It is assumed a) that the statement that a human right exists means that a state which does not grant it is not legitimate, and b) that the legitimacy of power can, in modern times, be justified only by showing that it is in the equal interest of everybody. Mere democracy is insufficient to legitimate political power. Freedom for every individual must be guaranteed. So much is common ground in the controversy on human rights, but to interpret these freedom as (...) a negative freedom, as the classical conception of human rights has done, is insufficient and therefore illegitimate, because it is not in the equal interest of everybody. To add a positive concept of freedom is correct but not enough, because it still neglects those who even if they are given the facilities do not have the capacity. Since the handicapped, the old and the young cannot even enter a contract and the disposessed cannot enter a fair contract, the contractarian foundation of human rights must be discarded. (shrink)

This interpretation is shown to receive confirmation from what frege says in a recently published manuscript about the b. Of predicates; finally, It is (...) applied to frege's doctrine of oblique b. Der Band enthält die wichtigsten kleineren philosophischen Arbeiten des Autors aus den Jahren 1960 bis 1990. Sie sind unterteilt in die Rubriken Sein, Wahrheit, Praxis und Kritik. Mit »Sein« und »Wahrheit« sind die wichtigsten Themen von Tugendhats früherer Arbeit genannt, ab ca. 1975 hat er sich weitgehend der praktischen Philosophie zugewandt. Sein Buch »Vorlesungen zur Einführung in die sprachanalytische Philosophie«, 1976 (stw 45), verstand sich als Alternativansatz zu Heideggers Frage nach der Struktur des menschlichen Verstehens. Die »Vorlesungen« orientieren diese Frage (...) an der Sprache, Heidegger hatte sie auf das Sein bezogen. Die hier gesammelten Aufsätze zum Thema »Sein« stützen seine Heidegger gewidmeten »Vorlesungen« negativ ab: sie sollen zeigen, daß das Sein nicht nur ein falscher Orientierungspunkt ist, sondern überhaupt keine einheitliche Thematik darstellt. O texto trata de três dificuldades relativas à moral, a saber: como, entre diferentes significações para a palavra “moral”, podemos entender que com ela se queira referir a uma só coisa; como entender que possamos falar de uma moral se sobre ela se podem ter tão diferentes concepções; e, finalmente, em que bases podemos perguntar como devemos ou queremos entender o que é a moral, se ela nos parece algo já dado. As respostas a essas questões estão baseadas na explicação (...) da moral como um sistema de exigências mútuas calcado na simetria de validade das justificações para cada um dos envolvidos. A partir dessa concepção de moral, o autor tenta uma reinterpretação do contratualismo. (shrink)

En una conferencia sobre el Tercer Sector en Cartagena, Daniel Pecaut afirmó: “Lo que le falta a Colombia más que un “mito fundacional” es un relato nacional ”. Se refería a un relato que posibilite a los colombianos de todas las clases, razas, etnias y regiones, ubicar sus experiencias cotidianas en una mínima trama compartida de duelos y de logros.

Os três artigos seguintes correspondema três aulas proferidas pelo Prof. Dr. ErnstTugendhat. No primeiro artigo, o autor trata doconceito de moral em Kant. Na Segunda aula,Prof. Tugendhat concentra-se no problema daliberdade em Kant. Por último, no terceiro artigo,aborda o conceito de liberdade como imputabilidade.

Das menschliche Verstehen bildet den Kern des Anthropologischen und ist als solches die Basis aller philosophischen Disziplinen. Der Beitrag weist auf die Bedeutung der prädikativen Sprache für das Verstehen hin und argumentiert, dass die Frage nach dem Guten als anthropologische Grundfrage zu verstehen ist. Der Rückgang aufs Anthropologische ergibt sich für den Autor, weil alle historischen Fragen nach dem Guten unzureichend sind.

El problema de la voluntad libre no es si existe o no, sino en qué consiste. Según una opinión popular, la voluntad libre consiste en poder hacer lo que uno quiere. Por ejemplo, puedo ahora, si quiero, alzar mi mano. En relación con esa opinión cabe hacer dos observaciones. Primero: que la acción depende de mi voluntad no es libertad de voluntad, sino de acción, Segundo: recientemente se ha mostrado en la fisiología cerebral que cada vez que uno quiere mover (...) su mano, este acto de la voluntad es anticipado una fracción de segundo por un movimiento en el cerebro. Pero aún si eso no fuera así, tendríamos que suponer que el acto de la voluntad está determinado por antecedentes sicológicos, 'la que la alternativa sería que la persona produce el acto de voluntad mágicamente desde la nada. Se puede decir, creo, que en cuanto a la moral nos encontramos hoy en una cierta desorientación, pues aunque casi todos tenemos convicciones morales bastante fuertes, en general no podemos decir en qué se basan. La razón de esta desorientación es que, mientras antes, tanto en nuestra propia cultura como en las demás, la moral siempre tenía su base en la religión o en la tradición, una tal justificación ya no nos convence. Morales anteriores tenían su base en una autoridad (...) que aceptaba, bien la autoridad de Dios o de la tradición o de ambos. Por consiguiente, la moral había sido heterónoma, no autónoma, ya que tenía su fundamento en la creencia y en la obediencia a Dios o a la tradición, no en un entendimiento y un querer propio. La desorientación en que nos encontramos hoy parece tener su raíz que por un lado una moral heterónoma ya no nos convence y en que, por otro lado, todavía no tenernos un entendimiento claro de lo que es una moral autónoma, pues la conciencia moral contemporánea se compone de una mezcla de factores de distintas proveniencias.
