in the text-building discourse strategies speakers and authors apply to.

I discuss the foundations of predicate ontologies based on two model notions – elementary states of affairs and eventualities, i.e. ordered pairs of initial and end states of affairs. Vendlerian classifications are oriented towards elementary states and tense logic, while Davidsonian classifications deal with eventualities and event logic. There are two kinds of atemporal predicates - fact and properties. Facts are propositional arguments of second-order predicates which add a special meaning that the embedded proposition was verified. Properties are atemporal first-order (...) predicates that lack eventive interpretation and are not associated with factive frames. Davidsonian states are homogeneous durable spatiotemporal things distinct both from atemporal properties and spatiotemporal dynamic predicates. Davidsonian states are causally independent, while resultatives are causally determined as they reconstruct a preceding event that has caused the end state p. I discuss the contrast between external and internal Davidsonian states. The former lack a priority argument and can be quantified extensionally. The latter have a priority experiential argument and can only be quantified intensionally. External states can be observed, while internal states cannot. (shrink)

Ernst Fehr’s experimental research on altruistic behaviour aims at superseding the classical homo oeconomicus in micro-economic behaviour theory. This essay discusses Fehr’s results from two points of view: first, in regard to the understanding of social action associated with the term “altruism”; second, in regard to the ‘anthropological’ strategy of research that is based on the laboratory method. Against the emphasis on altruism it will be argued that it misleads into providing a distorted description of social acting, and that, due (...) to insufficient clarity about motives for acting, Fehr’s empirical results give evidence not of altruism but rather of phenomena of social recognition. The objection against the anthropological strategy will be that it makes visible only local phenomena within prevailing social conditions and that it thus assumes more than it explains. (shrink)

This article considers natural signs and their role in the origin of language. Natural signs, sometimes called primary signs, are connected with their signified by causal relationships, concomitance, or likeliness. And their acquisition is directed by both objective reality and past experience (memory). The discovery and use of natural signs is a required prerequisite of existence for any living systems because they are indispensable to movement, the search for food, regulation, communication, and many other information-related activities. It is argued that (...) the birth of conventional signs, sometimes called secondary signs, was determined by a connotative use of natural signs and that, regulated and maintained by them, human language developed. At the same time, the origin and development of human language presupposes a ‘rational turn’ from the given and external reality of natural signs to the rationally constructed reality of artificial signs and rules that are internally maintained by the subjects’ deliberate activities, and actual and inherited social tradition (social memory). In view of this, language is defined as a dynamic system that must both be natural and artificial, empirical and a priori, inductive and deductive. This bilateral origin and regulation of language is the dual-inference of language. (shrink)

Some goods cannot, according to MacLean, be dealt with adequately by cost-benefit analysis. An explanation for this thesis is given, linking these goods to the altruism implied in intimate social relations. MacLean’s argument is then shown to be insufficient when extended to matters of public relevance. The integration of political values and economic costs should be possible, on a level doing justice to both.

Agency is a power, but what is it a power to do? The tradition presents us with three main answers: (1) that agency is a power to affect one’s own will, consequent upon which act further events ensue, beginning with the movement of a part of one's body; (2) that agency is a power to affect one’s own body, consequent upon which act further events ensue, beginning with the movement of an object that one touches; and (3) that agency is (...) a power to affect that material upon which one brings one's action to bear---e.g. the apple one is peeling (with a knife in one's hand). These three answers correspond to three increasingly expansive conceptions of the province of human agency. I refer to them, respectively, as volitionalism, corporealism and materialism. Only the first two are seriously considered in contemporary action theory. Favoring the third, and hoping to sharpen the conflict between the third and the first, I criticize the second. Corporealism has been a popular position—arguably, the default position in the philosophy of action—since Donald Davidson’s classic paper “Agency” (1971). Although it seems to occupy a sensible middle ground between volitionalism and materialism, corporealism is, I argue, indefensible: it shares the vulnerabilities of both its two rivals, without possessing the strengths of either. Nevertheless, reflection on corporealism lights the road to materialism, which, in the end, is the only possible alternative to volitionalism. (shrink)

Hyperpolitics and Political Commitment in the Twenty-First Century What do the January 6th invasion of the Capitol and the anti-racist demonstrations of mid-2020 have in common? Both birthed some of the largest protest movements in American history, but also diminished rapidly after their initial, pre-revolutionary peak. This article reads the recent political sequence through the concept of ‘hyperpolitics’. In contrast to previous types of post-politics or mass politics, ‘hyperpolitics’ stands for a distinctly novel mode of political commitment characteristic of the (...) 2010s, in which a formerly apolitical public sphere finds itself intensely repoliticized, imposing itself on other domains such as the private, cultural, or economic. The return in question yet also runs across parameters that are more low-cost, low-entry, and low-duration than previous twentieth-century types, in stark contrast Max Weber’s typology of politics as the ‘slow boring of hard boards.’. The conclusion of practical reasoning is commonly said to rest upon a diverse pair of representations—a “major” and a “minor” premise—the first of which concerns the end and the second, the means. Modern and contemporary philosophers writing on action and practical reasoning tend to portray the minor premise as a “means-end belief”—a belief about, as Michael Smith puts it, “the ways in which one thing leads to another,” or, as John McDowell puts it, “what can be relied on to bring (...) about what.” On this point there is little difference between followers of Davidson and followers of Anscombe, or between those who invoke Hume’s legacy and those who invoke Aristotle’s. But Aristotle himself held a very different position. According to him, the minor premise concerns particulars, a sphere controlled by perception. The perception of particulars—that is, of the really-existing people and things confronted in the field of action—plays no essential role in the modern account of rational agency. Because it does not, the modern account fails to explain how one could act for a reason, or how practical reasoning could deliver any conclusion. (shrink)

The article proposes to further develop the ideas of the Extended Evolutionary Synthesis by including into evolutionary research an analysis of phenomena that occur above the organismal level. We demonstrate that the current Extended Synthesis is focused more on individual traits (genetically or non-genetically inherited) and less on community system traits (synergetic/organizational traits) that characterize transgenerational biological, ecological, social, and cultural systems. In this regard, we will consider various communities that are made up of interacting populations, and for which the (...) individual members can belong to the same or to different species. Examples of communities include biofilms, ant colonies, symbiotic associations resulting in holobiont formation, and human societies. The proposed model of evolution at the level of communities revises classic theorizing on the major transitions in evolution by analyzing the interplay between community/social traits and individual traits, and how this brings forth ideas of top-down regulations of bottom-up evolutionary processes (collaboration of downward and upward causation). The work demonstrates that such interplay also includes reticulate interactions and reticulate causation. In this regard, we exemplify how community systems provide various non-genetic ‘scaffoldings’, ‘constraints’, and ‘affordances’ for individual and sociocultural evolutionary development. Such research complements prevailing models that focus on the vertical transmission of heritable information, from parent to offspring, with research that instead focusses on horizontal, oblique and even reverse information transmission, going from offspring to parent. We call this reversed information transfer the ‘offspring effect’ to contrast it from the ‘parental effect’. We argue that the proposed approach to inheritance is effective for modelling cumulative and distributed developmental process and for explaining the biological origins and evolution of language.
